An FTA lowers the duty on your export only when three conditions line up: the destination’s preferential rate is below its current MFN or applied rate, your goods satisfy the agreement’s product-specific rule of origin, and the claim is certified and supported by records. Check all three before shipping. Start with the correct HS code, use the International Trade Administration (ITA) FTA Tariff Tool to compare rates for the destination, then verify origin and certification requirements. Customs authorities still control the final classification and duty assessment.

What must be true for an FTA to lower your duty?

A negotiated FTA rate is not automatically the lowest rate available and it does not apply merely because a product is exported to a partner country. A duty reduction exists only when the shipment qualifies under the agreement and the preferential rate is lower than the rate the destination would otherwise apply.

  1. Correct classification: The product must be assigned the right Harmonized System (HS) code for the destination tariff schedule.
  2. Correct comparison: Compare the FTA preferential rate with the destination’s current most-favored-nation (MFN) or otherwise applied rate for that same tariff line.
  3. Origin qualification: The product must meet the product-specific rule of origin, which can require a tariff shift, regional value content, specified processing, wholly obtained status, accumulation, or another test.
  4. Valid claim: Follow the agreement’s certification process and retain evidence supporting the origin determination.

If the MFN or applied rate is equal to or lower than the preferential rate, claiming the FTA does not reduce duty. If the product fails the origin rule or the certification is unsupported, the preferential rate cannot be relied on even when the published FTA rate is lower.

How do I classify the export product before checking an FTA?

Begin with the product’s HS classification, because every rate and origin rule is tied to a tariff line. The ITA notes that schedules can use six-, eight- or ten-digit HS codes; the extra digits depend on the importing country’s tariff schedule.

Collect the facts that determine classification

  • What the product is and what it does.
  • Its principal material or composition, including mixtures and sets.
  • How it is presented at import: finished, unfinished, assembled, disassembled, packaged or in a kit.
  • The industry or end use when the tariff headings distinguish uses.
  • Technical specifications, dimensions and processing details that separate similar headings.

Use the destination country’s tariff schedule or an official customs classification resource to identify the complete tariff line. A six-digit HS heading may be shared internationally, while the destination’s eight- or ten-digit subdivisions can carry different rates and different origin rules.

Resolve classification uncertainty before calculating savings

Do not choose the code with the lowest duty simply because it produces a better result. Compare the legal descriptions, section and chapter notes, and any applicable explanatory material. If two headings remain plausible, document the facts supporting your position and seek a formal classification decision from the destination customs authority or qualified trade adviser. The ITA tool can display negotiated rates, but customs authorities control final classification and assessment.

How do I use the ITA FTA Tariff Tool?

The tool is designed to show the rates an FTA partner committed to implement and maintain, including scheduled reductions that may later reach zero. It covers agricultural and non-agricultural goods in all 97 HS chapters and includes product-specific rules of origin.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Open the ITA FTA Tariff Tool. Start from the export view rather than an import-to-the-United States view.
  2. Indicate that you are exporting. This sets the direction of the tariff search.
  3. Select the FTA partner country. Choose the destination agreement that could cover the shipment.
  4. Enter the HS code. Use the destination schedule’s level of detail when the tool requests eight or ten digits; do not truncate a code that has a more specific subdivision.
  5. Review the returned tariff line. Confirm the product description, the current preferential rate and any notes about staging or future reductions.
  6. Open the origin information. Read the product-specific rule attached to that tariff line rather than relying on a general summary of the agreement.

Record the search date, destination, complete HS code, rate shown and any scheduled change. Tariff nomenclature and implementing measures can change, so a saved result is evidence of what you checked, not a permanent guarantee of the rate.

How do I compare the FTA rate with the rate that would otherwise apply?

Compare rates for the same destination, tariff line and entry date. The relevant baseline is the destination’s current MFN or applied rate, not necessarily the rate printed in an older agreement summary.

Rate relationship What it means Practical result
FTA preferential rate is lower than the current MFN/applied rate The agreement offers a genuine duty advantage if origin and certification requirements are met. Proceed to the origin and documentation checks before claiming preference.
FTA preferential rate equals the current MFN/applied rate The negotiated preference does not improve the duty outcome at that time. There is no duty saving from making an FTA claim; still verify whether another commercial or compliance reason requires a claim.
FTA preferential rate is higher than the current MFN/applied rate The partner may have independently reduced its MFN rate below the negotiated FTA rate. Use the lower MFN/applied rate instead of claiming the more expensive preference.
FTA rate is scheduled to fall later The displayed rate may be a staging step rather than the final rate. Match the rate to the customs entry date and recheck the schedule before shipment.

