Shadow AI is not a separate prohibited category under the EU AI Act. It is the use of an AI system outside an organisation’s approved tools, accounts, contracts and controls. That use becomes a legal issue when the system’s purpose, data, provider/deployer role or risk level triggers duties under the Act or under related rules such as the GDPR, employment law, confidentiality obligations and sector regulation.

An employee who uses a public chatbot to polish an internal email is not automatically breaking EU law. An employee who sends customer health information to a personal account, or who uses an unassessed model to screen job applicants, can create serious exposure. The practical answer is to discover every AI service in use, classify what each one does, approve safe alternatives, train staff and monitor the resulting data flows.

What is shadow AI, and why is it a security problem?

Shadow AI is AI use that is not captured by an organisation’s approved systems and processes. The UK National Cyber Security Centre (NCSC) describes it as use outside approved systems and processes; IBM uses the related idea of unsanctioned AI use without formal IT approval or oversight. It can include a worker’s personal account on a chatbot, a browser extension that sends page contents to a model, an AI plug-in connected to company files, or an agent created with an unreviewed API key.

The central failure is visibility. As the NCSC puts it, “You cannot manage what you do not know.” If security and compliance teams do not know which service is being used, they cannot reliably determine what prompts contain, where data is stored, how long it is retained, whether it is used for training, which subprocessors receive it, or what permissions an AI agent has.

The risk is broader than confidential text. A connected agent may be able to read mail, shared drives, ticketing systems or source code and then expose information through its answers or actions. Consumer accounts can mix business prompts with personal activity, leaving the organisation without an enforceable retention or deletion setting. Weak audit trails also make it difficult to investigate an incident or prove that required human review took place.

NCSC material cited in 2026 reports that 71% of employees said they had used AI tools not approved by their employer. That figure is a survey finding, not a count of incidents or a measure of financial loss. There is no single EU-wide count showing how many security incidents or fines have been caused by shadow AI.

Does the EU AI Act ban shadow AI?

No. The EU AI Act does not make “shadow AI” an independent legal category. It applies a risk-based framework to AI systems and to defined actors, including providers, deployers, importers and distributors. The same unapproved chatbot can have different legal consequences depending on what it is used for, who controls the use and which people or decisions are affected.

The European Commission’s framework distinguishes unacceptable, high, transparency and minimal or limited-risk situations. An informal tool is therefore a governance and classification problem first. Its lack of approval is evidence that controls may be missing; it is not, by itself, proof that the tool is illegal.

When an ordinary chatbot creates other legal exposure

A general-purpose chatbot used to draft an internal email may fall outside the Act’s high-risk categories, yet still raise GDPR, confidentiality, copyright, employment or contractual questions. Sending personal data without a lawful basis or required safeguards can breach data-protection obligations. Uploading a customer’s trade secret can violate a confidentiality agreement even if the model produces a harmless-looking answer. An employer may also need to consult staff representatives or apply workplace policies before introducing monitoring.

When the purpose makes the use high risk

The Act lists high-risk uses in areas such as recruitment and worker management, credit access, healthcare and other regulated activities. An AI system used to rank applicants, evaluate workers, support a credit decision or influence a medical decision can trigger high-risk obligations regardless of whether the IT department approved it. The relevant question is what the system does in practice, not what the employee calls it.

When a prohibited practice is involved

Prohibitions, definitions and AI-literacy provisions became applicable on 2 February 2025. If an unapproved system is used for a practice the Act prohibits, the organisation cannot avoid the rule by describing the activity as an experiment or personal productivity. Stop the use, preserve relevant records and obtain legal and data-protection advice immediately.

Which EU AI Act dates matter for shadow-AI programmes?

The Act entered into force on 1 August 2024 and is being applied in stages. A company should map each deadline to the systems and roles it actually has rather than treating one date as a universal compliance deadline.

Date What changes Why it matters for unapproved use
1 August 2024 The regulation entered into force. Organisations could begin planning inventories, ownership and controls.
2 February 2025 Prohibitions, definitions and AI-literacy provisions became applicable. Staff using AI need appropriate competence, and prohibited practices must be prevented now.
2 August 2025 Governance rules and general-purpose AI model obligations became applicable. Provider and governance questions become more important when a company builds, supplies or materially integrates a model.
2 August 2026 Transparency requirements and enforcement for applicable rules begin. Disclosures, records and supervisory readiness must be built into relevant workflows.
2 December 2027 A later transition date applies to specified high-risk categories. Systems in those categories need a dated migration plan rather than an indefinite exception.
2 August 2028 The Act’s full roll-out is scheduled, including the remaining specified high-risk transition. Temporary arrangements should not be treated as a permanent control model.

