Ireland’s approach has two parts: the national AI – Here for Good Refresh 2024 sets the direction for trustworthy AI adoption, while the EU AI Act imposes binding, risk-based rules on organisations that develop or use AI. For an Irish business, the practical starting point is to inventory its AI uses, work out its role and the risk of each use, check whether personal data is involved, and follow the requirements that apply to that particular system and context.

What is Ireland’s AI strategy?

Ireland’s national AI strategy is AI – Here for Good, first launched in July 2021 and refreshed in 2024. The refresh frames AI as an opportunity to improve productivity, address societal challenges and deliver public services, while retaining a people-centred approach. It is a policy roadmap rather than a substitute for binding law: businesses should read it as a signal of Ireland’s priorities, not as a checklist of legal duties in itself.

The refresh’s business-facing agenda connects adoption with responsible implementation. It includes effective implementation of the EU AI Act and participation in EU AI Board work; standards and certification; awareness and adoption support for SMEs; an AI regulatory sandbox; a National AI Research Nexus; investment in AI skills and reskilling; access to advanced computing and related infrastructure; and safe experimentation by civil and public servants.

That mix matters to businesses because Ireland is not treating AI policy as only a question of restricting harmful uses. The stated direction is to enable useful deployment while building the skills, infrastructure, oversight and regulatory capacity needed to do it responsibly. The Department of Enterprise, Tourism and Employment describes the strategy as a roadmap for using AI to unlock productivity, address societal challenges and deliver public services.

Does the EU AI Act apply to my Irish business?

Potentially, yes. The EU AI Act, Regulation (EU) 2024/1689, is directly applicable across the EU and covers both public and private uses, subject to specified exemptions. It distinguishes between organisations that provide AI systems and those that deploy them, and assigns obligations according to the system’s risk and intended use.

This means a company does not need to develop its own model to have responsibilities. A business that buys, configures or uses an AI system as part of recruitment, customer service, operations or another process may have duties as a deployer. A business placing a system on the market or putting it into service may have a different role. Some organisations may occupy more than one role across a product’s supply chain, so role allocation should be done system by system rather than assumed from the company’s general description.

The Act uses four broad risk categories. The practical effect is not that every AI application receives the same level of scrutiny: some uses are prohibited, some high-risk uses carry substantial obligations, and lower-risk applications are treated differently. Ireland’s 2024 strategy cites voice-to-text transcription, content recommendation, marketing tools and back-office administration as examples of ordinary productivity uses that are generally low or minimal risk. It identifies recruitment systems and systems controlling access to essential services such as credit or health insurance as examples that can be high risk. Social scoring and criminal-profiling uses are examples of prohibited practices.

These examples are starting points, not automatic labels for every product with the same name. Classification depends on how a system is designed, what it is intended to do and the context in which an organisation uses it. A marketing tool used to draft routine copy is not necessarily equivalent to a system that evaluates people for access to a service. Record the specific business purpose and decision process, then assess the applicable category against the Act rather than relying on a vendor’s general description or a broad “AI” label.

Application dates and what to check

The Act entered into force in August 2024 and is being applied in stages. Official Irish summaries identify AI-literacy duties from 2 February 2025 and national competent-authority and penalty arrangements from 2 August 2025. The summaries also identify later obligations concerning transparency, prohibited practices, high-risk systems, general-purpose AI and regulatory sandboxes. The detailed timetable can change as EU rules develop, so use the AI Office of Ireland’s current timetable to confirm which provisions apply to a system and when; do not assume that one date marks the start of every obligation.

For planning, businesses should connect each applicable date to a named system, accountable owner and implementation task. That makes it easier to distinguish obligations that already apply from future work and to update plans when official guidance or the timetable changes. A single company-wide “AI compliance date” is unlikely to be a reliable way to manage systems with different uses and risk categories.

What should an Irish business do first?

