You can protect the original expression in a game—such as source code, artwork, music, dialogue, lore, and a written pitch—while copyright does not protect the broad idea, premise, genre, mechanic, or method of play. When AI coding tools are involved, use two separate controls: document the human creative work that makes an asset copyrightable, and keep confidential material out of any service whose retention, training, or account terms you have not verified.
This is a U.S.-focused practical guide, not individualized legal advice. Vendor policies and copyright guidance can change, so check the current terms for the exact plan, feature, and date you use.
Can I copyright a game idea?
No. In the United States, the Copyright Office says that copyright does not protect ideas, concepts, systems, or methods of doing something. Its games guidance states, “The idea for a game is not protected by copyright.” A premise such as “a cooperative space-survival game with time loops,” a genre, a rules system, or a method of play can be commercially important without being exclusive under copyright.

The same game idea can therefore be expressed in protectable writing, art, music, audiovisual presentation, and computer code, even though another developer may independently use a similar premise or mechanic. Do not describe copyright as locking up the concept itself.

What the distinction means in practice
- Idea: the premise, genre, mechanic, system, or method of play. Copyright does not protect these as such.
- Expression: the particular words, images, sounds, animation, audiovisual sequence, and code you created and fixed. Original expression may qualify for copyright protection, subject to the limits of the particular work.
- Confidential know-how: unreleased designs, code, production plans, or data that derive value from not being known. This is a separate secrecy question, not an automatic copyright right.
Which game assets can copyright protect?
Focus your documentation on concrete expression rather than trying to claim ownership of an abstract mechanic. The following map applies the U.S. framing in the Copyright Office materials to common indie-game assets.

Does AI-generated code or art belong to me?
AI assistance does not automatically make a game asset unprotectable, but a prompt by itself is not enough to establish human authorship. In its January 29, 2025 announcement summarizing Part 2 of its artificial-intelligence report, the U.S. Copyright Office said that outputs can be protected only where a human author has determined sufficient expressive elements.
What counts as a meaningful human contribution?
Keep evidence of the parts a person actually created or controlled: writing the underlying material, choosing among generations for expressive reasons, making creative edits, arranging components, painting over or substantially modifying an image, and integrating code into a larger human-authored program. A person’s creative selection or arrangement can matter even when a tool produced some components.

The legal analysis is specific to the work. A human-written script with a few generated lines may present a different authorship question from an image accepted unchanged from a single prompt. Functional code, game rules, and abstract systems also remain subject to the ordinary limits of copyright, regardless of whether a person or model produced them.
What a provenance record should contain
- The date, project, and asset or file name.
- Which portions were written, drawn, composed, or coded by a person before tool use.
- The tool, feature, account tier, and model involved, without placing confidential prompts in a service merely to create a record.
- What a person selected, rejected, revised, combined, or integrated, with links to local commits or dated drafts.
- The final human edits and the location of the released or archived version.
Keep this history in your own source-control and project systems. The Copyright Office’s guidance is developing, so review its current registration instructions if you later register a work and be prepared to identify the human-authored portions.

How do I keep an unreleased game concept confidential?
Confidentiality requires operational discipline. Trade-secret protection is available only when information has value because it is secret and the owner makes reasonable efforts to preserve that secrecy. The cited discussion of this rule appears in comments from the American Intellectual Property Law Association hosted by the U.S. Patent and Trademark Office; those comments are stakeholder input, not a USPTO ruling.
Apply secrecy controls to the material that matters
- Classify files: mark the design document, unreleased mechanics, source, art, credentials, and production plans that would damage the project if disclosed.
- Limit access: give each collaborator only the repositories, folders, and environments needed for the current task; remove access when a contract or role ends.
- Use written terms: put confidentiality and ownership obligations in agreements with employees, contractors, testers, and collaborators where appropriate. An agreement cannot turn an abstract idea into copyrighted expression, but it can define contractual duties between the parties.
- Separate public and secret material: keep public examples, generic scaffolding, and launch-ready information apart from the unreleased design and production repository.
- Protect credentials: never paste API keys, signing keys, private tokens, or build credentials into an AI chat or code prompt.
- Log disclosures: record who received a sensitive file, when, for what purpose, and when access ended.
Sending a secret to a third party can undermine the factual basis for treating it as secret, depending on the service terms and the circumstances. Before disclosure, determine whether the provider retains the interaction, uses it for training or product improvement, shares it with subprocessors, or allows the data to be accessed through connected features.
Can an AI coding assistant train on my code?
Sometimes, depending on the provider, feature, plan, settings, and date. A private repository is not a guarantee that every prompt, snippet, output, or context item sent to an assistant is handled like repository contents stored at rest.
GitHub Copilot as a dated example
GitHub announced on March 25, 2026 that a policy change would take effect on April 24, 2026. Under that announcement, interaction data from individual Copilot Free, Pro, and Pro+ users—including inputs, outputs, code snippets, and associated context—may be used to train and improve models unless the user opts out. GitHub said Copilot Business and Enterprise customer data would not be used for training under that change. Its documentation also describes an opt-out in personal settings for individual subscribers.
This is a vendor-specific example, not a rule for every coding assistant, every Copilot feature, or every later policy. Confirm the current terms and settings for the account you actually use. Check whether an IDE extension, command-line interface, chat feature, connected repository, third-party model, or organization agreement handles data differently.

What should I check before connecting a repository to an AI tool?
Use this review every time you add a tool, switch plans, enable a new feature, or notice a policy change. Capture the answers in your project security notes so a later collaborator does not have to guess.

