Yes, you can protect substantial human-authored game code and creative assets even when generative AI is part of the workflow—but you cannot copyright a game idea, rules, algorithm, or method of play. The safest approach is to classify every component, preserve a dated record of human contributions and licenses, disclose more-than-de-minimis AI material in registration applications, and prepare evidence before a dispute. A DMCA notice can address online copying, but it does not prove ownership or guarantee removal. This U.S.-focused guide shows how to build that protection without claiming rights in material your studio did not create or license.
What parts of a game can copyright protect?
Copyright protects original expression fixed in a tangible form. In a game, that can include copyrightable source and object code, dialogue, story text, character and environment artwork, animations, music, sound recordings, cinematics, interface graphics, manuals, and promotional images. Protection applies to the expressive choices embodied in those materials, not to the underlying game concept.
The U.S. Copyright Office states that “Copyright does not protect ideas, concepts, systems, or methods of doing something.” It likewise says, “The idea for a game is not protected by copyright.” A title, rules of play, scoring system, game mechanic, algorithm, or functional method may be commercially important without being copyrightable as such. Patent, trademark, trade-secret, contract, or other legal theories may be relevant, but they are separate analyses.
| Bucket | Typical game examples | Copyright posture | What to preserve |
|---|---|---|---|
| Human-authored expression | Original code architecture, hand-written implementation, dialogue, concept art, music, cinematics | Potentially protectable to the extent the work contains original expression | Repository history, source files, contributor records, dated drafts and release builds |
| AI-generated or AI-transformed material | Generated textures, images, code fragments, voices, music, or edits made through a model | Depends on human creative contribution, tool terms, and the specific work; disclose qualifying AI material in registration applications | Tool identity and terms, prompts and outputs where relevant, review notes, human edits, acceptance or rejection decisions |
| Idea, system, or method | Game premise, rules, mechanics, algorithms, balancing formula, functional layout | Not protected by copyright as an idea or method of play | Business-confidentiality controls and any separate contract, patent, trademark, or trade-secret analysis |
Apply the three-bucket inventory separately to every component rather than labeling an entire game “AI-made” or “human-made.” A studio may own strong rights in its dialogue and manually authored code while having limited or no copyright claim in an AI-generated texture or a familiar gameplay mechanic.

How should a studio inventory code and assets before release?
Start with a component register that identifies who created each item, how it was created, what rights were obtained, and what was shipped. Do not claim ownership over stock, open-source, contractor, licensed, or model-generated material without checking the applicable terms.
Record the codebase
- List engines, middleware, libraries, copied snippets, generated boilerplate, scripts, shaders, tools, comments, and data files.
- Identify original human architecture, naming, structure, implementation decisions, and comments that contain creative expression.
- Record employee and contractor assignments, work-made-for-hire terms where applicable, and licenses for third-party code.
- Separate confidential source repositories from public binaries, demos, and build artifacts.
Record each asset family
- Dialogue, lore, quests, subtitles, and manuals.
- Character sheets, environments, textures, models, rigs, animations, UI, icons, and promotional screenshots.
- Music compositions, sound recordings, voice performances, and cinematic sequences.
- Marketing art, trailers, store descriptions, and other fixed materials.
For every item, mark whether it is wholly human-authored, AI-assisted, supplied by a third party, or merely an unprotectable idea or function. This register prevents an overbroad claim later and tells counsel which deposits and agreements matter.
What evidence proves who created a game asset?
Preserve provenance continuously; reconstructing it after a dispute is slower and less reliable. The goal is to show what existed, who contributed, which tool or source was used, what human decisions changed it, and what version reached players.
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
Maintain dated production records
- Keep repository commits, branches, pull requests, issue discussions, and release tags with reliable timestamps.
- Retain design documents, sketches, layered source files, intermediate exports, edit histories, and asset manifests.
- Save contributor agreements, invoices, assignment clauses, licenses, model terms, and notices required by open-source or stock providers.
- Archive prompts and outputs when they help explain an AI-assisted contribution, along with review notes describing meaningful human selection, arrangement, or modification.
- Document when generated material was accepted, materially edited, rejected, or replaced.
Control access
- Use least-privilege permissions for source repositories and asset storage.
- Keep access logs and promptly remove former staff and contractor access.
- Store secrets outside public builds and do not distribute source maps or debug packages unnecessarily.
- Hash or otherwise preserve release files so the shipped version can be identified later.
These practices are evidence-management recommendations, not a universal statutory checklist. They make it easier to distinguish independent creation, licensed content, and unprotectable similarities from copying of protected expression.
Can I copyright my game code?
Copyright can cover original expression embodied in computer software. The Copyright Office explains that protection extends to “all the copyrightable expression embodied in the computer program,” while it is unavailable for “ideas, program logic, algorithms, systems, methods, concepts, or layouts.”