The dates above come from the European Commission AI Act Service Desk timeline. National competent authorities, penalties and sector rules still affect how obligations are enforced in a particular country. The regulation is directly applicable, but it does not replace the GDPR, national employment law, professional secrecy rules or a contract’s security requirements.

How do approved and shadow AI deployments differ?

Approval is valuable because it makes the system’s purpose, data path and accountable owner visible. The following comparison shows the control gap an organisation should close.

Axis Approved deployment Shadow deployment
Data handling Purpose, retention, access, deletion and permitted data can be assessed in a contract and configuration. A personal or consumer account may receive sensitive data without an enforceable organisational setting.
Visibility Inventory, identity, logs and usage monitoring are available to security and compliance teams. IT may not know the tool, users, prompts, destinations or volume of transfers.
Legal classification Provider or deployer role, purpose and risk category can be documented. The actor, purpose and applicable duties may remain unknown until after use or an incident.
Operational safeguards Human oversight, incident response, vendor review and policy enforcement are designed in. Activity may have weak audit trails and unassessed model or agent privileges.

How can a company discover shadow AI?

Discovery should combine technical evidence with conversations about unmet business needs. Blocking one website rarely finds browser extensions, API calls, mobile apps or AI features embedded in ordinary software.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Build an initial application inventory. Review DNS and proxy logs, identity-provider sign-ins, browser and endpoint telemetry, software-as-a-service procurement records, expense claims, API gateways and data-loss-prevention alerts. Application-discovery guidance from Microsoft highlights risk scores, usage analytics and data-transfer monitoring as useful signals.
  2. Identify users and data paths. Record the account type, authentication method, connected repositories, prompts or files transferred, model provider, geographic storage region and whether the service can retain inputs for training. Treat an AI plug-in with access to a mailbox or drive as a privileged application, not merely a writing aid.
  3. Ask what need the tool meets. NCSC guidance stresses communication and secure alternatives because people route around controls when approved tools are too slow, unavailable or incapable of a required task. A short survey, help-desk category and confidential reporting channel often reveal uses that telemetry misses.
  4. Assign an owner and confidence level. Mark each record as confirmed, suspected or unknown, with a business owner responsible for answering follow-up questions. Unknown systems should be restricted from sensitive data until their behaviour is established.

How should each AI use be classified?

Classify the use case, not just the brand or model name. A general-purpose model can support a low-risk drafting task in one department and a high-risk employment decision in another.

  1. Define the purpose and affected people. Write what the system produces, who relies on it and whether it influences access to employment, education, credit, healthcare, essential services or law-enforcement-related decisions.
  2. Determine the organisation’s role. Establish whether the company is a provider, deployer, importer, distributor or a user integrating someone else’s model. Document who selected the model, configured it and gives instructions to staff.
  3. Check prohibitions and transparency first. Ask whether the behaviour is prohibited and whether people must be told that they are interacting with AI or receiving AI-generated content. Do not wait for a high-risk assessment before addressing these questions.
  4. Assess high-risk criteria. For a listed high-risk purpose, plan for risk management, logging, data governance, human oversight, accuracy, robustness and cybersecurity controls. Keep the assessment tied to the actual workflow and decision, including any human approval step.
  5. Apply other laws and contracts. Check GDPR roles and lawful bases, international transfers, records of processing, copyright and trade-secret restrictions, employment consultation, professional rules, customer commitments and incident-notification clauses.

Keep the reasoning and evidence with the inventory record. A label such as “productivity tool” is not a legal analysis and will not explain why a particular use was permitted.

What controls should replace an informal AI tool?

Approval should produce a usable path, not merely a ban. The control package should match the data and risk of the use.

Set data and account rules

Define which information may be entered, such as public material, internal low-sensitivity text or approved pseudonymised data. Prohibit credentials, secrets, regulated personal data and customer-confidential material unless a reviewed service and lawful process exist. Require corporate identity, multifactor authentication and central offboarding instead of personal accounts.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Contract for the data lifecycle

Review retention, deletion, training use, access controls, subprocessors, security commitments, hosting locations, breach notice and audit rights. Record the approved configuration and prevent a vendor from silently switching an account to a setting that permits model training or longer retention.

Control integrations and privileges

Use least privilege for connectors, separate read from write access and require approval before an agent can send messages, change records or execute code. Rotate and revoke API keys through the organisation’s normal secrets-management process. Test prompt-injection and data-exfiltration paths before enabling an agent on production information.

Provide human oversight and quality checks

Require a named person to review outputs before they affect a customer, employee, applicant or regulated decision. Give reviewers enough information to challenge an answer, record material overrides and escalate unreliable or discriminatory results. Logging should preserve the version, input context, output, reviewer and action where the applicable rule requires it.

