A regulatory AI sandbox is a regulator-supervised, time-limited setting in which a firm tests a specific AI-enabled financial product, service or business model and learns how it works in practice and interacts with regulation. For a fintech firm, the right route depends on the purpose and maturity of the work: the UK Financial Conduct Authority (FCA) offers a Regulatory Sandbox for controlled live-market tests and a separate Supercharged Sandbox for AI experimentation. Neither route is blanket permission to operate, an endorsement, or a substitute for the authorisations and compliance work that apply to the firm.
What is a regulatory AI sandbox?
A regulatory sandbox is a structured experiment, not a general-purpose regulatory safe zone. A firm tests a defined innovation under agreed conditions, while the regulator gains a better understanding of the technology, its risks and how existing rules apply. The OECD’s Regulatory Sandbox Toolkit, published on 24 July 2025, describes this approach as a controlled environment for understanding the opportunities and risks of specific innovations and developing an appropriate regulatory environment.
In financial services, an AI sandbox may help a firm examine an AI-enabled service or a component of one, such as how a model performs in a use case. The important unit of work is a testable proposition: what the system does, who it is for, what financial activity it involves, what question the test is meant to answer, and what safeguards will apply. The label “AI sandbox” does not itself define the legal status of a product or its model.
The term also covers programs with different aims. Some provide a controlled route to test a proposition with real consumers; others offer technical infrastructure or data for earlier-stage development. A sandbox’s name alone does not tell a firm what it can test, what support it receives or what permissions it needs.

How do the FCA’s sandbox routes differ?
The FCA’s Regulatory Sandbox and Supercharged Sandbox address different stages and needs. Choose between them by asking whether the work is a controlled live-market test of a financial-services proposition or AI development and experimentation that needs technical resources.
| Dimension | FCA Regulatory Sandbox | FCA Supercharged Sandbox |
|---|---|---|
| Primary purpose | Controlled testing of innovative financial-services products and services, including tests with real consumers. | Cohort-based experimentation with advanced AI technologies and financial-services use cases. |
| Typical readiness | A developed proposition with a working model or credible test plan, target users and a defined test. | Can support work from proof of concept to more developed propositions needing component validation. |
| Support described by the FCA | Regulatory tools and engagement suited to the firm’s test and regulatory question. | Secure cloud infrastructure, GPU-enabled compute, enterprise AI tools, synthetic and curated datasets, mentorship and expert support. |
| Regulatory status | Firms of different sizes and regulatory statuses may apply, subject to the FCA criteria. The route does not remove applicable authorisation or registration requirements. | Firms need not already be FCA-regulated, but the solution must relate to UK financial services or markets. |
| Geographic connection | The proposition must fall within the FCA’s remit. | Applicants may be based outside the UK if their solution relates to UK financial services or consumers. |
| Schedule | The FCA describes assessment aims and typical test periods for applications. | Cohort openings and selection details vary; consult the FCA’s current program information. |
The FCA also identifies the Digital Sandbox, which supports early-stage development using datasets, and Innovation Pathways for firms not yet ready to test. These are alternatives to consider when the work is too early for a live test or the firm needs a different kind of support. The appropriate route is the one that addresses the actual development stage or regulatory question—not necessarily the one with “AI” in its name.
What are the FCA Regulatory Sandbox eligibility criteria?
The FCA assesses applications against five criteria: the proposal must be in scope, genuinely innovative, beneficial to consumers, ready to test and in need of regulatory support. A credible application explains how it meets each criterion with evidence, rather than relying on a general claim that its AI is novel or potentially useful.
In scope
Explain the connection to financial services and the FCA’s remit. Describe the activity the product performs, the firm’s role and any relevant regulated firm or partner. A technology supplier working with a regulated firm may apply, but the proposal still needs a clear connection to the FCA’s remit and a defined testing need.
Genuine innovation
Show what is materially different from existing products, services or business models. The FCA cautions that conventional or established propositions without clear differentiation are less likely to be supported. Identify the new element and why testing it in the proposed setting matters; simply using AI does not, by itself, establish a persuasive case for sandbox support.