The Office treats source code and object code as two representations of the same program and recognizes original authorship in program statements or instructions. That does not mean every line is protected. Functional requirements, dictated elements, commonplace interfaces, short phrases, and unoriginal or copied code can limit the scope of a claim. Comments and data can contribute when they contain sufficient original authorship, but generated boilerplate should not automatically be described as a studio’s protected expression.
Preserve the human-authored architecture and implementation decisions that give the program its expressive structure. Keep clean records showing which portions came from employees, contractors, open-source projects, vendors, or AI tools. A registration or lawsuit protects only the copyrightable expression actually owned; it cannot convert an algorithm or game mechanic into exclusive rights.

AI use is not automatically disqualifying. The Copyright Office recognizes protection for sufficient human-authored expression and for creative human selection, arrangement, or modification. A bare prompt, by itself, generally does not establish the human authorship needed for the generated material.
Evaluate each image, texture, model, animation, voice, or musical passage separately. A human-created composition that incorporates a generated element may have protectable human expression in the arrangement, edits, or surrounding original material even if the raw output is not claimed. Keep the unedited output and every significant human revision so the registration application can accurately identify what the studio is—and is not—claiming.
Tool terms also matter. Review whether the provider grants commercial rights, reserves rights in inputs or outputs, restricts certain uses, requires attribution, or offers contractual indemnity. “Commercially safe” or “indemnified” is a contract promise to interpret under its wording, not a universal conclusion that every output is noninfringing or copyrightable.

When should a studio register a game or its code?
Registration is strategic evidence, not a way to protect an unprotectable idea. For important works, use the Copyright Office’s computer-program and game-registration materials, including Circular 61, which addresses computer programs, video games, object code, trade secrets, screen displays, user manuals, and derivative programs.

- Identify the work, publication status, claimants, authors, and ownership chain.
- Describe the human-authored contribution: for example, original code, dialogue, artwork, arrangement, or modifications.
- Disclose AI-generated content that is more than de minimis and exclude that material from the claimed human authorship where appropriate.
- Do not list an AI technology or its provider as an author or co-author merely because it was used.
- Prepare the required deposit with attention to confidential source code, object code, trade secrets, screen displays, and any applicable redaction or limited-disclosure procedure.
Registration strategy depends on the work, publication date, deposit, ownership chain, and the facts of the AI contribution. Have counsel review a high-value title, disputed authorship, employee or contractor contributions, or extensive generative-AI use before filing.
How can a studio secure confidential code and assets?
Copyright records ownership of expression, but prevention also depends on security and contracts. Use a written access policy that covers repositories, build servers, asset stores, model accounts, and external vendors.
- Require individual accounts, multi-factor authentication, and role-based permissions.
- Limit production credentials and rotate them when staff or vendors leave.
- Separate internal source, licensed libraries, and public build outputs.
- Prohibit uploading confidential code, unreleased art, personal data, or third-party restricted material to a model unless the tool’s terms and the studio’s agreements permit it.
- Record approvals for external AI services and retain the version of their terms in force when material was created.
Confidentiality controls may support trade-secret arguments, but they do not create copyright in a game idea or method of play. Use the legal theory that fits the asset and the conduct involved.

