Put a plain-language AI disclosure inside the ad at the first point where viewers encounter the synthetic image, voice, video, person, or claim. Make it visually prominent and, when the ad communicates through sound, say it aloud too. If the placement is paid or sponsored, add a separate commercial disclosure such as “Advertisement” or “Sponsored by the advertiser.” Metadata, provenance records, and a platform’s AI badge can support the disclosure, but they should not be your only viewer-facing signal when law or platform policy requires a clear notice.

This approach covers the practical standard emerging for 2026: identify what was synthetically made, match the notice to the way people experience the ad, and preserve records showing how you reached the decision.

What exactly should an AI-generated advertisement disclose?

The notice should identify the synthetic element in ordinary language. “AI-generated video,” “This ad contains AI-generated imagery,” and “Synthetic voice generated with AI” tell a viewer what was made or altered without requiring technical knowledge. A vague badge, an unexplained acronym, or a notice hidden in account settings does not communicate the same thing.

There are two separate facts to disclose when both apply:

  • Production origin: explain that an image, video, voice, avatar, or other element was generated or materially altered with AI.
  • Commercial relationship: explain that the message is an advertisement, sponsorship, or paid endorsement.

One notice cannot reliably substitute for the other. “AI-generated” does not tell people that a company paid for the message, while “Advertisement” does not tell them that the apparent person or scene is synthetic.

Use literal wording tied to the element

Name the element viewers are about to encounter. For example, use “AI-generated spokesperson” when an avatar presents the offer, “AI-generated product image” when the product scene is synthetic, or “Synthetic voice generated with AI” when narration is not a human recording. If only the background is synthetic, say so rather than implying that every part of the commercial was generated.

Combine the notices when necessary

A commercial could show “AI-generated spokesperson” and “Advertisement” together, or use “This sponsored ad contains AI-generated imagery.” Keep the two ideas distinguishable so viewers do not mistake an origin notice for a sponsorship disclosure.

Where should the disclosure appear?

Place the AI notice in the creative itself, adjacent to the first synthetic scene, person, voice, or claim. It must be easy to notice at the moment the relevant impression is formed, not merely available elsewhere on the page.

Visual ads and video

  • Show the notice near the first synthetic visual or the first claim that depends on it.
  • Use strong contrast, readable type, and a size that remains legible on a phone.
  • Leave it on screen long enough to be read; a flash that viewers cannot process is not meaningful notice.
  • Keep it visible in the creative rather than relying only on a caption, profile page, description, or text hidden behind a “more” link.

Audio, voiceovers, and endorsements

When the synthetic element is heard, speak the disclosure as well as displaying it. An ad with a generated narrator should identify the synthetic voice audibly at the first relevant exposure. If an influencer or other person gives an endorsement, the paid-relationship disclosure also needs to be audible when viewers may experience the endorsement without looking at the screen.

Ads using more than one modality

If a spot combines a generated face, synthetic voice, and altered product demonstration, use both visual and spoken notices. A visual-only label can be missed by someone listening with the screen off; an audio-only notice can be missed by someone watching without sound.

Match the viewer’s language

Write and speak the disclosure in the same language as the ad. Avoid leaving terms such as “C2PA,” “synthetic media,” or “AI info” unexplained. If a technical term is useful for a specialist audience, pair it with a plain-language explanation.

Is a platform AI label or C2PA metadata enough?

No. Machine-readable provenance and platform labels are useful supporting signals, but they do not replace a perceivable notice in the ad when a legal or policy requirement calls for one.

C2PA-style credentials and other metadata can help platforms detect an origin, preserve an edit history, or display an automated label. They may be stripped when a file is re-encoded, downloaded, or reposted, and viewers may never open the interface where the information appears. Keep the in-ad wording independent of those systems.

Platform treatment is also changeable. Meta describes labeling a broad range of AI-generated images, video, and audio through shared industry indicators and user self-disclosure. Its “AI info” treatment can distinguish material generated by AI from material merely edited with AI, and some labels may move into a post menu. Check the current upload workflow for each market, format, and placement instead of assuming that an automatic badge will appear or remain in the same location.

What does the EU AI Act require for advertisements?

