Cryptocurrency paid for employee services is still taxable wages for U.S. federal payroll purposes. Convert the asset’s fair market value (FMV) to U.S. dollars when the employee receives it, include that dollar amount in payroll, calculate applicable federal income-tax withholding, employee and employer FICA, and FUTA, then report the wages on Form W-2. The payment method does not remove payroll obligations. The workflow below follows the Internal Revenue Service’s digital-asset FAQ, 2026 Publication 15, and 2026 W-2 instructions; state and local wage-payment and tax rules require separate review.

What does the IRS consider cryptocurrency paid to an employee?

The IRS treats digital assets paid by an employer for an employee’s services as wages. IRS FAQ 61 states: “Generally, the medium in which remuneration for services is paid is immaterial to the determination of whether the remuneration constitutes wages for employment tax purposes.” The FAQ, added December 15, 2025, uses the current term “digital assets”; older IRS material may say “virtual currency.”

For an employee, the asset’s U.S.-dollar FMV at receipt is payroll compensation. That amount is subject to applicable federal income-tax withholding, Social Security and Medicare taxes under FICA, and federal unemployment tax under FUTA. The employer reports the wage amount through the normal employment-tax process and on Form W-2, even if the employee never receives dollars in a bank account.

The rule concerns compensation for services. It does not turn every transfer of a token between an employer and worker into wages automatically. First establish whether the recipient is an employee and whether the transfer is payment for services. Then document the valuation and process it through payroll.

How do I determine whether the worker is an employee or an independent contractor?

Classification comes before tax calculation. Calling a payment “crypto,” paying it to a wallet, or using a contractor agreement does not by itself determine status. Apply the ordinary worker-classification analysis and keep the facts supporting the result.

Worker status How the digital-asset amount is treated Typical federal reporting path
Employee FMV in U.S. dollars when received is wages. Apply applicable income-tax withholding, FICA, and FUTA. Payroll deposits and employment-tax returns; report wages on Form W-2.
Independent contractor IRS FAQ 60 says FMV at receipt generally constitutes self-employment income subject to self-employment tax. Employer wage withholding does not apply under the employee path. Use the information-reporting rules that apply to the contractor, rather than treating the payment as employee wages.

If the facts are mixed or the relationship changes during the year, resolve classification before issuing payments. A misclassified worker can create back withholding, FICA, FUTA, reporting, and penalty exposure. The IRS digital-asset FAQ addresses the tax character after status is established; it does not replace the general worker-classification rules.

How do I value cryptocurrency wages and identify the receipt date?

Use the asset’s FMV in U.S. dollars at the time the employee receives it. Keep enough evidence for another person to reproduce the amount, including the asset, quantity, valuation source, date, time, and transaction identifiers.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Exchange-facilitated payments

When an exchange facilitates the transfer, the exchange-recorded dollar value is relevant to the receipt. Save the exchange statement or transaction export showing the quantity, price, timestamp, and transaction or order identifier. If the exchange supplies a time zone, preserve it and record how it maps to the payroll period.

On-chain transfers

For an on-chain transaction, receipt occurs when the transfer is recorded on the distributed ledger. Capture the transaction hash, block or ledger reference, ledger timestamp, wallet addresses used by the parties, quantity, and the USD price source used at that time. A wallet-interface display generated later is not a substitute for contemporaneous evidence if it does not show the receipt time.

Peer-to-peer transactions

For a peer-to-peer transfer, use FMV at the time the transaction is recorded on the ledger. The IRS FAQ allows the taxpayer to select a valuation method, but the taxpayer must be able to establish that the selected value accurately represents FMV. Preserve the market source, price methodology, timestamp, and a short explanation of why that source represented the asset’s market at the receipt time.

Build a payroll valuation record

  • Employee name or payroll identifier and worker status.
  • Digital-asset name, network, quantity, and any transaction fee treatment used in the payroll calculation.
  • Receipt date and exact time, with time zone or ledger-time convention.
  • U.S.-dollar FMV, price source, market or exchange identifier, and retrieval or export date.
  • Blockchain transaction hash or exchange order and settlement reference.
  • Approval record showing who reviewed the valuation and entered it into payroll.

