Export controls can apply to a cloud GPU workload even when you never possess the hardware. Under the U.S. Export Administration Regulations (EAR), the controlled item may be the advanced GPU, server, or electronic assembly in a provider’s data center. Your company’s headquarters and ultimate parent, the customer you serve, the workload (training, fine-tuning, inference, or storage), and the intended end use can determine whether a license, exception, or Data Center Validated End User (VEU) authorization is required.

As of October 20, 2026, moving a workload to Singapore or another third country is not a dependable workaround if the customer or ultimate parent is headquartered in China, Macau, or another Country Group D:5 destination. Before deployment, obtain the provider’s hardware classification and location, document every party and intended use, and confirm the exact authorization path with current BIS rules or qualified counsel.

What export controls change for a cloud-GPU project

Cloud GPU selection is no longer only a question of price, memory, uptime, and software compatibility. For advanced-computing workloads, it is also a jurisdiction, identity, end-use, and provider-compliance decision.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The Bureau of Industry and Security (BIS) controls certain advanced-computing integrated circuits, servers, and related assemblies under ECCNs that include 3A090, 4A090, and 5A992.z. A developer can access those items through infrastructure as a service (IaaS) without taking title to them, but the provider still has to manage export, reexport, transfer, end-user, and end-use obligations. Your contract, account approval, and ability to obtain capacity can therefore depend on facts outside your application code.

  • Read Before You Buy — No Video Output: These adapters support charging and USB 2.0 data transfer, but cannot transmit video signals. Except for standard USB webcams (which use USB data only), they are not compatible with HDMI/DisplayPort cables, video-capable USB-C hubs, or docking stations with video output.
  • Convert USB-A Ports to USB-C: Designed to connect USB-C earphones, cables, flash drives, card readers, and other USB-C accessories to standard USB-A ports. Plug-and-play with no drivers or software required.
  • Aluminum Alloy Housing: Built with a sturdy aluminum alloy shell that aids in heat dissipation and protects against daily wear and scratches. Designed to maintain a stable and secure connection.
  • Compact & Travel-Friendly: The ultra-compact design allows the adapter to stay plugged into your device without blocking adjacent ports or adding bulk, reducing wear and tear on your original USB ports.
  • 12-Month Warranty: Backed by a 12-month manufacturer warranty for peace of mind. Designed to meet strict quality control standards for reliable everyday performance.
  • The physical location of the GPU and the legal entity supplying it matter.
  • Your headquarters and ultimate parent can matter even when the server is in another country.
  • Pretraining, fine-tuning, inference, and model-weight storage do not receive identical treatment.
  • Knowledge of prohibited WMD or military-intelligence end uses can activate catch-all controls.
  • Provider marketing does not establish that a license exception or VEU authorization applies.

The framework described here is the U.S. BIS/EAR position reflected in official material through October 20, 2026. Other governments may impose additional controls, and a transaction-specific classification or legal opinion may be necessary.

Why remote access does not remove the controlled item

Export rules attach to the controlled commodity, software, technology, destination, end user, and end use—not simply to who clicks a web console. If an advanced GPU or server sits in a provider’s facility, that provider may be exporting, reexporting, or transferring the item when it allocates the capacity to your account or to a customer you support.

Remote access can therefore create several compliance events:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • A provider exports or reexports the GPU server to a foreign data-center operation.
  • The provider transfers controlled capacity to your legal entity or to your customer.
  • You transfer model weights, checkpoints, or controlled technical information between regions.
  • A subcontractor, contractor, or affiliate receives access to the environment.

Ask for the GPU family, the applicable ECCN or classification, the physical service location, and the legal entity that supplies the capacity. If the provider will not identify those basics, you cannot reliably evaluate the transaction.

Headquarters and ultimate parent can decide the result

BIS guidance issued May 31, 2026, clarifies that licensing requirements can follow an entity headquartered in Country Group D:5 or Macau even when that entity operates outside those locations. The same concern appears in EAR provisions addressing a foreign-located cloud or data-server provider whose headquarters or ultimate parent is in a restricted destination.

Consequently, placing a server in Singapore, Japan, or another third country does not by itself make a China-linked deployment permissible. The analysis can turn on:

Training, fine-tuning, inference, and model weights are different activities

Pretraining

The VEU acceptable-use text restricts training a specified advanced AI model outside approved destinations, including training delivered as IaaS for an entity headquartered outside those destinations, unless the required authorization is in place. A pretraining plan should therefore identify the model, where the training runs, who controls the account, and where checkpoints and final weights will be stored.

Fine-tuning and evaluation

The same text permits limited fine-tuning under its stated threshold, but that permission is conditional and does not automatically cover every adaptation, dataset, or customer. Evaluation can also involve model-weight access and transfers that are controlled separately from the compute session. Have compliance staff classify the activity rather than labeling every short run as “fine-tuning.”