Article 50 transparency obligations apply from 2 August 2026. Deployers of deepfake image, audio, or video content must disclose the artificial generation or manipulation clearly and distinguishably no later than first exposure. A machine-readable mark by itself is not sufficient for that viewer-facing duty.

Who has the marking duty?

Providers of generative AI systems must add machine-readable marks that make synthetic output detectable. Systems placed on the market before 2 August 2026 receive a limited grace period for those provider marking obligations until 2 December 2026. That grace period does not turn a conspicuous viewer disclosure into an optional step for an advertiser deploying a deepfake.

What counts as a deepfake disclosure?

The rule covers artificial generation or manipulation of image, audio, and video that can mislead viewers about what they are seeing or hearing. Put the notice where the audience first encounters the relevant content and make it distinguishable from surrounding creative. Assess the resemblance, message, audience expectations, human review, geography, and distribution channel before deciding how prominent the notice must be.

Are creative or satirical works exempt?

Artistic, creative, satirical, fictional, and analogous works receive a limited manner-of-disclosure exception. The obligation is not simply erased; the notice may be adapted so it does not unnecessarily damage the work while still informing the audience. Record why the exception applies and how viewers will receive the information.

What about AI-generated text?

For AI-generated text concerning matters of public interest, Article 50 provides an exception when the text has undergone human review or editorial control and a natural or legal person assumes editorial responsibility. That provision is narrower than a blanket exemption for all advertising copy. Document the review and responsible party, and consider the separate advertising and consumer-protection rules that still govern the message.

What are the potential penalties?

European Commission guidance says fines can reach €15 million or 3% of worldwide turnover, depending on the infringement and the undertaking. The amount is not a universal tariff for every campaign; exposure depends on the facts, jurisdiction, and enforcement decision.

What does U.S. FTC guidance require?

In the United States, the Federal Trade Commission requires advertising claims to be truthful, not deceptive or unfair, and supported by appropriate evidence. Its Endorsement Guides apply to online and social advertising and require material connections to be disclosed clearly and conspicuously.

An AI-origin notice does not cure a misleading claim. If a synthetic spokesperson appears to demonstrate a result, the underlying performance claim still needs substantiation. If the advertiser paid for the endorsement or provided another material connection, disclose that relationship alongside the AI notice.

The FTC’s practical instruction is to make sure people will see and understand the disclosure. A platform’s built-in disclosure tool may not be enough; include the notice in the video or image and place it with the endorsement or claim rather than only in a description.

How do I choose the right wording and treatment?

Use a risk-based decision that considers what viewers could reasonably believe, not only which software generated the file.

Rank #4
Situation Viewer-facing wording Additional treatment
Generated scene or still image “AI-generated imagery.” Show it beside the first synthetic scene in high-contrast text.
Generated narrator or altered voice “Synthetic voice generated with AI.” Speak the notice and display it on screen.
Avatar or digital twin presenting an offer “AI-generated spokesperson.” Add “Advertisement” or a sponsorship notice when paid.
AI-assisted edit that materially changes a person or event “This ad contains AI-generated video.” Explain the changed element if the shorter wording could mislead.
Paid ad with any synthetic element AI-origin notice plus “Advertisement,” “Sponsored by the advertiser,” or “Paid for by the advertiser.” Keep both notices visible at first relevant exposure.

There is no official universal phrase, icon size, exposure duration, or cross-platform safe harbor for every AI-generated advertisement. Treat the examples as clear starting language, then test legibility and comprehension for the actual placement.

How can a team implement compliant labels before launch?

  1. Inventory the synthetic elements. List every generated or materially altered image, video segment, voice, avatar, script passage, and interactive response. Note whether the audience could mistake it for a real person, event, product, or testimonial.
  2. Map the first exposure. Identify the first frame, spoken line, or interactive response in which each element matters. That is where the disclosure belongs.
  3. Choose literal wording. Name the element and avoid unexplained technical language. Use separate commercial wording if the placement is paid or sponsored.
  4. Match the modality. Add on-screen text for visual material, spoken wording for audio material, and both for mixed media.
  5. Design for noticeability. Check contrast, type size, position, safe areas, duration, captions, and mobile cropping. Verify that a viewer can read it without pausing.
  6. Apply market rules. Review EU Article 50 obligations for campaigns shown in the EU and FTC standards for U.S. advertising, then check additional local law and platform policies for every target market.
  7. Attach provenance where available. Preserve machine-readable credentials and use platform self-disclosure controls, but do not remove the in-ad notice because those signals exist.
  8. Review the claims. Confirm that demonstrations, testimonials, performance statements, and before-and-after scenes have evidence independent of the AI disclosure.
  9. Archive the decision. Save the tools used, synthetic elements, human review, final approver, markets, platforms, release version, and screenshots showing the label in the published placement.

