Data stored in Europe is not automatically beyond U.S. legal reach, and storing it there does not by itself make a company GDPR-compliant. The CLOUD Act concerns U.S. authorities’ ability to compel a provider subject to U.S. jurisdiction to preserve or disclose electronic evidence within its possession, custody, or control, regardless of where the provider stores it. The GDPR governs the processing of personal data when its territorial rules apply, including processing by certain organizations outside the EU. A provider can therefore face obligations under both laws; an EU data-center region alone settles neither question.
What is the difference between the CLOUD Act and the GDPR?
The laws address different problems. The CLOUD Act is a U.S. law concerning government access to electronic evidence held by covered service providers. The GDPR is an EU data-protection law governing how organizations process personal data and, in some circumstances, transfer it outside the European Economic Area (EEA).
That difference matters when a company chooses a cloud region. A server location can be relevant to data protection, contracts, and operational risk, but it does not by itself decide whether a U.S. provider can be compelled to produce data or whether the customer’s processing complies with the GDPR.

| Question | CLOUD Act | GDPR |
|---|---|---|
| What triggers it? | A qualifying provider’s jurisdictional connection and possession, custody, or control of the requested electronic evidence; storage location alone is not decisive. | Processing within the GDPR’s territorial scope, including by an organization established in the EU or certain organizations outside it that offer services to people in the EU or monitor their behavior. |
| Who is principally involved? | U.S. authorities seeking electronic evidence and providers subject to applicable U.S. legal process. | Controllers, processors, data subjects, and data-protection supervisory authorities. |
| What is regulated or sought? | Electronic evidence that authorities seek to preserve or disclose. | The processing of personal data, including the legal basis for processing and applicable safeguards for transfers. |
| How does the process work? | Through U.S. legal process and, in relevant cases, mechanisms that can include comity considerations or executive agreements with qualifying foreign governments. | Through GDPR duties such as lawful processing, controller-processor terms, transfer safeguards, and supervisory enforcement. |
| Does an EU server decide the outcome? | No. Provider jurisdiction and control over the data are central to the question. | No. Territorial scope and the organization’s processing activities matter; the server’s location alone does not establish compliance. |
The comparison is not a simple choice between one law and the other. A cloud provider may be subject to a U.S. demand while processing personal data on behalf of a customer to whom the GDPR applies. That can create a conflict-of-laws problem involving the provider, customer, and potentially EU or Member-State law.

Can the U.S. access data stored in Europe?
Potentially, yes: a U.S. authority may be able to compel a provider subject to U.S. jurisdiction to preserve or disclose data in its possession, custody, or control even when the data is held on servers in Europe. That does not mean U.S. authorities have unrestricted or automatic access to every file stored in an EU region.
The CLOUD Act clarified that a provider’s obligation to respond can apply regardless of where the data is stored. The key practical question is therefore not only “Where is the server?” but also “Which provider entity can be compelled, and does it possess, control, or have custody of the requested data?” A provider’s corporate structure, service design, and access arrangements may affect that assessment. A customer should not assume that a regional hosting selection answers it.
The law concerns government demands made through legal process, not a general permission for a provider to browse customer content or for authorities to collect all data indiscriminately. The EDPB and EDPS assessment describes the Act in the context of targeted investigations and discusses procedural safeguards. It also warns that a U.S. request may reach personal data protected by the GDPR and may bypass the ordinary mutual legal assistance pathway, potentially bringing U.S. demands into tension with EU or Member-State law.
What “possession, custody, or control” means for a customer
These terms direct attention to the provider’s relationship with the information, not just the physical drive holding it. A customer evaluating a service should map which provider entities can access the content, administer the infrastructure, provide support, manage backups, or operate relevant subprocessors. The precise legal effect of a particular corporate or technical arrangement depends on its facts; a marketing label such as “EU-only” does not establish that no U.S.-connected entity has control.
Content is not the only information worth reviewing. Depending on the service, account records, logs, identifiers, or other metadata may be handled separately from the stored files. Ask the provider what categories it handles, which entities can access them, and how its request-response process applies to each category.
Does the CLOUD Act override the GDPR?
It is misleading to describe the CLOUD Act as simply overriding the GDPR, or to assume the GDPR automatically blocks every U.S. demand. The regimes can apply at the same time, and a provider or customer may have to navigate competing legal obligations.

The CLOUD Act addresses a provider’s response to U.S. legal process. The GDPR imposes obligations on organizations that process personal data within its scope, including duties around processing and international transfers. When a U.S. demand concerns GDPR-protected data, the issue can become one of reconciling those duties with the demand and any other applicable law. The EDPB and EDPS have highlighted this potential conflict, including the possibility that the U.S. process does not follow the usual mutual legal assistance route.

