Sharing leaked game footage can trigger a copyright takedown, a platform strike, an order forcing a platform to identify you, civil damages, and—depending on the country and how the material was obtained—criminal or anti-circumvention charges. You do not need to be the original leaker: reposting, mirroring, clipping, reacting over, or using a leaked frame as a thumbnail can reproduce and distribute the publisher’s unpublished audiovisual work. The lowest-risk coverage pattern is to report that a leak occurred, quote the publisher’s response, and show no leaked frames.

For creators who already uploaded footage, deleting it before a notice arrives is the most valuable immediate step. A counter-notification is not a casual appeal; it is a sworn legal filing that gives the claimant your real name and address.

What happens first after you share leaked game footage?

The first consequence is usually a platform or publisher takedown, not a lawsuit. The practical risk stack is:

  1. Removal: a rights holder sends a copyright notice to the host, which removes the video, post, file, or message.
  2. Account penalties: YouTube can issue a formal copyright strike; Discord, X, file hosts, and search services have their own removal and repeat-infringer systems.
  3. Identity disclosure: a publisher can seek a court-ordered DMCA subpoena for account, payment, IP, or registration records.
  4. Civil claims: a rights holder may seek an injunction, actual damages, profits, or statutory damages.
  5. Additional or criminal exposure: obtaining a build by bypassing access controls can add a DMCA anti-circumvention claim, while some countries treat large-scale network distribution as criminal copyright infringement.

Enforcement is not proof that every post will be pursued, and no published rate shows how often ordinary Western reuploaders are personally sued. It does mean that a clip surviving for days or weeks is not evidence that it is authorized.

Can you get a copyright strike for posting a GTA 6 leak?

Yes. On YouTube, a copyright strike is different from a Content ID claim. A claim is an automated match that may leave a video online while the claimant monetizes, tracks, or geo-blocks it. A strike follows an accepted legal removal request: the video is removed and the channel’s enforcement history changes.

YouTube’s strike ladder

  • One active strike: the video is removed. You must complete Copyright School before the 90-day expiration clock starts.
  • Two active strikes: another removal occurs and restrictions become more severe. A live-stream removal can suspend live access; published explanations cite seven days for a first live hit and 14 days for a second.
  • Three active strikes in 90 days: YouTube can terminate the channel, make its uploads inaccessible, and block replacement channels under its repeat-infringer rules.

TeamYouTube stated on 22 October 2026: “If someone uses your copyrighted work without permission, you have the rights to submit a copyright takedown request. After YouTube reviews and accepts the request, the infringing video is removed, and the channel receives a formal copyright strike.” Live streams are particularly exposed because the broadcast can be cut while it is running and the account can lose live privileges during the leak wave.

Other services use different labels and timelines. Discord, X, GitHub, Telegram, file hosts, and Google Search all have DMCA routes. A counter-notice generally starts a 10–14-business-day window in which the host may restore content unless the rights holder files a lawsuit; YouTube’s own process gives the claimant 10 U.S. working days to respond with evidence of a lawsuit.

Is it illegal to share leaked gameplay if you did not leak it?

Usually, the fact that somebody else obtained the file does not authorize your copy. Uploading, embedding, mirroring, clipping, or publicly displaying leaked characters, environments, interface elements, dialogue, or audiovisual gameplay can reproduce and distribute an unpublished copyrighted work.

Rockstar Games’ policy, updated 10 January 2025, states: “No pre-release leaked footage of any kind. Any posting of in-game footage from leaked copies of the game prior to its official release date will be taken down, regardless of how the game was obtained. This includes ‘early unboxing’ videos.” The wording removes the common defense that a second poster is merely reporting what was already public. It also covers early unboxing, not only gameplay.

In an August 2026 Southern District of New York exhibit, EBRAND, acting for Take-Two Interactive Software, Inc., told Discord: “The reported post contains unauthorized, leaked gameplay footage from the unreleased game Grand Theft Auto VI. This material reproduces our Client’s copyrighted, unreleased game assets and was published and distributed without any authorization from the copyright holder.” The notice requested removal of listed messages and “any and all identical or substantially similar copies, reuploads, and mirrors.”

What damages can a U.S. publisher claim?