Build an AI inventory and assess each entry before treating adoption as either automatically safe or automatically prohibited. The inventory should cover systems supplied by vendors as well as internally developed tools, and should identify the process in which each is used.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. List the systems and uses. Record AI tools, vendors, models and the business processes in which they operate. Include systems embedded in software already used by teams, not just projects explicitly labelled “AI.”
  2. Identify the organisation’s role. For each system, determine whether the business is acting as provider, deployer, importer, distributor or another supply-chain actor. Write down who supplies the system, who configures it and who uses its output in the relevant process.
  3. Assess the use and risk. Compare the system’s purpose and actual context with the Act’s prohibited, high-risk, limited-risk and minimal-risk categories. Preserve the reasoning and evidence behind the classification, including any assumptions that would require reassessment if the use changes.
  4. Check personal-data processing. Establish whether data about identifiable people is used in training, inference, profiling, HR, customer service or automated decision-making. Where it is, carry out the GDPR analysis alongside the AI Act assessment rather than treating one as a replacement for the other.
  5. Assign controls and owners. Put appropriate literacy, human oversight, documentation, monitoring and incident escalation in place where required. Make clear who reviews outputs, who can intervene and how problems are reported.
  6. Track the relevant authorities and dates. Note the sector regulator, the AI Office’s guidance and the provisions that apply to the system. Revisit the assessment if the system’s purpose, data, level of automation or business context changes.

This is a governance workflow, not a claim that every control applies identically to every use. The point of the inventory is to make the differences visible: an organisation cannot sensibly set oversight, documentation or monitoring expectations until it knows what each system does and which role it occupies.

Who regulates AI in Ireland?

Ireland has chosen a distributed regulatory model that uses existing sector expertise. The AI Office of Ireland is the central coordinating authority and national single point of contact for the AI Act. Its functions include coordinating competent authorities, facilitating technical expertise, supporting cooperation and information sharing, and driving innovation and adoption.

Sector regulators retain relevant responsibilities according to the sector and use involved. The official list includes the Central Bank of Ireland, Coimisiún na Meán, ComReg, the Commission for Railway Regulation, the Commission for Regulation of Utilities, the Competition and Consumer Protection Commission, the Data Protection Commission, the Health and Safety Authority, the Health Products Regulatory Authority, the Health Service Executive, the Marine Survey Office, relevant ministers, the National Transport Authority and the Workplace Relations Commission.

For a business, the implication is that “the Irish AI regulator” is not necessarily one regulator handling every issue. The appropriate authority depends on what the system does and the domain in which it is used. A business should identify the sector regulator relevant to its use case as well as the AI Office’s coordinating role, and should not assume that a general-purpose AI tool has no sector-specific oversight simply because its supplier sells it across industries.

How do GDPR and the AI Act interact?

The two frameworks address related but distinct questions. The AI Act classifies AI systems and uses and sets obligations according to their risk and the roles of the organisations involved. GDPR obligations remain relevant whenever personal data is processed. A business may need to satisfy both sets of requirements for the same system.

Ireland’s Data Protection Commission is the independent GDPR supervisory authority and also has statutory functions under the AI Act. The AI Office identifies the DPC as a market-surveillance authority for certain prohibited practices and certain Annex III high-risk systems. That role does not make the DPC the only authority relevant to every AI deployment, nor does AI Act compliance settle whether a personal-data operation complies with GDPR.

Where personal data is involved, the business should document its lawful basis, transparency, data minimisation, purpose limitation, security, retention and handling of data-subject rights. It should also address human review and vendor responsibilities where relevant. Those GDPR questions should be mapped to the AI Act assessment: for example, a business should know both why personal data is used and what role it has in the AI system’s supply chain.

In practical terms, reviewing a vendor contract or a system’s technical description alone is not enough to answer both sets of questions. The organisation needs to understand the data it supplies, the decisions or outputs the system produces, how people are affected and who is responsible for each part of the process. That information supports both the data-protection analysis and the AI Act classification.