How should I compare disclosure options?

Compare each treatment against the actual viewer experience rather than selecting the shortest label by default.

Option Visibility at first exposure Modality coverage Specificity Evidence trail
In-creative plain-language label High when placed beside the first relevant scene Visual; add spoken wording for audio Can identify the exact synthetic element Archive screenshots and final creative
Platform self-disclosure control Depends on platform UI and placement Usually visual and interface-dependent May distinguish generated from edited content Save the upload settings and resulting label
Machine-readable provenance Not necessarily visible to viewers Not a substitute for audio or visual notice Can preserve technical origin and edit history Retain the credential and processing record
Caption or description only Low if hidden behind “more” or skipped Usually visual text only Can be specific, but detached from the claim Archive the published caption and its visibility

The strongest package usually combines an in-creative notice, a spoken notice when needed, platform self-disclosure, and provenance records. The package still has to be adapted to the platform’s current interface and the laws of each market.

What common labeling failures should I fix?

The label appears after the synthetic claim

Move it to the first relevant frame or spoken line. A disclosure that arrives after viewers have formed an impression may not correct that impression.

The notice is technically present but unreadable

Increase contrast, size, and duration; check compressed and mobile versions; and test the smallest placement in which the ad will run. Do not assume that a label visible on an editing monitor remains legible in a feed.

The creative says “AI” but not what AI changed

Replace generic wording with the element: image, voice, spokesperson, scene, or product depiction. Specificity helps viewers understand what is synthetic without implying that unrelated portions were generated.

The ad uses only a platform toggle

Keep the toggle, but add the notice to the creative. Platform behavior and label location can change, and viewers may never open the relevant menu.

The ad discloses AI but not sponsorship

Add a separate “Advertisement,” “Sponsored by,” or “Paid for by” notice whenever there is a paid relationship or other material connection. Place it with the endorsement or claim.

The label is visual in an audio-led placement

Record a spoken disclosure and retain it in the audio master. Repeat the notice in captions or on-screen text for people watching with sound off.

What records should be retained?

  • The model or tool used and the version or workflow, when known.
  • A list of generated, altered, and human-created elements.
  • The rationale for treating an element as material or non-material.
  • Human review, editorial control, fact checking, and the final approver.
  • Target markets, languages, platforms, placements, and publication dates.
  • Final creative files, audio masters, captions, metadata credentials, and screenshots of visible labels.
  • Any exception analysis for artistic, fictional, satirical, or public-interest text.

This evidence trail helps answer regulator, platform, client, and audience questions when a campaign is edited, localized, reposted, or reviewed months after launch.

Frequently Asked Questions

Do AI-assisted edits always require an AI label?

Not every minor workflow adjustment has the same risk as a generated person, event, voice, or product scene. Evaluate whether the change could alter a reasonable viewer’s understanding, how closely it resembles reality, the audience’s expectations, and the rules of the market and platform. Record the decision even when you conclude that a prominent notice is unnecessary.

Does the disclosure have to stay on screen for the entire commercial?

There is no single official duration that safely covers every format. Keep it visible long enough to be read at the first relevant exposure, and repeat it when a later section introduces a different synthetic element or when the ad is commonly encountered in a sound-off or cropped presentation.

How should a livestream or interactive chatbot disclose synthetic content?

Show the notice in the interface before the synthetic interaction begins and keep it available while the interaction continues. If the system can switch between human and AI responses, make that distinction clear at the point of each change and retain logs showing the mode used.

What should an influencer say when an AI avatar delivers the endorsement?

The influencer or advertiser should make the paid relationship clear in the endorsement itself, while the creative identifies the avatar or voice as AI-generated. Use spoken wording for an audio endorsement and on-screen wording for viewers who watch without sound; do not rely on a profile disclosure or a hidden caption.
