Treat every AI-generated game asset as an uncleared draft until your studio can show how it was made, what rights apply, what a human changed, and how it will be disclosed at release. A prompt is not a licence, a provider’s ownership clause is not a universal copyright grant, and a model’s output can still resemble protected work or an identifiable performer. Art, code and voices require different checks: copyright and similarity review for images, licence and security review for code, and specific written performer consent for synthetic voices. Store the tool and model details, accepted terms, source material, human approvals, scans, contracts and release disclosures in an asset record. The exact result depends on the jurisdiction, provider, performer agreement, game platform and whether generation is pre-rendered or live.
What does human authorship change?
In the United States, the Copyright Office’s 2025 report says generative-AI output can receive copyright protection only where a human author has determined sufficient expressive elements. Prompts alone generally do not supply that authorship. Human selection, arrangement, compositing, drawing, editing or other expressive modification may protect those human-authored portions, while the raw generated material may remain outside the studio’s exclusive copyright.
This is a U.S. framework, not a worldwide rule. Registration, ownership and infringement standards differ by country, and copyright is only one part of clearance. A generated asset can create publicity, unfair-competition, confidentiality, privacy, trademark or contract problems even when no copyright claim would succeed. Record the human contribution instead of assuming that the tool’s terms settle the question.
The Copyright Office received more than 10,000 comments in its 2023 AI inquiry, illustrating how quickly the policy landscape is developing. A release decision should therefore identify the relevant country, edition, provider terms and date rather than rely on a generic statement that AI content is legal.

How do art, code and voices differ?
Use the same basic gate for every asset, but change the evidence you demand for each medium.

How do I clear AI-generated art?
Clear art in stages. Concept art used only inside the studio presents a different exposure from final game art, store graphics or a character that deliberately resembles a real person.
- Classify the asset. Mark it as concept art, final in-game art, user interface, promotional material, text or a derivative of existing intellectual property. Note whether it will appear in a store listing, trailer, social post or downloadable content.
- Archive generation facts. Save the provider, model or feature name, version, generation date, accepted terms, commercial-use status and meaningful settings. Keep the prompt and reference inputs when doing so does not expose confidential material.
- Show human direction. Retain the brief, rejected options, chosen variants and edit history. Identify meaningful painting, masking, compositing, typography, layout, selection and arrangement. Register the human-authored additions separately from unmodified output.
- Remove risky targeting. Do not assume that an “in the style of” prompt is safe. Prompts aimed at a living artist’s distinctive style, a recognizable franchise character, a celebrity likeness or a protected logo require a rights basis and jurisdiction-specific assessment. No universal bright-line rule makes style imitation lawful.
- Run similarity checks. Use visual-search, character, trademark and marketplace checks appropriate to the asset. If a recognizable person, character, logo or third-party work appears, stop production and escalate; model output is not evidence that the source was independently created.
- Approve for the actual release. A marketing image may need a different review from an in-game texture. Record the approver, the intended territories, the storefronts and any disclosure or rating decision.
The U.S. Copyright Office states that including AI material in a larger human-authored work does not automatically eliminate copyright in the human-authored elements. That protection does not turn the unmodified output into a clean, exclusive asset, so the asset register should describe both portions.
Is AI-generated code safe to ship?
Generated code is safe to consider only after the same engineering and licence controls applied to human-written code. An output-ownership promise cannot cure a copied snippet, an incompatible open-source licence, a leaked secret or an exploitable defect.
- Read the tool terms first. Check output ownership or licence language, commercial-use limits, training and retention settings, output restrictions, security commitments, disclosure duties, model updates and any indemnity. Save the terms that applied when the code was generated.
- Keep sensitive material out. Do not paste credentials, confidential source, unreleased designs, personal data or proprietary partner material into a service without an approved data-handling basis. Document notices, consent where required, access controls, geographic processing, retention and deletion.
- Review the implementation. A named engineer must understand and approve the code. Run ordinary tests, security review, dependency and licence scans, secret detection and static analysis. AI assistance does not replace those controls.
- Investigate matches. Search for copied or substantially similar snippets and record the scan result and reviewer decision. A scanner can detect only material in its database or rules; a no-match result is not proof of originality.
- Preserve third-party notices. If a dependency or snippet is identified, keep its copyright notices and licence files. Apache guidance says a contributor must be legally entitled to grant the project licence and must address third-party material and compatible terms before contributing it.
- Record responsibility. Store the engineer’s name, tool and exact version, repository commit, review date and any disclosure required by the project or open-source distribution. Tool terms can restrict rights needed for an open-source contribution even when internal commercial use is permitted.
What permission is needed to clone a voice?
An identifiable performer’s synthetic voice needs a separate, specific consent workflow. Copyright analysis alone is insufficient because voice imitation can implicate publicity, privacy, unfair-competition and labour-contract rights.

