Use legal AI to accelerate discovery—such as generating issue lists, finding search terms, summarizing supplied documents, and organizing material. Use traditional legal research to establish what the law is, confirm that it is current and applies in the relevant jurisdiction, and support legal advice or filings. For consequential work, the safest default is a hybrid: let AI help frame and organize the search, then verify every material proposition against authoritative sources and apply lawyer judgment.
What separates legal AI from traditional legal research?
Legal AI is useful for generating or transforming information. Depending on the system and the material supplied, it can suggest issues, rephrase a question into search terms, summarize a group of cases, compare document versions, or draft a first-pass research outline. Its output is a starting point for review, not proof that a legal proposition is correct.
Traditional legal research is the process of locating and analyzing legal authority: statutes, regulations, reported decisions, court rules, and related materials. The researcher identifies the relevant jurisdiction and time period, retrieves the actual authority, checks its status and history, and determines how it applies to the facts. That work creates a more inspectable basis for a legal conclusion.
The distinction is not simply “AI versus databases.” AI may be built into a research product, and a researcher may use conventional search tools alongside an AI assistant. The important distinction is between a suggested answer and verified authority. An AI-produced summary or citation does not establish that the cited source exists, says what the summary claims, remains good law, or governs the matter.

When should traditional research lead?
Start with conventional source research when a mistake could affect a client’s rights, a court filing, or a consequential decision. The need is especially strong when the answer depends on a particular court, jurisdiction, statutory version, regulation, or procedural rule. In those situations, small differences in wording, effective date, or local procedure can change the result.
- Advice, filings, and client decisions: Build the analysis from the governing sources rather than relying on an AI response or a generated list of authorities.
- Current law: Confirm the text in force for the relevant date, including amendments, effective dates, and later decisions that affect interpretation.
- Novel or high-risk questions: Search for exceptions, adverse authority, and competing interpretations; a short generated answer may not expose those complications.
- Auditable work: When a reviewer needs to reproduce the analysis, retain the authority, relevant history, quotations, and research trail.
- Confidentiality concerns: If the proposed AI service cannot be used consistently with client, court, firm, or professional obligations, do not enter protected information into it.
South Australian professional guidance calls for checking AI outputs against current legislation, reported decisions, court rules, practice directions, client instructions, and the practitioner’s own judgment. Arizona guidance likewise says AI-generated research, citations, arguments, and documents must be independently verified. These are jurisdiction-specific examples, not a single rule that automatically governs every lawyer; apply the requirements of the relevant jurisdiction and forum.
Where can legal AI save useful time?
AI is most useful for tasks that expand, sort, or summarize material without making the final legal determination. A lawyer can use it to turn a fact pattern into candidate issues and elements, brainstorm synonyms, outline likely authority types, or generate questions to investigate. The output can help make a research plan more complete, but each suggested issue or search term still needs to be assessed against the assignment.

Once a lawyer has assembled a known set of documents, AI can help produce summaries, compare versions of a contract or pleading, cluster a large document set, or identify passages for closer review. It may also help draft a first-pass memo or organize research notes. The lawyer must check whether the summary preserves qualifications, whether the comparison catches meaningful changes, and whether the draft accurately reflects both favorable and adverse authority.

