A U.S. work visa or nonimmigrant status is temporary and tied to the rules of its category; a green card is evidence of lawful permanent residence and generally authorizes its holder to live and work in the United States permanently. An H-1B or other work classification does not automatically become a green card. For technology workers, the right comparison depends on the job and credentials, employer sponsorship, available immigration category, and— for employment-based green cards—the worker’s priority date and chargeability.

Temporary work classification, such as H-1B, L, or O Eligible workers seeking permission to work in the United States under a particular temporary category Work and authorized stay are governed by the classification and its conditions; a visa stamp does not itself guarantee admission or set the stay period. Employment-based green card Eligible workers seeking lawful permanent residence through an employment-based category Permanent-resident status generally provides authority to live and work in the United States permanently; approval of an immigrant petition alone is not a green card. Oct 2026

What is the difference between a work visa and a green card?

A temporary work classification gives an eligible person permission to work subject to that category’s conditions and authorized period of stay. A green card evidences lawful permanent-resident status, which generally gives the holder broad authority to live and work in the United States permanently. Permanent residence is not U.S. citizenship.

“Visa” can refer to the visa stamp placed in a passport for seeking admission, but that stamp is not the same thing as immigration status or authorized stay. The U.S. Department of State explains that “A visa does not guarantee entry into the United States.” Admission and the period of authorized stay are separate from the visa stamp. The State Department’s temporary-worker guidance describes this distinction.

There are also separate steps in an employment-based green-card case. An immigrant petition, any required labor certification, visa-number availability, and the final process to establish permanent residence are not interchangeable. An approved petition by itself does not grant a green card.

How do temporary work status and permanent residence compare?

The main practical difference is what authorizes the work. A temporary worker’s authorization is governed by the classification and, in many cases, a qualifying employer petition. A permanent resident’s general work authorization is not based on continuing that temporary employer petition.

Question Temporary work classification Employment-based green card
What is it? A nonimmigrant classification for a qualifying temporary purpose, such as H-1B, L, or O work. Lawful permanent-resident status obtained through an applicable immigrant route.
What governs work? The rules and conditions of the particular classification; some routes depend on an employer’s petition. General authority to live and work permanently in the United States.
Does an employer matter? Often. For example, a new H-1B employer must file a qualifying petition for portability. The holder’s general work authorization is not based on continuing the temporary employer petition.
Does one automatically lead to the other? No. Holding H-1B or another work classification does not itself grant permanent residence. Permanent residence is a separate immigrant status, not simply an extension of temporary work status.

These are general distinctions, not a guarantee that a particular worker qualifies for a category or can use a particular filing route. The rules differ by classification, immigrant category, and individual circumstances.

Which temporary work categories may fit technology workers?

A technology job title alone does not establish eligibility. The job’s duties, the worker’s qualifications, the employer relationship, and the requirements of the immigration category all matter.

H-1B: qualifying specialty occupations

H-1B is a temporary classification for qualifying specialty occupations. It is not blanket authorization to work in any technology role, and a worker’s eligibility cannot be established just by a title such as “software engineer.” The relevant question is whether the position and worker meet the category’s requirements.

H-1B workers are not necessarily locked into their first employer for the duration of their work in the United States. A new H-1B employer must file a qualifying petition for portability; that is a condition, not unrestricted permission to change jobs. The U.S. Department of Labor provides an overview of H-1B portability.

L: qualifying intracompany transfers

L classifications concern qualifying intracompany transfers. They are relevant when the worker and the employing organizations meet the category’s requirements—not simply because a company has offices in more than one country or a worker wants to transfer to a U.S. role.

O: qualifying extraordinary ability

O classifications concern qualifying extraordinary ability. Working in a high-skill field or having an impressive job title does not, by itself, establish eligibility; the worker must meet the standards for the specific classification.

TN: specified professional work for eligible Canadians and Mexicans

TN covers specified prearranged professional work for eligible Canadian and Mexican citizens. Canadian citizens generally do not need a TN visa stamp, while Mexican citizens do. The occupation and other requirements still matter: a technology role does not qualify merely because it is described as engineering or another professional job.

The Department of State’s temporary-worker visa information explains that employment categories have distinct requirements. A worker should compare the actual role, qualifications, employer relationship, and nationality where relevant rather than choose by job title alone.

Can someone pursue a green card while holding a temporary work classification?

In some circumstances, yes: pursuing permanent residence is separate from the temporary classification, and some categories allow a worker to pursue both. The Department of State’s temporary-worker guidance generally excepts H-1B and L applicants from the temporary-intent showing described there. That helps explain why workers in those classifications may pursue permanent residence without turning their temporary status into permanent residence.

This point should not be generalized to every work category. Each classification has its own intent rules, and a pending immigrant case does not by itself confer permanent-resident status or replace the requirements for maintaining and using a temporary classification.

Which employment-based green-card categories are relevant?

Employment-based immigrant categories assess different qualifications and do not all follow the same sponsorship or labor-certification route. The U.S. Department of State describes the principal employment-based preferences in its employment-based immigrant visa guidance.

EB-1: specified extraordinary ability, research, and multinational roles

EB-1 includes routes for qualifying applicants with extraordinary ability, certain researchers, and multinational managers. Self-petitioning is available in the specified extraordinary-ability circumstances; it is not a general option for every EB-1 applicant or every technology worker.

