Short answer: governments can regulate model providers, restrict new distribution, penalize unlawful deployment, and require security controls while an operator still controls the infrastructure and weights. They cannot reliably erase every copy after weights have been publicly downloaded. The International AI Safety Report 2025 puts the practical limit plainly: “Once model weights are available for public download, there is no way to implement a wholesale rollback of all existing copies of the model.”
That distinction separates a legally enforceable restriction on future access from a technical recall of data that has already spread. Whether a release should be allowed depends on its marginal risks and benefits, the available alternatives, who can still control the weights, and the jurisdiction and model category covered by a rule.
What “open-weight” means—and what it does not
An open-weight model is one whose trained parameters, or weights, are publicly available for download. The International AI Safety Report uses Llama and Stable Diffusion as examples. A person or organization that downloads the files can run the model on compatible hardware without asking the original provider to keep an online service available.
“Open-weight” is narrower than “open-source.” Open source generally implies a licence granting freedoms to use, study, modify and share, and may require additional source code, data documentation or build instructions. A model can therefore publish its weights without meeting every definition of open source. The terms should not be treated as synonyms when a law or licence turns on the distinction.

Openness is also a spectrum. A provider might publish weights but withhold training data, fine-tuning code, evaluation details or commercial rights; another might release most of the surrounding materials. More openness can improve independent research, auditing and innovation, while also making misuse easier and allowing defects or biases to persist in many copies.
Why a public release is hard to reverse
Weights behave like transferable data
Before release, a provider can revoke an API key, shut down a hosted endpoint, rotate credentials or delete the only controlled copy. After download, each holder can duplicate the files, move them to another server, modify them, or operate them offline. A provider may remove the original link, but that action does not reach mirrors, private archives, backups or derivatives.
This is why a takedown notice and a technical rollback are different outcomes. A court order might require a named distributor to stop offering a file. It does not automatically identify every person who copied it, establish which jurisdiction applies to each copy, or provide a mechanism for securely deleting all backups.

The report’s statement about no “wholesale rollback” is a claim about the practical limits of recovering existing public copies, not a claim that regulation is powerless. Governments can still control a provider’s conduct, restrict market placement, impose duties on deployers, and punish specific unlawful uses. Those tools reduce future distribution or harmful activity; they do not guarantee global erasure.

Ban, restriction and containment are different goals

Calling a rule a “ban” without naming the target creates confusion. A law may ban a provider from supplying a model in one territory, require a cloud service to remove a listing, or prohibit a particular use. None of those descriptions, by themselves, proves that the model’s weights have been eradicated.
Where containment is technically realistic
Keep weights inside a controlled service
If users interact only through an authenticated API or an internal application, the operator can enforce identity checks, rate limits, logging, content safeguards, network segmentation and rapid model replacement. Access can be suspended when abuse is detected. These controls are strongest when the weights never leave the operator’s infrastructure.
Protect weights and configuration
NIST’s Control Overlays for Securing AI Systems project addresses security controls for components including model weights and configuration settings. In practice, an organization can combine hardware-backed key management, least-privilege access, encrypted storage, isolated build systems, signed model artifacts, audit logs and tested incident-response procedures.

They are not proof of perfect containment: an authorized process still has to read the weights to run inference, and a sufficiently privileged user may be able to copy outputs or files. NIST describes an in-development standards effort, not a legal requirement or a guarantee against redistribution.

Use staged access when risk is uncertain
- Start with hosted access. Offer an API or sandbox while measuring misuse attempts, capability evaluations and operational demand.
- Limit privileges. Separate training, evaluation and production credentials; restrict export, debugging and bulk-download functions.
- Log and review. Record administrative access, model changes, high-risk prompts and anomalous volume, subject to applicable privacy law.
- Escalate deliberately. Release additional artifacts or weights only after documented testing, red-team findings and a mitigation plan.
- Prepare an incident response. Define how to revoke credentials, quarantine infrastructure, notify affected parties and publish a corrected model if a leak occurs.
Staged access can preserve reversibility for longer. It cannot make a later public release reversible once unrestricted downloads begin.
What current EU rules demonstrate
Provider duties began applying in 2025
European Union obligations for providers of general-purpose AI models began applying on 2 August 2025. The European Commission’s Questions & Answers and its 18 July 2025 guidelines describe duties that include technical documentation, information for downstream providers, a copyright policy and publication of a sufficiently detailed summary of training content.
The open-source exception is limited
Commission guidance says specified documentation duties under Article 53(1)(a) and (b) do not apply when a model is released under a free and open-source licence and its parameters, architecture and usage information are made public as required. This is an exception from particular obligations, not blanket immunity from the AI Act or other laws.

