Keep a human accountable for the mortgage decision and preserve a record that can reconstruct how it was made. At minimum, capture the material data and its source, the model and version, the output and any exception flags, the policy thresholds in force, the reviewer’s reasoning and override, the final action, and the reasons communicated to the applicant. The exact controls depend on the use: ECOA and Regulation B govern credit adverse-action explanations, the federal automated valuation model (AVM) rule applies to specified property-valuation uses, and Fannie Mae’s 2026 framework applies to covered seller/servicer use of AI and machine learning. A black-box score never excuses an inaccurate explanation or an unreviewable process.
What does an accountable AI mortgage workflow look like?
An accountable workflow separates three things that are often blurred together: what the system recommended, what a human decided, and what the lender told the applicant. Each stage should leave evidence that another qualified person can understand later without relying on the model’s current interface.
- Define the use and authority. Identify the workflow stage, business purpose, decision-maker, covered loan population, model or vendor, material inputs, and the policies and laws that apply.
- Run the model with version control. Record the model, vendor, configuration, policy thresholds, timestamp, output, confidence or exception indicators, and input provenance.
- Apply human review deliberately. Route cases that are incomplete, contradictory, unusual, low-confidence, out of policy, or otherwise flagged for escalation to a trained reviewer with authority to pause, correct, override, or escalate.
- Record the decision separately from the recommendation. Preserve the reviewer’s identity, role, evidence considered, rationale, action, and any override. The final authority must be identifiable.
- Generate notices from actual factors. Map adverse-action reasons to factors the creditor actually considered or scored, then validate the wording against the decision record.
- Test and improve. Review errors, exceptions, overrides, conflicts, data problems, and possible disparate-impact patterns. Track remediation and every material model, policy, threshold, or vendor change.
This sequence is a practical control design. The sources discussed below establish legal and investor duties, but they do not prescribe one universal database schema or one human-review recipe for every mortgage AI application.
Which mortgage AI rules apply to my use case?
Start by classifying the use before deciding how much review and recordkeeping it needs. A credit-underwriting model, an AVM used to set collateral value, and a servicing analytics tool can trigger different obligations.

| Framework | When it applies | What it requires or expects | Key date |
|---|---|---|---|
| ECOA and Regulation B | Credit decisions and adverse actions, regardless of whether a human, algorithm, or hybrid process produced the result | Specific principal reasons for adverse action. Reasons must relate to and accurately describe factors actually considered or scored; references only to internal standards or an unexplained qualifying score are insufficient. | CFPB Circular 2022-03, May 26, 2022; Circular 2023-03, September 19, 2023 |
| Federal AVM quality-control rule | Specified AVM uses by mortgage originators and secondary-market issuers when determining the value of a consumer’s principal-dwelling collateral for covered credit or securitization decisions | Policies, practices, procedures, and control systems designed for confidence in estimates, data integrity, protection against manipulation, conflicts-of-interest controls, random sample testing and review, and compliance with nondiscrimination laws | Published August 7, 2024; effective October 1, 2025 |
| Fannie Mae Lender Letter LL-2026-04 | AI or machine-learning use by seller/servicers in origination or servicing of loans sold to or guaranteed by Fannie Mae, or serviced for it | Transparent policies, risk management, staff communication, legal and regulatory understanding, an accountable owner with at least annual review, security and resiliency controls, vendor and subcontractor governance, and disclosure of AI use and safeguards when requested | Published April 8, 2026; official page updated October 21, 2026 |
These layers can overlap, but none automatically applies to every mortgage technology. The AVM rule, for example, does not cover every model that happens to process property data. Uses such as monitoring mortgage quality or performance, reviewing valuations that have already been completed, and appraisal development by a certified or licensed appraiser are outside the relevant AVM scope described by the agencies.
How do I inventory an AI use before putting it into production?
Create a living use inventory that lets compliance, operations, and examiners identify what the system does and which decision it can influence. Fannie Mae’s disclosure expectation makes an accurate inventory especially important for covered seller/servicers.
- Name the workflow stage. Examples include application intake, income or document analysis, underwriting recommendation, collateral valuation, fraud screening, quality control, or servicing.
- State the purpose and authority. Say whether the output informs a human, automatically blocks a case, sets a value, prioritizes work, or performs a monitoring function. Identify who has final decision authority.
- Define the population and geography. Record loan products, occupancy or collateral types, channels, and whether the use touches a consumer’s principal dwelling.
- List material inputs and sources. Include applicant-provided data, third-party data, property records, derived variables, and any manual adjustments. Retain provenance so a later reviewer can tell what was available at the decision time.
- Identify the model and suppliers. Record the vendor, model family, version, configuration, subcontractors, deployment location, and the contract owner.
- Map applicable rules and policies. Mark whether ECOA/Regulation B adverse-action duties, the covered AVM rule, investor requirements, privacy controls, or internal policies apply.
- Set review and retention ownership. Assign the business owner, compliance reviewer, technology custodian, and records owner. Document how changes are approved and how a case is connected to the version in force.
Update the inventory whenever a model, vendor, input, threshold, purpose, or decision authority changes. A stale inventory can make an otherwise well-documented case impossible to explain.

