Kalshi is federally regulated, but that does not make every Kalshi market unquestionably legal in every state. KalshiEX operates as a Commodity Futures Trading Commission (CFTC)-regulated Designated Contract Market, and the CFTC argues that federal law gives it exclusive authority over event contracts. State regulators and attorneys general dispute that position, especially for sports-related contracts. As of October 30, 2026, lawsuits, injunction requests, appeals and platform restrictions are still changing the practical answer.
To check your own position, identify the exact contract, confirm whether Kalshi currently allows trading from your location, read the latest notice from your state gaming authority or attorney general, and check the newest court order or filing. Treat platform access as an operational signal—not a legal opinion.
What is the legally accurate answer about Kalshi?
The defensible answer is neither “legal nationwide” nor “illegal nationwide.” Federal regulators and state authorities are asserting competing jurisdiction over the same event contracts, so legality depends on the state, the contract category, the current court posture and Kalshi’s geolocation rules.

KalshiEX is registered as a CFTC-regulated Designated Contract Market. The CFTC says Congress assigned it exclusive jurisdiction over event contracts traded on designated markets and that conflicting state laws are preempted. That is the agency’s litigation position; it is not a final judicial ruling that settles every state.

State officials generally characterize at least some sports contracts as unlicensed gambling or sports betting. A user may therefore be able to see or trade a market while a state is asking a court to stop it. The reverse can also happen: a court order or Kalshi restriction can remove a market even while the broader federal dispute continues.
What does CFTC regulation actually mean?
CFTC oversight places Kalshi’s exchange activity inside the federal Commodity Exchange Act framework. It does not automatically supply a state gambling license, answer every question about a particular contract, or prevent a state from filing an enforcement action.
The CFTC’s federal-jurisdiction theory
In a May 12, 2026 filing, the CFTC argued that federal law gives it exclusive jurisdiction over prediction markets and preempts state laws as applied to CFTC-regulated markets. In a June 12, 2026 release concerning New Mexico, the agency said it was seeking a declaration that federal authority controls event contracts and conflicts with the state’s sports-betting theory.

Selig summarized that position by saying, “States cannot circumvent the clear directive of Congress.” The statement describes the agency’s view in the litigation; it is not itself a court judgment.
What federal oversight can cover
Federal rules address exchange registration, contract review, market conduct and related compliance obligations. The CFTC has also described enforcement against individual conduct: one 2026 case resulted in a $2,246.36 penalty and a five-year suspension for an insider-trading-related violation. That action illustrates federal market oversight, not a nationwide finding that every contract is lawful under every state statute.
What federal regulation does not answer
- Whether a state classifies a sports event contract as gambling under its own law.
- Whether a state license is required for a particular product or customer group.
- Whether a temporary restraining order, injunction or settlement limits trading in a state.
- Whether Kalshi’s current geolocation rule matches the latest legal development.
- How state age, tax, advertising or responsible-gambling requirements apply.
Why are states challenging prediction markets?
States regulate gambling and sports betting under their own statutes, while the CFTC regulates derivatives and event contracts under federal law. The conflict is whether a contract that pays according to a sports result is a federally regulated derivative, state-regulated wagering, or both in ways that require a state license.

New York’s position
New York’s governor and attorney general sued Kalshi, alleging that its markets meet the state’s definition of gambling and that the company operates without the required state license. The state also alleged that people aged 18 to 20 could access markets despite New York’s 21-and-over rule for mobile sports betting. Attorney General Letitia James called prediction markets such as Kalshi “gambling platforms, plain and simple.” Those are allegations in an active dispute, not a final nationwide holding.

The Congressional Research Service describes the issue as an unresolved federal-preemption and regulatory-arbitrage question. It notes that the CFTC can review or regulate event contracts under the Commodity Exchange Act, while states regulate sports gambling under separate laws. Congress has also considered statutory limits that could change the balance.
Sports betting is already legal in some form in 39 states and the District of Columbia, according to the Congressional Research Service’s 2026 summary. That patchwork makes a single national answer especially unreliable: a state may permit licensed sportsbooks while still challenging exchange-traded sports contracts, or it may treat different contract categories differently.
Does the type of Kalshi contract change the answer?
Yes. A ruling or complaint focused on sports contracts should not automatically be applied to election, culture, finance, weather or other event markets.