Do businesses need an AI-literacy policy?

The Irish summaries identify AI-literacy duties from 2 February 2025. Businesses should therefore make AI literacy part of their governance planning, rather than assuming that responsible use can be handled only by a legal or technical team. The appropriate training and awareness work will depend on the systems used, the people who interact with them and the consequences of their use.

For example, employees who use AI outputs in a consequential process need to understand the limits of their role and how to raise concerns; people selecting or configuring systems need to know enough to identify when the use or data changes. The key operational step is to connect literacy efforts to actual systems and responsibilities, document what the organisation has put in place, and check current official guidance for the requirements applicable to it. The available data does not establish a single prescribed course, credential or policy format for every business, so organisations should not treat a particular training product as a universal legal answer.

Where can an Irish SME get help adopting AI?

Ireland’s Digital and AI Strategy points businesses beginning an AI journey to Enterprise Ireland or their Local Enterprise Office. It also identifies CeADAR as Ireland’s National AI Hub and a one-stop shop for businesses embarking on AI adoption. The Department of Enterprise, Tourism and Employment’s 2026 strategy page lists an allocation of €1.9 million per annum for CeADAR; a funding allocation does not by itself confirm that a particular service, programme or grant is available to an individual business.

These routes can help with awareness, planning, capability building, experimentation and implementation. They are adoption supports, not substitutes for a business-specific assessment of risk, data protection, contracts or regulatory duties. Before relying on a programme, check its current eligibility and availability directly with the relevant organisation.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The 2024 strategy also includes an AI regulatory sandbox among its priorities. A sandbox can be relevant to businesses exploring regulated or novel uses, but the material available here does not establish current application rules, eligibility or how a particular company can participate. Treat it as a policy initiative to monitor through official Irish channels, rather than a guaranteed route to approval or an exemption from the law.

How should a business compare AI deployment options?

When choosing between tools or deciding whether to build, buy or continue using a system, compare the operating and compliance consequences—not just the feature list. The same tool can produce different obligations in different workflows, and changing the use may change the assessment.

  • Risk category: What is the intended use, and does the context place it in a prohibited, high-risk or lower-risk category?
  • Business role: Is the organisation a deployer, provider or another actor, and are those responsibilities reflected in supplier arrangements?
  • Personal-data exposure: What information is provided, for what purpose, and what GDPR analysis is needed?
  • Sector oversight: Which competent authority or sector regulator is relevant to the process?
  • Operational controls: What human oversight, documentation, monitoring and incident escalation are needed?
  • Timing and support: Which staged requirements apply, and are there current Irish adoption supports relevant to the project?

These questions turn a broad AI procurement decision into a reviewable decision about a particular system in a particular business process. They also help identify when a proposed change—such as using an existing tool to make or inform decisions about people—requires a fresh assessment instead of inheriting an earlier low-risk conclusion.

Frequently Asked Questions

Is there a general ban on businesses using AI in Ireland?

Ireland’s framework is not a blanket ban on commercial AI. The EU AI Act prohibits specified practices, imposes requirements on certain high-risk uses and treats other applications according to their risk and context.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Does a vendor’s low-risk label settle my company’s AI Act classification?

No. The assessment depends on the system’s purpose and how your organisation uses it. Keep your own record of the workflow, affected people and role allocation, and revisit the assessment if those facts change.

Can an Irish SME get help before choosing an AI system?

Enterprise Ireland, Local Enterprise Offices and CeADAR are named Irish routes for businesses exploring AI adoption. Their current services and eligibility can vary, so confirm programme details with the organisation before relying on a particular form of support.

Does the 2024 strategy itself make AI use lawful?

No. The strategy states national priorities and supports adoption; it does not displace the EU AI Act, GDPR or applicable sector rules. A business still needs to assess the specific system and use against the rules that apply.