Do not value the wage using the token’s price when the payroll team happens to process the transaction later. The relevant event is receipt, and the evidence should connect the dollar amount to that event.

Which federal payroll taxes apply to crypto wages?

Once the FMV is established, calculate payroll taxes as you would for other taxable wages, using the employee’s facts and the current-year IRS procedures. Cryptocurrency does not create a separate federal payroll-tax category or eliminate ordinary withholding and employer obligations.

Federal income-tax withholding

Include the dollar FMV in the employee’s taxable payroll for the pay period and apply the withholding method required by the current 2026 Publication 15 (Circular E) and the employee’s withholding information. Do not apply a guessed “crypto rate”; withholding depends on the employee’s wages, pay frequency, Form W-4 information, and the current-year tables or computational procedures.

FICA: Social Security and Medicare

The employee and employer portions of Social Security and Medicare generally apply to the FMV of employee digital-asset wages, subject to the ordinary statutory limits, additional-tax rules, and exceptions that depend on the employee and payroll facts. Use the current-year instructions rather than carrying forward a prior year’s wage base or rate.

FUTA

Include the applicable wage amount when determining the employer’s federal unemployment-tax obligation, subject to the normal FUTA rules and wage limits. FUTA is an employer liability; it is not an amount to take from the employee’s wallet transfer.

Noncash-wage treatment

Publication 15 generally treats noncash in-kind wages as subject to federal income-tax withholding, Social Security, Medicare, and FUTA based on FMV when provided. It lists exceptions for certain household work, agricultural labor, and services outside the employer’s trade or business. Digital-asset wages are addressed independently in the IRS digital-asset FAQ, so do not assume that a noncash exception automatically excludes a cryptocurrency payment.

The sources do not establish a single withholding percentage, wage-base amount, or universal exception for every employee. Enter the FMV into the same payroll-tax calculations used for the employee’s other taxable compensation and apply the current-year rules to the full fact pattern.

How do I run a cryptocurrency wage through payroll?

Use a controlled handoff between the wallet or exchange record and the payroll ledger. The following sequence keeps the tax event, valuation, calculation, and reporting connected.

  1. Confirm status and payment purpose. Identify the recipient as an employee or contractor and document that the transfer is compensation for services. Stop and resolve an uncertain classification before processing it as wages.
  2. Capture the receipt event. Record the asset, quantity, transaction reference, ledger or exchange timestamp, and the wallet or exchange account that delivered it.
  3. Determine the USD FMV. Use the exchange-recorded value for an exchange-facilitated receipt, or FMV at ledger-recording time for on-chain and peer-to-peer receipts. Preserve the source and method, including evidence that a peer-to-peer value accurately represented FMV.
  4. Create a payroll earning entry. Enter the USD FMV as taxable employee compensation for the appropriate pay period. Keep the token quantity as supporting detail, but use the dollar amount for payroll calculations and wage reporting.
  5. Calculate withholding and employer taxes. Apply the current Publication 15 procedures for federal income-tax withholding, employee and employer FICA, and FUTA as applicable. Include other cash wages in the same payroll run so the calculations reflect the employee’s total compensation.
  6. Plan the cash needed for remittance. A token transfer may leave no dollars with which to remit withheld taxes. Before promising an all-crypto pay arrangement, establish how the payroll account will obtain the cash required for employee withholding and employer liabilities and document the arrangement in the payroll process.
  7. Reconcile the ledger to payroll. Match the payroll earning entry to the transaction hash or exchange record, verify the USD conversion, and have a second reviewer approve material or unusual valuations.
  8. Release the payment and retain the evidence. Store the payroll register, valuation file, transaction record, tax calculation, and approvals together under the employee and pay-period records.

Payroll software can automate arithmetic, but the employer remains responsible for the receipt timestamp, FMV support, worker classification, deposits, and filings. A system that stores only token quantities or a current market quote does not, by itself, demonstrate the wage value at receipt.

