AI time tracking is not a universal mind-reading system. Most products watch device and application signals, apply configurable inactivity rules, classify each interval, and assemble a timesheet that people can review and correct. The result can show active, passive, idle, productive and inactive time, but it cannot reliably infer intent from keystrokes alone. Whether a meeting counts as work, a lunch break is paid, or extra hours qualify as overtime depends on the software configuration, employer policy and applicable law.
What an AI time tracker actually measures
Automated trackers generally combine two kinds of evidence: context and input. Context identifies what is in the foreground, such as an application, browser tab or document. Input records device activity, typically mouse movement and keyboard events. Some systems can also use microphone or camera status for calls, while mobile products may collect GPS or other location signals. The software then turns those events into time intervals rather than recording a continuous statement of what a person intended to do.
Vendors use different labels and rules. Clockify describes active time as mouse and keyboard activity, and defines work time as active time plus idle time. Hubstaff labels every second active or inactive. ActivTrak distinguishes active, passive and inactive periods. These are vendor rule systems marketed as AI-assisted automation, not one industry-wide algorithm. Two products can therefore produce different totals from the same workday.
From signal to timesheet
- Capture context. After a minimum duration in an app, tab or document, the tracker records that context against the user and project. Clockify documents a 10-second minimum and a configurable default of 60 seconds.
- Watch for inactivity. A timer starts when no qualifying input is detected. Clockify permits a threshold from one to 30 minutes. Hubstaff’s default inactivity warning is five minutes and can be changed. ActivTrak’s glossary uses a five-minute passive-time limit before time becomes inactive or break time.
- Classify the interval. The product assigns active, idle, passive, productive or inactive status according to its rules. “Productive” usually comes from an administrator’s classification of work-related applications and websites; an active session is not automatically productive.
- Aggregate and report. Accepted intervals feed timesheets, attendance, schedule-adherence, utilization and overtime reports. Depending on policy, a user or manager may edit, approve, discard or restore idle periods, so the final record is policy-controlled rather than an immutable sensor reading.
Active, passive, idle and productive time are different
These terms describe separate dimensions, and confusing them causes most disputes.

| Label | Typical meaning | What it does not prove |
|---|---|---|
| Active | Recent qualifying keyboard or mouse input, or another signal the vendor accepts as activity. | That the work is useful, authorized or related to the assigned project. |
| Idle | A period with no input that remains attached to a work session under the product’s rules. | That the employee stopped working; reading, thinking or speaking may produce no input. |
| Passive | Non-input time that a product recognizes as potentially work-related, such as viewing a document or attending a call. | That the person was continuously attentive or that the interval is payable under local law. |
| Inactive or break | Time beyond an inactivity threshold, or time explicitly removed or marked as a break. | That the person took an unauthorized break or was off duty. |
| Productive | Time in apps or sites an administrator has classified as work-related. | That every active second produced an output or met a performance target. |
A useful report therefore needs both an activity total and the rules behind it. A team with a high active percentage may simply use software that treats reading as inactive, while a team with more passive time may be using a system designed to recognize meetings and research.
Why meetings, calls and non-keyboard work are difficult
Keyboard and mouse tests are a poor proxy for many legitimate tasks. A person can be working while listening to a customer, presenting in a video meeting, watching required training, reading a specification, making handwritten notes or thinking through a problem. Conversely, an unattended browser tab can remain open while no work is occurring.
Hubstaff specifically identifies meetings, phone calls, training videos and handwritten notes as situations in which an input-only rule can report inactivity. ActivTrak treats non-input work as passive before it becomes inactive. Clockify can keep a meeting active when its Active-on-Call rule detects microphone or camera use. None of these approaches establishes intent perfectly; they are ways to reduce false idle time.
How to configure a fair meeting rule
- Decide which call signals are allowed and whether microphone or camera status is collected at all.
- Set the inactivity threshold long enough for the work pattern. A one-minute threshold can punish reading; a 30-minute threshold can hide a genuine break.
- Tell users what happens when the threshold is reached: a warning, an idle label, automatic removal or a manager review.
- Provide a correction path for meetings, calls, handwritten work and travel between work areas.
For privacy, collect the least intrusive signal that answers the administrative question. If attendance is sufficient, continuous audio, video or location capture adds exposure without improving the timesheet.

How breaks are detected and recorded
A break is a policy decision layered on top of activity data. A short pause may remain inside a work block, be labelled idle or passive, trigger a prompt, or be removed from the payable timesheet. The same five minutes can therefore appear differently in two organizations.
Before relying on an automated total, document four settings: the inactivity threshold, whether passive time is retained, who can edit or discard intervals, and whether edits leave an audit history. Employees should be able to explain an interval and managers should be able to see what changed. A tracker that silently deletes idle time is less defensible than one that asks for confirmation and preserves the original event.
Break rules under United States federal law
The U.S. Department of Labor says short breaks, usually five to 20 minutes, are generally compensable work hours. Bona fide meal periods, typically at least 30 minutes, generally are not compensable when the employee is relieved from duty. State and local rules can be more protective, and collective agreements or company policy may add requirements. An application cannot decide those legal questions from activity signals alone.

Time-tracking software can compare captured or approved hours with a schedule, daily capacity or workweek rule. That comparison supports payroll review; it is not automatically a legal finding. Clockify’s example shows 10 productive hours against an eight-hour expected capacity as 125% utilization. Utilization is a management ratio, not overtime pay.