Human review is a control only when the reviewer can see relevant evidence, has genuine authority, and records independent reasoning. A person who merely clicks “approve” beside an unexplained score adds little accountability.
Set objective escalation triggers
Route a case to a trained reviewer when information is missing, contradictory, unusual, outside policy, low-confidence, or marked as an exception. Add triggers for material data corrections, a model failure, an unavailable data source, a threshold breach, or a conflict between model output and documented evidence. The trigger list should be versioned with the policy so the record shows which rule caused escalation.
Give the reviewer the right context
The review screen or packet should show the material inputs and their sources, the model and version, output and confidence or exception indicators, policy thresholds, relevant documents, and prior corrections. Do not expose more sensitive information than the reviewer needs; protect the record under the lender’s privacy, access-control, and security requirements.

Define the reviewer’s authority
Document whether the reviewer may request corrected information, pause processing, accept the recommendation, override it, or escalate to a second decision-maker. If an override requires a higher approval level, identify that level in the policy and in the case record.

Require the reviewer to state what evidence was considered, what action was taken, why the model recommendation was accepted or rejected, and whether a correction or escalation occurred. Keep the model’s recommendation and the human’s decision in separate fields; otherwise an audit may not show who actually exercised authority.
Use review patterns as governance signals
Aggregate exception, correction, and override patterns by model version, product, channel, and reviewer group. Concentrations can reveal data-quality problems, a policy threshold that no longer fits, or a model that performs differently for part of the population. Feed findings into testing, remediation, training, and change approval rather than treating each review as an isolated event.
What records should a lender keep when AI is used?
The following record design is an implementation recommendation inferred from the cited duties and governance expectations, not a verbatim statutory checklist. Retain enough context to reproduce the path from source data to communicated outcome.
| Record element | What to capture | How it supports reconstruction |
|---|---|---|
| Use and authority | Workflow stage, purpose, covered population, final decision authority, applicable policy and rule scope | Shows what the system was allowed to do and which controls governed the case |
| Input snapshot and provenance | Material values as they stood at decision time, source system or document, collection time, transformations, corrections, and who supplied a manual change | Lets a reviewer distinguish original evidence from later edits |
| Model lineage | Vendor, model name, version, configuration, deployment identifier, and effective dates | Identifies the exact logic that produced the output |
| Output and exceptions | Recommendation, score or value where relevant, confidence or uncertainty indicator, validation result, error state, and exception flags | Shows what the system actually returned, including warnings that may have prompted review |
| Policy context | Thresholds, cutoffs, reason-code mapping, policy version, and effective date | Connects the output to the rule applied at that time |
| Human action | Reviewer identity and role, timestamp, evidence presented, decision, rationale, requested correction, escalation, and override approval | Separates human judgment from automated recommendation and proves who acted |
| Notice record | Final action, adverse-action reason codes, text delivered, delivery date, and the decision factors supporting each reason | Allows the lender to test whether the explanation matches the actual decision |
| Change history | Model, vendor, policy, threshold, and configuration changes; effective dates; approvers; test results; remediation; and the version linked to each decision | Prevents a later system update from obscuring what was in force |
Limit collection to what is necessary and apply role-based access, retention, deletion, and security controls appropriate to lender data. The cited materials do not set one universal retention period for all AI mortgage records, so the lender must coordinate applicable law, investor contracts, litigation holds, and its records policy.

How do I issue accurate adverse-action reasons from an AI decision?
Build the notice from the actual principal factors that affected the decision, not from a generic list selected after the fact. CFPB Circular 2022-03 states that ECOA and Regulation B apply regardless of the technology and that a creditor cannot rely on model complexity if it cannot identify specific, accurate reasons.

