Amazon says it no longer uses nondisclosure agreements (NDAs) with government agencies it works with on its projects, including data-center developments. CEO Matt Garman announced the change on October 2, 2026. The statement does not say whether previously signed NDAs have been canceled or whether the policy covers contractors and other intermediaries.
Is Amazon still making local officials sign NDAs for data centers?
Amazon’s stated policy is that it no longer uses NDAs with government agencies it works with on its projects. That is narrower than a promise to make every detail of every data-center project public. The announcement does not specify which project information will be disclosed, or how the policy applies when an agreement is signed by a third party rather than directly with Amazon. Associated Press reported the announcement on October 2, 2026.
That distinction matters in practice: a government agency may be only one party in a project’s communications, and a public statement about Amazon’s own agreements does not automatically establish what a contractor or consultant may be required to keep confidential.
Does the announcement cancel NDAs that officials already signed?
Amazon’s public announcement does not say that existing agreements have been released, amended, or voided. Residents and officials should therefore treat the status of any earlier NDA as unresolved unless the relevant parties provide a specific update. The announcement describes a current policy, not the legal effect of past contracts.

Can a contractor still sign an NDA about an Amazon data center?
The materials describing Amazon’s policy do not establish whether it covers contractors, consultants, or other intermediaries. WIRED reported that a Wharton County, Texas, official signed an NDA with VisionFirst Advisors, a contractor, concerning an Amazon project. That example shows why residents may want to ask who signed an agreement and with whom; it does not establish the terms of Amazon’s new policy for contractors.
Why do local data-center NDAs concern residents?
Project details can shape public discussion of a facility’s scale and its implications for local planning and resources. A March 31, 2026, letter from the Senate Committee on Homeland Security and Governmental Affairs cites University of Mary Washington researchers’ finding that 25 of 31 Virginia localities where a data center could be identified were operating under an NDA. The letter says agreements often restricted disclosure of basic details, including planned data-center counts and project size. That figure applies to the identified Virginia-locality sample, not to localities nationwide.

The committee letter argues that limits on discussing and sharing information can impede residents’ ability to debate local impacts and assess whether adequate plans exist. That is the committee’s stated concern, not a judicial finding. The letter puts its position plainly: “American families deserve full transparency over Big Tech’s expansion of data centers.”

What else did Amazon announce alongside the policy?
Amazon’s Built Together announcement describes a U.S. framework for more than $1 billion in additional investment over five years in communities where the company operates data centers. The commitment is a planned investment framework, not evidence that the money has already been spent.

Amazon says its community priorities include education, job training, energy affordability, water preservation, and projects shaped by community priorities. The company also says it aims to remove community-college costs for more than 300,000 students in communities where it operates data centers. These are Amazon’s stated commitments and target; the announcement does not independently verify outcomes.
AP also reported that Amazon said it hosts open houses in communities where it operates data centers. In the same report, Garman cited more than 100 proposed moratoriums across the country while describing the commitments amid public and political backlash. The moratorium figure is attributed to Garman’s remarks as reported by AP, not presented here as an independently verified count.

What should residents ask about a local project?
Amazon’s announcement addresses its stated use of NDAs with government agencies, but it leaves important implementation details open. For a specific proposal, residents can direct questions to the relevant local agency and ask:

- Does the agreement involve Amazon directly, or a contractor, consultant, or other intermediary?
- What information about the project’s scale, water and energy needs, and infrastructure planning can the agency disclose?
- Has Amazon or the agency clarified whether an existing agreement remains in effect?
Answers will depend on the particular project and agreement. Amazon’s announcement alone does not resolve those questions.
