Short answer: Harvey is the strongest documented fit when a firm needs matter confidentiality, ethical walls, regional processing and granular retention controls. Thomson Reuters CoCounsel Legal is the better choice when Westlaw or Practical Law grounding, citations and Microsoft 365 or document-management integration matter most. An OpenAI enterprise/API deployment suits firms that can build and operate their own controlled assistant. Clio-oriented legal AI is most relevant when practice-management integration is the priority.
No product automatically preserves attorney-client privilege. The firm remains responsible for client instructions, protective orders, professional-conduct duties, access controls, data residency, subprocessors, retention, incident response and human review.
What a “safe” Copilot alternative means for privileged work
For a law firm, safety is not simply whether a vendor says it uses encryption. You need a defensible chain from the matter-opening decision through deletion: who can submit a document, which model and region process it, whether any provider can retain or train on it, who can retrieve the output, how activity is logged, and when every copy is removed.

Attorney-client privilege is a legal doctrine, not a product feature. Using a cloud service does not automatically waive privilege, but an unreasonable confidentiality practice can create risk. Harvey’s privilege materials frame the issue as a discipline problem: lawyers must take reasonable steps to keep client information confidential. Security features, certifications and contract terms can change. Treat the table as a screening tool, then obtain current contractual language and test the configured service.
Harvey: strongest documented confidentiality posture
Harvey is the leading candidate when the hard problem is separating matters and controlling where sensitive work is processed. Its security materials describe encryption at rest and in transit, no training on customer data by default, customer-controlled retention and deletion, role-based access and logical workspace separation. It offers processing choices for the EU/Switzerland, the United States and Australia.
Controls that matter in a law-firm deployment
- Ethical walls: Harvey describes enforcement mechanisms intended to keep one matter or team from seeing another. Test a cross-matter search and an administrator’s visibility before production use.
- Regional processing: Select the region that matches the engagement, client and protective-order requirements, then confirm where subprocessors and backups operate.
- Retention: Customer-selected retention and deletion should be mapped to the matter-closing schedule. Ask whether uploaded files, generated outputs, logs, abuse-monitoring records and backups follow the same policy.
- Provider controls: Harvey says model providers must meet zero-data-retention requirements. Obtain the current subprocessor list and the exact flow for each model used.
- Assurance: The company describes annual SOC 2 Type II and ISO 27001 audits, vulnerability scanning and penetration tests. Request the current reports or attestation letters under NDA.
Harvey’s privilege materials also describe authenticated workspaces, ephemeral processing and no human review. Those are vendor-described design commitments, not a substitute for your own access test and contract review.
Harvey’s chief legal officer, John LaBarre, summarizes the legal position this way: “Using technology to handle client information does not waive privilege, so long as lawyers take reasonable steps to keep that information confidential.” The phrase “reasonable steps” is the operational requirement: configure the service, train users and document why the setup is appropriate for each matter.

CoCounsel Legal is designed for professional work and connects legal tasks to Thomson Reuters content and productivity workflows. Its materials cover legal research, document analysis, drafting, Westlaw and Practical Law options, Microsoft Word workflows and document-management integrations.
Privacy and security terms
Thomson Reuters states that user content and prompts are not used to train or improve CoCounsel or associated models. Its security FAQ describes zero-retention API calls when CoCounsel interacts with model providers. Organization-level retention can be customized, and data can be deleted under the customer’s policy. TLS 1.2 is used in transit and AES-256 at rest.
Why grounding changes the risk calculation
For research, the ability to identify the authority behind an answer is as important as keeping the prompt confidential. CoCounsel’s Westlaw and Practical Law options, citations and document-analysis features are aimed at producing outputs that can be checked. Require attorneys to open and verify every cited authority before relying on an answer; a citation is a starting point, not a filing-ready conclusion.
Vendor-reported scale
Thomson Reuters’ 2026 product materials report “1M users,” use by “over 20,000 legal teams,” and support from “over 1,200 attorney-editors and more than 1,000 AI specialists.” These are vendor-reported marketing figures, not independent adoption measurements.
The company describes its approach as “Fiduciary-Grade AI,” meaning professional use with authoritative, domain-specific content, privacy and security safeguards, subject-matter expertise and transparent outputs that can be verified. Confirm which content packages, connectors and retention settings are included in your organization’s order.

OpenAI enterprise/API deployments: maximum control for capable engineering teams
An enterprise or API deployment is appropriate when the firm wants to build an internal assistant around its own identity provider, document repositories, matter database and approval gates. OpenAI’s legal-industry offering says API usage under its legal offering comes with zero data retention and is designed around lawyers’ duties to protect client confidences and exercise independent judgment.

