If an AI startup shuts down, your data is not automatically deleted—and a bankruptcy or sale does not automatically give a buyer unrestricted rights to use it. The outcome depends on the provider’s privacy promises, what happens to the company and its systems, the types of data involved, and the laws and contracts that apply to you. A website going offline is not proof that prompts, files, account details, or billing records have been erased.
If you use the service, act before access disappears: check the closure notice and privacy policy, export information you need, and submit any deletion request through the provider’s designated channel. Keep in mind that providers may retain some information for legal, safety, or other stated reasons.
What can happen to my data when an AI startup closes?
There is no single outcome for every failed AI company. A provider may delete some data, retain some records for a stated reason, or transfer information as part of a sale or other transaction. Its published policy, closure plan, any proposed transaction, applicable law, and your account agreement all matter.

It helps to separate two events that can look like one: the service becoming unavailable and the company disposing of its data. A login page can stop working while records remain in systems used to wind down the business, meet legal obligations, preserve backups, or support a potential transaction. Conversely, a company may delete data as part of closing. The reviewed sources do not establish a universal deletion schedule for closed AI startups.

Federal Trade Commission (FTC) business guidance says companies should keep sensitive information only as long as there is a business reason or legal need, then dispose of it properly. That guidance is not a shutdown timetable for a particular AI service. Without that provider’s policy and closure information, you cannot tell from a vanished website whether your data was deleted, retained, or transferred.
Different data can have different outcomes
“My data” may include prompts and generated responses, uploaded documents or images, account identifiers, billing records, support conversations, feedback, and information associated with a business account. A provider’s policy may treat these categories differently. It may also distinguish identifiable information from information that has been de-identified or disassociated from an account.
For a useful answer about a specific service, look for the policy’s definitions and retention terms for each category—not just a general statement about account deletion. Also check whether the account is a consumer account or a business account: commercial products and enterprise agreements can have different controls and terms.

There is no universal rule that a bankruptcy lets a buyer use all customer data for any purpose, nor a universal rule that all data must be destroyed. Prior privacy promises, the proposed transaction, the data involved, court orders, and applicable law can all affect what happens.

The FTC has addressed the tension between a proposed transfer and a company’s earlier promises. Its 2011 letter about Borders’ bankruptcy discussed the possibility that transferring customer information could conflict with the company’s privacy representations. The letter discussed seeking customer consent or applying significant restrictions. Earlier Toysmart settlement materials describe a specific, historical arrangement: transfer was limited to a qualified buyer, as part of a larger package rather than a stand-alone customer list, with continued treatment under the original privacy statement. Changes affecting previously collected data required notice and affirmative consent under that settlement.
Those materials illustrate how privacy commitments can matter; they are not a universal legal test for every bankruptcy or a promise that every case will use the same conditions. The central question is not simply whether a buyer can “own” data. Consider what the original company promised, what information is involved, whether the buyer plans to continue the service or use the information for a new purpose, and what law or court order applies.
What the 23andMe proceeding shows—and does not show
In March 2025, FTC Chairman Andrew N. Ferguson wrote about the potential sale or transfer of 23andMe data in bankruptcy. He referred to the company’s privacy statement, which said personal information could be accessed, sold, or transferred in a bankruptcy, merger, acquisition, reorganization, or asset sale, with the statement applying to transferred information. Ferguson said that, consistent with Bankruptcy Code section 363(b)(1), such promises must be kept. The FTC’s accompanying press release emphasized consumer concerns about the potential transaction and the importance of keeping promises about sensitive information.

This is an FTC position in a particular proceeding, not a guarantee of what will happen in every company’s bankruptcy. For a specific service, read the company’s actual notice and the official information about the transaction. A proposed sale or transfer is not itself proof that the sale has closed or that a buyer has received the data.

