Short answer: an Indian game studio does not have one universal “video-game tax.” A contract for programming, art, QA, porting or live-ops may fit the ordinary IT-service baseline of 18% GST, while online money gaming is under a separate 28% GST regime on the relevant full face value from 1 October 2023. A genuine export of development services can be zero-rated when all export conditions are met. Imported tools and contractors can trigger IGST under reverse charge, and player winnings are a separate income-tax issue: 30% tax and 30% TDS on net winnings. The correct result depends on the contract, supply classification, customer location, place-of-supply rules, payment flow and related-party structure.
What GST rate applies to ordinary game-development work in India?
The closest official baseline for ordinary software work is 18% GST. The GST Council’s IT/ITES FAQ states, “The rate of GST on IT services is 18%” (GST Council IT/ITES FAQ). A studio’s programming, 2D or 3D art production, quality assurance, porting, maintenance, cloud implementation or live-operations support may fit that baseline when the contract is properly classified as an IT or software-development service.
That is not a bespoke rate ruling for every game-related receipt. A sale or licence of software, a platform’s service to players, advertising, a royalty, and an online-money-gaming supply can have different legal character and valuation. Read the agreement and payment flow first; do not label an invoice “game development” merely because the customer operates a game.

Does the 28% online-gaming GST apply to every video game?
No. The special regime concerns online money gaming, not every title delivered over the internet. GST Council and NACIN material records 28% on the relevant full face value, whether the game involves skill or chance, effective 1 October 2023 (GST Council/NACIN explainer).

A free-to-play game with no stake, a one-time premium game, a subscription, an advertising-funded title, a development fee or an ordinary software export should not be treated as online money gaming just because it is online. Identify whether players pay or deposit amounts that can produce winnings, what the platform supplies, and whose receipt is being taxed. The 28% rule should not be applied to a studio’s unrelated development invoice without a classification analysis.
| Commercial flow | Starting tax question | What the available data supports |
|---|---|---|
| Programming, art, QA, porting or live-ops for a client | Is it an IT/software service, and where is the recipient? | 18% IT-service baseline, subject to classification |
| Premium game, subscription or advertising-funded title | What exactly is sold and who is the customer? | Do not assume online-money-gaming treatment |
| Platform accepting stakes and paying winnings | Is it online money gaming and what is the statutory valuation? | 28% regime on the relevant full face value from 1 October 2023 |
| Player’s withdrawal from an online game | Is the amount net winnings? | 30% income tax and 30% TDS rules apply to the player’s winnings |
| Foreign engine, music, middleware or consultant | Is it an import of service, royalty or fees for technical services? | IGST/reverse charge and Section 195 analysis may be required |
How should an Indian studio handle domestic GST on development invoices?
For IT/ITES services, the official FAQ generally places the place of supply at the recipient’s location. If an unregistered recipient’s address is unavailable, it uses the supplier’s location (official FAQ). A Mumbai-registered software provider billing a Bengaluru client makes an inter-State supply, so IGST applies; the provider does not need Karnataka registration solely for that supply, according to the FAQ’s example.
Before issuing an invoice, document:
- the statement of work and deliverables;
- whether the customer is registered and the customer’s address;
- the service classification and applicable tax;
- the place-of-supply reasoning;
- milestones, acceptance and payment terms; and
- input-tax-credit records for eligible business purchases.
Invoice particulars are governed by Rule 46 of the CGST Rules. The FAQ says there is no separate invoice format solely because a payment is under reverse charge. Include the required supplier and recipient details, invoice number and date, description, value, tax rate and amount, and any other Rule 46 particulars. Keep the contract, purchase orders, delivery evidence and correspondence together in case the classification is questioned.

It can be, but a foreign billing address alone is not enough. The GST Council FAQ lists five export-of-service conditions:
Also popular on Amazon
- Ideal for Gifting
- Ideal for a bookworm
- Compact for travelling
- the supplier is located in India;
- the recipient is located outside India;
- the place of supply is outside India;
- payment is received in convertible foreign exchange; and
- the supplier and recipient are not merely establishments of the same person.
If all five are satisfied, the service is zero-rated. The FAQ also says supplies to SEZ units and SEZ developers are zero-rated. A supplier may either pay IGST and claim a refund after export, or supply under a bond or letter of undertaking and claim a refund of tax suffered on related inputs and input services (GST Council FAQ).
Use a contract-and-evidence checklist rather than a “foreign client equals export” shortcut. Confirm who receives the service, where that recipient is established, the contractual place-of-supply position, foreign-exchange realization, and whether the counterparty is a branch or other establishment of the same legal person. A foreign parent, platform or publisher may require a related-establishment analysis before zero-rating is claimed.
What changes when an Indian studio buys foreign software or services?
An import of service exists, under the official FAQ, when the supplier is outside India, the recipient is in India and the place of supply is in India. IGST can apply, and the FAQ says the currency used for payment is immaterial (official FAQ). This can be relevant to foreign-hosted development tools, localization, art or audio contractors, consultants, cloud-related services and other software services.
Do not apply reverse charge solely because a vendor is overseas. Establish what was supplied, whether it is actually a service, the recipient entity, the place of supply and any exemption or special rule. Where reverse charge applies, calculate and report IGST in the prescribed return, pay it from the appropriate cash ledger and assess whether the tax is eligible for input tax credit. Retain the agreement, invoice, payment proof, tax calculation and credit documentation.