Consumer or business-user benefit
State who is expected to benefit and what improvement the proposition is intended to deliver. Then explain how the test will measure whether that benefit occurs. The claim should be specific enough to evaluate alongside the risks: a test plan that discusses upside but not possible consumer harm leaves an essential part of the case unanswered.
Readiness
Demonstrate that the proposition can be tested responsibly. The FCA expects a sufficiently developed proposal, a working model or credible plan, target users, a defined test rationale and appropriate safeguards. Identify any operational or technical dependencies. If a partner is necessary, show that the arrangement is sufficiently advanced; the FCA says it cannot find partners for applicants and may question readiness when essential partnerships remain unresolved.

Need for support
Identify the concrete regulatory issue or practical reason FCA support is necessary to run the test. Explain why a sandbox is more appropriate than asking for general guidance or endorsement. The application should make clear what the regulator’s involvement would help the firm learn or test, not ask the FCA to validate the business idea in the abstract.
How can a fintech firm apply to the FCA Regulatory Sandbox?
Start with a bounded test and work through jurisdiction, route, evidence and permissions before submitting. The application should give the FCA enough information to assess the proposition, the proposed safeguards and whether the firm is ready to carry out the test.
- Identify the regulator and jurisdiction. Set out where the service will operate, who the intended users are and what financial activity is involved. Do not assume that a program in one country settles the requirements in another.
- Select the relevant support route. Use the Regulatory Sandbox if the proposition is ready for controlled live-market testing and FCA engagement is needed. Consider Supercharged Sandbox for AI experimentation requiring its technical resources, and consider the Digital Sandbox or Innovation Pathways if the work is at an earlier stage or not ready for testing.
- Write the test question. Describe what the firm plans to test, the test’s boundaries and what the results will help establish. A concrete question helps distinguish a genuine test from a request for broad approval or regulatory advice.
- Build the evidence against all five criteria. Explain the FCA connection, the innovation, expected user benefit and measurement, readiness, and the specific need for support. Include supporting information and research relevant to the proposition.
- Set out the test design and safeguards. Identify target users, the test period, success measures, intended outcomes, risks and safeguards. Explain how the test will be kept within its agreed scope and what would lead the firm to stop or change it.
- Confirm dependencies and permissions. Establish whether the firm needs partners, data, infrastructure, authorisation or registration to conduct the proposed activity. Describe how the necessary arrangements will be secured; sandbox staff do not supply the firm’s partners or test data.
- Plan the end of the test. Specify the intended outcomes and exit arrangements. Consider what permissions, reporting or operational changes would be needed after testing, rather than treating entry into the sandbox as the final step.
Applications should be comprehensive and supported by evidence. If a firm is unsure how to prepare its application and associated documents, the FCA notes that it may consider compliance consulting; any such adviser is independent, not an FCA representative or endorsement.

How long does the FCA sandbox application and test take?
The FCA’s application guidance, last updated on 1 October 2026, sets out target assessment periods and typical test milestones. It describes aims and usual periods, not guaranteed deadlines; complexity and the completeness of the information can affect the process.
| Stage | FCA-stated period | What it means |
|---|---|---|
| Initial assessment outcome | 2 to 3 weeks | The FCA aims to provide an initial assessment outcome after receiving a complete application. |
| Full assessment and panel review | 8 to 12 weeks | The stated aim depends on the complexity of the application and the information provided. |
| Testing | Around 6 months | This is the usual test duration; the use case and its complexity can change the period. |
| Final report | Within 3 months after the test ends | The firm is expected to submit its final report within this period. |
After acceptance, the firm prepares with a case officer and agrees which regulatory tool is appropriate. That preparation and the agreed test conditions are part of the process, so a firm should not treat the assessment estimate as the date on which testing can automatically begin.
Does sandbox participation waive regulation or mean FCA approval?
No. The FCA states, “The Regulatory Sandbox is not regulatory exempt.” A firm carrying on regulated activity needs the relevant authorisation or registration unless an exemption applies, including while it is testing. Sandbox access does not generally switch off legal obligations or establish that the firm’s product complies with every rule that applies to it.
Depending on the circumstances, the FCA may use tools such as restricted authorisation, signposting, informal steer, individual guidance, waivers or modifications where legally possible, and no-enforcement-action letters with limited effect. These are not interchangeable permissions. The tool, its scope and legal effect depend on the firm’s case, and the firm should understand the conditions agreed for its test.
Supercharged Sandbox participation has a separate and explicit limit: the FCA says it “does not indicate FCA approval, endorsement, or authorisation of a product or service.” Treat technical support, regulator contact and participation in a cohort as support for experimentation—not as a regulator’s approval of a business, model or intended deployment.