Put consent in a conspicuous written agreement
SAG-AFTRA’s February 2026 interactive-digital-replicas bulletin says consent “Must be put in writing in a clear and conspicuous manner.” Use a separately signed or initialled provision, not a buried generic AI clause. Identify the performer, project or code name, genre, character and role; describe the dialogue context, media, territories, term, sensitive content, role size and whether generation can be real-time.
Define the commercial and technical scope
State compensation and residual or reuse treatment, permitted recordings, model training, retention, deletion, security, sublicensing, marketing, sequels, expansions and franchise transfers. Specify who may operate the system, whether a human must approve output, and what happens if the performer suspends or revokes permission. A pre-rendered line, an interactive system and real-time generated dialogue are materially different uses.

SAG-AFTRA distinguishes visual and vocal digital replicas and gives special treatment to real-time generated dialogue. Its 2025 Interactive Media Agreement was approved by a 95.04% to 4.96% vote; the union reported a 15.17% increase on ratification followed by 3% increases in November 2025, November 2026 and November 2027. Those figures describe that agreement, not a universal rate card. The contract governing your performer and territory controls.
Plan for disclosure and complaints
Decide whether players will hear an on-screen, in-dialogue, store-page or other clear notice that content is synthetic. Provide a route to report impersonation or harmful output, and keep a suspension procedure if a consent limit is exceeded.
Which provider and data records should a studio keep?
Archive the terms and privacy documentation in force for every production asset. Microsoft’s provider code describes an operational baseline: input and output controls, synthetic-media disclosure, necessary notices and consents, testing, human oversight, feedback channels and security.

- Commercial-use and ownership language, output restrictions, training-use choice, retention and deletion controls.
- Inputs, reference files and personal-data categories, with the lawful basis and notices used.
- Geographic processing, subprocessors, access permissions, encryption or other security commitments.
- Human reviewer, edits, similarity or licence scans, exceptions and final approval.
- Indemnity scope, auditability, model-update notices and the exact terms snapshot.
For voices and other personal data, document the lawful basis, notice, consent, retention, deletion, access control and vendor decisions. GDPR and state-law answers depend on jurisdiction and deployment; obtain local legal advice rather than applying one universal checklist.

What do platforms and EU rules require?
Roblox distribution
Roblox says third-party AI output remains the developer’s responsibility and must follow its Community Standards. Extended AI interactions can trigger a content-maturity disclosure and a Restricted label. Its Creator Hub gives this example: “This is an AI-powered conversation, not human. It may make mistakes.” Apply the current moderation, reporting and maturity requirements to the shipped experience, not merely to the model.
Google Play distribution
Google Play’s AI-content policy requires compliance with existing safety rules, prevention of restricted or deceptive content and an in-app mechanism for users to report or flag offensive output. A game that generates content after installation needs controls for the output players can request, not only a review of the initial build.
EU-facing releases
Article 50 of the EU AI Act applies from 2 August 2026. Providers must support machine-readable marking of synthetic audio, image, video or text that is detectable as artificially generated or manipulated. Deployers must clearly disclose qualifying deepfakes. The European Commission describes maximum figures of up to €15 million or 3% of total worldwide turnover for specified Article 50 violations, subject to proportionality and enforcement context; certain pre-existing systems have a limited grace period for marking obligations.
Other storefronts and consoles have their own agreements, content-rating questionnaires, AI disclosure rules, reporting duties and restrictions on deceptive or impersonating content. Passing one platform’s review does not establish compliance elsewhere.

