For a U.S. healthcare practice, the safest public reply to a negative review is brief and general: acknowledge the feedback, do not confirm the reviewer is a patient, and invite them to contact the practice privately. A reviewer’s own public account does not, by itself, give the practice a basis to add details about care, appointments, billing, or records.
Why a public response can create a privacy problem
A reply posted on a public review page can disclose protected health information (PHI), even when its purpose is to correct a complaint or defend the practice. HHS defines PHI as individually identifiable health information held or transmitted by a covered entity or business associate, in any form or medium. Whether HIPAA applies depends on the organization and the information involved.
HHS describes the HIPAA Privacy Rule as applying to health plans, health care clearinghouses, and health care providers that conduct certain health care transactions electronically. See the HHS HIPAA Privacy Rule overview and HHS guidance on consumer health information.
In practice, avoid confirming or elaborating on whether someone is or was a patient. Do not discuss their appointment, diagnosis, treatment, payment, or record in the public thread. Even a seemingly simple correction—such as saying the person missed an appointment—could reveal information about an individual’s relationship with the practice.

Use a short, neutral response
A public reply can acknowledge feedback without addressing the facts of an individual case. For example:

This is an illustrative template, not an HHS-approved statement or a guarantee that particular wording is legally sufficient in every situation. Keep the invitation neutral: do not address the reviewer by name in a way that confirms a patient relationship, and do not add individualized medical, scheduling, billing, or record details.
What HHS enforcement examples show
HHS Office for Civil Rights (OCR) has publicized enforcement matters involving responses to negative online reviews. They illustrate why a public rebuttal can carry privacy risk; the amounts below relate to particular resolutions and are not typical-penalty estimates.

These two cases do not establish how often providers disclose PHI in review replies or what penalty another practice would face. They do show that a response written to address a public complaint can itself become the source of a privacy concern.
Apply the minimum-necessary principle
HHS says covered entities generally must take reasonable steps to limit the use and disclosure of PHI to the minimum necessary for the intended purpose. A public reputation response will ordinarily be able to acknowledge feedback without including case details. The HHS minimum-necessary guidance explains the general standard.

Do not treat a reviewer’s description of their own experience as permission to reveal more. Nor does HHS guidance about communications with family, friends, and others involved in care create a general exception for public review replies; that guidance addresses specified care-related circumstances. HHS says providers and health plans need privacy procedures, workforce training, and an assigned person responsible for privacy compliance. Practices should use those procedures for public replies rather than leaving a sensitive response to an individual staff member’s judgment. HHS summarizes these expectations in its guidance on what the Privacy Rule requires of an average provider or health plan.

- Draft without case facts. Acknowledge the feedback and invite private contact; remove details that could confirm a patient relationship or disclose health information.
- Escalate disputed or sensitive cases. If a review alleges misconduct, includes a threat, or appears to require a factual rebuttal, preserve the review and send the draft through the organization’s privacy and legal process.
- Keep the dispute off the public thread. Do not litigate the facts online. Use the practice’s private contact channel to handle the concern.
What this guidance does—and does not—settle
HIPAA’s application depends on whether the organization is within the rule’s scope and whether the information at issue is PHI. This practical approach is aimed at U.S. providers and practice staff handling public reviews; it is general information, not legal advice for a particular organization or dispute.
It is not a complete account of state privacy laws or of every review platform’s policies.