Calculate the potential duty difference

For a simple ad-valorem duty, the gross rate difference is the customs value multiplied by the MFN or applied rate minus the preferential rate. Treat that result as a potential saving, not a promise: the calculation is valid only if the classification, customs value, origin determination and entry date are correct. Specific duties, tariff-rate quotas and other measures require a separate analysis of the tariff line’s terms.

Check whether the destination’s MFN rate changed independently

The ITA warns that the tool displays negotiated preferential rates. A partner country can independently lower its MFN rate after an FTA was negotiated. When that happens, the lower MFN rate applies and the shipment does not gain an additional FTA preference. This is why a current applied-rate check is essential even when the tool lists a positive preference margin.

How do I determine whether the product qualifies as originating?

Finding a lower preferential rate is only the beginning. Read the exact product-specific rule of origin for the tariff line and test the finished product against every condition it states. Rules differ by agreement and product.

Wholly obtained goods

Some rules cover goods wholly obtained or produced in the territory, such as qualifying agricultural or mineral products. If the product includes imported materials, a wholly obtained rule may not fit, even when substantial processing occurs locally.

Tariff-shift rules

A tariff-shift rule requires non-originating inputs to move from specified tariff headings, subheadings or chapters into the heading for the exported product. Map each non-originating material to its HS classification and verify that every required shift occurs. A shift that is allowed for one input may not satisfy a different product rule.

Regional value content

A regional value content (RVC) rule requires a minimum share of value to come from the agreement’s qualifying region. Follow the agreement’s prescribed calculation method and definitions. Keep the cost, value and sourcing records needed to reproduce the calculation; a broad statement that the product is assembled locally is not enough.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Processing requirements

Some products must undergo specified manufacturing or processing operations. Confirm that the operation performed in the qualifying territory is the one the rule names and that simple packaging, dilution or minor handling is not being treated as qualifying production when the rule excludes it.

Accumulation

Accumulation can allow materials or processing from another FTA party to count toward origin, but only when the agreement provides for it and the conditions are met. Identify the parties whose materials are being counted and retain supplier evidence showing their status.

Rules with multiple tests

A rule may require a tariff shift plus an RVC threshold, or a tariff shift with an exception for particular inputs. Read the connectors carefully: terms such as “and,” “or,” a minimum percentage and an excluded subheading change the result. Apply the rule to the exact HS line returned by the tariff tool.

What certification and records do I need for an FTA claim?

Follow the agreement’s certification procedure for the destination and product. ITA provides certification resources and a Rules of Origin Facilitator, but the required format, data elements and who may issue the certification vary by agreement.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Build an origin file

  • The final HS classification and the facts supporting it.
  • The product-specific rule of origin used for the determination.
  • A bill of materials identifying originating and non-originating inputs.
  • Supplier declarations or other evidence for materials counted as originating.
  • Tariff-shift analysis, RVC calculations or processing records required by the rule.
  • Production records showing where qualifying operations occurred.
  • The completed certification or origin statement in the form the agreement accepts.
  • The date and version of the tariff and rule information used for the decision.

Coordinate exporter and importer responsibilities

Many agreements require the importer to claim preference at entry using information supplied by the exporter. Confirm who is authorized to make the certification, what minimum data must appear, and how corrections are handled. Give the importer a clear copy of the certification and the supporting product description so the entry declaration matches your origin file.

Retain records that support the claim

Keep records sufficient to show how you reached the origin conclusion and how the shipment’s classification and rate were identified. The agreement’s own retention period and customs rules govern how long records must be kept; there is no single period that applies to every FTA. Make the file retrievable by shipment, product and tariff line.

How do tariff staging and nomenclature changes affect the result?

FTA schedules can reduce a rate in stages. A tool result may show the rate currently in force and a later date when it falls further or reaches zero. Use the rate effective on the date customs enters or assesses the goods, not a future rate that has not yet taken effect.