EB-2: advanced degrees, exceptional ability, and possible national-interest waivers

EB-2 covers qualifying advanced-degree professionals and people with exceptional ability. A national-interest waiver may provide a self-petition route in qualifying circumstances. The possibility of a waiver does not mean that every advanced-degree technology worker qualifies for one or that employer sponsorship is unnecessary in every EB-2 case.

EB-3: qualifying skilled workers and professionals

EB-3 includes qualifying skilled workers and professionals. Whether an individual fits depends on the applicable category requirements and case facts; a job title by itself does not determine eligibility.

For any of these routes, distinguish the immigrant category from the current availability of an immigrant visa number. A petition may be approved while the priority date is not current for the next step. That is why “petition approved” and “green card approved” are not equivalent outcomes.

Why does a green-card priority date matter?

Employment-based immigrant visas are numerically limited, so a worker’s preference category, priority date, and usually country of birth for chargeability affect when an immigrant visa may be available. A priority-date cutoff in a Visa Bulletin is a queue threshold, not a personal processing-time estimate or a prediction of when a particular person will receive a green card.

The U.S. Department of State’s October 2026 Visa Bulletin lists EB-2 final-action dates of January 1, 2025, for most chargeability areas and November 1, 2013, for India. Those dates are cutoffs, not estimated wait times. The October bulletin lists EB-1 as current for most areas, with dates for applicants chargeable to mainland China and India.

The bulletin provides both Final Action Dates and Dates for Filing. USCIS determines which chart may be used for adjustment filings, so a reader should check the applicable month and USCIS chart guidance rather than assume that a date on one chart makes a filing available. As of October 30, 2026, the State Department lists October 2026 as current and November 2026 as upcoming, although the November bulletin has already been published. Filing options can change with the month.

The October 2026 bulletin states a statutory worldwide level of at least 140,000 employment-based preference immigrant visas annually. This is a worldwide statutory level, not a technology-worker allocation and not a forecast of any individual’s outcome.

How should a technology worker compare the two paths?

There is no single best route for every technology worker. A useful comparison starts with eligibility and the practical consequences of each route, rather than assuming a temporary work classification will turn into a green card.

  1. Check the exact job and credentials. Identify the actual duties and qualifications, then compare them with a category’s requirements. A technology title alone does not establish eligibility for H-1B, TN, O, or an employment-based immigrant category.
  2. Identify the employer’s role. Determine whether a route depends on an employer petition, a qualifying intracompany transfer, or a different sponsorship arrangement. Check the applicable rules before changing employers.
  3. Assess whether a self-petition route is specifically available. The available data-supported examples are qualifying EB-1 extraordinary-ability circumstances and qualifying EB-2 national-interest-waiver circumstances; self-petitioning is not available across all employment-based categories.
  4. Separate petition approval from visa availability. For an employment-based immigrant route, identify the preference category and priority date, then check the relevant Visa Bulletin and USCIS chart for the month in question.
  5. Consider nationality and chargeability where relevant. Nationality matters for the specified TN route; country of birth usually affects employment-based immigrant visa chargeability. These are different considerations and should not be conflated.
  6. Get individualized advice for a consequential decision. Job changes, travel, filing choices, or questions about maintaining status turn on specific facts and current agency instructions; a general comparison cannot determine an individual’s eligibility.

What should workers avoid assuming?

Several common shortcuts can lead to mistaken expectations:

  • “My visa stamp is my whole status.” A stamp, admission, authorized stay, and any immigrant petition are distinct legal matters.
  • “My H-1B becomes a green card after enough time.” A work classification does not automatically convert to permanent residence. The worker needs an applicable immigrant route and must complete its separate requirements.
  • “An approved petition means I can get the green card now.” Visa-number availability and the applicable filing or final-action chart are separate issues.
  • “My job title qualifies me.” Category requirements concern more than a technology title; the worker’s qualifications, job, and employer arrangement can matter.
  • “A cutoff date tells me my personal wait.” A bulletin cutoff is not an individual processing-time estimate, and the relevant chart and dates can change by month.

Because immigration rules and monthly availability can change, readers should verify current agency instructions and seek individualized legal guidance when making a filing, job-change, or travel decision.

Frequently Asked Questions

Does an approved I-140 petition mean I can work permanently in the United States?

No. An approved immigrant petition is one part of an employment-based process, not proof that permanent-resident status has been granted. Visa-number availability and the remaining steps still matter.

Can an employer-sponsored green-card case continue if I change companies?

It depends on the case stage, category, and facts; the general comparison here cannot determine whether a particular case can continue. Before changing employers, get advice on the specific petition and any status consequences rather than assuming temporary-work portability and an immigrant case have identical rules.

Do Canadian and Mexican tech workers use the same TN visa-stamp process?

No. For eligible specified professional work, Canadian citizens generally do not need a TN visa stamp, while Mexican citizens do. The job must still qualify under the TN rules.

Are employment-based green cards reserved for technology workers?

No. The October 2026 Visa Bulletin describes a worldwide statutory level of at least 140,000 employment-based preference immigrant visas annually, not a technology-only allotment. A technology worker must qualify under an applicable preference category.
