Yes—in the United States, you can generally sell a game made with generative AI. But permission to sell, copyright ownership, and the right to use an output without infringing someone else’s rights are separate questions. Before shipping, check that your tool’s current terms permit commercial use on your plan, screen the content for infringement, and meet each store’s disclosure rules. A tool may let you use an output commercially without giving you copyright in it: under current U.S. Copyright Office guidance, material created entirely by AI is generally not copyrightable, while qualifying human-authored contributions can be.
This is general information about publicly stated U.S. copyright policy and store rules, not legal advice for a specific game. Rules differ by country; the discussion below reflects sources current through October 29, 2026.
What does “legal to sell” mean for an AI-made game?
It usually means satisfying three independent conditions: your AI tool’s terms allow the commercial use, the shipped content does not unlawfully use someone else’s protected work or identity, and your store disclosures are accurate. Meeting those conditions can make a sale permissible without making every generated asset yours under copyright law.

A vendor’s contract can grant whatever rights it has in an output, but it cannot create a federal copyright in material that the law does not recognize as human-authored. Nor does a commercial-use licence clear a resemblance to another creator’s protected work.

- May I sell it? Usually, if the relevant tool plan permits commercial use, the content is non-infringing, and you follow store rules.
- Do I own copyright? Only in qualifying human-authored elements. Purely generated material generally lacks U.S. copyright protection.
- Could I still face a claim? Yes. A tool licence does not grant rights to third-party characters, trademarks, copyrighted expression, or a person’s protected likeness or voice.
Can I copyright AI-generated game assets?
In the United States, copyright protects human authorship, not an AI system’s expressive choices by themselves. The U.S. Copyright Office’s January 29, 2025 report, Copyright and Artificial Intelligence, Part 2: Copyrightability, states: “The outputs of generative AI can be protected by copyright only where a human author has determined sufficient expressive elements.”
The Office also explains: “Copyright protects the original expression in a work created by a human author, even if the work also includes AI-generated material.” Conversely, “Copyright does not extend to purely AI-generated material, or material where there is insufficient human control over the expressive elements.” The Office’s public AI hub is at copyright.gov/ai/.
Why a prompt alone is generally not enough
Under the Office’s assessment of currently generally available technology, a prompt does not usually give its author enough control over the output’s specific expressive details. The Office put it this way: “Prompts may reflect a user’s mental conception or idea, but they do not control the way that idea is expressed.” Its report further says: “The gaps between prompts and resulting outputs demonstrate that the user lacks control over the conversion of their ideas into fixed expression.”
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsSo a prompt-only sprite, image, music track, or NPC line generated and shipped without meaningful human authorship is generally not copyrightable in the United States. Choosing one output from a batch does not, by itself, turn the output into a human-authored work. There is no “30% rule”: the Copyright Act and Office guidance do not set a percentage of human edits that automatically earns protection. The Office says authorship must be assessed case by case.
Which parts of a game may be protected?
Human expression can remain protected when it is perceptible in a mixed human-and-AI work. The Office says: “Where a human inputs their own copyrightable work and that work is perceptible in the output, they will be the author of at least that portion of the output.” Substantial human modifications may also qualify if they meet ordinary originality standards. Human-authored writing, code, design, and expressive edits are not made unprotectable simply because AI assisted elsewhere in the project.
For a game, the potentially protectable core may include original scripts and dialogue written by people, code and architecture written or substantially reworked by the team, hand-painted additions, level design, and creative selection or arrangement of elements across screens or levels. Protection for a combined work does not automatically extend to AI-generated components standing alone.
The Office’s February 2023 decision on Zarya of the Dawn provides a useful illustration: the human-authored text and the selection and arrangement of the comic’s material were protected, but the individual Midjourney images were not. A January 2025 registration for A Single Piece of American Cheese, reported by Perkins Coie, is a different example: the human actively selected, coordinated, and arranged AI-generated elements through inpainting, with video evidence of about 35 regional edits. That registration illustrates a possible path, not a rule that a certain editing method or number of edits guarantees copyright.

