You generally cannot prevent a lawful public-road automated license plate reader (ALPR) from scanning your vehicle, and no verified, lawful consumer countermeasure is established here. Keep your required plate properly displayed and readable. The practical steps are to understand what may be collected, check how local agencies handle it, and support safeguards on retention, access, sharing, and auditing.
What an ALPR may record
Automated license plate readers use cameras mounted on police vehicles or fixed infrastructure, such as roadsides and bridges. The ACLU describes systems that photograph a plate and record its number along with the date, time, and location. Records may be pooled into regional databases. The ACLU says some agencies may retain records for years or indefinitely; that is its description of possible practices, not a duration that applies to every agency or vendor. ACLU overview of ALPRs
Other information may be derived from an image. The ACLU’s February 2026 model bill defines captured plate data to include GPS coordinates, photographs, and vehicle characteristics such as make, model, and color. That is a proposed legal definition, not proof that every reader collects every listed field. ACLU model bill (February 2026)
Because a scan can happen during ordinary lawful driving, changing a route or driving normally cannot be relied on to keep a plate out of view. The useful point of control for an individual is usually what happens to collected records—not whether a public camera sees the plate.

What you can do as a driver
- Keep your plate compliant and readable. Display required plates as local law requires. Do not obscure, alter, disguise, switch, or apply a treatment to a plate to defeat reading. This article does not establish that shields or sprays are lawful or effective, and interfering with readability may violate local rules.
- Find out which agencies operate or access systems locally. Check policies for municipal police, county sheriffs, state police, toll agencies, and any known private ALPR network. A policy may explain permitted purposes, retention, access, sharing, and oversight.
- Ask specific questions. Find out how long non-hit data is retained, who may search it, which agencies or vendors may receive it, whether searches and access are logged and audited, and how to report suspected misuse. - Use public-records procedures where available. Depending on local law and exemptions, you may be able to request policies, contracts, retention schedules, access logs, audit reports, or data-sharing agreements. Access rules vary; a request does not guarantee access to identifiable plate records.
- Take part in local oversight. Public comments and messages to representatives can support narrow permitted purposes, short retention, restricted access and sharing, independent audits, and transparency reporting.
- Get jurisdiction-specific legal advice for a specific case. If an ALPR scan or use relates to a legal matter, consult a lawyer licensed where the matter arises. General information cannot determine your rights in an individual case.
How ALPR safeguards vary by place
Compare a rule or policy by its scope and legal status, not just by its stated retention period. A statute, proposed bill, and agency policy have different force, and rules in one jurisdiction do not establish what applies elsewhere.

When reading a local policy, look for the purpose of collection, the retention period for data that does not produce a hit, who can access or share records, audit and reporting duties, and how complaints or violations are handled. Those safeguards govern data handling; they are not equipment a driver can buy to stop scans.

What the law does—and does not—settle
In United States v. Jones (2012), the U.S. Supreme Court held that the government’s installation of a GPS device on a vehicle and its use to monitor the vehicle’s movements constituted a Fourth Amendment search. That decision is relevant context for location tracking, but it does not resolve every legal question about fixed cameras or ALPR programs. Read the decision
ALPR rules and remedies depend on jurisdiction, agency, and circumstances. Do not assume that one court decision, state law, or local policy answers whether a particular scan or later use was lawful.

How to assess claims about ALPR prevalence
There is no current, attributable national prevalence figure established here. The ACLU reported that in July 2012 its affiliates in 38 states and Washington, D.C., requested records from almost 600 local and state police departments and other agencies. Those figures describe the historical scope of that records-request project, not today’s number of ALPR operators or scans. ACLU overview
