Save the notice, verify it with your internet service provider (ISP) using contact details you find independently, and check what kind of document it is before replying. An ISP warning is not the same as a platform takedown, legal demand, subpoena, or court filing—and an allegation alone does not mean a court has found you liable. The right process depends on your country and the wording of the notice.

What to do first

  1. Keep the notice and note its dates. Save the original email or letter, attachments, envelope, and any message in your ISP account portal. Record when it arrived and any response deadline shown. Do not delete it while you work out what it is.
  2. Verify the sender independently. Contact your ISP through its official website, account portal, or a customer-service number you already know. Do not rely on links or phone numbers in an unexpected message to establish that it is genuine. Appearance alone cannot confirm whether a notice is authentic.
  3. Work out what the document is. Check who sent it, what conduct or material it identifies, the date of the alleged activity, and whether it concerns material hosted online or activity associated with your internet connection. Look for a stated deadline, consequence, and route to dispute or appeal.
  4. Check the ISP’s current terms and instructions. Follow any account-process directions and the deadline printed on the notice while you verify its status. Do not assume that procedures from another country or a different type of notice apply.
  5. Stop any ongoing sharing or posting you do not have rights to distribute. Preserve relevant records as you review what happened. Avoid making unsupported admissions or sending a formal legal counter-notice simply to acknowledge receipt.
  6. Get local legal advice if the stakes are formal or immediate. If the document includes a lawsuit, subpoena, court deadline, payment demand, or threatened legal action, contact a lawyer licensed where the matter is being handled promptly.

Identify the kind of notice before responding

Similar-sounding copyright messages can trigger different procedures. Use the sender, subject, alleged conduct, and requested action to distinguish them.

Document type What it generally concerns How to treat it
ISP-forwarded warning A rights-holder allegation associated with an internet subscriber or account. Verify it with the ISP, preserve it, and follow the notice’s instructions. It is not, by itself, a court finding of infringement.
Platform or hosting-service takedown notice Specific material allegedly posted or hosted through an online service. Check the platform’s process. In the United States, a DMCA counter-notice is a formal option tied to qualifying material removed or disabled under that process—not a general reply to any ISP warning.
Lawyer or rights-holder demand letter A demand or allegation that may request payment, action, or a response. Check the sender independently, note any deadline, and seek local legal advice if it demands payment or threatens legal action.
Subpoena or court filing Formal legal process, potentially with a court deadline or required response. Do not treat it as a routine warning. Contact a lawyer licensed in the relevant jurisdiction promptly.

What a copyright notice does—and does not—establish

A notice communicates an allegation or invokes a process; it does not by itself establish that the named subscriber personally carried out the activity or that a court has found infringement. Read the specific claim and the document’s legal status rather than assuming that an ISP warning is a judgment.

For U.S. readers, the Copyright Office describes Section 512 as a notice-and-takedown system for online service providers. A DMCA takedown notice is directed to a provider’s designated agent and identifies allegedly infringing material on or through that provider’s service. The Copyright Office’s DMCA Designated Agent Directory explains that an effective notice must substantially include the sender’s authority or signature, identify the copyrighted work and allegedly infringing material, provide contact information, and include good-faith and accuracy statements under penalty of perjury. These requirements concern the takedown process; they do not turn every notice forwarded by an ISP into proof of a subscriber’s personal conduct. How the process differs by country

United States: DMCA takedown and counter-notice

A DMCA counter-notice applies to material removed or disabled under the relevant DMCA process. It is not a routine acknowledgment or universal response to an ISP warning. It requires specific statements and contact and jurisdiction information, so understand the consequences before submitting one.

According to the U.S. Copyright Office’s Section 512 guidance, after a provider receives a qualifying counter-notice, it may restore the material no fewer than 10 and no more than 14 business days later unless it receives notice that the rights holder has filed a court action seeking to restrain the user. That is a restoration window for this process—not a general deadline to respond to an ISP email.

Canada: Notice-and-Notice

Canada’s federal Office of Consumer Affairs describes a Notice-and-Notice system in which an ISP forwards a copyright notice to an internet subscriber. Its guidance says an ISP or host must release subscriber information to the copyright owner if ordered by a court. See Notices to Canadian Internet subscribers. Do not apply U.S. DMCA counter-notice instructions to a Canadian notice; follow current Canadian guidance and seek legal advice if a claim is threatened.

United Kingdom: alleged-infringement letters

GOV.UK guidance on letters alleging online copyright infringement says an ISP may be able to tell a recipient whether a letter is part of a legitimate enforcement process and recommends getting legal advice. It also explains that, if a court grants an order, an ISP may have to provide account-holder details to copyright owners. A UK letter is not a U.S. DMCA notice; local procedure applies.

What not to assume or do

  • Do not assume an allegation is a court decision. Check whether the document is a warning, demand, or formal legal process.
  • Do not use a counter-notice as a generic reply. In the United States, it is a formal procedure relevant to material removed or disabled under the DMCA process, with required statements and potential legal consequences.
  • Do not assume a VPN, router, or computer-cleaning tool will resolve a past notice or guarantee protection from future claims. Such a claim is not established by the official procedures described here.
  • Do not ignore a stated court deadline or subpoena. Get advice from a lawyer qualified in the jurisdiction handling the matter.