For a commercial game, this is a practical distinction. AI-made placeholders may be replaceable; a hero character or signature piece of key art may be central to a brand and difficult to protect if it remains purely generated. A human-led design and substantial, perceptible contributions can make the protectable parts clearer, but no specific workflow guarantees a result.
Does a tool’s “you own the output” clause mean I own its copyright?
No. Such language describes the relationship between you and the tool provider; it does not decide whether copyright exists under federal law, or whether the output violates someone else’s rights.
For example, OpenAI’s Terms of Use effective January 1, 2026 state: “As between you and OpenAI, and to the extent permitted by applicable law, you (a) retain your ownership rights in Input and (b) own the Output. We hereby assign to you all our right, title, and interest, if any, in and to Output.” The qualification “if any” matters: an assignment cannot transfer a copyright that never arose. The same terms say outputs may not be unique, prohibit infringing use, and prohibit representing output as human-generated when it was not.
Check the current terms for the specific tool and plan you used, not just a marketing summary or a different subscription tier. A dataset checked October 19, 2026 reported that Leonardo.Ai and Recraft did not permit commercial use on their free plans but did on paid plans; Meshy permitted commercial use on its free plan with attribution; and Scenario and PixelLab permitted commercial use on free and paid plans. Those are time-sensitive examples, not a substitute for the terms that apply to your account when you ship.

The exact current grant should be verified in Midjourney’s live terms before release. More generally, check for commercial-use limits, attribution requirements, rights in inputs and outputs, and any permission for the provider to use your material.
Can AI-generated content still infringe someone else’s rights?
Yes. Permission from the AI provider is not permission from the owner of a character, logo, recording, or other protected material that an output may reproduce. Avoid prompting for or shipping recognizable third-party characters, logos, or a real person’s face or voice unless you have the necessary permission. A general resemblance in style is not usually copyrightable by itself, but copying protected expression can create legal risk.
The Copyright Office’s May 9, 2025 pre-publication report on AI training says: “Such outputs likely infringe the reproduction right and, to the extent they adapt the originals, the right to prepare derivative works.” That is the Office’s position in that report, not a court ruling that settles every output or training dispute. A game developer’s exposure depends on the material used and the facts of the particular case.

Several prominent training-data cases are not direct rulings about game assets. In Bartz v. Anthropic, the court found fair use for training on lawfully obtained books but not for pirated library copies; final approval of a class settlement followed on July 20, 2026. In Kadrey v. Meta, the court granted summary judgment for Meta on the record before it on June 25, 2025. In Thomson Reuters v. ROSS, the Third Circuit found no fair use for a competing legal-search tool on September 29, 2026. None establishes a blanket answer for AI-generated video-game content.

Those disputes concern allegations about the service and its outputs, not a final finding that every AI-generated asset infringes. Getty Images v. It is a UK case with a limited scope, not a general U.S. rule.
What must I disclose on Steam, itch.io, and other stores?
Store approval and disclosure are separate from copyright ownership. Steam and itch.io have explicit generative-AI disclosure mechanisms, but their categories differ. If you publish on both, answer each form according to that store’s wording rather than assuming one disclosure covers the other.
Steam: distinguish shipped content from development assistance
Steam has accepted games containing generative-AI content since January 2024 through its Content Survey. Valve narrowed the relevant question in an update reported by GamesIndustry.biz on January 19, 2026: “Efficiency gains through the use of these tools is not the focus of this section. Instead, it is concerned with the use of AI in creating content that ships with your game, and is consumed by players. This includes content such as artwork, sound narrative, localisation, etc.”
Steam’s two practical categories are Pre-Generated content made with AI during development and shipped in the game, and Live-Generated content created with AI while the game runs. Think of fixed art, audio, dialogue, or localization as pre-generated; runtime-generated dialogue or images fall under live-generated. Valve says live-generation disclosures must explain guardrails for preventing illegal content. Its prerelease reviewers assess AI output the same way they assess other content, and Valve says much of a developer’s disclosure will appear on the game’s store page.
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
Disclose player-facing assets such as sprites, textures, character art, voices, music, narrative, localization, and store or promotional assets such as capsule art and trailers, as described in reporting on the updated survey. Coding assistants, debugging, and internal reference images that never ship are not the focus of this Steam section. Make the store page and survey consistent; do not suggest that a disclosure will be hidden from customers.
Disclosure does not replace Steam’s requirement that a game contain no illegal or infringing material and match its marketing. Non-disclosure may delay review or lead to a policy violation after release, including removal of the store page or delisting, according to vbgnt’s September 24, 2026 guidance. Steam’s Content Survey and its wording can change, so check the current form before submission.

