GST invoice fraud is the use of a tax invoice that does not represent a genuine taxable supply, usually to create, transfer or claim input tax credit (ITC). A fake registration may issue invoices for goods or services that were never supplied, while the recipient records the document and reduces its GST liability. Under section 16 of the CGST Act, an invoice by itself is not enough: the recipient must satisfy statutory conditions, including receiving the goods or services, and meet the documentation and reporting rules. If the supply is fictitious, the ITC can be denied or recovered with interest, penalties and, in serious cases, prosecution.

This India-focused guide explains how the schemes operate, what the law requires, how to verify a supplier and what to do when a suspicious invoice has already been used.

What is GST invoice fraud?

GST invoice fraud occurs when an invoice is used to claim or pass on ITC without a real taxable transaction behind it. The document may look complete and carry a valid-looking GSTIN, but the stated supply may never have happened, may be grossly different from what was delivered, or may be routed through entities that exist only on paper.

The Central Board of Indirect Taxes and Customs (CBIC) describes bogus registrations being used to issue invoices without an underlying supply and pass fraudulent ITC to recipients. Fraud can involve a seller, a buyer, intermediaries or all of them. A recipient that knowingly uses a false invoice is exposed differently from a business that was deceived, but both must be able to demonstrate what was bought, received and used.

Typical examples

  • An entity invoices machinery that was never manufactured, shipped or installed.
  • A service provider bills for consultancy hours that no employee performed and no business received.
  • Several shell entities issue back-to-back invoices so a paper trail appears to show movement of goods.
  • Someone uses another person’s PAN, Aadhaar or premises documents to obtain registration and then sells invoices under that identity.

The economic question is always whether a genuine supply occurred and whether the recipient meets the legal conditions for credit, not merely whether a PDF or e-invoice number exists.

How do fake GST invoice schemes work?

Bogus or misused registration

A fraudster can obtain registration by misusing identity documents or submitting forged electricity bills, property-tax receipts, rent agreements or other evidence of business premises. CBIC Instruction 03/2023 states that such fake or non-genuine registrations are used to issue invoices without an underlying supply and pass ITC to unscrupulous recipients. The registered person may have no meaningful inventory, staff or operating premises.

Invoices without a supply

The entity issues a tax invoice, reports it in its outward-supply return and may collect GST from the recipient. The recipient books a purchase and claims the corresponding ITC even though nothing was delivered. In another variant, a real product is supplied but the invoice inflates quantity, value or tax so the credit exceeds the legitimate transaction.

Chains and circular billing

Networks can route invoices through multiple dummy firms. Circular chains make the same goods appear to move repeatedly, or create a sequence of purchases and sales with no commercial purpose. A long chain does not cure a missing supply: each recipient must establish its own receipt and business use.

Identity theft and “front” firms

A January 2024 Government of India release described syndicates obtaining KYC documents from people promised jobs, commissions or loans, then using those documents to create shell firms. The named person may not know that invoices are being issued in the firm’s name. Businesses should therefore verify not only a GSTIN but also the supplier’s real operations and bank-account identity.

Why does a GST invoice alone not create ITC?

Section 16 of the CGST Act makes ITC conditional. For a normal business purchase, the registered person must use the purchase in the course or furtherance of business, possess a tax invoice or prescribed document and actually receive the goods or services. Other statutory conditions and time limits also apply.

Rule 36 adds reporting controls. Invoice or debit-note details must be furnished by the supplier in GSTR-1 (or the invoice furnishing facility) and communicated to the recipient through GSTR-2B. This creates an important workflow: the recipient should reconcile the supplier’s report before claiming credit.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

GSTR-2B is evidence that an invoice was reported; it is not conclusive proof that the supply happened. A fraudulent supplier can report a fictitious invoice, and a legitimate supplier can make a reporting mistake. Keep independent evidence such as purchase orders, delivery records, e-way bills where applicable, goods-received notes, service completion records, correspondence and payment trails.

How do fake invoices affect the recipient?