How can a studio prove an asset was cleared?
Build a release packet that a producer, counsel or platform reviewer can follow without reconstructing the project from chat logs.
- Rights basis: identify the copyright, licence, publicity, performer contract, trademark, confidentiality and privacy grounds.
- Provenance: record provider, model, version, date, inputs, terms and any third-party material.
- Human contribution: preserve briefs, prompts where appropriate, edit history, code reviews, compositing and approvals.
- Similarity and licence review: attach visual searches, code scans, dependency notices and documented decisions on matches.
- Consent: attach voice or likeness agreements with scope, compensation, retention, deletion, marketing and real-time limits.
- Privacy and security: show notices, lawful basis, access controls, subprocessors and deletion tests or confirmations.
- Platform decision: record moderation, reporting, maturity, rating, watermarking and disclosure requirements for each target storefront.
- Named sign-off: assign an accountable producer or legal approver, the release build, territories and an expiry or re-review date when terms or models change.
Keep the packet with the asset identifier and repository or build reference. For live services, repeat the review when a model, prompt, voice scope, provider terms or user-facing behavior changes.

Do not ship until every applicable answer is recorded as yes, no with a documented exception, or not applicable with a reason:
- Is the asset’s purpose, territory, platform and release build identified?
- Are provider terms, model version, commercial rights, retention and training settings archived?
- Are inputs and third-party materials known, permitted and checked for confidentiality and privacy?
- Can the studio show meaningful human selection, editing, engineering review or performance direction?
- Were visual, character, trademark, code, dependency and security checks completed where relevant?
- Does every identifiable performer have clear, conspicuous, scope-specific written consent?
- Are deletion, revocation, suspension and incident contacts assigned?
- Are storefront, rating, reporting, watermarking and EU disclosure obligations satisfied?
- Has a named approver accepted the residual uncertainty and attached the evidence?
This gate does not make risk disappear. It turns an opaque model output into a traceable production decision that can be corrected before launch.

Can a prompt by itself give me copyright in a game image?
Generally not in the United States. The Copyright Office’s 2025 guidance treats prompts as instructions rather than sufficient human authorship; protection is more plausible for human-determined expressive elements such as selection, arrangement or substantial editing. Other countries may apply different tests, so register the human additions separately.

What if the AI provider changes its terms after we generated the asset?
Keep a dated copy of the terms and privacy notice accepted at generation, plus the asset’s model and account details. Recheck the provider before a major update, sequel or new territory; a later permission cannot reliably cure a restriction that applied when the asset entered production.
Can I use a synthetic voice for an anonymous NPC without hiring an actor?
An unidentifiable voice may reduce publicity risk, but it does not eliminate provider, privacy, contract or platform duties. Confirm that the source recordings and model licence permit the use, avoid resemblance to a real performer, and document a human review and disclosure decision.
Do EU marking rules apply to a game sold only outside Europe?
The Article 50 assessment turns on the system’s EU-facing deployment and the roles of provider and deployer, not simply where the studio is incorporated. If the game can reach EU users, obtain a jurisdiction-specific assessment and design machine-readable marking and clear deepfake disclosure where the rule applies.

Keep versioned prompts or policies, model and provider changes, consent scope, safety filters, user reports, moderation actions and each public disclosure. Tie every change to a build or configuration identifier so the studio can show what players encountered at a particular time.