Under 17 U.S.C. § 504(c), a copyright owner can elect statutory damages instead of proving its exact lost sales. The U.S. Copyright Office’s Circular 92 describes the following amounts per infringed work:

Situation Potential statutory award
Ordinary infringement $750–$30,000 per work, as the court considers just
Willful infringement proven Up to $150,000 per work
Innocent infringement proven The court may reduce the award to at least $200

The figures are per work, not a guaranteed bill for every view. A court decides the award, and the owner must establish the relevant infringement and, for the enhanced ceiling, willfulness. The reduced minimum applies only when the infringer proves they were unaware and had no reason to believe the acts infringed.

The Copyright Claims Board is a voluntary small-claims option with a $30,000 total cap and a smaller track under $5,000. Either side can opt out, so it does not prevent a publisher from pursuing federal court.

A Nintendo complaint against Colorado streamer Jesse Keighin, reported by Global Law Today in 2025, sought up to $150,000 per alleged copyright infringement plus $2,500 for each alleged DMCA anti-circumvention violation. It alleged at least 50 streams of pirated unreleased titles using emulators or hacked consoles and encouraging viewers toward those tools. The report did not describe a final judgment, so it is an enforcement signal rather than a decided damages award.

When does hacking or an emulator create an extra claim?

DMCA § 1201(a) prohibits circumventing a technological protection measure that effectively controls access to a copyrighted work, and separately addresses trafficking in circumvention tools. The statute is aimed at access control, not merely at the later act of reposting a clip.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Courts have used the analogy of “the electronic equivalent of breaking into a locked room in order to obtain a copy of a book.” If footage came from a stolen protected build, a hacked console, or an emulator alleged to bypass platform locks, a publisher may plead ordinary copyright infringement and anti-circumvention counts together. A person who only re-encodes a clip found online generally faces the copyright theory first; the person who broke the access control faces the additional statutory risk.

Is reacting to leaked gameplay safe if you add commentary?

Commentary can support a fair-use argument, but it does not grant permission and does not prevent an automated or legal takedown. Fair use under 17 U.S.C. § 107 weighs four factors:

  1. Purpose and character: commercial and minimally transformative uses are weaker than genuinely analytical uses.
  2. Nature of the work: a creative, unpublished audiovisual game work weighs against the user.
  3. Amount and substantiality: even a short clip can contain the work’s “heart.” There is no safe 10-second or 30-second rule.
  4. Market effect: pre-release footage can substitute for the publisher’s planned reveal or launch marketing.

The Supreme Court’s 2023 Andy Warhol Foundation v. Goldsmith decision makes a new expression less persuasive when the new use serves substantially the same commercial purpose as the original. A monetized reaction that continuously plays leaked gameplay while the host talks is therefore a weak candidate: it uses a highly creative unpublished work and can spoil the launch market.

Rockstar’s policy has no commentary carve-out. Credit, a disclaimer, or “no copyright infringement intended” language does not change the analysis. YouTube says a counter-notification is “A counter notification is a legal request to reinstate content that was removed due to a copyright removal request.” It also warns: “Only submit a counter notification if you believe that your content was removed due to a mistake. This includes misidentifications of content that may qualify for a copyright exception, such as fair use, fair dealing or public domain.”

Submitting one requires your complete physical address and legal name, a statement under penalty of perjury, and consent to federal-district-court jurisdiction. YouTube shares it with the claimant. For genuine leaked pre-release footage, that is a high-risk legal decision, not a support-ticket strategy.

Can a publisher identify an anonymous Discord or YouTube poster?

Yes, if a court grants a subpoena. In August 2026, Take-Two and Rockstar sought identifying information in the Southern District of New York from Discord and Microsoft, including GitHub, over GTA 6 leak material. Reporting also identified X and Google, including YouTube, as subpoena targets. The filings described audiovisual content, artwork, dialogue, creative elements, and media posted to Discord servers and GitHub.

Discord has said it complies with valid DMCA subpoenas, and Microsoft said it was working with the rights holders. A throwaway account can still be connected through subscriber details, recovery addresses, payment records, IP logs, device information, or linked accounts. Anonymity is therefore not a reliable legal shield.

Can you go to jail for posting game leaks?

Criminal exposure depends heavily on jurisdiction, scale, and conduct. The documented prison cases in the current record are from China, not a U.S. conviction of an ordinary fan who merely reuploaded leaked gameplay.

China’s click-count threshold

An April 2025 judicial interpretation by China’s Supreme People’s Court and Supreme People’s Procuratorate says network distribution can meet a criminal copyright threshold at at least 100,000 clicks, more than 10,000 downloads, or distribution to at least 1,000 registered members.