  1. ITC denial or reversal. If receipt, business use, documentation or reporting conditions are not met, the department can disallow the credit or recover credit already used.
  2. Additional tax and interest. A wrongly reduced output-tax liability becomes a demand. Interest can apply for the period during which tax remained unpaid, subject to the applicable provisions and facts.
  3. Penalty exposure. Section 122 covers issuing invoices without supply and taking or using ITC without actual receipt. The penalty is ₹10,000 or the tax evaded, or the ITC irregularly availed or passed on, whichever is higher, for the relevant contraventions.
  4. Criminal prosecution. Section 132 covers issuing invoices without supply and availing ITC using such invoices. Where evaded tax or wrongly availed ITC exceeds ₹5 crore, imprisonment may extend to five years and a fine. The section provides lower maximum terms for lower monetary bands; the applicable band depends on the amount and conduct established.
  5. Operational disruption. Investigations can involve summons, production of books and electronic records, account scrutiny, blocked or disputed credit, registration action and reputational damage. The result depends on the person’s role, knowledge, amount and cooperation.

CBIC Circular 171/03/2022 was issued after cases in which registered persons issued invoices without actual supply so recipients could fraudulently avail and use ITC. The circular reflects the department’s focus on both the issuer and the beneficiary of the credit.

What penalties and consequences can apply?

Conduct Primary provision Possible consequence
Issuing an invoice without a supply Section 122, CGST Act ₹10,000 or the tax evaded/ITC irregularly availed or passed on, whichever is higher; further action may apply.
Taking or using ITC without actually receiving goods or services Section 122, CGST Act Penalty calculated under the same statutory test, along with recovery of ineligible credit and applicable interest.
Issuing invoices without supply or availing ITC through such invoices with the required criminal ingredients Section 132, CGST Act Prosecution with graded imprisonment and fines; for amounts above ₹5 crore, imprisonment may extend to five years.
Failure to substantiate a purchase during verification Section 16 and related rules Credit can be denied or reversed, creating a tax demand and possible interest and penalty.

These are statutory maximums or calculation rules, not an automatic outcome in every disputed invoice. Authorities examine evidence, intent, the amount involved and whether a person issued, received, facilitated or merely recorded the document.

How large is the fake-invoice problem?

Official enforcement figures show the scale of detected cases, but they are not an estimate of every fraudulent transaction in India.

CBIC central tax formations, financial year 2023–24 ₹36,374 crore of fake ITC detected in 9,190 cases 182 arrests and ₹3,413 crore voluntarily deposited
Government of India release, January 2024; sustained drive against non-existent taxpayers since mid-May 2023 29,273 bogus firms and suspected ITC evasion of ₹44,015 crore 121 arrests reported

Because the two releases use different periods, agencies and counting methods, their totals should not be added together. They indicate enforcement detections, not the total amount of fraud in the economy.

How can a business check whether a GST invoice is genuine?

Use layered checks. A GSTIN lookup or GSTR-2B match is a starting point, not a substitute for evidence that the transaction occurred.

  1. Validate the supplier identity. Check the GSTIN, legal name, registration status, principal address and stated business activity. Compare the supplier’s bank-account name with the registered legal entity; unexplained third-party accounts require escalation.
  2. Inspect invoice particulars. Confirm the invoice number and date, supplier and recipient GSTINs, legal names and addresses, description, quantity or service scope, taxable value, tax rate, place of supply and applicable reverse-charge or e-invoice details. Look for altered fonts, duplicate numbering or inconsistent tax calculations.
  3. Trace the commercial origin. Match the invoice to an approved purchase order, quotation, contract or work order. A purchase made only after an unexplained request for a large round-number invoice is a red flag.
  4. Prove receipt of goods. Retain delivery challans, transporter records, e-way bills where applicable, gate entries, weighbridge slips, warehouse logs, goods-received notes and inventory records. Reconcile quantity and date to the invoice.
  5. Prove receipt of services. Keep statements of work, timesheets, reports, tickets, acceptance emails, meeting records, deliverables and evidence that the business used the result. A generic invoice with no identifiable output is difficult to defend.
  6. Verify reporting. Confirm that the supplier furnished the invoice in GSTR-1 or the invoice furnishing facility and that it appears in the correct GSTR-2B before claiming credit. Investigate omissions, late appearances, unexplained amendments or a supplier who repeatedly asks you to claim before reporting.
  7. Check payment and accounting consistency. Match the amount, GST and payment date to bank statements and the ledger. Cash settlements, immediate round-tripping or payments to unrelated accounts warrant enhanced review.
  8. Escalate unusual patterns. Apply additional approval to unusually high-value, back-to-back or circular transactions, suppliers with no credible operations, identical invoice descriptions across customers, or transactions that do not make commercial sense.