Neither a customer contract nor a provider’s general promise to comply with privacy law can resolve every conflict in advance. The response may depend on the legal instrument, the requested data, the provider’s role and control, applicable Member-State rules, and whether a challenge or other review mechanism is available. Organizations should agree in advance how requests are escalated, assessed, challenged where appropriate, and communicated when notification is legally permitted.
Executive agreements are not the same as every U.S. request
The U.S. Department of Justice says the CLOUD Act authorizes executive agreements under which qualifying foreign governments can seek electronic evidence directly from covered providers, subject to the terms of the relevant agreement. This is a separate mechanism from the statute’s clarification of provider obligations for data within a provider’s possession, custody, or control regardless of storage location. Do not conflate a foreign government’s access under an executive agreement with every demand made by U.S. authorities.
The DOJ has also described the statutory amendment as codifying the longstanding U.S. practice after a 2016 appellate decision concerning Microsoft. That history helps explain why data location became prominent in the debate; it does not mean that server location alone now determines whether a provider must respond.
Does GDPR apply if personal data is stored outside Europe?
It can. EU guidance says the GDPR applies to an organization established in the EU regardless of where the processing takes place. It can also apply to a non-EU organization that offers goods or services to people in the EU or monitors their behavior. Those territorial triggers make the organization’s activities and relationship to people in the EU central; physical storage in Europe is not a substitute for analyzing scope.

Controller, processor, or another relationship?
A customer using a cloud service should not assume every provider is automatically a processor for every activity. The Irish Data Protection Commission advises organizations to determine whether the relationship is controller-processor, joint controllership, or another arrangement. The role depends on what the parties actually do, not only on the label in a sales document.
Where a provider acts as a processor, the parties need a binding agreement meeting GDPR Article 28 requirements, and the processor must provide sufficient guarantees. The agreement should fit the actual service: it should make clear what data is processed, for what purpose and duration, how access is controlled, and how the provider supports the customer’s compliance responsibilities.
Does the EU-U.S. Data Privacy Framework protect data from CLOUD Act requests?
No. The EU-U.S. Data Privacy Framework (DPF) is a transfer mechanism for participating organizations, not immunity from law-enforcement demands and not a general GDPR-compliance certificate. The European Commission’s adequacy decision for the DPF entered into force on July 10, 2023. The DPF addresses transfers; the CLOUD Act addresses government access to electronic evidence.
That distinction is important when a provider advertises a framework certification or an EU hosting option. A valid transfer mechanism can address one part of the GDPR analysis, but it does not answer whether a provider can be compelled by U.S. authorities, who controls encryption keys, what other data the provider can access, or what the provider will do upon receiving a demand.
Transfer compliance and government-access risk should be assessed separately. Organizations need to understand where and how a provider handles information outside the EEA, select an appropriate Chapter V transfer basis when required, and assess the practical access and safeguards relevant to the service. An adequacy decision can support a transfer under Article 45 for participating organizations; it does not replace the customer’s wider GDPR responsibilities.
What should a European company ask its cloud provider?
Ask questions that reveal the provider’s legal footprint, technical access, and response procedures—not just which region hosts the primary workload. Request concrete answers for the service and data categories you actually use, and retain the answers in your vendor and privacy records.