Inference and API access

Under the cited VEU acceptable-use paragraph, API access and IaaS inference are not prohibited by that paragraph. That is not a blanket exemption: future-equivalence provisions, end-user and end-use rules, model-weight controls, sanctions, and other EAR requirements can still apply. A provider should record whether a customer receives only outputs or also receives weights, checkpoints, privileged tooling, or persistent access to the underlying system.

Model-weight storage and transfer

Model weights are subject to separate restrictions. Storing a checkpoint in a different region, copying it to a customer tenancy, or allowing a contractor to download it can be a controlled transfer even when the original training run was permitted. Define approved storage regions, copying rights, administrators, retention, and deletion before the first checkpoint is written.

End use, end user, and knowledge obligations

BIS’s May 13, 2025 AI-training guidance explains that catch-all controls may apply when an exporter or provider has knowledge that an AI model or commodity will support prohibited weapons-of-mass-destruction or military-intelligence end uses or users. “Knowledge” is broader than an admission by the customer; warning signs, documents, ownership structures, technical descriptions, and other facts can create an escalation duty.

An effective intake process should obtain an intended-use statement and then test it against the actual project:

  • What model or service is being trained, adapted, evaluated, or served?
  • Which legal entity controls the account and who ultimately benefits?
  • Will the system support military, intelligence, surveillance, weapons, or WMD-related work?
  • Which contractors, data suppliers, and downstream customers will receive access?
  • Where will data, weights, logs, and backups reside?

Screen customers, beneficial owners, contractors, and counterparties against applicable restricted-party lists and Entity List controls. Escalate inconsistencies instead of relying on an IP-address check.

What a Data Center VEU requires

BIS expanded the Validated End User program to eligible data centers on September 30 and October 2, 2024. A Data Center VEU arrangement is a structured authorization for trusted handling of advanced compute, not a general permission to serve every customer or workload.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Data centers operating under the framework must maintain safeguards aligned with NIST 800-53 and FedRAMP High, protect model weights and proprietary techniques, and control the physical and digital movement of advanced-computing items. Operational duties include:

  • Shipment security and positive chain of custody.
  • Tamper detection and investigation.
  • Prompt reporting of theft, loss, or tampering.
  • Access controls and records that identify who used the systems.
  • Geographic allocation controls for compute installed or transferred under the authorization.

Ask the provider for the scope of its VEU authorization, the covered legal entity and facilities, the countries permitted for your workload, and the evidence it retains. A provider’s general statement that it participates in a trusted program is not enough to prove that your account, GPU type, customer, or workload falls within the authorization.

Key BIS changes and dates

Date Development Why developers should care
September 30 and October 2, 2024 BIS expanded Data Center VEU eligibility and requirements. Trusted facilities can handle advanced compute only with security, accounting, chain-of-custody, and geographic controls.
January 13, 2025 BIS announced the AI Diffusion framework covering advanced-computing chips and certain closed AI model weights, with license exceptions and Data Center VEU updates. GPU access, model-weight movement, and destination planning became linked parts of one compliance analysis.
May 13, 2025 BIS issued AI-training guidance identifying controls involving ECCNs 3A090.a, 4A090.a, and 5A992.z and explaining catch-all end-use rules. Training providers need item classification and an escalation process for prohibited WMD or military-intelligence uses.
January 13, 2026 BIS adopted a case-by-case licensing policy for Nvidia H200, AMD MI325X, and similar chips in specified China-related transactions. The policy creates a review path under conditions; it is not blanket permission.
May 31, 2026 BIS clarified that requirements follow entities headquartered in Country Group D:5 or Macau, even when they operate elsewhere. A third-country data center does not automatically cure a restricted headquarters or ultimate-parent relationship.

When announcing the 2025 framework, BIS said it sought to build a trusted technology ecosystem while protecting national security without stifling innovation or U.S. technological leadership. In 2026, Under Secretary Jeffrey Kessler said export controls should evolve with technology while protecting national security.

Developer checklist before provisioning GPUs

  1. Classify the hardware. Obtain the GPU family, server configuration, relevant ECCN or classification, and whether the provider treats the item as an advanced-computing part or assembly.
  2. Map locations and legal entities. Record the physical facility, the contracting provider, the supplying entity, your headquarters, your ultimate parent, and the equivalent information for every customer.
  3. Describe the workload precisely. State whether the job is pretraining, fine-tuning, evaluation, inference, or model-weight storage. Identify the model, expected scale, data sources, checkpoint locations, and transfer paths.
  4. Screen people and organizations. Check customers, beneficial owners, contractors, affiliates, and downstream counterparties against applicable restricted-party and Entity List controls.
  5. Analyze end use. Obtain an intended-use statement and escalate any indication of WMD, military-intelligence, or other prohibited activity.
  6. Confirm authorization. Determine whether a license, license exception, Data Center VEU authorization, or another specific authorization covers this exact item, destination, entity, and activity. Do not infer eligibility from a marketing page.
  7. Lock down transfers. Define where data, weights, logs, and backups may reside; who can copy them; and what happens when a job, customer, or contract ends.
  8. Preserve evidence. Keep purchase orders, customer certifications, provider attestations, transfer records, screening results, and security evidence for the period required by the applicable rule.
  9. Review before scaling. Re-check country groups, ECCN thresholds, provider terms, ownership, and authorization before materially increasing compute or relocating a workload.

