The comparison is useful as a set of principles, not a ready-made rulebook: AI systems vary widely in purpose and impact, and their risks differ from those of nuclear power.
How nuclear safety divides responsibility
Nuclear safety regulation separates the duties of the operator from those of the regulator. The International Atomic Energy Agency (IAEA) says the organization responsible for a facility or activity has prime responsibility for safety. Regulation does not transfer that responsibility to the regulator.
In the European Union, Member States retain ultimate responsibility for the safety of their nuclear installations. Independent national regulators set rules, license installations where applicable, inspect compliance and enforce requirements. Operators remain responsible for safety and conduct regular assessments and upgrades. The European Nuclear Safety Regulators Group describes this division in its overview of nuclear safety.
This is a useful starting point for AI governance: the organization deploying or operating an AI system should remain accountable for its use. A regulator’s approval or an outside assessment should not be treated as transferring that responsibility. That is a policy lesson drawn from nuclear arrangements, not a statement of existing AI law.

Principles AI oversight can borrow
Keep the regulator independent and able to enforce rules
The IAEA’s GSR Part 1 (Rev. 1) says governments should ensure that the regulatory body is effectively independent in safety-related decision-making and functionally separated from entities whose interests could unduly influence it. In the EU nuclear framework, national regulators inspect and enforce as well as set rules and, where applicable, license installations. AI oversight can draw on the same institutional principle: meaningful oversight needs decision-making independence and authority to check compliance, not just voluntary guidance.
The IAEA sets out this requirement in GSR Part 1 (Rev. 1). It is a nuclear safety standard; it does not itself establish a general AI regulator or AI rules.

Scale requirements to risk and impact
Nuclear regulation uses a graded approach: the level of regulatory attention reflects the risks involved. The IAEA’s publication on AI for nuclear power applications likewise discusses risk categorization and more stringent scrutiny for AI systems with greater safety or security significance. Together, these sources support a proportional approach to AI oversight rather than imposing identical controls on every use, from a low-impact convenience feature to a system whose failure could cause serious harm.
They do not establish a universal threshold for deciding which AI uses are high-risk. Any general AI regime would need criteria suited to its own applications and context; nuclear categories cannot simply be copied over.

Build protection in layers
Nuclear safety does not depend on a single safeguard. The European Nuclear Safety Regulators Group describes defence in depth: if one layer fails, other layers should prevent an incident or limit its consequences. In AI systems used in nuclear settings, the IAEA discusses measures including monitoring, cybersecurity, contingency procedures, redundancy, isolation from safety-critical systems and personnel training.
For other AI applications, the specific protections should match the system and its failure modes. The transferable idea is to avoid relying on one test, one approval or one technical control as the entire safety strategy.

Plan for incidents and learn from them
Nuclear operators and authorities are expected to prepare and test emergency plans. IAEA requirements also address timely emergency response and the sharing of lessons from operating and regulatory experience. For AI governance, this points toward incident reporting, response exercises and mechanisms for organizations and regulators to learn from failures. The procedures and reporting rules would need to be designed for AI rather than borrowed wholesale from nuclear emergency planning.

The scholarly comparison by Park and co-authors proposes that international standard-setting, independent supervision, response protocols and international information-sharing can inform AI safety regulation. It also cautions that nuclear power and AI have different characteristics and risks, and that international harmonization may be slow or poorly suited to some national conditions. Licensing, inspections and documented safety cases may be useful models for governing some high-impact AI systems. But nuclear licensing is one possible tool, not a reason to require every AI system to obtain a facility-style license. AI is used across contexts with sharply different consequences, and the IAEA publication on AI addresses applications in the nuclear sector—not a comprehensive regulatory code for AI generally.
What this means for AI regulation
The practical lesson is to adapt nuclear safety’s governance disciplines while designing rules around AI’s varied uses. A credible framework can keep the operator accountable, give an independent regulator real oversight powers, match scrutiny to risk, require layered safeguards where warranted, and make response and learning part of ongoing oversight. Nuclear practice offers a useful reference for those choices, but AI-specific definitions, thresholds and procedures remain essential.