North Carolina’s 2024 ethics opinion recognizes possible AI use in discovery, document review, legal research, contract drafting, and data analysis, while emphasizing competence, security, supervision, and independent professional judgment. The Law Society of South Australia’s practice note, updated June 30, 2026, warns that generative AI is non-deterministic and cannot reliably verify its own accuracy. A second AI prompt asking whether the first answer is correct is therefore not a substitute for checking the underlying source.
How do the two approaches compare?
| Decision factor | Legal AI | Traditional research |
|---|---|---|
| Speed and breadth | Can quickly expand issues and synthesize supplied material. | Usually involves more deliberate searching, but lets the researcher inspect the source trail. |
| Authority | Can suggest relevant authorities, but may omit, misstate, or fabricate them. | Provides direct access to primary authorities and, where available, citator history. |
| Currency and jurisdiction | Depends on the system’s corpus, update cycle, and configuration. | Lets the researcher select jurisdiction-specific sources and investigate the law for the relevant date. |
| Reproducibility | Outputs can vary between runs; prompts and system versions may need to be logged. | Queries, retrieved documents, and citations can generally be reproduced more directly. |
| Confidentiality | Requires review of data governance, retention, access, and training terms. | Still depends on the databases and repositories used, but the research environment may be easier to scope. |
| Human review | Substantive output requires human verification and oversight. | Human analysis remains essential, while the source verification process is more transparent. |
| Best role | Discovery, summarization, comparison, organization, and drafting assistance. | Establishing, validating, and supporting the governing law. |
There is no reliable general accuracy percentage in the cited official guidance that establishes one method as universally more accurate. The practical question is whether the work product is supported by current authority and appropriate review, not whether a tool performs well on an abstract accuracy score.
A safe hybrid workflow, step by step
- Define the assignment. Write down the jurisdiction, relevant date range, governing law if known, client or forum constraints, and the deliverable. A question that omits these boundaries can invite a broad answer that does not fit the matter.
- Protect information before using AI. Remove unnecessary identifiers and review the service’s retention, sharing, training, access, and security terms. Confirm whether firm policy, client instructions, privilege considerations, or court obligations require an approved enterprise environment or prohibit the proposed use.
- Ask AI for discovery, not a final conclusion. Request candidate issues, elements, defenses, alternative terminology, likely authority categories, and a checklist of questions to investigate. Treat any case name, quotation, citation, or rule it supplies as a lead to verify.
- Retrieve primary sources. Locate the current statute, regulation, rule, and relevant opinions in authoritative databases or official repositories. Confirm the jurisdiction, version, effective dates, amendments, and subsequent history. Check for negative treatment and adverse authority rather than stopping with sources that support the initial theory.
- Validate each legal proposition. Match every material statement to the source that supports it. Check quotations word for word, confirm pinpoint references, and make sure the cited authority actually addresses the issue and applies in the relevant jurisdiction and procedural setting.
- Apply legal judgment to the facts. Resolve conflicts among authorities, distinguish adverse decisions, test assumptions, and identify facts that could change the result. A citation check alone cannot decide how a rule applies to a client’s circumstances.
- Record the review and any required disclosure. Preserve prompts or tool logs when policy requires, identify the human reviewer, and determine whether the engagement, applicable rules, or the nature of the delegation requires disclosure to the client.
- Deliver only reviewed work. Do not send an AI-generated draft to a client, opposing party, or court until the level of human review is proportionate to the stakes and every material claim has been checked.
How to verify an AI-generated citation or legal claim
Verification means reaching the source itself, not accepting an AI-generated citation because it looks plausible or appears in a polished answer. For each authority, confirm that the source exists, that its identifying details are accurate, and that the quoted or summarized language supports the proposition for which it is offered.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Repair Windows errors before they cause bigger problems3Scan for outdated or missing drivers - takes under a minute- Check identity: Confirm the court or issuing body, jurisdiction, date, citation, and document type.
- Read the relevant passage: Review the surrounding text, not just an isolated quotation or an AI summary. Check that any pinpoint leads to the cited proposition.
- Check status and timing: Investigate amendments, effective dates, later history, and whether a subsequent decision has limited, distinguished, or overruled the authority.
- Test fit: Make sure the decision concerns the relevant issue and procedural posture, and that its rule applies to the facts and jurisdiction in question.
- Search beyond the citation: Look for contrary authority, exceptions, and other sources the generated answer may have omitted.
If a citation cannot be located in an authoritative source, do not rely on it or pass it along as verified. If the source exists but does not support the stated proposition, correct the analysis and review any other claims derived from the same output.