When must I deposit and file the federal employment taxes?

Follow the deposit schedule and return instructions in the current Publication 15. The schedule depends on the employer’s applicable IRS deposit status and the tax liability, so use the employer’s current notice and the publication’s calendar rather than an informal monthly or quarterly assumption.

Withheld federal income tax, employee Social Security, and employee Medicare are trust-fund taxes. The IRS warns that failing to withhold, deposit, or pay them can lead to the trust fund recovery penalty, which can reach responsible individuals. Keep a calendar that covers each deposit deadline, the relevant employment-tax return, and any year-end reconciliation.

  • Reconcile the payroll register to the deposit confirmation for every period containing digital-asset wages.
  • Investigate a missed or late deposit immediately; do not wait for the annual W-2 process.
  • Retain amended calculations and explanations when a valuation or classification correction changes a deposit.
  • Use the current-year IRS forms and electronic-filing or payment instructions in effect for the filing year.

The IRS overview of employer responsibilities is available in Understanding employment taxes. It explains the federal withholding, FICA, and FUTA framework but does not replace the detailed schedules in Publication 15.

How do I report cryptocurrency wages on Form W-2?

Report the employee’s applicable wage amount in U.S. dollars through the normal Form W-2 process. The 2026 General Instructions for Forms W-2 and W-3 specifically state that the FMV of virtual currency paid as wages is subject to withholding, FICA, and FUTA and must be reported on Form W-2.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Use the same employee information, wage-period reconciliation, and filing controls used for cash compensation. The token quantity and wallet transaction details belong in supporting payroll records; they do not replace the dollar wage amounts required on the form. Check the current W-2 instructions for electronic filing, furnishing, corrections, and deadlines because those administrative requirements can change by year.

Before furnishing the form, reconcile:

  • Total digital-asset FMV entered as wages during the year.
  • Federal income tax withheld and the employee and employer FICA amounts calculated from those wages.
  • FUTA wages and tax included in the employer’s records.
  • All payroll deposits and employment-tax returns that include the digital-asset compensation.
  • Any corrected valuation, reversed transfer, or reclassified payment reflected consistently in the payroll register and year-end forms.

For general filing information, see the IRS About Form W-2 page and the current W-2/W-3 instructions.

What records must an employer keep?

The 2026 Publication 15 record rule requires employment-tax records to be retained for at least four years. That record set includes the FMV of in-kind wages. Keep the crypto evidence with the ordinary payroll records rather than in a separate wallet system that cannot be tied to the employee’s wage entry.

Minimum record set

  • Worker classification determination and supporting facts.
  • Employment agreement, compensation authorization, and pay-period dates.
  • Asset type, network, quantity, wallet or exchange identifiers, and transaction hash or order reference.
  • Receipt timestamp, time zone or ledger convention, and the event showing when the employee obtained control of the asset.
  • USD FMV calculation, source export or market data, methodology, and reviewer approval.
  • Payroll register, withholding calculations, employer-tax calculations, deposit confirmations, and employment-tax returns.
  • Form W-2 workpapers, furnished copy, filing confirmation, and any correction documentation.

Longer retention may be prudent when a return, examination, employment dispute, or other legal requirement remains open. The four-year period is the minimum specified in the cited employment-tax guide, not a guarantee that every other record-retention rule ends at the same time.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

How do exchange, on-chain, and peer-to-peer payments differ?

The tax result for an employee is the same wage concept, but the evidence available for FMV and receipt time differs. Design the payroll control around the transaction channel.

When a transaction spans a calendar year, use the documented receipt event and preserve the exact time convention. Do not move the wage into a more convenient pay period merely because payroll approval occurred later.

What state and local rules still need checking?

Publication 15 covers federal employment taxes and directs employers to state or local tax departments for their rules. The federal sources do not establish whether a particular state or city permits an employer to satisfy wages in digital assets, requires payment in U.S. currency, imposes a specific pay-stub disclosure, or uses a different valuation rule.