- Freeze the decision basis. Preserve the inputs, model output, policy version, and reviewer action before generating the notice.
- Identify principal factors. Use the factors actually considered or scored and distinguish them from information that was merely available in the file.
- Map each factor to an approved reason code. The mapping should be versioned and tested against the model and policy change history.
- Generate plain, specific language. Explain the factor in terms the applicant can understand. A statement that only cites “internal standards” or says the applicant failed to reach a qualifying score does not satisfy the specificity requirement.
- Validate before delivery. Compare the generated text with the decision snapshot and reviewer rationale. Remove a reason that did not contribute to the outcome and add a principal factor that did.
- Store the delivered notice. Keep the exact reason text, date, channel, and supporting decision record.
Circular 2023-03 warns that a sample checklist is not a safe substitute when its entries do not accurately identify the reasons in the particular case. A checklist can support consistency only when it is tied to the factors the creditor actually used.
Illustrative reason mapping
If a policy actually evaluated a documented debt-to-income threshold and that factor materially drove the adverse action, the notice should identify that factor in clear language. It should not substitute “failed score” or “did not meet internal criteria.” The example is illustrative; the lender must use the factors and wording supported by its own decision record.
What extra controls are needed for a covered AVM?
For an AVM use within the federal rule’s scope, establish a control system aimed at reliable estimates and lawful use. The rule does not prescribe one universal human-review sequence, so document how the institution meets each control objective.
- Confidence in estimates: define validation, exception handling, and escalation for low-confidence or unusual properties.
- Data integrity: control data ingestion, transformations, corrections, and access; test for missing, stale, manipulated, or inconsistent records.
- Conflict-of-interest protection: identify incentives or relationships that could bias the valuation process and assign independent oversight where appropriate.
- Random sample testing and review: select cases without allowing staff to choose only easy or favorable examples; document the sample, findings, reviewer, and remediation.
- Nondiscrimination compliance: test and investigate patterns that could indicate unlawful discrimination, using the data and legal analyses appropriate to the institution.
The rule became effective October 1, 2025. It covers specified valuation decisions involving a consumer’s principal dwelling collateral, not every property-data or analytics activity. Monitoring mortgage quality or performance, reviewing a valuation that is already complete, and appraisal development by a certified or licensed appraiser are among the uses described as outside the relevant scope.
What does Fannie Mae’s 2026 AI/ML framework add?
Fannie Mae Lender Letter LL-2026-04 creates a separate investor-governance layer for covered seller/servicers. It applies to AI or machine-learning use in origination or servicing of loans sold to or guaranteed by Fannie Mae, or serviced for it; it is not a rule for every lender or every mortgage product.
Establish transparent policies and ownership
Maintain written policies and procedures that explain permitted uses, risk tolerance, legal and regulatory responsibilities, security and resiliency controls, and escalation. Assign an owner responsible for implementation and conduct at least an annual review, with evidence of the review and resulting changes.

Govern vendors and subcontractors
Assess the model provider and relevant subcontractors, define their responsibilities, require information needed for oversight, and preserve evidence of monitoring. Contracts should support access to version, performance, incident, and control information needed to reconstruct a covered decision.

Prepare disclosures
When requested, seller/servicers must promptly disclose the AI/ML types used, their purpose and manner of use, safeguards, and other requested information. An up-to-date inventory and version history make that response possible without guessing.
Communicate with staff
Train affected employees on approved uses, escalation, privacy and security, override authority, and how to document decisions. Record completion and refresh training when a material model or policy change alters a person’s responsibilities.
How should testing, monitoring, and change control work?
Operate governance as a continuing cycle rather than a one-time model approval.
- Before release, test input validation, reason-code mapping, exception handling, access controls, and the reviewer workflow. Preserve test cases, approvers, defects, and remediation.
- During operation, monitor error findings, missing-data rates, exception volumes, overrides, turnaround impacts, and patterns that may indicate disparate impact or data drift. Do not turn any one metric into a legal safe harbor.
- For covered AVMs, perform the required random sample testing and reviews and retain the sample-selection method, results, findings, and corrective actions.
- After incidents or material findings, pause or restrict the affected use when necessary, correct records, notify responsible governance staff, and document the resolution.
- For every change, record the old and new model, vendor, threshold, policy, or configuration; effective date; approval; test evidence; and the method for identifying decisions made under each version.
- At least annually where required by the investor framework, review policies, risk tolerance, vendor oversight, security, and staff communication, then record the owner’s determination and actions.
Keep model recommendations, human decisions, notices, and change records linked by a stable case identifier. That linkage is what turns separate logs into an audit trail.

