Buy AI for a safety-critical service only after proving that AI is appropriate, the data is fit and lawful, the system performs acceptably in normal and adverse conditions, and people can remain accountable for its effects. Treat the product as a governed service inside an operational process—not as a model that can be accepted once and left alone. A defensible purchase starts with a public-benefit problem statement, a multidisciplinary team, pre-tender impact and data assessments, output-based requirements, comparable testing, and a contract covering oversight, change, incidents, portability and retirement.
What does a safe AI procurement actually evaluate?
A safe procurement evaluates the complete service: the decision or task being supported, the people affected, the data flows, the model and interfaces, human roles, security controls, supplier capability, operating costs and the plan for failure or exit. “Accurate” by itself is not an acceptance criterion. A system can score well on an average test while producing unacceptable false positives for a vulnerable group, failing on degraded inputs, or preventing operators from understanding and correcting an error.
The UK Government’s Guidelines for AI procurement (29 January 2025) recommends approaching a problem with the mindset of “how could AI technologies potentially benefit us?” rather than forcing the problem to fit an AI solution. Keep a non-AI option in the business case and record the point at which the organisation will stop if evidence does not justify deployment.
How do we define the problem and public benefit before talking to suppliers?
Write an outcome-based problem statement before issuing a request for information or tender. It should describe the service outcome, not a preferred algorithm or product category.

- Service need: State the operational task, who performs it now, and what is failing or costing users.
- Public benefit: Explain how a change would improve safety, access, timeliness, quality or another public outcome, and which communities could gain or lose.
- AI hypothesis: Record why AI might help and what evidence would disprove that hypothesis. Compare rules, process redesign, additional staff, conventional software and other non-AI approaches.
- Success measures: Define task-level measures, acceptable error costs, service levels, accessibility outcomes and user-experience measures before seeing vendor claims.
- Decision gates: Set go/no-go points for data readiness, market evaluation, pilot, live operation and retirement. Name the accountable decision owner at each gate.
This prevents “solutioneering,” in which a supplier demonstration becomes the definition of the problem. It also gives evaluators a basis for rejecting a technically impressive system that cannot deliver the intended public benefit.
Who should be on the AI buying and assurance team?
Use a multidisciplinary team with authority to pause the procurement. No single technical or commercial role can assess operational, legal, equality and safety consequences.
- Domain and service owners who understand the real workflow and consequences of an error.
- Procurement and commercial staff who can shape competition, pricing, liability and exit terms.
- Data engineers and systems architects who can verify data flows, interfaces, resilience and integration effort.
- Model or evaluation specialists who design representative, edge-case and degraded-input tests.
- Security and information-assurance staff who assess threats, access, supply chain and incident response.
- Legal, privacy and records-management specialists who check lawful processing, retention and sharing.
- Ethics, equality and accessibility specialists, with meaningful input from affected communities where possible.
- Service operators, support and training leads who can judge workload, escalation and practical usability.
Require the supplier to name delivery staff with the skills needed for the service and to maintain adequate diversity of perspective. A sales demonstration is not evidence that the proposed implementation team can operate a high-consequence system.

How do we check whether the data is ready?
Complete a data-readiness assessment before tender. A model cannot compensate for data that is missing, unlawfully obtained, unrepresentative or too poor for the decision being supported.
- Relevance and coverage: Confirm that the data represents the populations, locations, languages, operating conditions and unusual cases the service will encounter.
- Quality: Measure errors, missing fields, label consistency, duplication, time lag and changes in collection practice.
- Provenance and rights: Document where each dataset came from, the legal basis for use, licences, ownership, access permissions and any sharing limits.
- Classification and retention: Record sensitivity classifications, storage locations, retention periods, deletion rules and cross-border transfers.
- Bias and impact: Look for historical under-representation or patterns that could produce unequal outcomes. Decide how gaps will be mitigated and who accepts residual risk.
- Supplier access: Specify what data leaves the organisation, who can view it, whether it is used to train a general or customer-specific model, and how copies are controlled.
Ask vendors to identify the minimum data needed, assumptions about labels and sampling, and how performance changes when fields are absent or stale. If the required data cannot be made lawful and representative, pause the AI route rather than lowering the standard.

