FDA, HIPAA, and NIST address different cybersecurity responsibilities. FDA requirements and recommendations focus on manufacturers and qualifying internet-connected medical devices, especially during premarket review and throughout the device lifecycle. HIPAA’s Security Rule applies to covered entities and business associates that create, receive, use, or maintain electronic protected health information (ePHI). NIST offers practical frameworks and implementation guidance; it is not a substitute for either FDA law or HIPAA regulations.

A manufacturer may need to satisfy FDA section 524B and document cybersecurity for a device submission. A hospital or health plan must apply HIPAA safeguards to its ePHI environment. When a connected device is used by a regulated healthcare organization, the two regimes can overlap operationally, but they do not become one combined standard.

What are the medical device cybersecurity regulations?

There is no single U.S. “medical device cybersecurity regulation.” The obligations come from several authorities with different regulated subjects and legal force:

Authority Primary subject Legal force or role Typical evidence or action
FD&C Act section 524B Qualifying cyber devices and sponsors submitting them Statutory premarket submission duties Vulnerability-management plan, secure-lifecycle processes, updates and patches, and a software bill of materials (SBOM)
FDA February 2026 premarket guidance Devices with cybersecurity risk and cyber devices Agency recommendations for design, labeling, and submission content Lifecycle documentation and cybersecurity evidence in a premarket file
HIPAA Security Rule Covered entities and business associates handling ePHI Federal regulation requiring appropriate safeguards Administrative, physical, and technical safeguards supported by risk analysis and risk management
NIST SP 800-66 Rev. 2 and the Cybersecurity Framework Organizations designing or improving cybersecurity programs Voluntary implementation resources and mappings Control selection, risk-management processes, and mappings to HIPAA and SP 800-53 controls

The most important distinction is scope. FDA asks whether a device and its sponsor meet cybersecurity expectations and statutory submission requirements. HIPAA asks whether regulated organizations protect ePHI. NIST helps an organization structure the work but does not create a new legal obligation.

How does FDA regulate cybersecurity for medical devices?

FDA treats cybersecurity as a safety and effectiveness issue because a compromised connected device can affect device performance and patient care. Its current premarket document is Cybersecurity in Medical Devices: Quality Management System Considerations and Content of Premarket Submissions, finalized in February 2026. FDA says this version supersedes the June 27, 2025 version and provides recommendations about device design, labeling, and documentation for premarket submissions.

FDA’s guidance is not the statute itself. Guidance describes the agency’s current recommendations; the binding submission duties for qualifying devices arise from the Federal Food, Drug, and Cosmetic Act, including section 524B.

What does FDA section 524B require?

Section 524B was added by section 3305 of the Consolidated Appropriations Act, 2023, signed on December 29, 2022, and became effective March 29, 2023. FDA says it applies to new qualifying premarket submissions made on or after that effective date. A device that was authorized earlier can become subject to the requirements when a later device change requires premarket review.

Which devices qualify as “cyber devices”?

FDA’s FAQ describes three criteria. The device must include software validated, installed, or authorized by the sponsor as a device or in a device; be able to connect to the internet; and have technological characteristics that could be vulnerable to cybersecurity threats, where those characteristics are sponsor-validated, installed, or authorized.

The criteria are applied to the device and the sponsor’s submission, not to every piece of clinical equipment simply because it is electronic. A sponsor should document how the device’s software, connectivity, and technology meet—or do not meet—the statutory definition.

Which submissions are covered?

When a submission concerns a qualifying cyber device, FDA identifies the following pathways and relevant supplements as covered: 510(k), Premarket Approval (PMA), Product Development Protocol (PDP), De Novo classification, and Humanitarian Device Exemption (HDE). The requirement is tied to the qualifying device and the type of premarket review, not to a universal filing for every product update.

What three duties must the submission address?

  1. Postmarket vulnerability and exploit management. The sponsor must submit a plan to monitor, identify, and address postmarket vulnerabilities and exploits within a reasonable time. The plan must include coordinated vulnerability disclosure.
  2. Cybersecure design and maintenance. The sponsor must document processes and procedures that provide reasonable assurance the device and related systems are cybersecure. Postmarket updates and patches must be made available.
  3. Software bill of materials. The submission must include an SBOM covering commercial, open-source, and off-the-shelf software components.