Before launching a crypto-pay program, check each jurisdiction where an employee works, not only the employer’s headquarters. Review wage-payment, minimum-wage, withholding, unemployment, pay-statement, recordkeeping, and money-transmission requirements as applicable. A compliant federal W-2 process does not answer those local questions.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

  • Confirm whether noncash wages are permitted and how the jurisdiction defines wage value and payment timing.

  • Document any location-specific limits or required employee notices before changing the compensation plan.

What are the most common payroll failures and how can I fix them?

Recording the token quantity but not its dollar value

Why it fails: payroll taxes and Form W-2 reporting require the wage amount in U.S. dollars. Fix: create a contemporaneous FMV record tied to the receipt event and retain the source and methodology.

Using the price at payroll-processing time

Why it fails: service income is measured at FMV when received, not when an administrator later enters the transaction. Fix: use the exchange or ledger event that establishes receipt and explain any time-zone conversion.

Assuming a contractor agreement eliminates withholding

Why it fails: worker status depends on the relationship and facts, not the payment medium or label. Fix: complete the classification analysis first; use the employee payroll path when the worker is an employee.

Paying tokens without a cash-remittance plan

Why it fails: withheld taxes and employer liabilities still have to be deposited in cash through the federal process. Fix: design the funding and reconciliation process before the first pay run and test it with the payroll administrator.

Ignoring state and local requirements

Why it fails: federal guidance does not determine every wage-payment or tax rule. Fix: obtain requirements from each relevant state or local tax and labor agency before implementation.

Keeping only a wallet address

Why it fails: an address does not prove who received the wage, when receipt occurred, or how the USD value was determined. Fix: retain the transaction proof, timestamp, valuation source, payroll entry, and reviewer approval together.

What should an employer’s implementation checklist include?

Use this checklist for each employee payment and for the program as a whole:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Classify each worker and document employee or contractor status.
  2. Define which wallet, exchange, and ledger event constitutes receipt.
  3. Choose a repeatable FMV source and a backup evidence process for outages or missing quotes.
  4. Capture quantity, USD value, timestamp, transaction reference, and reviewer approval.
  5. Map the USD value into the payroll earning code used for taxable wages.
  6. Calculate federal income-tax withholding, employee and employer FICA, and FUTA under the current Publication 15 rules.
  7. Confirm that the payroll account can fund required cash deposits even when compensation is delivered in tokens.
  8. Reconcile deposits, employment-tax returns, and annual Form W-2 amounts to the crypto transaction ledger.
  9. Retain records for at least four years and preserve longer when another legal or examination requirement applies.
  10. Obtain state and local wage-payment and tax requirements for every employee work location.

The central control is simple: establish employee status, convert the payment to documented U.S.-dollar FMV at receipt, run ordinary payroll taxes, deposit and report on schedule, and preserve the evidence.

Frequently Asked Questions

Is there a special IRS payroll-tax rate for cryptocurrency wages?

The cited IRS guidance does not create a separate crypto payroll rate. Employers use the ordinary current-year withholding, FICA, and FUTA procedures in Publication 15, with the employee’s pay, withholding information, and applicable limits determining the calculation.

Does paying a stablecoin instead of Bitcoin change the wage analysis?

The IRS FAQ discusses digital assets generally and does not provide a wage-tax exemption based on a token’s name or price stability. Treat the payment according to its U.S.-dollar FMV at receipt and verify any additional state-law requirements for the specific asset.

Can an employee’s crypto compensation be reported on Form 1099-NEC instead of Form W-2?

Only a worker who is properly classified as an independent contractor follows the contractor reporting path. Compensation for an employee’s services remains payroll wages and is reported on Form W-2, regardless of whether the transfer was made in tokens.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What if the blockchain timestamp and the payroll system use different time zones?

Keep the original ledger timestamp and state the time-zone convention used in the FMV calculation and payroll record. Consistent conversion and documentation are more defensible than silently substituting the time shown by a local payroll interface.