itch.io: disclose AI-generated assets and code honestly
On November 20, 2024, itch.io administrator leafo announced a “Generative AI disclosure” field on project edit pages. Selecting yes prompts creators to identify categories including Graphics, Sound, Text & Dialog, and Code, and adds an “AI Generated” tag with content-type subtags. Selecting no adds a “No AI” tag only when the creator explicitly marks it that way.
itch.io’s Quality Guidelines, accessed October 29, 2026, say generative AI includes large language models and image-generation models, while traditional game AI such as pathfinding, procedural levels, and dynamic difficulty does not require the tag. The guidelines warn that failure to tag an asset page may result in delisting, and separately discourage mass-uploading automatically generated or AI-generated product pages. The platform’s administrator has clarified that using a chatbot only for personal information does not make the project AI-generated, but code inserted into the project does count. Unlike Steam’s stated focus, itch.io’s form asks about code.
What about Apple, Google Play, Epic, and consoles?
Games made with AI tools are sold through the App Store and Google Play, but the exact current generative-AI disclosure language for Apple and Google was not established in the cited sources. Check each platform’s live developer documentation for submission and content rules rather than inferring a requirement from another store. No current Epic Games Store disclosure rule was established either; Epic CEO Tim Sweeney argued in 2025 that stores should stop tagging AI-made games, which is not itself a published store policy. Specific PlayStation, Xbox, and Nintendo eShop submission rules also are not established here.
How should I prepare an AI-assisted game for release?
Build a record of what went into the shipped game, which rights apply, and what each store asks you to disclose. The following workflow helps separate tool permission, human authorship, infringement review, and platform compliance.
- Inventory what players and customers will see. List art, sound, voices, dialogue, localization, in-game content, capsule images, trailers, and other promotional materials. Include runtime-generated material separately from fixed content.
- Check the terms for every tool and plan. Confirm commercial use, attribution, account or subscription limits, and any licence-back or training terms. Recheck close to release because provider terms can change.
- Review rights and recognizable content. Do not ship outputs depicting protected characters, brands, or real people without permission. A commercial-use grant from the tool is not third-party clearance.
- Decide where human authorship matters most. Put human creative control into the game’s identity, hero art, writing, code, and the selection and arrangement of its levels or screens. Keep human edits and contributions that are actually perceptible in the final work.
- Maintain a dated asset register. Record the tool and plan, prompt or input, material human edits, and who approved each asset for release. This record can help explain authorship and provenance to a publisher, insurer, or registration examiner.
- Complete each store’s disclosure separately. Name the relevant content categories in plain language. For Steam, account for shipped pre-generated content and live-generated output, including relevant promotional assets; for itch.io, answer the categories it asks about, including code.
- Prepare any copyright registration accurately. The Copyright Office’s 2023 registration guidance remains in force. Applicants must disclose more-than-de-minimis AI-generated content and briefly explain human contributions; the AI-generated material should be excluded from the copyright claim. Omission can risk cancellation and, in litigation, a court disregarding a registration under 17 U.S.C. § 411(b).
- Align agreements with contractors and collaborators. State disclosure obligations for AI use and address assignment of rights that exist, a backup licence or waiver for unprotectable portions where appropriate, and indemnity language that specifically addresses AI outputs. A work-for-hire or assignment clause cannot manufacture copyright in material that has none.
- For live generation, document safeguards. Explain the guardrails in Steam’s survey and plan for player reports of problematic output through the Steam overlay. Store disclosure does not replace the obligation to prevent illegal or infringing content.
- Keep descriptions consistent across storefronts. The facts should match even when the forms and labels differ. If your store page describes AI use, make sure the relevant survey or disclosure says the same thing.
Does using AI affect a game’s commercial prospects?
Available storefront data show that AI disclosure has become common, but reported correlations do not establish that a label causes weaker sales or reviews. They are not a reason to hide required information; inaccurate or evasive disclosure can prompt backlash and platform consequences.
The GDC’s 2024 State of the Game Industry survey, reported by Perkins Coie and Legal 500 in 2025, found that 49% of more than 3,000 surveyed game developers used generative-AI tools at work; the reported figures were 21% of game designers and 16% of visual artists. Totally Human Media counted nearly 8,000 Steam games disclosing generative-AI tools as of July 2025; about 60% of those disclosures mentioned visual asset generation. A separate July 2025 estimate put disclosed games at 7% of Steam’s library, up from 1.1% the year before.
A census of 53,597 Steam games from July 2023 through July 2026 by Sulka Haro found AI-flagged launches rose from about 13 per month before the disclosure mandate to about 530 per month; by mid-2026, the author estimated roughly one in three new releases carried a genuine AI disclosure at submission. A separate Q2 2026 estimate put AI-flagged games at 33% of new releases and 10% of estimated sales. Those figures use different methods and describe flagged releases, not proof that AI caused any commercial result.

