Linus Torvalds owns the Linux trademark; the Linux Foundation administers the Linux Mark Institute and the sublicense program. The distinction is between referring to Linux and using Linux as a mark.
What the trademark policy covers
The Linux Foundation says Torvalds owns the registered Linux mark and that the Foundation administers its use through the Linux Mark Institute. The Foundation describes its role this way: “The Linux Foundation protects the public and Linux users from unauthorized and confusing uses of the trademark and authorizes proper uses of the mark through an accessible sublicensing program.” That is the Foundation’s statement, not a direct quotation from Torvalds.
Owning the mark, administering permissions, and enforcing trademark rights are related but distinct roles. Torvalds is the owner; the Foundation handles the sublicense program and says it may object to unauthorized or confusing uses. The policy does not mean that every appearance of the word Linux requires permission.
When you can mention Linux without a sublicense
The Foundation says members of the public may refer to a registered mark in fair use. Its FAQ specifically says journalists do not need a sublicense simply to write articles that include Linux. An ordinary descriptive reference is different from presenting Linux as the name or brand of a commercial offering.

For example, writing that a computer runs Linux is a reference to the operating system. Using Linux as a prominent part of a product or service name can instead signal a branded offering, which is the kind of use the sublicense policy addresses.
When a commercial name may need approval
The Foundation identifies marketing a Linux-based product or service to the public using Linux in the mark, and certain software-related entity names, as uses requiring an approved sublicense. Whether a proposed name qualifies depends on how Linux functions in the name and the commercial context; a domain name that contains Linux is not automatically resolved by the word’s mere presence. The Foundation FAQ addresses domain names and commercial product, service, and entity names, so check its current guidance for the specific use.

The licensed form described in the policy uses Linux as an adjective before a generic noun, such as “Linux OS,” rather than as a standalone noun or verb. For an actual company, product, service, or domain naming decision, consult the Linux Foundation’s current trademark guidance and, where the consequences matter, qualified trademark counsel.
What the sublicense provides
The Foundation describes an approved sublicense as free, perpetual, and worldwide. Sublicensees agree not to challenge Torvalds’ ownership and must comply with attribution requirements. The Foundation’s public guidance asks for Linux® at the first prominent appearance and gives this ownership statement: “Linux® is the registered trademark of Linus Torvalds in the U.S. and other countries.”

The sublicense agreement contains a separate legend for sublicensees: “The registered trademark Linux® is used pursuant to a sublicense from the Linux Foundation, the exclusive licensee of Linus Torvalds, owner of the mark on a world-wide basis.” Use the current sublicense agreement for compliance wording, since agreement terms can change. The Foundation’s program details are on its Linux mark sublicense page.
Why the title says Linus “gets tough”
The phrase points to a historical account, not a newly verified legal action. In a Linux.com article published April 19, 2002, Jon “maddog” Hall described Torvalds as wanting Linux to be used for legitimate purposes while retaining a way to object to uses considered inappropriate. Hall recounted a linuxchix.com domain dispute in which, he said, an attorney’s letter led to removal of a pornographic reference from that URL. That anecdote is Hall’s account; it should not be treated as independently established legal history.

The account illustrates why a trademark owner might act against a use viewed as confusing or damaging while leaving ordinary public discussion accessible. It does not establish a blanket rule that anyone mentioning Linux needs permission, nor does the available account identify a new trademark dispute or legal filing behind this title.

Trademark rights in the word Linux should not be conflated with rights in the penguin logo. Kernel.org’s FAQ credits Larry Ewing as the creator of Tux, the Linux penguin image. That identifies the image’s creator; it does not make Tux and the Linux word mark the same asset or establish that the word-mark sublicense grants rights to use the image.