- A chronology showing creation, access, publication, and any communications.
Do not publicly accuse another developer based only on visual similarity or a model’s output. First rule out independent creation, licensed or stock assets, open-source components, common genre elements, and unprotectable mechanics. Public statements can complicate settlement and may create separate commercial or legal exposure.
Can I send a DMCA takedown for stolen game assets?
You can send a notice for qualifying online infringement, but a notice is not a court finding and does not guarantee removal. Section 512’s safe-harbor system depends on statutory conditions and cooperation between service providers and rights holders.
Include the required assertions
- An authorized physical or electronic signature.
- Identification of the copyrighted work claimed to be infringed; identify registrations when available.
- Identification of the allegedly infringing material and information reasonably sufficient to locate it, such as exact URLs or account and file locations.
- Your contact information, including a usable email address and other required details.
- A statement that you have a good-faith belief the challenged use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information is accurate and that you are authorized to act for the owner.
Send the notice to the service provider’s designated agent using its current published procedure. Keep a copy of the notice, attachments, delivery record, and the evidence supporting each assertion. An incorrect or overbroad notice can trigger a counter-notice, delay a legitimate claim, or create legal and commercial risk. Obtain counsel’s review when fair use, licensed material, employee or contractor ownership, jurisdiction, or major business impact is uncertain.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. What if an AI tool copies my code or assets?
Separate three questions: whether the material is yours, whether the output reproduces protected expression, and which party may be responsible. Preserve the input, output, model and service terms, timestamps, and the comparison before requesting removal or making accusations.
- Identify the exact protected expression allegedly reproduced and confirm your ownership or license.
- Check whether the similarity is functional code, a common mechanic, a short phrase, a style, or another unprotectable element.
- Compare the output with your source and public releases, documenting substantial similarities and any evidence of access.
- Review the tool’s complaint, indemnity, confidentiality, and dispute procedures.
- Ask counsel whether a provider complaint, platform notice, negotiated resolution, or litigation is appropriate.
Do not assume that a model producing similar code proves that it ingested your repository or that the user knowingly copied it. Access evidence and the scope of protected expression remain critical.

What AI copyright issues are still unsettled?
U.S. policy is developing. The Copyright Office received more than 10,000 comments in response to its 2023 artificial-intelligence notice of inquiry. Part 2 of its AI report on copyrightability was published January 29, 2025. A pre-publication Part 3 report on generative-AI training was released May 9, 2025.
Open questions include when training-data copying is infringing, what evidence proves access, when an output infringes a particular work, and how responsibility should be allocated among model developers, system integrators, and end users. The training report explains that dataset creation can involve reproducing works through downloading, transferring, converting, and modifying copies. Those questions are not settled across all tools, uses, or jurisdictions.
Because law and vendor terms can change, review the current contract and obtain jurisdiction-specific advice for a commercial release or dispute. A tool’s marketing statement cannot replace that analysis.

- Build the three-bucket inventory for code, scripts, art, audio, UI, cinematics, marketing, and builds.
- Export and preserve repository history, source files, asset manifests, contributor agreements, and release dates.
- Review every AI tool’s current terms, confidentiality settings, commercial-use rules, attribution requirements, and indemnity language.
- Close repository gaps with individual accounts, multi-factor authentication, least privilege, access logs, and offboarding procedures.
- Document meaningful human selection, arrangement, and modification of AI-assisted material.
- Ask counsel which high-value works merit registration and how to describe and exclude AI-generated content.
- Prepare a notice template and evidence packet, but have counsel review any real DMCA notice involving uncertainty or major commercial stakes.
Frequently Asked Questions
Does a game title have copyright protection in the United States?
A game title is not protected by copyright. Trademark law may protect a distinctive title used to identify a source of games or related goods and services, subject to a separate clearance and registration analysis.
Can I use an AI-generated asset if the tool’s terms say I own the output?
Contractual output rights do not guarantee that the output is original, noninfringing, or registrable. Check restrictions on inputs, similar-output claims, attribution, confidentiality, and indemnity, and keep records of the human edits and the terms in force when you created the asset.
Do I need to register every game asset separately?
No single filing strategy fits every studio. Grouping, publication status, deposit requirements, ownership, and the value of the work affect the choice; a copyright attorney can identify efficient registrations without claiming uncopyrightable ideas or raw AI output.
What happens after a platform receives my DMCA notice?
The provider may remove or disable access and notify the poster, who can submit a counter-notice. The dispute can continue if the claimant pursues a court action, so preserve evidence and be prepared to substantiate ownership and the specific expression at issue.