For covered, nonexempt employees under the U.S. Fair Labor Standards Act (FLSA), the federal rule is at least one and one-half times the regular rate for hours worked over 40 in a workweek. The Department of Labor states: “The FLSA requires that covered nonexempt employees receive at least the minimum wage and at least one and one-half times their regular rates of pay for hours worked over 40 in a workweek.” The rule concerns hours actually worked, not an app’s active percentage, and exemptions and state laws can change the result.
A defensible overtime workflow
- Define the workweek. Use the employer’s established seven-day period, not an arbitrary calendar-month total.
- Collect all work time. Include approved manual entries, meetings, travel that legally counts as work, and work performed away from the tracked device.
- Apply break policy. Separate compensable short breaks from unpaid meal periods only when the employee was actually relieved from duty.
- Review exceptions. Investigate missing device time, duplicate sessions, edits, schedule changes and work performed after a tracker was paused.
- Calculate pay. Apply the regular-rate and overtime rules for the employee’s jurisdiction, then export the approved record to payroll.
The FLSA requires covered employers to keep accurate daily and weekly hours, overtime earnings and wage records, but it does not prescribe a particular timekeeping form. Automated records can help meet that obligation only when the employer reviews errors and follows state and local requirements.
What administrators and employees should compare
| Capability | Questions to ask before deployment |
|---|---|
| Signals | Does it capture apps, URLs, keyboard and mouse events, microphone or camera status, mobile activity or GPS? Are all signals optional? |
| Thresholds | What is the minimum context duration? Can the inactivity interval be changed per team, and is a warning shown before time is classified as idle? |
| Passive work | Can reading, calls, training and other non-input tasks remain visible as passive time rather than disappearing? |
| Break handling | Are breaks prompted, automatically discarded or manually approved? Is there an edit history? |
| Productivity | Who classifies applications and websites, how are ambiguous sites handled, and can employees see the classification? |
| Schedules and overtime | Can the system represent workweeks, shifts, paid time off, attendance rules and jurisdiction-specific overtime policies? |
| Privacy | Are screenshots, audio, camera and location collection configurable? How long are raw events retained, and who can view them? |
| Integrations | Can approved time flow to payroll, invoicing and scheduling systems, and can reports be exported for audit? |
How the major approaches differ
| Product | Documented approach | Important configuration point |
|---|---|---|
| Clockify | Records app or browser context after a minimum duration; defines work time as active plus idle and supports utilization reporting. | Minimum context duration is documented as 10 seconds, with a 60-second configurable default; inactivity can be set from one to 30 minutes. An Active-on-Call rule can recognize microphone or camera use. |
| Hubstaff | Labels each second active or inactive and provides inactivity warnings and tracking controls. | The default inactivity warning is five minutes and can be configured. Users or managers may review and edit idle periods, so totals depend on approval policy. |
| ActivTrak | Separates active, passive and inactive periods and adds productive classifications based on app and site categories. | Its glossary uses a five-minute passive-time limit by default before inactive or break time begins. Non-input work can remain passive instead of being treated as immediately inactive. |
These differences matter more than the “AI” label. Select the model that matches the work: a call-heavy team needs passive or call recognition; a compliance team needs transparent edits and retention; a payroll team needs approved weekly totals rather than a raw activity score.

Deployment checklist for a trustworthy system
- Define the purpose. State whether the system supports payroll, project costing, attendance, utilization or security. Do not collect extra signals without a documented reason.
- Write the policy first. Specify tracked devices, work locations, break treatment, overtime approval, manual corrections, retention and who can access reports.
- Configure classifications. Publish productive, neutral and non-work categories, with a route for employees to challenge a mistaken classification.
- Pilot varied work. Test meetings, reading, coding, customer calls, training, travel and lunch. Compare the report with a human timesheet before using it for pay.
- Train everyone. Explain what is captured, what is not, how warnings appear and how to correct a missed or misclassified interval.
- Audit regularly. Check edits, discarded idle time, missing sessions, overtime exceptions and access logs. Update settings when work patterns or laws change.
Common failure modes and fixes
A meeting appears as a long break
Check whether the product recognizes microphone or camera activity or offers a passive-time category. If not, preserve the meeting through a manual entry and adjust the policy rather than lowering the threshold for everyone.

Reading or thinking is reported as inactivity
Increase the threshold for that team, enable passive tracking where available, and require review before idle time is removed. Do not label every quiet interval as misconduct.
Active time is high but output is low
Review application classifications and the definition of productive time. Active input can occur in an unproductive site, while valuable planning may generate little input. Use activity data as one management signal, not a standalone performance score.
Overtime totals do not match payroll
Compare the workweek boundary, approved manual entries, meal-break treatment, schedule changes and jurisdictional rules. Reconcile the approved human record with the automated export before paying or denying overtime.

Is employee monitoring legal?
Legality depends on location, worker classification, notice, consent requirements, collective agreements, data-protection rules and the particular signal collected. The federal FLSA addresses minimum wage, overtime and recordkeeping; it does not authorize every form of surveillance or require a specific tracking product. State, local and non-U.S. rules may impose additional limits, especially for recording communications, biometric data, location and off-duty activity.
Before deployment, obtain jurisdiction-specific legal advice, give the required notice, limit collection to a legitimate purpose, secure raw data and define retention and deletion. Never use an automated “inactive” label as the sole basis for discipline or a wage decision without human review and a way to correct the record.
Bottom line for buyers and users
AI time tracking works by translating application context and device events into vendor-defined activity intervals. Its accuracy is therefore a product of thresholds, classifications, break policy and human review—not a guarantee that software knows when someone is working. Choose a system that recognizes the work your people actually do, keeps passive and edited time visible, separates utilization from legal overtime, and gives employees a transparent way to correct mistakes. For U.S. payroll, use the resulting record as evidence to review against the FLSA and applicable state rules, never as a substitute for those obligations.