Game Oracle’s December 2025 analysis of 9,879 paid Steam releases from January through October 2025 found that 17.9% had an AI declaration. After controlling for experience, publisher, type, and month, AI use was associated with 52.6% fewer first-month reviews; the authors cautioned that unmeasured marketing and skill could bias the result. Separately, Totally Human Media estimated that 10,258 disclosed games had grossed $660 million, using a reviews-times-price-times-35 calculation; this is an estimate, not Valve sales data.
Even snapshots of a festival can disagree: October 2026 reporting counted 2,595 of 7,145 Steam Next Fest listings with disclosures, while another count found at least 1,054 of 7,164 demos. The counts use different methods and denominators. Taken together, this evidence can describe adoption and correlation, but it cannot show that a disclosure label itself caused weaker traction. Small productions may face commercial challenges regardless of whether they used AI.
What changes outside the United States?
Copyright rules are territorial, and the U.S. human-authorship position should not be treated as a universal rule. The United Kingdom has a provision in section 9(3) of the Copyright, Designs and Patents Act that can credit the person who made the arrangements for a computer-generated work. A 2026 UK government process could change that protection, so verify current UK law before relying on it.
Secondary legal reporting describes the European Union as also requiring human authorship for copyright in purely generated works. China’s Wuhan court issued a September 23, 2026 decision protecting an AI-assisted short drama, but that is not a U.S. copyright rule. A Tokyo District Court decision on September 30, 2026 concerned publicity rights in AI-style narration involving a voice actor, not authorship of game assets. For a game sold internationally, consider local copyright, likeness, privacy, and consumer rules as distinct questions.
What is the safest practical conclusion?
A U.S. developer can generally sell a generative-AI game, but should not treat commercial-use permission as proof of copyright ownership or proof that every asset is cleared. Check the current plan terms, avoid unauthorized third-party material, disclose shipped and runtime AI content as each store requires, and preserve records of the human work behind the game. The Copyright Office’s AI hub and Steamworks Content Survey are useful places to recheck because guidance and forms can change.
The law does not currently specify a universal amount of editing that makes AI output copyrightable. The D.C. Circuit affirmed the refusal to register a work listing an AI system as sole author in Thaler v. Perlmutter on March 18, 2025, and the Supreme Court denied review on March 2, 2026. That confirms the human-authorship requirement, not a precise threshold for human involvement. Allen v. Perlmutter, involving Jason Allen’s AI-assisted artwork, remained pending on the merits as of mid-October 2026.
Frequently Asked Questions
Does “public domain” mean I can use any AI-generated asset without checking it?
No. Lack of copyright in a purely generated asset does not erase rights in material it may reproduce, a trademark it may display, or a person’s likeness or voice. Review the output and its source context before shipping.
Can a publisher or contractor promise me exclusive rights to AI-generated art?
An agreement can allocate rights the parties actually have and may grant contractual permissions, but it cannot create a federal copyright in purely AI-generated material. Ask counsel to distinguish ownership, licence, exclusivity, and infringement indemnity in the contract.
Can I register a whole game if it contains AI-generated assets?
A mixed work may be registered for its eligible human-authored material, but applicants must disclose more-than-de-minimis AI material and identify the human contribution. The claim should not imply ownership of generated portions that are not copyrightable.
Does a platform’s AI tag prove the game is legally cleared?
No. A platform tag is a disclosure, not a copyright licence, infringement ruling, or promise that a submission complies with every law. Store review and rights clearance are separate responsibilities.
