Before putting generative AI into business use, review the full insurance contract—not just a coverage summary—and check how it treats AI-related events, data, vendors, service interruptions, and claims. There is no universal answer: the wording of your policy, endorsements, application, and the facts of a loss determine whether coverage may apply. Ask your broker or insurer to explain any material ambiguity in writing.

What does cyber insurance cover, and why is AI use worth checking?

Cyber insurance coverage depends on the policy’s insuring agreement, definitions, exclusions, conditions, limits, and endorsements. A policy may respond to certain security or privacy events, but a broad label such as “cyber” does not establish whether a particular AI-related loss is covered. Read the contract wording that applies to your business rather than relying on a marketing summary or a general statement about what cyber policies usually cover.

Generative AI can introduce several different kinds of exposure. A business might use an external AI service to process information, rely on AI-generated material in its work, or suffer an interruption involving an AI provider. The resulting dispute or loss could raise questions about data, a security or privacy event, a service provider, professional work, or another policy line. The relevant issue is not simply whether AI was involved; it is how the actual event fits the contract’s terms.

The Bank for International Settlements’ Financial Stability Institute (BIS FSI) described this uncertainty in a June 2026 report as “silent AI”: losses potentially falling within policies that neither expressly include nor exclude AI risks. The report says AI-related losses may involve cyber liability, errors and omissions (E&O), directors and officers (D&O), property, or product liability coverage, depending on circumstances. That is a reason to review relevant policies together—not evidence that any specific claim will be covered.

What are “silent AI” and “silent cyber” risks?

Both terms describe uncertainty that can arise when policy language does not clearly say whether a category of loss is included or excluded. “Silent AI” is the term used in the BIS FSI report for AI-related ambiguity; “silent cyber” or “non-affirmative cyber” is terminology used by the New York State Department of Financial Services (NY DFS) for possible cyber losses under policies that do not explicitly mention cyber.

In its 2021 framework, NY DFS advised insurers to clarify whether policies potentially subject to cyber claims provide or exclude coverage for cyber losses. The point for a policyholder is narrower: wording that does not mention AI or cyber is not, by itself, a definitive answer to a coverage question. The actual policy and applicable endorsements need to be examined.

The BIS FSI report also notes that, at the time discussed, AI risks were “not yet excluded in most cyber policies.” It attributes to Munich Re a 2025 position that AI risks covered under traditional cyber policies were manageable and broad exclusions were not then needed. These are dated, qualitative market observations—not a percentage, a promise about current policy forms, or a decision about an individual claim.

Which parts of the policy should I inspect?

Review the complete set of documents that forms the insurance contract. Start with the policy period and insured entities, then follow the coverage grant through the definitions, exclusions, conditions, limits, and endorsements that could affect your AI use.

Policy section What to check for an AI deployment
Declarations Confirm the named insureds, subsidiaries, locations, policy period, limits, and retentions match the entities and business units involved.
Insuring agreements Identify what counts as a covered security failure, privacy event, claim, loss, or incident. Check whether the wording addresses your specific AI use, provider, or service interruption.
Definitions Inspect terms that may control the result, such as “computer system,” “data,” “security failure,” “privacy event,” “service provider,” “claim,” and “covered loss.” These are terms to look for, not a claim that every policy uses them.
Exclusions and carve-backs Look for express AI language and exclusions that may intersect with the use case, including data or privacy, professional services, intellectual property, bodily injury, property damage, or infrastructure failures. Read any exceptions or carve-backs alongside the exclusion.
Endorsements Check whether an endorsement changes the coverage grant, adds or removes an exclusion, or alters a definition, limit, or condition relevant to the deployment.
Conditions and claims provisions Locate requirements for notice, consent, cooperation, approved counsel or response providers, and evidence preservation. Their details and deadlines are contract-specific.
Limits, sublimits, and retentions Check whether relevant privacy, extortion, business-interruption, dependent-business-interruption, or incident-response coverage has a separate cap, waiting period, or retention—and whether the provision applies to the contemplated event.

The categories in this table are review prompts, not statements that a particular policy contains those provisions or that an exclusion necessarily applies. Only the full form and endorsements can answer that.

How should I assess an AI provider and its data handling?

Determine which external providers the business relies on and what role each plays in the use case. Check whether the policy addresses vendor incidents, dependent service interruption, and a provider’s handling of data that may be covered by the policy. The available sources do not establish a standard clause that every policy must contain, so look for the wording in your own contract.

Keep the relevant provider terms and identify the services, data, and business processes involved. That information helps your broker or insurer discuss a concrete scenario rather than answer a broad question such as “Is AI covered?” A provider’s contract may help describe the service and responsibilities, but it does not by itself establish what your insurance policy covers.