Identify the exact activity
Write down the state, the market category and the specific contract. Distinguish sports, elections, culture, finance, weather and other events. Do not use a sports-market answer as a rule for every Kalshi product.

Check current platform access
Sign in only through the official Kalshi service and see whether the particular market is visible and tradable from your location. Note any geolocation, identity or market-specific message. Access is useful evidence of the platform’s current operating policy, but it is not a court ruling or legal advice.

Read the state authority’s latest position
Check the state gaming or racing regulator, attorney general and relevant statute or administrative notice. Search for the exact contract category and for terms such as prediction market, event contract, sports betting, gambling, injunction and license. An agency allegation, a proposed rule and a final order have different legal effects.

Check the current court posture
Look for the newest complaint, answer, temporary restraining order, preliminary injunction, stay, appellate filing or settlement. Confirm whether an order applies statewide, only to a named party, only to sports contracts or only for a limited period. A lawsuit being filed does not by itself establish that the state will win.

Record the result and its scope
Your note should include the state, contract, sources checked, date checked and the conclusion’s scope: settled rule, agency allegation, temporary order, appeal or practical platform restriction. This prevents an old state map or a case about sports contracts from being presented as a permanent rule for all markets.
A simple verification record
- State and residence: where you are physically located when trading.
- Contract: market name, category and settlement condition.
- State sources: regulator, attorney general, statute and any notice date.
- Federal sources: CFTC release, filing or court document.
- Court status: case number if available, latest order date and whether an appeal or stay is pending.
- Platform status: visible, tradable, restricted or blocked on the date checked.

Legal documents describe different stages of a dispute. Use the label in the table below instead of treating every announcement as a final rule.

What is the current state landscape?
As of October 30, 2026, the evidence supports broad reported availability but not a reliable 50-state yes-or-no chart. A current state-by-state overview identifies contested or restricted states and warns that platform footprints can differ. Use such a map only as a starting list for primary-source checking.
The CFTC has identified litigation or federal intervention involving Arizona, Connecticut, Illinois, New York, Minnesota, Rhode Island, Wisconsin and New Mexico. The agency separately described Wisconsin actions against Kalshi and other prediction-market companies and said it sued Wisconsin to reaffirm federal jurisdiction.
The Associated Press reported on October 29, 2026, that the dispute had spread across roughly 20 states. It also reported that Utah brought criminal charges against Kalshi and its founders. Utah federal-court and appellate proceedings had not produced a final nationwide answer at that point.
These developments explain why the phrase “legal in the United States” is too broad. A useful answer must identify the state, the contract, the regulator’s theory, the court stage and the platform’s current access decision.

Calling a product a “prediction market” does not resolve the classification. Calling it “betting” does not resolve the federal preemption argument. The contract terms and controlling legal documents matter.

What should I do if Kalshi lets me trade but my state objects?
Do not treat successful sign-in or an accepted order as proof that your state permits the activity. Platform geolocation can lag a new filing, and a state case can target a market that was available yesterday.
- Save the market name, rules and access notice shown on the date you checked.
- Read whether the state action names that contract or only another category.
- Check for a temporary order, stay or appeal issued after the state announcement.
- Do not assume that a federal registration eliminates state age, tax or gambling exposure.
- If the amount is material or the legal position is unclear, obtain advice from a lawyer licensed in your state.
What can change the answer quickly?
Prediction-market legality has a short shelf life because courts can issue interim orders, agencies can publish new notices and Kalshi can change geolocation rules. A state may also amend its gambling statute or adopt a licensing framework that changes the analysis without resolving the federal question.

A current platform map can help you find questions to investigate; it cannot substitute for those primary checks.

Does a CFTC registration replace a state gambling license?
No. CFTC registration supports the federal jurisdiction argument, but states continue to argue that some contracts require a state gambling or sports-betting license. Whether a state license is required depends on the contract, the statute and the current court orders.
If sports contracts are restricted, can I still trade election or finance markets?
Possibly, but a sports-market dispute does not automatically decide every other category. Confirm that the state complaint or order covers the market you want and check whether Kalshi applies a separate geolocation restriction.
Can I rely on a third-party map showing Kalshi availability?