These are statutory submission elements. FDA’s recommendations may explain what evidence, procedures, and lifecycle records make those elements understandable to reviewers, but a recommendation should not be presented as an additional statutory command.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What does the February 2026 FDA guidance add?

The final guidance turns the statutory concepts into a broader lifecycle submission strategy. It recommends that sponsors show how cybersecurity is considered from design through postmarket support rather than treating it as a one-time premarket checklist.

Design and quality management

Recommended documentation can connect cybersecurity risks to the device’s quality-management and engineering processes. A submission should make clear how security objectives, threat considerations, architecture decisions, testing, and residual risk are handled. The guidance is directed to industry and FDA staff, so it explains the type of information FDA recommends seeing in a premarket file.

Labeling and user-facing information

FDA’s recommendations include cybersecurity-related labeling. Sponsors should explain security-relevant configuration, maintenance, update, and operational information in a way that supports safe use by customers and operators. Labeling is not a replacement for technical controls or a vulnerability-response process.

Postmarket monitoring and coordinated disclosure

The guidance recommends a continuing process for receiving vulnerability reports, assessing them, coordinating disclosure, and delivering mitigations or patches. FDA’s postmarket guidance emphasizes that a customer notice alone is incomplete when it does not provide a strategy to reduce patient-harm risk to an acceptable and controlled level. Effective response therefore includes practical risk reduction, not merely public communication.

Does HIPAA apply to medical devices?

HIPAA does not regulate device market authorization. Its Security Rule protects ePHI created, received, used, or maintained by covered entities and business associates. The rule establishes administrative, physical, and technical safeguards for the confidentiality, integrity, and availability of that information.

A hospital, health plan, healthcare clearinghouse, or qualifying business associate may use connected devices in an environment that handles ePHI. In that situation, the organization must assess and manage risks to ePHI, including risks arising from device interfaces, networks, accounts, access paths, or data flows. That does not turn the hospital into the device manufacturer or make HIPAA a substitute for FDA’s device requirements.

What does the Security Rule require?

The Security Rule is scalable and technology neutral. An organization selects reasonable and appropriate safeguards after considering its size, complexity, capabilities, infrastructure, costs, and the probability and criticality of risks. HIPAA does not mandate one product, one network design, or one universal security architecture.

The required safeguard categories are:

  • Administrative safeguards: policies, procedures, workforce controls, and risk processes.
  • Physical safeguards: protections for facilities, workstations, and devices that access ePHI.
  • Technical safeguards: technology and processes controlling access, auditability, integrity, and transmission security.

What is the difference between HIPAA risk analysis and risk management?

Risk analysis identifies and evaluates risk; risk management implements measures to reduce it. HHS describes risk analysis as an assessment of threats and vulnerabilities that could affect the confidentiality, integrity, and availability of ePHI, including likelihood and impact. Risk management is the actual implementation of safeguards to sufficiently reduce the organization’s risk and meet the general security standards.

Risk analysis in practice

The analysis should cover ePHI across the organization, not only the electronic medical record. Its scope can include device-generated data, interfaces, portable media, cloud services, remote access, backups, and vendors when those systems create, receive, use, or maintain ePHI. HHS does not prescribe one method or guarantee that a particular methodology produces compliance.

Risk management in practice

Management turns findings into decisions and controls: for example, changing access privileges, segmenting a device network, improving authentication, revising vendor procedures, strengthening logging, or establishing a patch process. The selected measures should be documented and proportionate to the organization’s circumstances.

HHS describes the analysis as documented and ongoing. The Security Rule does not set one frequency that fits every organization; timing depends on organizational circumstances and changes in the environment.

Is NIST mandatory for healthcare?

NIST is not a medical-device approval authority and is not itself a HIPAA regulation. NIST SP 800-66 Revision 2, Implementing the HIPAA Security Rule: A Cybersecurity Resource Guide, was published in February 2024 and superseded Revision 1 from 2008. NIST describes it as practical guidance for regulated entities of all sizes.

NIST’s Cybersecurity and Privacy Reference Tool maps HIPAA Security Rule standards and implementation specifications to NIST Cybersecurity Framework subcategories and controls in SP 800-53 Revision 5. Those mappings can help an organization organize its control library, assign responsibilities, identify gaps, and explain how a safeguard supports a HIPAA requirement.