What should you do if a suspicious invoice has already been claimed?

Do not delete, alter or backdate records. A defensible response starts with preserving the evidence and getting advice before making an inconsistent disclosure.

  1. Freeze further use of the disputed ITC and identify every return, invoice and payment affected.
  2. Preserve the original invoice file, emails, purchase orders, delivery or service evidence, ledger entries, bank records, e-way-bill data and reconciliation history, including the dates on which the invoice appeared in GSTR-2B.
  3. Ask the supplier for clarification and supporting documents through a documented channel. Do not create new documents to fill an evidentiary gap.
  4. Have a qualified GST professional assess whether the supply was received, whether the credit conditions were met and whether reversal, voluntary payment, disclosure or a response to a notice is appropriate.
  5. Respond to summons or notices within the stated time, provide an indexed record set and distinguish facts known personally from information obtained from the supplier.

Early, consistent correction can materially change the risk profile, but the right action depends on the amount, timing, knowledge and available evidence.

Control area Useful capability Why it matters
Supplier validation GSTIN, legal-name, status and bank-account checks Helps detect identity mismatch and non-genuine counterparties.
Return reconciliation GSTR-1 to GSTR-2B matching with amendment and period tracking Flags invoices absent, changed or reported in a different period.
Transaction linkage Links invoices to purchase orders, receipts, service approvals and payments Connects the tax document to the underlying business event.
E-invoice and movement data Integration with e-invoice and e-way-bill records where applicable Supports checks on invoice validity and physical movement.
Pattern detection Duplicate, round-number, back-to-back and circular-invoice alerts Prioritizes transactions for human investigation.
Governance Role-based access, approval thresholds, immutable change logs and notice-ready exports Reduces unauthorized changes and makes an audit response coherent.

Automation can surface exceptions, but it cannot establish that a service was actually performed or that goods were used in the business. That judgment still requires accountable staff and source documents.

How is an honest mistake different from deliberate invoice fraud?

A supplier’s late or incorrect return does not automatically prove that a buyer participated in fraud, and a GSTR-2B match does not automatically prove innocence. Investigators may examine the buyer’s due diligence, commercial rationale, receipt evidence, payment trail, relationship with the supplier and conduct after discovering an error.

The safest approach is proportionate control: perform stronger checks for new, high-value or unusual suppliers; document why a transaction was approved; and correct discrepancies promptly. Businesses should avoid both extremes—treating every mismatch as criminal and treating a matching return as permission to ignore missing goods or services.

Frequently Asked Questions

Can I claim ITC when the supplier’s GSTIN is active but the invoice is missing from GSTR-2B?

An active GSTIN does not establish that the supplier reported your invoice or that the supply occurred. Pause the claim, obtain the supplier’s explanation and reconcile the invoice in the prescribed reporting chain before relying on the credit.

Does paying a supplier through a bank account protect my ITC claim?

Bank payment helps show that money moved, but it does not prove delivery or performance. The payment must align with the invoice, contract, recipient identity and evidence of business use.

What records should I keep for a service invoice?

Keep the contract or statement of work, approval, timesheets or activity logs, deliverables, acceptance evidence, correspondence and proof that the result was used. Retain the tax invoice and reconciliation history with those operational records.

What if a supplier’s registration is cancelled after my purchase?

Cancellation timing and the facts of the supply matter; a later status change does not by itself answer whether credit was available for the earlier transaction. Preserve the purchase and receipt evidence and obtain professional advice on the relevant return period and notice risk.