How do I compare two cyber policies for AI use?

Compare the operative wording, not just the coverage names or premium. Use the same AI deployment and loss scenarios when reviewing each form so that differences in treatment are visible.

Comparison point Question to ask
AI and cyber wording Does the form expressly include, exclude, or leave uncertain losses connected with AI or cyber events?
Covered events and systems How do the coverage grant and definitions apply to the relevant event, systems, data, and business unit?
Exclusions and carve-backs Which exclusions could intersect with this use case, and do exceptions or endorsements change their effect?
Providers and service dependency How does each policy address vendor incidents, provider-held data, and interruption of a dependent service?
Financial terms What limits, sublimits, waiting periods, and retentions apply to the coverage that may be relevant?
Claims response What notice, consent, cooperation, counsel, response-provider, or evidence-preservation conditions apply?
Other insurance Where relevant, how do the cyber form and E&O, D&O, property, or product liability policies address the same scenario?

This is a practical comparison framework drawn from the issues identified by BIS FSI and NY DFS; it is not a regulator-mandated scorecard or a substitute for interpreting the forms.

What should I document before deployment or renewal?

Make an inventory that lets you explain the proposed AI use accurately. Record the systems and use cases, types of data involved, providers, user groups, human review, and safeguards. Keep it current enough to support clear answers when an insurer asks about the business’s technology or controls.

When completing an application or renewal, answer the questions asked accurately. If a deployment changes the business’s use of AI, ask the broker or insurer whether that change triggers a policy notice or renewal disclosure. The cited regulatory materials do not establish a universal policyholder duty to disclose every AI deployment or change; the contract, application questions, and applicable circumstances matter.

Human review is also an important operational safeguard, particularly when AI-generated information informs an important decision. The National Association of Insurance Commissioners (NAIC) cautions that generative systems can produce information that sounds accurate but is incorrect, and recommends careful review of important AI-generated information. That guidance is about the reliability of AI output; it does not determine insurance coverage.

How do I get a useful written answer about an ambiguous clause?

Give your broker or insurer a specific scenario and ask them to identify the controlling policy form or endorsement. For example, describe the provider, what data it handles, what business process depends on it, what event occurs, and what loss or claim follows. Ask which provisions apply and whether an endorsement or clarification is available if the wording does not clearly address the scenario.

  1. Gather the contract. Assemble the declarations, full policy form, endorsements, application, and relevant renewal materials.
  2. Describe the deployment. Summarize the AI system, business purpose, data types, users, provider, human review, and safeguards.
  3. Frame a loss scenario. Explain the event and resulting claimed loss without assuming that AI involvement alone makes it a cyber claim.
  4. Request clause-level clarification. Ask which insuring agreement, definition, exclusion, condition, limit, or endorsement controls the answer.
  5. Keep the response. Preserve written clarification with the policy documents, and seek qualified insurance or legal advice where the interpretation has material consequences.

A response to a hypothetical is not necessarily a guarantee that a future claim will be covered: the facts, policy in force, and applicable terms still matter. Written clarification is nevertheless more useful than relying on a broad verbal assurance or a general statement about the market.

Do insurance regulators’ AI rules tell businesses what their policy covers?

No. NY DFS Circular Letter No. 7, dated July 11, 2024, addresses expectations for insurers authorized in New York when using AI and external consumer data in underwriting and pricing. It discusses fairness, actuarial validity, governance, documentation, model-risk controls, vendor oversight, and consumer transparency; it expressly does not address other insurance lifecycle stages. It should not be recast as a checklist of duties for a commercial policyholder or as proof that a particular claim is covered.

A Texas Department of Insurance bulletin dated June 12, 2026, similarly says regulated entities’ AI-supported decisions and actions that affect consumers must comply with applicable insurance laws, including rules concerning unfair trade practices and discrimination. That statement concerns regulated entities in Texas, not the coverage terms of an insured’s cyber policy. Neither regulator’s material replaces review of the applicable insurance contract.

Frequently Asked Questions

If an AI tool gives a wrong answer, is that automatically a cyber-insurance claim?

No general conclusion follows from the error alone. The NAIC warns that AI output can sound accurate while being incorrect, but the sources do not establish that an incorrect output by itself is a covered cyber event; the policy’s definitions and the circumstances would matter.

Does a cyber policy have to cover generative AI because insurers use AI?

The regulator guidance described here concerns insurers’ conduct in underwriting and pricing or other regulated consumer-impacting actions. It does not establish a general requirement that an insurer cover an insured’s AI-related losses.

Should I review policies other than cyber insurance?

Potentially. BIS FSI identifies E&O, D&O, property, and product liability policies as lines that may be implicated depending on the circumstances, so involve the relevant policy documents where the use case could reach those exposures.
