In the UK, a video-game union recognition vote decides whether a union will represent a defined group of workers for collective bargaining. It is not permission to strike, and it does not automatically change anyone’s pay or contract. The Central Arbitration Committee (CAC) first defines the bargaining unit and checks the union’s application. If a ballot is required, recognition follows when more than half of the workers who cast valid votes support the union under the amended 2025 rules. The electorate is the bargaining unit, not necessarily everyone employed by the studio, and people who join that unit after the union’s application day are excluded.
What is a union-recognition vote, and what is it not?
A recognition ballot asks whether an employer must recognise a union for collective bargaining. Collective bargaining is the formal process for negotiating matters such as pay, working time, holidays, workplace policies and other terms within the agreed bargaining scope.
The ballot is separate from an industrial-action or strike ballot. A recognition result gives the union bargaining rights; it does not authorise a walkout. Nor does a successful vote instantly settle salary levels, working hours, holiday arrangements or individual disputes. Those issues are dealt with through the bargaining process that follows recognition.

Who gets a vote at a game studio?
Only workers in the CAC-approved bargaining unit vote. A bargaining unit might cover particular job families, departments, sites or management structures rather than the whole studio or corporate group.

The CAC must decide whether the proposed unit is compatible with effective management. For example, a unit could be limited to developers and designers at one UK site, or it could combine several related groups if that structure makes collective bargaining workable. Employees outside the approved unit do not become voters simply because they work for the same employer.
The electorate is fixed by the statutory process. Workers who joined the bargaining unit after the union’s application day are excluded from the recognition ballot under the Employment Rights Act 2025 amendments. That cut-off prevents the pool of voters being changed by later joiners once the case is under way.
How does the UK recognition process start?
The process normally moves through voluntary discussions first and a statutory CAC route if agreement cannot be reached.

- CAC application: If voluntary recognition or negotiations fail, the union applies to the CAC under Schedule A1 of the Trade Union and Labour Relations (Consolidation) Act 1992, as amended.
- Admissibility and support checks: The CAC examines the application, including whether the union has the required level of membership support and whether the proposed bargaining unit is appropriate.
- Bargaining-unit decision: The CAC settles the final unit if the parties disagree or the proposed scope needs adjustment.
- Recognition decision or ballot: The CAC may declare recognition without a ballot in some circumstances, or order a ballot when the statutory conditions require one.
Can a union win recognition without a ballot?
Yes. If the CAC is satisfied that a majority of workers in the bargaining unit are union members, it may issue a recognition declaration without putting the question to a vote. That is not automatic: statutory conditions can still require a ballot, and the CAC must apply the rules to the particular case.
The union must also pass the application’s membership-support gateway. The Employment Rights Act 2025 replaced the former fixed 10% threshold with a “required percentage” set by regulations, within a statutory range of 2% to 10%. The exact percentage currently prescribed is not established in the materials available for this explainer, so it should be checked against the current regulations or CAC guidance before relying on a single number.
The 2025 amendments also removed the requirement for a union to show, at the application stage, that a majority of workers was likely to vote for recognition. Membership support and ballot support are therefore separate questions: the first concerns whether the CAC application can proceed, while the second concerns the result if a ballot is held.

How is a recognition ballot run?
When a ballot is ordered, the CAC can appoint a qualified independent person to conduct it. The CAC determines the form and arrangements, while the employer has statutory cooperation duties. The union must be able to communicate with workers during the balloting period, and the legislation governs how ballot costs are handled.

Employees should read the formal CAC directions and ballot notice rather than assume that every worker at the studio is included.
Do not assume that an online vote will be available in 2026. In its June 2026 government response, the Department for Business and Trade placed electronic and hybrid voting for recognition and derecognition ballots in “Phase 2”, with delivery intended for 2027. A 2026 recognition ballot may therefore use postal or another currently authorised arrangement specified for that case.
What percentage is needed for recognition?
Under the amended Schedule A1 rule, the union wins when a majority of the workers voting support recognition. The test is based on valid votes cast, not on a separate minimum percentage of the entire bargaining unit.
For example, suppose 100 workers are eligible and 60 cast valid votes. If 35 vote for recognition and 25 vote against, the union has a majority of those voting and passes the current test. The same 35 yes votes would have failed the additional threshold under the former rule because they represented 35% of the entire unit, below the old 40% floor.
The former two-part test required both a majority of votes cast and support from at least 40% of everyone entitled to vote. The Employment Rights Act 2025 removed that second requirement. Descriptions of the 40% floor as the current statutory threshold are therefore outdated unless a specific transitional or historical case makes the old rule relevant.