- Identity and authorization: enforce single sign-on, multifactor authentication and matter-level entitlements before retrieval occurs.
- Document boundaries: tag every source with client, matter, ethical-wall and sensitivity metadata; prevent a general index from spanning restricted matters.
- Retention and deletion: define separate lifecycles for source files, embeddings, prompts, outputs, logs, backups and administrator exports.
- Provenance: return document names, page or section references and retrieval timestamps so an attorney can check the source.
- Operational controls: monitor failures, rate limits, prompt injection, model changes and unauthorized exports; preserve an audit trail without retaining more content than necessary.
The legal-industry page does not, by itself, establish a complete law-firm architecture, a regional guarantee or a privilege outcome. Procurement must validate those details for the selected API, region, contract and subprocessor chain.
Clio-oriented legal AI: practice-management integration first
Clio’s legal-AI privacy guidance recommends zero data retention, encryption, SOC 2 Type 2 certification and role-based access controls. It also notes that firms using Clio Work with Clio Manage can avoid copying data between systems, reducing duplicate stores and manual exports.
Clio’s legal-risk guidance identifies four recurring exposures: sensitive information entered into public tools, data passed to third-party vendors, outputs that cannot be explained, and information retained longer than necessary. Use those four exposures as acceptance tests. Confirm the exact Clio product, plan, connectors, data flows and contract language; “Clio-oriented” is not one uniform security configuration.

This baseline matters in two ways. First, an alternative should offer a concrete advantage—such as stronger legal-source grounding, ethical walls, regional processing or a custom matter workflow—rather than merely repeating “enterprise security.” Second, moving documents out of Microsoft 365 can create a new copy, new subprocessor and new deletion obligation. Document the reason for the move and preserve equivalent or stronger controls.

Procurement checklist for privileged material
Have the security, IT, knowledge-management and professional-responsibility teams sign off together. Obtain written answers, not slide-deck assurances.
- Collect contracts: request the data-processing agreement, security addendum, subprocessor list, retention schedule and data-residency map.
- Map every data class: ask separately about prompts, uploaded documents, generated outputs, support tickets, abuse-monitoring logs, telemetry and backups.
- Verify training language: confirm whether “no training” covers customer content, metadata, prompts, outputs and human review, and whether any exception applies to a third-party model.
- Test deletion: create a test matter, upload a synthetic file, generate outputs, delete the matter and request an export or deletion report. Establish how long backups persist.
- Test permissions and ethical walls: use two users, two matters and an administrator account. Attempt search, retrieval, sharing, export and link access across the wall.
- Check geography: record processing, support, subprocessor and backup locations. Compare them with client instructions, protective orders and applicable data-transfer rules.
- Require provenance: define the minimum citation, page-reference and source-display behavior for research and document review.
- Set review gates: require attorney review before filings, legal advice, factual assertions, client communications or external sharing.
- Review assurance: obtain current SOC reports, ISO certificates, penetration-test summaries and incident-notification commitments that match the purchased service.
- Record the decision: enter the model, region, retention setting, approved uses, prohibited uses, owner and review date in the firm’s AI governance register.
Implementation runbook
1. Start with a low-consequence pilot
Use synthetic or already-public documents first. Measure retrieval accuracy, citation quality, permission enforcement, export behavior, deletion and response to deliberately malformed prompts. Do not use a live privileged matter merely to discover whether a control exists.
2. Define approved and prohibited uses
Write task-level rules. A policy might permit summarizing a reviewed deposition inside its matter workspace, require attorney verification for legal propositions, and prohibit pasting an entire client file into an unapproved public tool. Tie each rule to the engagement letter, outside-counsel guidelines and protective order.

Use single sign-on, multifactor authentication, role-based groups and matter-level workspaces. Disable broad sharing and personal accounts. Make the default workspace private, and require a named owner to add a collaborator.

4. Establish human-review gates
Require a lawyer to inspect source documents, citations, quotations, calculations, redactions and confidentiality designations before an output becomes work product or leaves the firm. AI-generated text should never silently flow into a filing or client email.
5. Train and monitor
Teach attorneys and staff how to select the correct matter, recognize fabricated authorities, report a suspected disclosure and request deletion. Review audit logs, rejected prompts, permission changes and exports at a defined cadence.

Ongoing governance
Review the deployment whenever the vendor changes a model, connector, retention setting, subprocessor or processing region. Re-run permission and deletion tests after major updates. Keep a record of incidents, near misses, client objections, protective-order requirements and the rationale for each approved use case.
Commercial diligence belongs in the same control framework. Verify current pricing, service levels, contract terms, certifications and partner arrangements directly with the vendor; marketing pages and user counts are not substitutes for enforceable commitments.
The practical standard is straightforward: choose the platform whose controls match the matter, limit access to the people who need it, ground legal work in sources that can be checked, retain only what policy permits and require a lawyer to make the final judgment.