Jurisdiction, entities, and access
- Which legal entities provide, operate, support, and bill for the service, and which have a U.S. legal presence or operations?
- Which provider entities or personnel can access customer content, backups, logs, account data, or metadata?
- Which subprocessors handle personal data, where do they operate, and how can support or maintenance take place from outside the EEA?
- Which entity has possession, custody, or control of each data category, and what technical or contractual facts support that answer?
Encryption and technical control
- Is customer content encrypted at rest and in transit, and who controls the keys?
- Can the provider technically decrypt or otherwise access the content, including for support, recovery, or service administration?
- Are backups, replicas, and logs covered by the same key architecture and access restrictions as the main workload?
- Can the customer limit access or use customer-controlled keys, and what service functions would that affect?
Encryption is a risk control, not an automatic legal answer. Its practical value depends on whether the provider can decrypt the data or reach the keys, and whether the data being considered includes content, metadata, or other information outside that encryption design.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Fix the driver behind crashes, sound loss and screen glitches3Clear out junk files and repair common Windows errorsLegal requests and transparency
- How does the provider validate, narrow, and route subpoenas, warrants, preservation requests, or other government demands?
- Will it challenge an unlawful or overbroad demand when appropriate, and what assistance can it provide to the customer?
- When can it notify the customer, and what lawful limits might prevent notice?
- Does it publish transparency reporting that distinguishes request types, data categories, regions, and outcomes?
- What retention, deletion, audit, and cooperation commitments apply when a request is received?
Ask for the provider’s actual policy and contractual commitments rather than relying only on broad assurances. Notification and challenge commitments may be subject to legal limits, so a contract should explain the process and its constraints rather than promise notice in every circumstance.
How can an organization reduce and manage the risk?
No single location setting or contract clause resolves every issue. A sound approach combines data minimization, technical controls, transfer and role documentation, provider due diligence, and a practiced response process.
- Inventory the data and its path. Record personal-data categories, primary regions, replicas, backups, support access, logs, and subprocessors. Distinguish content from account or operational metadata where the service handles them differently.
- Map the entities and control points. Identify every provider entity involved, including those with U.S. operations or legal presence. For each data category, determine who can access it and who appears to have possession, custody, or control.
- Document GDPR roles and terms. Determine whether the provider is a processor, joint controller, or has another role for each relevant activity. Put Article 28 terms in place where the provider is a processor, and verify that they reflect the real service.
- Choose and document a transfer basis. Where personal data is handled outside the EEA, identify the applicable Chapter V mechanism and assess the provider’s handling. Participation in the DPF may provide an Article 45 basis for transfers to participating organizations, but it is not a substitute for the rest of the compliance analysis.
- Assess access risk in the actual architecture. Review the provider’s technical access, key custody, support model, transparency practices, and procedures for challenging requests. Consider national secrecy or blocking laws and contractual commitments that may affect disclosure or notice.
- Minimize and protect data. Keep only the data the service needs, use strong encryption, and consider customer-controlled keys where feasible. Verify whether the provider can technically decrypt and account for backups, replicas, and support operations.
- Negotiate workable commitments. Address notice subject to lawful limits, challenges, assistance, deletion, audit, and transparency in the contract. Make sure the terms cover the entities and subprocessors that actually handle the data.
- Prepare a response playbook. Define who receives and evaluates subpoenas, warrants, preservation requests, and supervisory-authority inquiries; who contacts counsel and the provider; what records to preserve; and how customer communications are approved.
- Reassess when facts change. Review the analysis if the provider changes legal entities, regions, subprocessors, encryption architecture, or legal commitments. A prior assessment may no longer describe the service in use.
These controls do not guarantee that a provider will never receive a demand or that a demand cannot reach the data. They help the organization understand exposure, meet its own duties, and respond in a controlled way rather than relying on a region label or an untested assumption.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. What do provider transparency figures show?
Provider reporting can offer useful evidence about one company’s disclosed experience, but it cannot establish a market-wide rate. Amazon Web Services reported that, as of June 2025, it had received no data requests resulting in disclosure to the U.S. government of enterprise or government content data stored outside the United States since it began reporting that statistic.
That is a company-specific statement, limited to the described category of content, geography, outcome, and reporting period. It does not show that no provider has ever disclosed European data, that no request has been made, or that future requests will have the same result. The evidence does not establish an authoritative market-wide statistic for CLOUD Act disclosures of GDPR data stored in Europe.

Use transparency reports as one input to due diligence. Compare what a provider counts as a request, disclosure, customer content, or non-U.S. data, and note whether it reports requests that were challenged, rejected, or resulted in no disclosure. A zero for one defined measure is not a substitute for understanding the provider’s architecture, legal commitments, or the customer’s own obligations.
What is the practical conclusion for EU-region cloud storage?
An EU region can help meet data-location requirements and may be part of a GDPR-compliant design, but it does not alone resolve U.S. jurisdiction or provider-control questions. Conversely, potential CLOUD Act reach does not mean every U.S.-connected provider will disclose every European customer record. The relevant facts include the provider entities involved, their control over the data, the legal process, the data category, technical access, and applicable EU and national rules.
Evaluate the two regimes separately and then together: establish GDPR scope, roles, and transfer safeguards; map the provider’s legal and technical access; and document how a demand would be handled. Treat “EU-only” as a claim to verify across data, backups, support, and subprocessors—not as a legal conclusion.

Does the CLOUD Act let U.S. authorities search every European cloud account without a warrant?
No. It is not a general authorization for indiscriminate access; it concerns demands for electronic evidence through applicable legal process. The precise process and safeguards depend on the kind of demand and circumstances.
Can a European customer refuse a provider’s disclosure of its data?
A customer’s position depends on the demand, the provider’s legal obligations, and applicable EU or Member-State law. Organizations should have counsel and a provider-response procedure ready; a contract alone cannot guarantee that a disclosure can be refused.
Does using a European provider guarantee that the CLOUD Act cannot apply?
Not by itself. The answer depends on the provider’s legal connections and its possession, custody, or control of the information, not simply its headquarters or the location of a server.