How should safety, rights and equality impacts be assessed before tender?
Assess impacts before selecting a supplier, then revisit the assessment whenever the design, data, users or purpose changes. Record the harm, likelihood, severity, mitigation, evidence required, owner and decision gate for each material risk.
- Safety: Identify physical, health, financial or service-continuity consequences of wrong or unavailable outputs. Define safe states and human intervention.
- Civil rights and privacy: Examine surveillance, profiling, due-process, confidentiality and secondary-use risks.
- Equality and accessibility: Test effects on protected or vulnerable groups, language communities and people using assistive technologies.
- Security: Consider prompt or data manipulation, unauthorised access, model extraction, supply-chain compromise and failure of connected systems.
- Economic and operational effects: Include displacement of tasks, new workload, supplier dependency, service degradation and recovery costs.
The UK Data and AI Ethics Framework (updated 18 December 2025) and the UK Department for Science, Innovation and Technology’s AI Risk Management Toolkit (8 September 2026) provide current public-sector structures for documenting these questions. Use their principles alongside the organisation’s own statutory and sector controls; a framework does not replace a service-specific risk decision.

Describe the challenge, required outcomes, interfaces, constraints and measurable thresholds, then let suppliers propose methods. At the same time, require enough technical information to make the proposals comparable and auditable.
- Define the input and output contract, latency or availability needs, accessibility requirements and permitted human decisions.
- Set performance thresholds for representative, edge and degraded cases, including separate limits for false positives and false negatives where their costs differ.
- Require documentation of model type, versions, training-data provenance, known limitations, evaluation design and intended operating conditions.
- Specify logging, monitoring, explainability, reproducibility, security, incident notification and integration requirements.
- State prohibited uses, data-sharing boundaries and conditions under which the system must defer to a person or stop.
Output-based requirements preserve competition and reduce the risk of buying a fashionable technique instead of a service that works. They do not justify accepting a black box: disclosure must be sufficient for evaluators, operators and auditors to understand limitations and accountability.
How should competing AI suppliers and products be compared?
Use the same test protocol, data partitions, operating assumptions and scoring rules for every option. Request independent testing or audit evidence where the consequence and cost justify it, and verify vendor-supplied results rather than treating them as benchmarks.