Ask for a live reconstruction demonstration: select a closed case, identify the exact input snapshot and model version, show the reviewer’s action, and reproduce the adverse-action reasons. If the system can export only a final score, it cannot by itself provide the trail described above.
What are the most common failure modes and fixes?
| Failure mode | Why it fails | Practical correction |
|---|---|---|
| The lender stores only the final score | There is no way to tell which inputs, version, threshold, or exception produced it | Capture the input snapshot, provenance, model lineage, configuration, output, and policy context together |
| A reviewer approves every recommendation without explanation | The human is a rubber stamp and the record cannot show independent judgment | Require evidence considered, rationale, action, and override or escalation details |
| Notice software uses a fixed checklist | The selected reason may not be a principal factor in the actual case | Map reason codes to factors actually considered or scored and validate text before delivery |
| “Failed score” or “internal standards” is sent to the applicant | The explanation is too vague and does not identify the specific basis | State the concrete principal factor supported by the decision record |
| The AVM is treated as covered in every context | The federal rule has a defined scope and exclusions | Classify the use and document why the rule applies or does not apply |
| Vendor updates are invisible to operations | Past decisions cannot be tied to the logic in force, and disclosures may be incomplete | Require advance notice, version identifiers, approval, testing evidence, and effective dates |
| Human review sees less evidence than the model | The reviewer cannot meaningfully check the recommendation | Present relevant inputs, provenance, policy thresholds, output, warnings, and source documents with least-privilege access |
| Records are editable without history | Later changes can overwrite the original decision path | Use immutable or append-only event history with correction records and timestamps |
How can a lender implement this control set?
Begin with one high-impact workflow and prove that a case can be reconstructed from intake through notice. Then extend the pattern to other uses.
- Map the current path. Interview underwriting, valuation, servicing, compliance, technology, records, and vendor-management teams. Draw where data enters, where the model runs, where a person acts, and where a notice is produced.
- Mark decision points and scope. Identify credit decisions, covered AVM uses, investor-covered origination or servicing, and activities that are outside those scopes.
- Define the minimum record. Adopt the input, lineage, output, policy, reviewer, notice, and change fields above; assign owners and access rules.
- Write escalation and override procedures. Specify triggers, reviewer qualifications, authority, second-level approval, correction handling, and the evidence required in each outcome.
- Build reason validation. Test every adverse-action code and generated sentence against factors actually used. Include regression tests whenever a model or policy changes.
- Run sample reconstructions. Select completed cases, ask an independent reviewer to reproduce the path, and record gaps as remediation items.
- Integrate governance. Feed findings into model-risk review, vendor oversight, annual policy review, staff training, and investor disclosures where applicable.
The objective is not to make every mortgage decision manual. It is to ensure that automation remains reviewable, that the final authority is clear, and that the lender can explain a decision with evidence tied to the factors that actually mattered.

A defensible workflow can answer five questions for any case: What information did the lender use? Which model, vendor, and policy version were active? What did the system produce? What did the reviewer or decision-maker do, and why? What final action and explanation were delivered? If any answer requires reconstructing history from memory or asking a vendor to recreate an old environment, the audit trail is incomplete.
As CFPB Director Rohit Chopra put it when announcing Circular 2022-03: “Companies are not absolved of their legal responsibilities when they let a black-box model make lending decisions.” Human review and detailed records operationalize that principle without pretending that one control fits every mortgage AI use.
Frequently Asked Questions
Does every AI mortgage decision require a human to approve it?
No single source here mandates one human-review recipe for every mortgage AI tool. Human review is a recommended accountable control, while the applicable duties depend on the use; design review authority and escalation around uncertainty, exceptions, policy breaches, and the risk of the decision.
How long must AI mortgage records be retained?
The frameworks summarized here do not establish one universal retention period for all records. Set retention and deletion schedules by coordinating applicable law, investor or servicing contracts, litigation holds, privacy requirements, and the lender’s records policy.
What if a model vendor will not provide its version history?
Treat missing lineage as a governance and contracting risk, not as a reason to omit the field. Require version identifiers, effective dates, change notices, testing evidence, and access to information needed for case reconstruction before expanding the use; escalate or restrict the workflow if those controls cannot be met.
Can a lender use an AI-generated explanation without a separate check?
Generation alone is not enough. Compare the proposed text with the frozen decision snapshot, the factors actually considered or scored, the reviewer rationale, and the reason-code version before delivery, then retain the exact notice sent.