GamesHub reported that Shanghai’s Xuhui District People’s Court convicted two Bilibili users in 2026 for repeatedly posting unreleased footage from Genshin Impact, Honkai: Star Rail, and Zenless Zone Zero. One received one year and two months in prison, suspended; the other received one year, suspended. Their uploads exceeded 600,000 and 300,000 views, respectively, and the court used view counts even though reported illegal earnings were below the traditional money threshold.

An earlier Chengdu case involving leaked Honor of Kings character skins resulted in a three-year sentence suspended for five years and a 300,000-yuan fine. The same reporting said miHoYo had acted against more than 200 people accused of obtaining or sharing unreleased content, while Shanghai police described more than 13 million views across Bilibili, private groups, and a wiki in the related investigation.

Those outcomes do not mean a U.S. uploader automatically faces prison. They do show that “I did not make much money” is not a universal defense and that a platform’s view count can matter in some countries.

What if a takedown is wrong?

A takedown is an assertion by a claimant, not a court finding. Overbroad notices have affected legitimate reporting. Techdirt documented an X lockout involving journalist Stephen Totilo after a notice over a post showing public subpoena orders and an Xbox executive’s tweet, with no leaked footage. The account was later restored and the claim rescinded. GameStop also reported a strike over a post using an official GTA 6 press-gallery screenshot, not a leaked frame.

Section 512(f) of the U.S. Copyright Act makes a person who knowingly materially misrepresents a takedown or counter-notice liable for damages, costs, and attorneys’ fees. That rule does not make every mistaken notice actionable; knowledge and material misrepresentation matter.

If your post contains no leak, preserve the original file, timestamps, notice, correspondence, and screenshots. Check whether the image or video came from an official press gallery or public court record. Then use the platform’s dispute process or consult counsel. Do not respond by uploading the disputed material again.

What is relatively safer to publish?

These are risk comparisons, not blanket permissions:

What should you do if you already posted leaked footage?

  1. Delete the upload and every mirror you control. Self-removal before a notice prevents that copy from receiving a future strike, although it does not erase potential past liability.
  2. Stop scheduled posts and live replays. Check clips, shorts, thumbnails, community posts, cloud folders, and embeds, not just the main video.
  3. Preserve the notice privately. Keep the URL, date, claimant, affected file, and correspondence for counsel; do not republish the disputed frames.
  4. Do not counter-notify impulsively. Read the legal requirements and understand that your identity and address go to the claimant.
  5. Get jurisdiction-specific advice if contacted. A subpoena, complaint, preservation request, or demand for settlement should go to a lawyer who handles copyright in the relevant country.

How should a journalist or creator cover a leak without showing it?

Describe that unauthorized material appeared, identify the publisher’s response, quote the applicable policy, and rely on official trailers, press images, court filings, or your own text analysis. Keep screenshots of court records and official posts clearly labeled so readers can distinguish them from leaked frames. Avoid linking to mirrors, naming instructions for obtaining a build, or embedding reaction footage that reproduces the leak.

The legal record does not establish a primary NDA or trade-secret judgment against an ordinary member of the public who merely reshared a leak. Insider, tester, and contractor agreements can create separate obligations, but those facts are different from a public reuploader’s case. There is also no published statistic showing what percentage of leak videos lead to personal lawsuits, and no official Twitch-specific strike number was established here.

What is the practical bottom line?

If you have not posted the material, cover the event without leaked frames. If you have posted it, remove it and its mirrors. Treat a platform strike as a formal legal consequence, not a routine Content ID claim; treat a subpoena as an identity investigation; and treat a counter-notification as a decision that normally warrants legal advice.

Frequently Asked Questions

Can deleting a leaked video prevent a lawsuit?

Deletion can stop future views, mirrors, and a strike on that specific upload, but it does not automatically erase evidence of earlier copying or distribution. Keep the notice and seek advice if the rights holder has already contacted you.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Does making a leaked video private or unlisted make it legal?

No. Privacy settings change who can see the file, not whether you copied an unauthorized work or whether a platform can act on it. A private upload can still be reviewed under a notice or subpoena.

Can a copyright claim turn into a strike later?

Yes. A Content ID claim and a formal takedown are separate processes, and a claimant can later submit a legal removal request. The fact that a claim initially left the video online does not guarantee it will remain available.

What information should I save after receiving a takedown?

Save the notice, affected URLs, upload and deletion times, source or license records, and screenshots showing whether the material was official. Preserve them privately and avoid forwarding the disputed footage while you decide whether to contest the notice.