How are online-game winnings taxed, and who pays?
Player winnings are not the same thing as the studio’s business income or the platform’s GST. The Income Tax Department states that net winnings from online games are taxed at 30% under Section 115BBJ. Section 194BA requires 30% TDS on net winnings at withdrawal, or at the end of the financial year when no withdrawal occurs (Income Tax Department guidance).
The statutory definition covers a game offered on the internet and accessible through a computer resource, including a telecommunications device (Income-tax Act text). In practice, keep three ledgers conceptually separate:
- Studio: ordinary business receipts, expenses and corporate income-tax computation.
- Platform/operator: GST obligations for the online-money-gaming supply and operational TDS compliance.
- Player: tax on net winnings and credit for TDS shown in tax records.
Therefore, 30% is not a blanket income-tax rate on game-development revenue. It addresses the player’s net winnings under the cited provisions.
What tax applies to foreign royalties, licences and technical services?
Studios often pay for engines, middleware, music, characters, publishing rights, cloud tooling or specialist consulting. A payment may be characterized as a royalty, fees for technical services, a standard business service, or an import for GST purposes. The Income Tax Department’s non-resident guidance says the result depends on the source rule, permanent-establishment connection, relevant agreement dates and the applicable Double Taxation Avoidance Agreement; Section 195 governs withholding on payments to non-residents (Income Tax Department non-resident guidance).

There is no responsible universal withholding percentage without identifying the recipient, tax residence, beneficial ownership, contract rights, permanent establishment and treaty article. Obtain a residency certificate and treaty documents where relevant, classify the payment before remitting it, determine whether a gross-up clause changes the calculation, and complete the applicable withholding, reporting and remittance steps. The same agreement can require separate GST and income-tax analyses.
What records should a game studio maintain?
A defensible file connects the commercial story to each tax position. Maintain:
- signed master services, licence and publishing agreements;
- statements of work identifying deliverables and intellectual-property rights;
- customer registration, address and establishment evidence;
- invoices and credit/debit notes with the Rule 46 particulars;
- bank advice and foreign-exchange realization evidence for exports;
- SEZ endorsements, bond/LUT records and refund workings where used;
- reverse-charge calculations and input-tax-credit support for imports;
- player wallet, deposit, withdrawal and net-winnings data if operating a money-gaming platform; and
- non-resident tax-residency, treaty and Section 195 working papers.
Keep product, payments and accounting teams aligned. A change from a fixed development fee to a revenue share, the addition of player deposits, or a new related-party entity can change the tax analysis even when the game itself is unchanged.

What are the most common mistakes?
- Calling every online title “online gaming”: first establish whether stakes and potential winnings exist.
- Applying 28% to a development invoice: classify the actual supply and recipient before selecting the rate.
- Assuming every foreign invoice is zero-rated: test all five export conditions, including place of supply, convertible foreign exchange and distinct-establishment status.
- Treating player TDS as studio tax: Section 194BA concerns online-game net winnings, not ordinary development fees.
- Using a standard royalty rate: source, treaty, permanent establishment and payment rights control the Section 195 result.
- Ignoring imported-service reverse charge: overseas tools and contractors require a supply-by-supply review.
- Relying on an old ruling: a Maharashtra AAR had placed a historical online-content/software-download case under an 18% framework, but later statutory treatment of online money gaming changed. It is context, not the current rate for money gaming (Maharashtra AAR).
How can a studio decide the right treatment before billing?
Use this five-question workflow for each revenue or cost stream:

- It can be a gift option

- Helpful in various ways
- What is supplied? Separate development, software access or download, platform service, money gaming, licence/royalty and technical service.
- Who is the counterparty? Record registration, country, establishment and related-party status.
- Where is the place of supply? Apply the relevant GST rule rather than relying on the invoice address.
- What is the valuation base? Check ordinary consideration versus the special full-face-value rule for online money gaming.
- Are there withholding or payment conditions? Review foreign exchange, reverse charge, Section 195, Section 194BA and refund evidence.
Escalate unusual arrangements—player wallets, prize pools, revenue-share publishing, bundled licences, parent-company services or multi-country platforms—to a GST and international-tax professional before launch or contract signature. Registration thresholds, e-invoicing applicability, entity-specific income-tax rates and state incentives are fact-specific and are not determined by the general rules above.
Bottom line for Indian game developers
Start with the legal supply, not the word “game.” Ordinary software-development work may use the 18% IT-service baseline; qualifying exports and SEZ supplies can be zero-rated; imports may require IGST under reverse charge; and online money gaming has a separate 28% regime on the relevant full face value from 1 October 2023. Player net winnings and foreign royalties then raise distinct income-tax and withholding questions. A contract-by-contract classification file is safer than a single “video-game GST rate.”
Frequently Asked Questions
Do I charge GST when a foreign publisher pays my Indian studio in US dollars?
Possibly, but payment in dollars does not by itself make the invoice an export. Confirm the recipient’s location, place of supply, convertible-foreign-exchange receipt and distinct-establishment test; if all five conditions are met, the service can be zero-rated.
Crashes, No Sound, or Screen Glitches?

Not automatically. The key question is whether the transaction is online money gaming involving stakes and winnings, rather than a normal sale of digital content or another service. Map the payment flow and player rights before choosing the regime.
If my studio pays a foreign engine provider, must I deduct tax?
The answer depends on whether the payment is a royalty, fees for technical services or another business payment, plus source, treaty and permanent-establishment facts. Section 195 analysis is required; there is no single rate that applies to every foreign software invoice.
Is the 30% online-game tax deducted from my studio’s revenue?
No. The cited 30% rate under Section 115BBJ and 30% TDS under Section 194BA concern a player’s net winnings from online games. They are separate from the studio’s ordinary business-income computation and GST obligations.