HS nomenclature is also revised periodically. A product can move to a new tariff subheading even when its physical design has not changed. When a code is renumbered, recheck the destination schedule, the FTA staging line and the product-specific origin rule together. Preserve the old and new references in your records so an auditor can see how the transition was handled.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Because customs authorities control final classification and assessment, contact the destination authority when the tariff tool and a customs ruling, entry system or broker classification do not align. Do not assume that an unchanged six-digit HS number means the eight- or ten-digit treatment is unchanged.

What should I do when the tool, broker or customs result does not match?

The product does not appear under the code you expected

Recheck the destination’s full tariff line, product description and chapter notes. Confirm that you selected the export direction and the correct FTA partner. If the classification remains uncertain, obtain an official customs determination before relying on a preference.

The tool shows a lower FTA rate, but the broker finds a lower MFN rate

Verify that both figures are for the same tariff line and entry date. If the destination’s current MFN or applied rate is lower, the negotiated preference does not create a saving; document the comparison and use the applicable lower treatment.

The product fails part of the origin rule

Do not issue a certification based only on the lower tariff rate. Identify whether a different approved calculation, qualifying supplier, accumulation provision or manufacturing step can satisfy the rule. If no permitted route exists, enter the goods without claiming the preference.

The rate is attractive only after a future staging date

Use the rate currently effective for the planned entry. Recheck the schedule close to shipment and update the commercial calculation if the entry date moves across a staging boundary.

Customs challenges the classification or claim

Provide the classification rationale, origin rule, calculations and source records in the format requested by customs. Customs’ determination controls the assessment, so correct the entry or seek the authority’s review rather than relying on the tool result alone.

What comparison should an exporter document before choosing FTA treatment?

A short decision worksheet prevents a rate-only decision. Complete every row for each product and destination.

Destination and agreement Partner country, agreement name and search date Different agreements and markets have different rates and rules.
Classification Complete HS code and supporting product facts The code determines both the duty line and the origin rule.

What is the practical pre-shipment workflow?

  1. Freeze the product description. Record the model, composition, condition and manufacturing steps for the exact shipment.
  2. Confirm the HS code. Validate the destination’s full tariff line and note any classification uncertainty.
  3. Run the ITA search. Select export, choose the partner and enter the code; save the displayed preferential rate and staging notes.
  4. Find the baseline rate. Check the destination’s current MFN or applied rate for the same line and entry date.
  5. Make the rate decision. If MFN is equal to or lower than the FTA rate, there is no duty reduction from claiming the FTA.
  6. Apply the origin rule. Test wholly obtained status, tariff shift, RVC, processing, accumulation and any combined requirements that the rule lists.
  7. Assemble evidence. Collect supplier information, production records, calculations and the required certification.
  8. Align the entry. Give the importer and broker the same HS code, origin conclusion and certification data.
  9. Recheck before filing. Confirm that no tariff staging date, nomenclature change or independent MFN reduction has changed the result.
  10. Retain the file. Store the rate comparison and origin records under the shipment or product identifier for the agreement’s required period.

How can I tell whether an FTA claim is worth the compliance effort?

Compare the expected duty difference with the work needed to prove origin and maintain certification. A large rate gap can justify a detailed origin program, while a zero or negative gap usually does not justify claiming the preference. The decision should include future staging, recurring supplier-document costs and the risk that classification or origin evidence will not survive a customs review.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Use a written go/no-go decision: claim the FTA when the preferential rate is lower, the origin rule is satisfied with documented evidence, and the certification can be issued correctly; use the MFN or applied treatment when it is equal or lower; and pause for a classification or origin ruling when a material uncertainty remains.

Frequently asked questions

Who actually claims the FTA preference at import?

The importer generally makes the preference claim in the customs entry, using the exporter’s certification or origin information when the agreement requires it. The exact allocation of responsibilities differs by agreement, so confirm the destination’s procedure rather than assuming the exporter files the claim directly.

What if my product uses materials from several FTA countries?

Check whether the agreement permits accumulation and which partner-country materials can be counted. Obtain supplier evidence for each input and apply the agreement’s definitions; materials from a non-participating country normally cannot be counted unless the rule expressly allows them.

How long should I keep an origin file?

Use the retention period stated in the agreement and the destination’s customs rules for the type of record involved. Because periods differ, write the applicable deadline into your compliance procedure instead of relying on a universal number.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Can the tariff tool guarantee the duty customs will assess?

No. It reports negotiated rates and related origin information, while customs authorities make the final classification and assessment. A changed nomenclature, an official ruling or a lower independently applied MFN rate can change the result for a shipment.
