If you downloaded an unauthorized Nintendo Switch 2 game, stop using and sharing it, remove it with ordinary console or storage controls, stop using any circumvention device, and obtain the game from Nintendo eShop, Nintendo’s website, or a legitimate physical cartridge. Do not download another tool to hide, repair, or disguise the copy. Nintendo of America’s Switch 2 User Agreement, effective September 2026, says violations can end your rights, remove content, disable access, and potentially leave the console or software permanently unusable. Deleting the file is a sensible risk-reduction step, but Nintendo’s published materials do not promise that deletion prevents enforcement. The agreement discussed here applies to the Americas-facing Nintendo of America terms; legal consequences can differ by country.
What should you do first?
Act conservatively and stop adding activity that could extend the violation. The safest sequence is to stop, remove, avoid circumvention, and return to an official distribution channel.
- Stop launching the unauthorized copy. Close it and do not continue playing, testing, modifying, or troubleshooting it. Nintendo’s agreement says that when its restrictions are violated, the rights granted under the agreement terminate immediately and the user must cease use of the console and software.
- Do not upload, seed, send, or redistribute it. That includes sharing a ROM, a download link, a torrent, a key, or a modified package. Nintendo’s Intellectual Property & Piracy FAQ states: “The uploading and downloading of pirate copies of Nintendo games is illegal.”
- Remove the files through normal controls. Use the Switch 2’s standard software and data-management controls for a copy installed on the console. If the file is on a computer, removable card, or other storage, delete it with the operating system’s ordinary file-management tools. Do not install an unauthorized utility merely to remove, conceal, or alter the copy.
- Stop using any circumvention product. If the download involved a modchip, piracy cartridge, emulator, unauthorized console modification, or similar device, disconnect it and do not use it to access other games or services.
- Replace the copy through an official source. Nintendo identifies Nintendo eShop and Nintendo’s website as legitimate online download channels. A compatible Switch 2 physical game cartridge bought from a retailer is another legitimate route.
- Preserve only information you need for a report or legal advice. Do not keep or forward the game itself. If you need to ask a lawyer about your situation, describe what happened without distributing the copyrighted files.
What does Nintendo’s Switch 2 agreement say?
The Switch 2 User Agreement is a license agreement, not a promise that purchased software can be copied or redistributed without limits. Nintendo’s wording is direct: “Software is licensed, not sold.” The agreement restricts copying, distribution, circumvention, and use of unauthorized copies.
Nintendo can end the rights granted by the agreement
Nintendo says a violation can terminate the user’s rights immediately. Its terms also require the user to stop using the console and software after a violation. That language is broader than a request to delete one file: it describes the contractual consequences Nintendo reserves when its restrictions are breached.

Content can be removed and access can be disabled
The agreement says Nintendo may remove content obtained through an unauthorized device or through an unauthorized modification of the console or software. It also says Nintendo may implement technical measures designed to disable access to some or all of the software or console when it determines, or reasonably suspects, a violation.
Permanent loss is a stated possibility
Nintendo’s terms warn that the console or software could become permanently unusable, in whole or in part. This is a reserved remedy, not a prediction that every unauthorized download produces that result. The official material does not publish a universal amnesty rule for people who delete a copy, so no one can honestly promise that removal guarantees immunity.
Can Nintendo ban your Switch 2 for a pirated game?
It is possible for Nintendo to take contractual or technical action, but the published terms do not establish a single automatic outcome for every case. The result can depend on what was installed, whether the console or software was modified, the state of the account and device, the evidence available to Nintendo, and the law that applies where you live.

“Ban” can describe different things: loss of rights under the agreement, removal of unauthorized content, inability to use online functions, disabling of software, or a console that no longer works. Nintendo’s agreement reserves several of those measures, including disabling access and potentially rendering the console or software unusable. It does not say that every first-time download receives the same penalty, and it does not guarantee that deleting the file will restore any access that has already been disabled.

Do not treat a successful sign-in, a working game, or an absence of an immediate warning as proof that the activity is authorized. The practical response is still to stop, remove the copy through ordinary controls, and avoid further unauthorized activity.
How do you remove the copy without creating another problem?
Removal should be simple and non-invasive. The goal is to stop using the unauthorized material, not to investigate the console with another unapproved product.
- Identify where the copy resides. It may be installed on the console, stored on removable media, or saved on a computer or external drive. Do not open it again to confirm its identity.
- Use the platform’s built-in deletion controls. On the console, use the ordinary software or data-management function supplied with the system. On a computer or storage device, use the normal delete function and empty the recycle or trash area if the copy is still present there.
- Remove related unauthorized installers and patches. Delete files that exist solely to install, launch, modify, or redistribute the unauthorized copy, but do not download a new circumvention program to perform the cleanup.
- Stop before making a destructive change. A factory reset, firmware alteration, or hardware change is not required by the published Nintendo guidance for this situation. If you are unsure what a reset would erase, do not perform it just to seek a guarantee Nintendo does not provide.
Nintendo’s agreement says that content obtained through an unauthorized device or unauthorized modification may be removed. Ordinary deletion is therefore a practical risk-reduction measure, not a promise that Nintendo will treat the incident as erased.

The hardware and software used to circumvent Nintendo’s controls add risks beyond the unauthorized file itself. Nintendo warns that unauthorized products may damage the product, reduce functionality such as online play, and create a risk that the console will no longer work after network updates.

Disconnect or stop using the circumvention product rather than trying to update it, conceal it, or use it to install another title. Do not assume that removing the game while leaving the modification active resolves the issue; Nintendo’s warnings address unauthorized devices and modifications as separate sources of risk.
If a third-party service performed a modification, keep communication limited to arranging lawful repair or removal. Do not ask the service to install another game, defeat an update, or provide instructions for bypassing Nintendo’s controls.
How can you get the game legally now?
A legitimate purchase is a replacement path for the unauthorized copy, not retroactive authorization for the download. Choose the format that fits your needs without retaining or using the unauthorized version.

Should you report the website or source?
If the source is still distributing Nintendo material, Nintendo publishes a reporting address for piracy-related activity: piracyscene@noa.nintendo.com. Nintendo lists this address for ROM sites, emulators, game copiers, counterfeit manufacturing, and other illegal activity.

What mistakes should you avoid after the download?
- Do not keep playing “offline.” Lack of an internet connection does not turn an unauthorized copy into an authorized one.
- Do not upload a copy to cloud storage. Moving the file to another service can still involve copying or distribution.
- Do not ask for a workaround. Instructions for bypassing checks, defeating updates, or hiding a modification can create additional circumvention activity.
- Do not assume ownership of another copy creates permission. The official piracy guidance does not provide a blanket exception for people who own a cartridge or previously bought a game.
