GPU export controls affect which advanced AI accelerators can be shipped to particular destinations, which customers may receive them, and whether a license is required. That can constrain or delay supply and add compliance costs, but the rules and sources available as of October 4, 2026 do not establish a market-wide GPU price increase or a specific change in availability.
What export controls change
Export controls are not a single worldwide ban on advanced GPUs. Requirements can depend on the product’s technical specifications, destination, end user and intended use. Entity headquarters and ultimate-parent location can also matter, so the recipient’s physical address alone may not settle whether a transaction is covered.
For a shipment, the practical questions are whether the item is controlled, what rules apply to its destination and recipient, whether the proposed end use is allowed, and whether a license or other authorization is needed. A license review is a government decision process—not permission to ship while the application is pending, nor a promise that the application will be approved.
What the January 2026 China and Macau rule allows
A U.S. Department of Commerce, Bureau of Industry and Security (BIS) announcement on January 13, 2026 described case-by-case review for certain advanced chips exported to China. The final rule, “Revision to License Review Policy for Advanced Computing Commodities,” took effect January 15, 2026 and sets out the pathway for qualifying exports to end users in China or Macau. BIS named NVIDIA H200 and AMD MI325X as examples of chips that may qualify.

For this pathway, the product must have total processing performance (TPP) below 21,000 and total DRAM bandwidth below 6,500 GB/s. Those are technical eligibility thresholds in the rule, not measures of market supply. The change is from a presumption of denial to case-by-case review for the defined category; it does not make all advanced GPUs exportable or ensure any particular license is granted. Other destination, end-user and end-use restrictions still apply. The rule also retains restrictive treatment for certain reexports and transfers, including those involving entities headquartered in or parented in Macau or a Country Group D:5 destination.
Conditions that can limit shipments
Even when a product and transaction are eligible for case-by-case review, the applicant must satisfy conditions intended to protect U.S. supply and constrain who can receive the chips and how they can be used.

U.S. supply and order fulfillment
The applicant must certify that the product is commercially available in the United States and that exports will not delay existing or new orders from U.S. customers, accounting for normal lead times. It must also certify that relevant global foundry capacity will not be diverted from similar or more advanced integrated circuits for U.S. end users.
A limit tied to U.S. shipments
For the defined licensing pathway, aggregate shipments of the product to China and Macau may not exceed 50% of the amount shipped to U.S. customers for U.S. end use. This is a ceiling for that pathway and product—not a statement that China receives half of all GPUs, or that the same ratio applies across all GPU trade.

Customer checks and testing
Transactions must meet end-user and nonmilitary-use controls. Applicants must use rigorous know-your-customer (KYC) and screening procedures designed to prevent unauthorized remote access. Qualified third-party testing is required before export from the United States; representative sampling of a shipment batch is permitted.
Together, these requirements can narrow the set of eligible products and customers, add compliance and testing work, and extend the time before a shipment can proceed. They also make U.S. inventory, order fulfillment and foundry capacity relevant to eligibility. The rule does not establish that these conditions will raise U.S. prices.

How controls can affect AI hardware availability
When a destination, buyer or end use requires a license, a shipment may be delayed, denied or limited to the transactions that satisfy the applicable conditions. That can make an accelerator harder to obtain in a particular market even if it is available elsewhere. Compliance checks, testing and uncertainty about license outcomes can also affect delivery timing and distributors’ willingness to serve a market.
Product eligibility matters too: a rule written around performance and bandwidth thresholds does not automatically cover every accelerator with a similar name or use. A buyer comparing access across markets should check the exact model and configuration, the destination and recipient’s entity status, the licensing posture, verified supply and lead time, and total delivered cost. A company outside a restricted destination is not automatically outside the rules if its ownership, customers, transfers or end use trigger other controls.

What can—and cannot—be said about prices
There are plausible ways controls could contribute to higher costs: fewer eligible suppliers or destinations, added licensing and testing work, shipment delays, and supplier decisions about which markets to serve. Restrictions on resale, repair, transfer or downstream use may also change the economics of providing AI computing services.
NVIDIA’s annual-report risk disclosures filed with the SEC describe company-specific exposure: export controls could affect costs, the ability to provide AI cloud services, and supply chains and distribution channels, including outside China. That disclosure identifies risks reported by the company; it is not an independent estimate of their effect on average GPU prices.
The evidence cited here does not establish a comparable market-wide price or availability impact by GPU model and geography. The regulation sets eligibility criteria and shipment conditions, not consumer price quotes or a measured price change. Without comparable transaction prices and delivery data over time—separated by market and other supply-and-demand factors—it would be misleading to assign a percentage change to export controls alone.
How this fits the broader U.S. framework
BIS announced a broader advanced-computing and AI framework on January 13, 2025, covering specified destinations and authorizations, license exceptions for certain allies and partners and supply-chain activities, low-volume flows, country allocations, and separate controls on certain closed AI model weights. That announcement provides historical context; the January 2026 final rule is the more specific source for the H200-class China and Macau review pathway described above.
BIS guidance emphasizes that licensing requirements may depend on an entity’s headquarters and ultimate parent, not only the physical location of the recipient. Exporters and organizations handling advanced hardware should consult BIS classification, country guidance, screening and licensing resources and verify the current rule text before acting. Rules and guidance can change; this account reflects the sources available as of October 4, 2026.