What professional duties apply when lawyers use legal AI?
AI use does not transfer responsibility for legal work to the tool. ABA Formal Opinion 512, issued July 29, 2024, says lawyers using generative AI must “fully consider their applicable ethical obligations.” Its guidance addresses competence, confidentiality, communication, candor, supervision, and reasonable fees. The practical implication is to evaluate the tool and task before use, protect client information, review the output, and bill in a way that reflects the work actually performed.
Other guidance illustrates how the details can vary. The Florida Bar says lawyers remain responsible for work product and judgment, must protect confidentiality, provide accurate and competent services, avoid improper billing, and comply with advertising restrictions. It also says a client-facing AI chatbot must identify itself as AI rather than as a lawyer or firm employee. North Carolina distinguishes ordinary AI-assisted research, which generally need not be disclosed under its 2024 opinion, from substantive delegation, which can require advanced informed consent depending on the representation. New York City Bar guidance adds conflicts, client consultation, candor, supervision, fees, and discrimination to the issues lawyers should consider.
These statements should not be collapsed into one universal disclosure rule. Requirements may depend on the jurisdiction, court, engagement letter, client policy, and what work was delegated. A lawyer should check the applicable rules and guidance for the matter rather than infer that disclosure is always required—or never required—from another jurisdiction’s opinion.
Can you put confidential client facts into an AI tool?
Only after determining that the specific tool and proposed use are consistent with confidentiality, privilege, security, client, and organizational requirements. The fact that a service accepts a prompt does not establish that the service is appropriate for confidential material. Review how prompts and uploaded documents are stored, who can access them, whether they may be shared or used for training, and what deletion or retention controls apply.

Where permitted, reduce exposure by omitting names and other identifiers that are unnecessary to the task, and provide only the minimum facts needed for the requested analysis. De-identification is a risk-reduction measure, not a guarantee: a distinctive fact pattern or combination of details may still reveal a client’s identity. If policy requires an approved environment, use it; if the terms or protections cannot be established, keep confidential facts out of that system and conduct the research through an approved channel.

Early issue spotting
AI can help turn a fact pattern into a broad issue tree and suggest alternate terminology. Use the result as a checklist against the facts and applicable law, then research the issues that actually matter. Do not treat the generated list as exhaustive, and do not assume that an omitted defense or exception is unavailable.
Researching a statute or court rule
Use the official or otherwise authoritative text to identify the applicable version and effective date. AI can suggest related terms or help summarize the text once retrieved, but the lawyer should verify the language, amendments, cross-references, and applicable decisions directly.
Summarizing a known group of cases
AI may help compare holdings or organize cases the lawyer supplies. Review each case’s relevant passage and procedural context, check whether the summary omits qualifications or contrary reasoning, and independently research subsequent treatment before relying on the synthesis.

Drafting a client memo, contract, or filing
AI may assist with a first draft or comparison, but the finished document needs a lawyer’s review of facts, authority, strategy, language, and jurisdiction-specific requirements. For a filing, confirm every citation, quotation, procedural statement, and factual assertion against its source before submission.
Handling material that cannot safely be shared
If the system’s data terms or protections do not satisfy the matter’s requirements, do not use it with that information. Continue with an approved research environment, or use AI only on a suitably minimized or non-confidential version if that use is permitted.
What legal AI cannot establish by itself
A fluent answer does not demonstrate that the law is current, the jurisdiction is correct, or all relevant authority has been considered. Generative output can vary, and its apparent confidence is not a measure of legal reliability. Nor does an AI-created citation, pinpoint, quotation, or procedural description become trustworthy merely because it is formatted convincingly.

The Law Society of South Australia’s June 30, 2026 practice note states that “AI does not replace professional judgment, ethical responsibility or the duties owed to clients, courts and the administration of justice.” North Carolina’s 2024 opinion similarly says that “lawyers remain fully responsible for the use and impact of AI in the client’s case.”
A practical decision rule
Ask two questions before choosing a method: What must this work product prove? and What information can this tool safely receive? If the work product must establish the law, support advice, or go to a court, build it from verified authority and lawyer analysis. If the task is to broaden, organize, or summarize material, AI may help within a controlled workflow. When both needs are present—as they usually are in meaningful legal work—combine them, but keep verification and judgment with the lawyer.