Train people and make reporting easy

AI literacy became an applicable obligation on 2 February 2025. Training should cover approved tools, prohibited data, hallucination and bias, verification of generated code or text, prompt-injection risks, copyright and the route for reporting a new tool or suspected exposure. Short, role-specific exercises are more useful than a one-time generic slide deck.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What should happen when shadow AI is found?

Use a proportionate response that stops harmful exposure while preserving evidence and keeping the business functioning.

  1. Contain the data flow. Disable a connector, revoke a token, suspend a personal account used for company information or apply a temporary network rule. Do not delete logs or messages that may be needed for an investigation.
  2. Determine what was disclosed. Identify prompts, files, personal data, recipients, retention settings and dates. Ask the provider for deletion or access information through the contractual contact, without assuming deletion has occurred.
  3. Assess notification duties. Consult the privacy, security, legal and employment teams about GDPR breach assessment, customer notices, regulator reporting, confidentiality commitments and any AI Act incident process that applies to the system.
  4. Decide the disposition. Approve the use with conditions, migrate it to a contracted service, restrict it to non-sensitive data, or retire it. Explain the decision to the user and provide a workable replacement.
  5. Reassess after material change. A new model, connector, purpose, user population or retention setting can alter the classification. Update the inventory, risk assessment, training and monitoring rather than relying on the original approval.

Who is responsible for an unauthorised AI system?

Responsibility depends on conduct and role, not on which department paid for the subscription. A provider that places a high-risk system on the market has different duties from a company deploying it in recruitment. A company can also become responsible for how it configures, instructs and monitors a third-party system.

Managers own the business purpose and must not encourage staff to bypass controls. IT and security teams own discovery, identity, logging and technical restrictions. Procurement and legal teams assess contracts and role allocation. Privacy and compliance teams map GDPR, employment, sector and AI Act duties. Employees remain responsible for following data-handling instructions and reporting an unsafe tool, but an organisation cannot transfer its governance obligations to an individual worker.

Is a company-wide “no public chatbot” rule enough?

No. A blanket prohibition may reduce one visible route while driving work to phone apps, browser extensions, personal APIs or unapproved automation. It also leaves legitimate low-risk work without a safe option.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A stronger policy states the allowed purposes, data classes, account requirements, review thresholds, prohibited practices, retention settings, human-oversight expectations and consequences for bypassing controls. Pair the policy with an approved service that meets common needs, a quick exception process and monitoring that respects employment and privacy requirements. Governance should make the secure path easier than the shadow path.

What should an organisation do this quarter?

Start with a dated, owned plan rather than waiting for every implementing detail to settle.

  • Nominate an executive owner and a cross-functional AI governance group.
  • Publish a plain-language rule for confidential, personal, regulated and public data.
  • Run discovery across identity, endpoints, browsers, SaaS procurement, network traffic and API use.
  • Interview high-use teams and document the business need behind each unapproved service.
  • Classify the highest-impact workflows for prohibited, transparency and high-risk concerns.
  • Approve a small set of contracted tools with corporate accounts, retention controls and least-privilege integrations.
  • Deliver role-based AI-literacy training and a simple reporting route.
  • Test containment, deletion requests, incident escalation and human-review evidence.
  • Review the inventory when models, connectors, purposes or applicable deadlines change.

The NCSC warns that “The use of shadow AI is unlikely to disappear completely.” The realistic objective is therefore measurable visibility and controlled adoption: know what is used, why it is used, what data leaves the organisation and which legal duties follow.

Frequently Asked Questions

Can an employee use ChatGPT at work without asking permission in the EU?

There is no blanket EU AI Act rule that makes every workplace chatbot use illegal. The employee must follow the employer’s policy and data-protection instructions, and the organisation must assess the tool’s purpose, data handling and contractual terms before permitting business information to be entered.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Does the EU AI Act apply to a company outside the European Union?

It can apply when an organisation places an AI system on the EU market, puts an AI system into service in the EU, or the output is used in the EU in circumstances covered by the regulation. The exact connection and role should be reviewed with counsel because territorial scope depends on the activity, not simply the company’s incorporation country.

What evidence should we keep for an AI-literacy programme?

Keep the training scope, audience, completion records, role-specific materials, assessment or acknowledgement results and the date the content was updated. Link training to the systems and data classes employees actually use so an auditor can see how competence was maintained.

Can we rely on a vendor’s claim that its model is compliant?

A vendor statement does not determine your organisation’s deployer duties or prove that your configuration is safe. Verify the contract, retention and training settings, access controls, logging, incident terms and the way your staff use the system.

What happens if an AI system changes after approval?

Treat a material model, connector, purpose, user group or data-policy change as a change-control event. Recheck the risk classification, privacy impact, human oversight, security tests and user instructions before allowing the changed system to handle the same information.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