Determine which files, open buffers, dependency files, terminal output, commit history, issue text, and repository context are sent automatically. Look for default context windows and connected extensions.
- Read the current data terms. Find the sections covering prompts, outputs, snippets, context, retention, deletion, training, product improvement, subprocessors, and security incidents. Record the effective date you reviewed.
- Check the account tier and controls. Establish whether the account is personal or organizational, whether opt-out is available or enabled, and whether an organization agreement changes processing.
- Inspect each access method. IDE chat, autocomplete, command-line tools, web chat, pull-request features, and third-party model selections can have different handling. Do not assume one setting covers all of them.
- Configure exclusions. Exclude design documents, unreleased assets, private keys, credentials, and crown-jewel source paths when the tool supports file or repository exclusions. Test the exclusion with a harmless marker and confirm it is not transmitted.
- Minimize prompts. Ask about a small, sanitized interface or a short synthetic example instead of pasting the whole design document or repository.
- Recheck after changes. Revisit the terms and settings before a material release, plan change, model change, or new integration.
How can I use AI coding tools without exposing the game’s core secret?
Design the workflow so an assistant solves generic implementation problems while the human team retains the unreleased concept and sensitive assets.
- Make a sensitivity inventory. Label mechanics that are not public, story twists, character reveals, proprietary art, economy values, source modules, player data, credentials, and build infrastructure.
- Create a sanitized test case. Replace names, numbers, lore, and proprietary algorithms with placeholders or a toy example that preserves the programming problem but not the commercial secret.
- Expose an interface, not the implementation. Share a function signature, data schema, or error message when that is enough. Keep the internal rules, content tables, and secret assets local.
- Use local review before submission. Search the prompt and attached context for project names, unreleased text, keys, URLs, personal data, and distinctive mechanics. Remove anything the tool does not need.
- Review the response offline. Treat generated code as a draft. Check dependencies, licenses, security behavior, performance, and whether it accidentally reproduces confidential material before merging.
- Commit human changes clearly. Use source-control commits or design logs to show what a person wrote, changed, selected, and tested. Do not merge unreviewed output directly into a release branch.
- Keep the source of truth separate. Store the complete design, original assets, credentials, and release keys in systems with access controls that the assistant cannot automatically crawl.
Can someone steal my game concept?
A similar concept can be developed independently because copyright does not give exclusive rights to an idea, mechanic, or method of play. The risk becomes different when someone obtains and copies your fixed expression—such as your text, artwork, music, audiovisual presentation, or code—or when a person receives confidential information in circumstances that create a duty to keep it secret.
Reduce practical exposure by sharing only what a collaborator needs, using written confidentiality and ownership terms where appropriate, keeping dated development records, and separating public prototypes from unreleased materials. Avoid claiming that an NDA, a private repository, or a copyright registration makes the broad premise exclusive; each measure addresses a different risk.
What records should a small team keep?
A lightweight evidence trail can help you explain authorship, ownership, and disclosure history later. Keep the records in systems you control and preserve them when team membership changes.

- Source-control history identifying human-authored code, reviews, merges, and material edits to generated code.

These records do not create rights by themselves. They make it easier to demonstrate the human contribution, identify what was confidential, and investigate a disputed disclosure.

Act promptly, but do not assume that deleting a chat erases every retained copy. First preserve the relevant facts: the account, feature, date, prompt or attachment, response, repository context, settings, and terms that applied at the time.
- Disable further transmission by turning off the integration, removing repository access, or pausing the affected account.
- Rotate exposed credentials immediately and invalidate tokens that appeared in prompts, logs, or generated output.
- Review the provider’s retention, deletion, training, and incident-reporting procedures and submit any available deletion or support request.
- Document who may have received the material and whether the disclosure involved contractors, customers, or other third parties.
- Ask qualified U.S. counsel to assess contractual duties, trade-secret implications, and any required notice before making public accusations or promises.
Future use should resume only after you have narrowed the context, confirmed the applicable controls, and updated the team’s written policy.
What should an indie team policy say?
A usable policy can be short if it is specific. State which tools and account tiers are approved, what data classes are prohibited, who may change settings, and how a developer reports an accidental disclosure.
- Do not submit unreleased mechanics, full design documents, private source modules, credentials, personal data, or unannounced art unless the project owner has approved the exact service and terms.
- Use sanitized examples and minimum necessary context by default.
- Keep human review and source-control records for generated or assisted code and assets.
- Recheck provider terms before enabling new features, changing plans, or accepting a material policy update.
- Report a suspected disclosure immediately; do not hide it by deleting local evidence.
The policy should name an owner responsible for the review. A tool that is acceptable for generic boilerplate may be inappropriate for the project’s central mechanic or unreleased content.

What is the practical rule for protecting a game with AI assistance?
Protect expression and secrecy separately. Preserve dated evidence of human creative work for copyright analysis, and treat every prompt, attachment, and automatically supplied context as a potential disclosure until the provider’s current, plan-specific terms show otherwise. The safest workflow is the one that shares the least sensitive information needed to solve the programming task.

Can an NDA make a game mechanic legally exclusive?
An NDA can create contractual duties for the parties who sign it, but it does not convert an abstract mechanic or premise into copyright-protected expression. Its scope, enforceability, and remedies depend on the agreement and applicable law, so have counsel review important deals.
Should I ban AI tools entirely on an indie game project?
Not necessarily. Use a risk-based rule: generic, sanitized programming questions may be acceptable, while unreleased mechanics, private source, credentials, and distinctive assets stay out unless the exact service and controls have been approved.