What costs, data and permissions should a firm plan for?
The FCA says there is no charge for applying to or being accepted into its Regulatory Sandbox. That does not mean the test has no costs: if a firm needs authorisation to conduct it, authorisation fees apply. The firm should separately plan the resources and arrangements required for its own test.
- Data: The FCA does not provide data for a Regulatory Sandbox test. Firms need to arrange their own data access and address the relevant safeguards for the proposed test.
- Partners: The FCA cannot secure partners for applicants. Where a test depends on a regulated firm or another partner, the firm should progress that arrangement before relying on it in the application.
- Permissions: Assess whether the proposed activity requires authorisation or registration, and whether any available exemption applies. Do not assume sandbox participation resolves that question.
- Restricted authorisation: If used, it limits the firm to the agreed test. After a successful test, the firm may need a Variation of Permission to remove restrictions; it should not assume it can expand activity automatically.
- Exit and reporting: Include a practical plan for closing the test, meeting reporting expectations and deciding what the firm will do next. A successful experiment is not itself a permission for unrestricted operation.
What changes if the firm is applying in the EU or Italy?
The FCA programs are UK routes. The European Union has a separate AI Act requirement, while Italy provides a national example of a controlled testing environment. Firms must identify the competent authority and application route for the jurisdiction in which they plan to operate.
EU AI Act: a Member State obligation, not a single firm application route
Article 57 of Regulation (EU) 2024/1689 requires Member States to ensure that at least one national AI regulatory sandbox is operational by 2 August 2026. That date has passed as of 25 October 2026. The requirement allows Member States to establish or participate in a sandbox jointly where equivalent national coverage is provided, and it does not prevent additional local or regional sandboxes.
Article 57 does not, by itself, give every fintech firm the same intake process or identify which national program fits a particular project. A firm should check the competent authority and current application route in its own Member State. Nor should a firm infer that access to a UK program meets an EU requirement or replaces obligations under financial-services law.
Italy: Banca d’Italia’s controlled testing environment
Banca d’Italia describes a limited-duration testing environment for supervised entities and fintech operators in banking, financial and insurance sectors. Tests take place in close contact with supervisory authorities and may benefit from a simplified transitional regime under Italy’s framework. Its stated purposes include developing the Italian fintech market while maintaining consumer protection, competition and financial stability. This is an Italy-specific illustration; its conditions should not be projected onto UK or other national programs.

What should a fintech team check before submitting?
Use this checklist to make sure the application is about an executable experiment rather than a general request for support.
- Have we described the AI-enabled service, its intended users and the financial activity involved?
- Have we identified the relevant regulator and jurisdiction, rather than assuming a sandbox is portable across borders?
- Can we explain what is genuinely innovative and how the proposition differs from existing offerings?
- Have we identified the expected consumer or business-user benefit and how the test will measure it?
- Is the specific regulatory question or reason for regulator support clear?
- Are the scope, timing, success measures, safeguards and exit criteria defined?
- Are the model, data, infrastructure and necessary partner arrangements ready enough for the proposed test?
- Have we checked whether the activity requires authorisation or registration during testing?
- Have we budgeted for applicable authorisation fees and planned data and partner access?
- Have we avoided describing participation as approval, endorsement or permission to disregard applicable rules?
Frequently Asked Questions
Can an FCA sandbox decision determine whether my AI system is high-risk under the EU AI Act?
Do not treat participation in a UK program as an EU AI Act classification decision. The applicable classification depends on the system and its use; the material cited here does not establish that an FCA sandbox makes that determination. Ask the relevant authority and obtain advice for the specific deployment.
Can a firm use one sandbox application for several countries?
The FCA routes described here are tied to UK financial services or the FCA’s remit, while EU Member States set or participate in their own national arrangements. The cited frameworks do not establish a shared cross-border application that covers multiple countries, so confirm each relevant authority’s process.

Does a sandbox guarantee the regulator will provide informal advice?
No general guarantee follows from applying or taking part. The support available depends on the program and the specific case; the FCA agrees an appropriate tool with accepted Regulatory Sandbox firms, and applicants should describe the concrete help their test needs rather than expect a particular response.