Models classified as posing systemic risk remain subject to the relevant obligations even when released on an open-source basis. The legal result therefore depends on the model’s category, the exact licence and disclosures, and the obligation being considered.

Enforcement can restrict availability, not recall every copy
The Commission’s AI Act enforcement framework describes powers for the AI Office to evaluate models and request access, risk mitigation, or restrictions on market availability, including withdrawal or recall in applicable cases. Such measures can be consequential for a provider and its official distribution channels. They are not a technical mechanism for locating and deleting every independently held weight. Enforcement provisions and dates can change, so organizations should verify the Commission’s current page before relying on a specific procedure.
What the cited US example does—and does not—show
The Federal Register item 90 FR 4544, Framework for Artificial Intelligence Diffusion, dated 15 January 2025, concerned controls on model weights for certain advanced closed-weight dual-use AI models. Its scope is important: it is evidence of a targeted control on a defined category, not a general ban on open-weight models.
Export, sanctions, customs or infrastructure rules can make acquisition and distribution harder in covered transactions. They still must be analyzed by model category, actor, destination, effective date and later amendments. A rule aimed at a provider or exporter does not automatically bind every person who already possesses a copy outside that rule’s jurisdiction.
How to assess whether release is responsible
The International AI Safety Report recommends evaluating openness relative to realistic alternatives, rather than treating “open” as inherently safe or unsafe. A decision record should address the following axes.

- Misuse capability: What harmful tasks become easier, cheaper or more scalable if the weights are downloadable?
- Access and oversight: Can the operator authenticate users, monitor activity and investigate incidents, or will the model run offline without supervision?
- Benefits: Would independent research, accessibility, competition, safety testing or local-language performance materially improve?
- Reversibility: Can the provider suspend access and update the system, and what happens if copies spread beyond its control?
- Persistence of flaws: Could an unsafe refusal failure, bias or vulnerability remain embedded in many unchanged or modified copies?
- Available alternatives: Is a closed hosted model, a smaller model, a restricted licence or a staged release able to deliver most of the benefit with less exposure?
The relevant comparison is marginal risk: the additional harm created by this release compared with the next-best available option. A model that adds little capability over existing public systems may present a different policy case from one that makes a dangerous capability broadly accessible for the first time.
Common policy and engineering mistakes
Claiming a provider takedown equals erasure
Removing an official download page can be worthwhile, but it should be described as stopping an identified distribution channel. Do not promise that all copies have disappeared unless there is evidence for that much narrower claim.
Using “open-source” as a legal shortcut
Check the licence and the public components. A label alone does not establish that code, data information, architecture and usage rights satisfy a statute’s definition or exception.
Applying a rule beyond its scope
Identify the covered territory, model class, actor and effective date. The EU GPAI obligations, the EU’s conditional documentation exception and the cited US closed-weight rule address different questions.
Relying on access controls after exporting the weights
Authentication, monitoring and rate limits work while an operator controls the service. They cannot be enforced on an offline copy owned by someone else. If containment is essential, keep the weights inside an environment whose operator controls identity, storage and execution.
A practical decision checklist
- Classify the artifact. Record whether the release includes weights, source code, training information, a licence and deployment tooling.
- Map control points. List the provider, distributors, cloud hosts, deployers and likely end users; assign which party can actually revoke or modify each copy.
- Define the jurisdiction. Note the territory, applicable statute, model category, effective date and enforcement authority.
- Measure capability and misuse. Test the model against the harmful and beneficial use cases that matter for the intended audience.
- Choose the least irreversible option. Prefer hosted, rate-limited or staged access when the evidence is uncertain and the benefits do not require public weights.
- Document residual risk. State plainly what can be suspended, what can be recalled, and what will remain outside the operator’s reach after a leak or public release.
Bottom line for decision-makers
A government can make a release unlawful, restrict future supply, penalize specified uses and pressure providers or platforms to remove official access. An organization can substantially contain a model while it keeps the weights and execution environment under its control. Neither form of control reliably recalls all copies after public download.
Therefore, treat unrestricted weight publication as a largely irreversible distribution decision. Use precise terms—open-weight rather than automatically open-source—separate provider regulation from control of independent copies, and evaluate release against concrete alternatives. For current legal obligations, consult the European Commission pages and the applicable Federal Register rule rather than assuming that a past restriction or exception remains unchanged.