Use NIST as an implementation aid: it supplies vocabulary, examples, mappings, and risk-management structure. Do not describe SP 800-66 or the Cybersecurity Framework as a statute, an FDA requirement, a certification, or a universally mandatory checklist for private entities. HHS rules establish the legal obligations.

How should a manufacturer and healthcare provider apply the authorities together?

The following workflow keeps responsibilities separate while addressing the points where they intersect.

  1. Classify the role and object. A manufacturer starts with the device and its proposed FDA pathway. A healthcare organization starts with the ePHI it creates, receives, uses, or maintains. A business associate assesses its contractual and operational role.
  2. Determine FDA applicability. For a device submission, evaluate the three cyber-device criteria and whether the filing is a covered 510(k), PMA, PDP, De Novo, HDE, or relevant supplement. Record the determination and its rationale.
  3. Build the manufacturer evidence set. For a qualifying device, prepare the vulnerability-management plan, coordinated-disclosure process, secure-lifecycle procedures, update and patch process, and SBOM required by section 524B. Use the February 2026 guidance to organize recommended design, labeling, and submission documentation.
  4. Map the healthcare organization’s ePHI environment. Identify where device data enters, moves through, or leaves systems that handle ePHI. Include interfaces, user accounts, remote support, storage, backups, and vendors in the risk analysis.
  5. Choose and document safeguards. Use the HIPAA risk-management process to reduce identified risks. NIST SP 800-66 and the NIST mappings can help translate the Security Rule into control owners, procedures, and review evidence.
  6. Coordinate postmarket and operational response. Manufacturers need a vulnerability and patch process. Providers need a process for evaluating vendor notices, applying updates, managing downtime or compensating controls, and reassessing ePHI risk when device security changes.

What common mistakes cause confusion?

  • Calling FDA guidance “the law.” The February 2026 document contains FDA recommendations; section 524B supplies statutory duties for qualifying devices.
  • Assuming every healthcare device is covered by HIPAA. HIPAA coverage turns on the regulated entity and ePHI, not simply on whether a product is used in healthcare.
  • Treating an SBOM as a complete security program. An SBOM is one statutory submission element for qualifying cyber devices. It does not by itself provide HIPAA’s administrative, physical, and technical safeguards.
  • Using NIST as a legal safe harbor. A framework mapping can improve implementation and documentation, but it does not replace the Security Rule or FDA requirements.
  • Ignoring later device changes. An already-authorized device can become subject to section 524B requirements when a later change requires premarket review.
  • Confusing notice with remediation. FDA’s postmarket position links vulnerability response to reducing patient-harm risk, so communication should be accompanied by a practical mitigation strategy.

Is the HIPAA cybersecurity update final?

HHS’s current Security Rule summary describes the rule in effect. The same HHS materials list a separate proposed rule, titled “HIPAA Security Rule to Strengthen the Cybersecurity of Electronic Protected Health Information,” dated January 6, 2025. That item should be described as a proposal unless an official HHS status update confirms that it has become final. Organizations should base present compliance statements on the rule currently in effect and verify status before relying on a later change.

Frequently Asked Questions

Does FDA issue a separate cybersecurity certificate for every medical device?

Section 524B works through qualifying premarket submissions rather than a standalone, universally issued cybersecurity certificate. The sponsor demonstrates the required elements in the applicable submission, and FDA reviews that information within the device’s regulatory pathway.

Can an FDA-required SBOM satisfy a hospital’s HIPAA obligations?

No. An SBOM documents software components for a qualifying device submission. A hospital still needs its own HIPAA risk analysis, risk-management decisions, and administrative, physical, and technical safeguards for ePHI.

When should a provider reassess a connected device’s security risk?

A reassessment is appropriate when the device, software, connectivity, vendor relationship, data flow, or threat environment changes materially. HHS does not prescribe one universal interval, so the organization should document the trigger and its reasoning.

Can a manufacturer use NIST controls in an FDA submission?

A manufacturer may use NIST terminology or controls to organize its engineering and evidence, but NIST does not replace the FDA submission requirements. The submission still needs to address the statutory section 524B elements and the evidence FDA recommends for the device.