How to compare cloud GPU options

Use the following questions in a request for proposal or technical review. A cheaper or closer region is not necessarily the compliant choice.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Comparison axis Evidence to request
Physical and legal location Facility country and region, contracting entity, supplying entity, and backup locations.
Provider ownership Headquarters and ultimate parent, including any change-notification commitment.
GPU and server classification Model, server configuration, ECCN or other classification, and covered firmware or assemblies.
Workload type Provider treatment of pretraining, fine-tuning, evaluation, inference, and persistent access.
Weight handling Storage regions, replication, download permissions, administrators, retention, and deletion.
Compliance operations Customer screening, logging, incident response, tamper detection, and audit records.
Authorization License number or exception basis, VEU scope, covered facilities, and customer eligibility conditions.
Contract rights Audit access, relocation notice, suspension triggers, incident reporting, and termination assistance.

What the January 2026 China policy actually permits

On January 13, 2026, BIS said applications involving Nvidia H200, AMD MI325X, and similar chips for specified China-related transactions may receive case-by-case review. Applicants must demonstrate three conditions described in the announcement:

  • The export will not reduce semiconductor capacity available to U.S. customers.
  • The Chinese purchaser has export-compliance procedures, including customer screening.
  • Independent testing in the United States verifies performance and security.

This is a licensing-policy change, not an open authorization for every Chinese-owned company, overseas affiliate, or cloud account. A provider and customer still need to establish item classification, headquarters and ultimate-parent status, end use, security controls, and the specific license outcome. BIS described permitting H200 sales under controlled conditions as a way to strengthen the American technology ecosystem; that statement does not replace transaction-specific approval.

Geographic and annual limits that may affect capacity planning

Some VEU and license-exception structures impose quantitative limits. The figures below are the limits described in the cited EAR provisions, not a general allocation available to every developer.

Limit Scope Source context
25% Maximum share of total AI computing power a qualifying UVEU may transfer or install outside specified approved countries. BIS EAR Part 748 text, 2025.
7% Maximum share of total AI computing power a qualifying UVEU may transfer or install in any single country outside those approved countries. BIS EAR Part 748 text, 2025.
50% Maximum share of total AI computing power a U.S.-headquartered UVEU may transfer or install outside the United States. BIS EAR Part 748 text, 2025.
26,900,000 cumulative TPP per calendar year Limit for License Exception LPP to a single ultimate consignee. BIS current EAR Part 740.

Because these limits are tied to the authorization, consignee, and accounting method, do not convert them into a promise that a particular provider can offer a fixed number of GPUs to your project.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Common deployment decisions

Can a developer in China use a U.S. cloud GPU?

Possibly, but not automatically. The answer depends on the GPU and server classification, the developer’s headquarters and ultimate parent, the provider’s location and authorization, the workload, the end use, and any license or exception. A remote login does not erase those factors.

Does Singapore avoid export controls?

No. A Singapore facility can still be supplying controlled items to an entity headquartered in China, Macau, or another D:5 destination, and model-weight transfers or prohibited end uses can create separate issues.

Are only training jobs controlled?

No. Training receives specific restrictions, while inference may be treated differently under the VEU acceptable-use paragraph. Hardware transfers, model-weight storage, end-user screening, end-use controls, and future-equivalence provisions can apply to inference deployments as well.

What should a provider collect?

At minimum: GPU and ECCN details; physical and legal service locations; customer and ultimate-parent identity; intended workload and end use; storage and transfer locations; restricted-party screening results; authorization basis; and security, logging, and incident-response evidence.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Records, change management, and escalation

Export compliance is a continuing control, not a one-time checkbox at signup. Keep a versioned record of classifications, customer certifications, ownership checks, provider attestations, licenses or exception analyses, region assignments, weight transfers, and incidents. Tie that record to the account and project identifiers used by engineering so that a compliance reviewer can reconstruct who used which capacity and when.

Escalate before deployment when the provider cannot identify the hardware classification, the customer will not disclose its ultimate parent, the proposed use touches military or WMD work, a model checkpoint must cross a new border, or the provider proposes moving capacity to another facility. Pause scaling while the issue is resolved; do not assume that an existing contract or a previously approved region covers a materially different GPU, customer, or workload.

Bottom line for developers

Choose cloud GPUs by combining technical fit with export-control facts. Verify the item, location, provider and ultimate parent, customer identity, workload category, model-weight path, end use, and authorization. The January 2026 China policy and Data Center VEU program can create lawful routes for some transactions, but both operate through conditions, records, security duties, and case-specific eligibility. Re-check current BIS country groups, ECCN thresholds, provider terms, and licensing before you deploy or materially expand a cloud-GPU workload.