Can I request deletion, and how long does it take?
You may have a right to request deletion depending on where you live, whether the provider is covered by the relevant law, and what exceptions apply. The California Attorney General’s consumer guidance, updated August 28, 2026, says consumers may ask covered businesses to delete personal information and to direct their service providers to do likewise. The guidance also describes exceptions and does not establish a deadline for every jurisdiction or every AI company.
California’s guidance says a covered business generally must respond to a deletion request within 45 calendar days. It may take an additional 45 days if it notifies the consumer of the extension. These are California-specific procedural periods for covered requests under the state’s consumer privacy law—not a general shutdown deadline, and not a promise that every copy will be removed from every system within that period.
What exceptions and practical limits should I expect?
The California Attorney General lists examples of reasons a covered business may retain information, including completing a transaction, certain security practices, complying with legal obligations, and handling legal claims. A service provider may also direct you to submit your request to the business it serves. The designated request method matters: use the route identified in the company’s privacy notice rather than assuming that an email to a general support address is enough.

The available sources do not establish a universal rule for removing every backup copy after a request or a shutdown. Do not treat an account disappearing from your screen, uninstalling an app, or losing access to a website as confirmation that you submitted a formal deletion request.

How do provider deletion policies differ?
Published policies from current providers show why it is important to read the terms for the particular product and account. These examples describe those providers’ services; they do not predict how an unnamed or failed startup will handle its data.

A “30 days” statement in one provider’s policy is not an industry standard, and it does not mean that every category of information or every legally retained copy disappears on that schedule. Check the current policy for the precise product, account type, data category, and exceptions that apply.
What should I do before an AI service disappears?
If you rely on an AI service, take practical steps while you still have access. You do not need to assume a sale or shutdown is imminent; these steps help you understand your options if a closure notice arrives.
- Find the official notice and policy. Use the provider’s official website, account notices, or support channel to locate its closure announcement and privacy notice. Record the date, any cutoff for exports or requests, and any instructions about a successor or transaction.
- Export what you need and are entitled to retain. Save chats, files, or account information that you have a lawful and practical reason to keep. Follow the provider’s export process while it remains available, and store exported material securely—especially if it contains personal, confidential, or work information.
- Submit requests through the designated privacy channel. If you want deletion or have another privacy request, use the method specified in the policy. Preserve a copy of your request, any confirmation, and the company’s response. Exporting data and requesting its deletion are separate actions; one does not necessarily perform the other.
- Read transfer notices against the promises you saw when signing up. Look for language covering a sale, merger, reorganization, bankruptcy, successor, or new use of information. Note what the company says will happen to the privacy policy and to each relevant data category.
- Check work-account terms before acting. If you used the service for work, review the organization’s agreement and contact its administrator or data-protection contact. A business account may have different controls, obligations, or retention terms from a consumer account; do not export or delete organizational data without following your organization’s rules.
- Use official case information if bankruptcy is involved. Look for court, trustee, or regulator information about the case rather than relying on speculation about a potential buyer. Whether a transfer is proposed, approved, or completed can make a material difference.
- Contact the appropriate authority if the company stops responding. The relevant privacy regulator or consumer authority depends on your jurisdiction and circumstances. California’s Attorney General guidance is one state-specific route, not a worldwide process.
How can I compare services’ closure and data policies?
A broad label such as “privacy-friendly” does not tell you what happens to data if a company closes. Compare the actual terms and controls that matter to your use case.

These comparisons help identify what a provider says it will do; they cannot establish the outcome of a future closure or transaction. No general statistic establishes what percentage of failed AI startups delete, retain, or sell user data. For a specific provider, the answer requires its policies, closure plan, transaction information, relevant data categories, and the user’s jurisdiction.

Are my AI prompts personal information?
They can be, depending on what they contain and whether they can be linked to you or another identifiable person. A prompt may include personal details even if the account is registered under a business or pseudonym, so review the provider’s definitions and avoid putting sensitive information into a service unless its terms and your organization’s rules allow it.
Does a bankruptcy notice mean the AI company has already sold my data?
No. A notice may describe a proposed transaction, a completed transaction, or a possible transfer; those are different stages. Check the notice’s wording and official case information for the status and conditions rather than treating an announcement of a potential sale as proof it has closed.

Can I ask a buyer to delete my data after the service is acquired?
The correct request route depends on who controls the service after the transaction and what privacy terms and laws apply. Check the successor’s privacy notice and any transfer notice for the designated channel; if the company does not clarify who is responsible, contact the relevant privacy authority for your location.
Should I keep exported chats after deleting my account?
Only retain material you have a lawful and practical reason to keep, and protect it as carefully as the original account. Exports may contain sensitive information about you or others, and deleting the online account does not delete a file you saved on your own device or storage.
