Choose an AI assistant by checking what happens to your conversations—not by relying on a broad “private” or “secure” label. Compare training use, retention, deletion, access and sharing, security, and account-specific controls; then verify the current policy and settings for the exact product and plan before entering sensitive information. No single privacy-protective winner is established here.
What to check before choosing an AI assistant
Use the same questions for each assistant you are considering. Read the service’s current privacy policy, terms, and in-product settings for the account you will actually use. Consumer and business accounts can have different rules, and settings and terms may change.
Training and model improvement
Find out whether the provider uses conversations to improve its models, whether that use is on by default or depends on account type, and whether you can change the choice. Check when a change takes effect: it may govern only new or resumed conversations, not data already used or training already underway.
Retention and deletion
Ask how long prompts and related data are kept, including when they are not used for training. Some data may be retained for safety or abuse review. Check whether you can delete individual chats, memories, or account data, and what deletion does—and does not—mean for information already used in training.

Access, sharing, and connected services
Look for who may review conversation data, including staff and service providers, and what happens when you connect files, apps, or other accounts. For work use, check contractual commitments governing customer prompts and confidential information rather than assuming consumer-account terms apply.
Security and clarity
Look for concrete safeguards such as encryption, account protections, access controls, and product-specific compliance information. Security and privacy are related, but distinct: encryption does not tell you whether conversations are retained, reviewed, or used to train models. NIST notes that AI security and resilience challenges are changing rapidly, so a certification or safeguard should not be treated as a complete answer to every risk (NIST AI Research – Security and Resilience, updated August 14, 2026).

Prefer specific explanations and visible controls over vague assurances or disclosures buried in legal language. FTC staff guidance says companies can face legal risk for using or retaining data for other purposes without clear, conspicuous notice and affirmative express consent; it also warns against quietly changing terms or hiding disclosures in fine print. The FTC puts it plainly: “There is no AI exemption from the laws on the books” (FTC guidance, January 2024).
Audience and account type
Evaluate consumer and business offerings separately. If a child or teenager may use the assistant, check its age rules, parental controls, safety information, and handling of conversation data. In September 2025, the FTC announced an inquiry into seven consumer-facing chatbot companies, asking about personal-information use and sharing and how users, parents, and children are informed. The announcement describes an inquiry, not findings against all the companies involved (FTC inquiry announcement, September 2025).

How the questions apply to current provider examples
These dated examples illustrate why the exact service, plan, and setting matter. They are provider statements, not a neutral head-to-head audit or proof of how a particular account is configured.

Anthropic’s stated retention durations are terms in that August 2025 announcement, not general rules for all AI assistants or all Claude offerings. OpenAI’s page likewise describes provider policies and controls; it does not show which setting is active on your account.

Verify the exact account before sharing sensitive information
- Choose the precise product and plan. Identify whether you will use a consumer, business, or API offering, and whether any connected apps or services will receive data.
- Open the current privacy policy and terms. Locate the provisions on model improvement, retention, deletion, review, sharing, and changes to terms.
- Inspect the account’s privacy controls. Confirm the current training or improvement setting and what conversations it covers, including resumed chats or coding sessions where applicable.
- Check deletion and retention separately. Determine what you can delete, how long other copies may remain, and whether deletion affects data already used for training.
- For work, confirm the contract and controls. Verify the organization’s commitments for prompts and confidential information rather than relying on consumer-facing statements.
- For children and teens, review age and safety information. Confirm the service’s rules, parental controls, and conversation-data practices before allowing use.
- Recheck before sharing high-risk data. Policies and controls can change; if the service’s current terms do not clearly answer a material question, do not assume the data will remain private.
Use a simple decision rule
Prefer the assistant whose current, account-specific terms clearly explain training, retention, deletion, access, and sharing—and whose controls match your needs. Treat unanswered questions as uncertainty, not as evidence that data is not collected or retained. For especially sensitive personal or workplace information, share only what the service’s verified terms and your organization’s rules permit.