What happens after a yes vote?
A successful ballot leads to a CAC recognition declaration for collective-bargaining purposes. Recognition does not itself determine the subjects, timetable or detailed procedures for negotiations.
The employer and union must agree a method of collective bargaining. Their agreement normally sets out matters such as who represents each side, how proposals are exchanged, how meetings are arranged and how disagreements are handled. If they cannot agree, the CAC can assist and may ultimately specify a bargaining method that is legally enforceable between the parties.
Because recognition is a bargaining framework rather than an instant contract variation, individual employment terms do not change merely because the result is “yes”. Any negotiated changes still have to be reached through the agreed bargaining process and implemented under the applicable employment rules.
Can a game studio be forced to recognise a union?
Yes, an employer can be required to recognise a union through the statutory CAC route even if it does not agree to voluntary recognition. The requirement follows only after the union satisfies the legal application conditions and, where ordered, wins the recognition ballot.
The employer is not required to accept the union’s original proposed unit or preferred bargaining procedure. The CAC can define a different appropriate unit and can determine the bargaining method if the parties cannot settle one. Those decisions are what make statutory recognition enforceable rather than dependent on the employer’s continuing consent.
How is recognition different from a strike ballot?
A recognition ballot decides whether the union will represent the bargaining unit in collective bargaining. A strike ballot asks whether workers support industrial action over a dispute. They have different legal purposes, electorates and procedural rules.

A recognition “yes” does not authorise industrial action, and a strike-ballot result does not create union recognition. Employees may encounter both types of ballot during a workplace dispute, but they should read the question and legal notice on each ballot separately.
What should employees check before voting?
- Bargaining-unit description: Confirm which roles, locations and reporting structures are included. “Everyone at the studio” is not a safe assumption.
- Eligibility date: Check whether you were in the bargaining unit on the union’s application day. A later joiner is excluded by the 2025 amendments.
- Ballot question: Make sure the question is about recognition for collective bargaining, not industrial action.
- Voting instructions: Follow the arrangements set by the CAC and its qualified independent person, including deadlines and the permitted voting method.
- Information from both sides: The union must be able to communicate during the balloting period, while the employer has cooperation duties. Consider the arguments from each side against the actual scope of recognition.
- Post-ballot expectations: A yes vote starts the recognition and bargaining framework; it is not an immediate promise of a particular pay rise, schedule or policy.
What are the main failure points in a recognition case?
Assuming the whole company votes
A studio may have several offices, disciplines and management lines. Treating the ballot as a company-wide referendum can mislead workers who are outside the CAC unit and can obscure the interests of those who are inside it. The formal unit description controls.
Using the old 40% rule
Older explainers often state that recognition needs a majority of voters plus 40% support from the entire unit. That was the former rule. For ballots under the amended framework, the operative test is a majority of workers voting.
Confusing membership with a ballot majority
A union’s membership evidence helps it pass the CAC application gateway, but it does not determine the ballot result. Workers who are not union members may still be eligible voters if they are in the bargaining unit, while membership alone does not replace a ballot where the CAC requires one.
Expecting an immediate workplace settlement
Recognition establishes who bargains with the employer. Pay, hours, leave and other terms still require negotiations, and the CAC’s role in setting a bargaining method does not substitute for agreement on every substantive issue.

What is the practical timeline?
| Stage | What happens | Who decides or acts |
|---|---|---|
| Request and voluntary talks | The union proposes recognition and a bargaining unit; the employer may agree or negotiate. | Union and employer |
| CAC application | The union submits the statutory application and membership-support evidence. | Union, reviewed by CAC |
| Unit determination | The appropriate bargaining unit is confirmed or adjusted. | CAC |
| Recognition without ballot | Possible where majority membership and the statutory conditions are established. | CAC |
| Recognition ballot | Eligible workers vote through arrangements set for the case. | Qualified independent person under CAC directions |
| Result and bargaining method | A majority of workers voting produces recognition; the parties then agree bargaining procedures. | CAC, union and employer |
What should workers remember?
The decisive questions are not “Does everyone at the studio vote?” or “Will a yes vote change my contract tomorrow?” They are: which bargaining unit did the CAC approve, was I in it on the application day, what voting method and deadline apply, and does more than half of the valid votes support recognition? Under the post-2025 framework, a simple majority of those voting is the ballot threshold, while the old 40%-of-the-whole-unit floor no longer applies.
Frequently Asked Questions
Does a recognition ballot include contractors and freelancers?
Only people included in the CAC-defined bargaining unit are in the statutory electorate. Whether a particular non-standard role is included depends on the unit description and the employment relationship considered in that case, so contractors should check the formal CAC documents rather than rely on the studio’s general headcount.
Where can I find the exact voting deadline and method?
The ballot notice and directions issued for the case set the deadline, the approved voting channel and the eligible unit. Those documents are more reliable than a general statement that UK recognition ballots are online, postal or workplace votes.

Does joining the union guarantee that I can vote?
No. Union membership and ballot eligibility are different. You must be within the approved bargaining unit and have been there by the union’s application day; membership evidence is also used for the CAC application gateway, not as a substitute for the ballot rules.