| Evaluation dimension | Evidence to request or produce | Decision question |
|---|---|---|
| Mission performance | Results on representative, edge and degraded inputs; confidence information; error analysis | Does it meet the service threshold where it will actually operate? |
| Safety and failure modes | Unsafe-output tests, fail-safe behaviour, human override and recovery demonstrations | What happens when the model is wrong, unavailable or manipulated? |
| Fairness and accessibility | Disaggregated results, accessibility testing and impact analysis for affected groups | Are burdens and errors acceptable across the populations served? |
| Explainability and auditability | Reason codes or explanations, complete event logs, reproducible run records | Can an operator, reviewer or court reconstruct a decision? |
| Data governance | Data-flow map, residency, retention, deletion, training-use policy and access controls | Does use remain lawful and within the organisation’s instructions? |
| Cybersecurity and resilience | Security assessment, dependency inventory, recovery objectives and incident history | Can the service withstand attack, outage and supplier failure? |
| Interoperability and portability | Interface specifications, export formats, migration tests and open standards | Can the organisation change provider without rebuilding the service? |
| Integration and operations | Implementation plan, operator training, staffing assumptions and support model | Can the service team run it safely after handover? |
| Whole-of-life cost | Implementation, usage, monitoring, assurance, updates, training and exit costs | What will the service cost over its full life, not just at purchase? |
| Supplier viability and governance | Relevant skills, subcontractors, governance maturity, continuity plan and incident record | Can this supplier meet public-sector obligations for the contract term? |
Weight the criteria according to harm and mission importance. Do not let a low price or a single aggregate accuracy score outweigh a failure mode that could make the service unsafe.
What AI-use disclosures should a government contract require?
Require suppliers to disclose AI use both in the proposed product and in the supplier’s own delivery of the service. The UK Cabinet Office’s PPN 017 (updated 17 February 2025) states that where AI is likely to be used in service delivery, commercial teams may require suppliers to declare it and provide further details.
- Where AI is used, which tasks it performs, and which subcontractors or hosted services are involved.
- What customer, personal or operational data is processed; where it is stored; and whether it trains a shared, foundation or customer-specific model.
- What safeguards, access controls, testing, human review and incident processes apply.
- How the supplier will notify the organisation of a new model, changed data source, material performance change or new subcontractor.
- Which claims are supported by independent evaluation and which are the supplier’s own estimates.
Make disclosure a continuing obligation, not a one-time questionnaire. Additional due diligence or a contract amendment may be needed when a supplier introduces AI after award.
Which contract terms prevent unsafe dependence and vendor lock-in?
The contract should allocate accountability across the complete lifecycle and preserve the organisation’s ability to inspect, correct, replace or retire the service.
- Responsibility: Assign owners for operational decisions, model failures, data breaches, security incidents and regulatory cooperation. State that automation does not transfer the organisation’s public duties.
- Audit and records: Require tamper-evident logs, access for authorised audits, model and data-version records, test evidence and retention periods.
- Change control: Define material change, advance notice, revalidation, approval and rollback. A model update must not silently alter a high-consequence decision.
- Data use: Prohibit unapproved secondary use, set retention and deletion rules, control sub-processing and require return or deletion at termination with evidence.
- Security and resilience: Set baseline controls, vulnerability reporting, incident deadlines, continuity arrangements, recovery testing and service levels.
- Human capability: Include operator training, documentation, knowledge transfer and access to appropriately skilled support.
- Portability and exit: Require export of data, configurations, prompts or rules where applicable, logs and documentation in usable formats; define migration assistance, transition support and end-of-contract deletion or return.
- Interoperability: Prefer open standards and explainable interfaces so another provider can connect without a proprietary rewrite.
Price schedules should expose usage, storage, support, assurance, update and exit charges. A low initial quote can conceal dependence if the supplier controls the data format, evaluation evidence or only practical route to continued operation.

How do we validate an AI system before deployment?
Validation is a staged acceptance process, not a demonstration. The service owner should approve each gate using evidence generated under conditions that resemble live use.
- Freeze the intended use: Document users, decisions, prohibited uses, data flows, human authority and the risk assessment version being tested.
- Prepare controlled test data: Use lawful, representative cases held out from supplier tuning, with edge, rare, adversarial and degraded inputs. Protect personal information and record provenance.
- Run technical evaluations: Measure task performance, false-positive and false-negative costs, robustness, calibration, fairness, accessibility, latency, availability and security behaviour.
- Test the human process: Observe operators using explanations, overrides, escalation and feedback paths. Check whether workload, automation bias or unclear responsibility creates new risk.
- Exercise failure and recovery: Simulate bad inputs, outages, model refusal, compromised accounts, supplier incidents and rollback. Verify that a safe manual or alternative process works.
- Review independently: Have security, privacy, equality, legal and domain reviewers challenge the evidence. Obtain external assurance when internal expertise or consequence warrants it.
- Record residual risk: List unresolved limitations, compensating controls, owners, monitoring thresholds and the expiry date of the approval.
- Run a limited release: Start with bounded users or decisions, retain meaningful human authority and compare live results with the acceptance baseline before expansion.
Acceptance should include reproducibility: another authorised evaluator must be able to rerun the defined tests and understand any difference caused by a model or data change.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. How should the system be monitored after go-live?
Operate the model as a changing service. The UK procurement guidance notes that implementation plans, sustainable ongoing evaluation and mechanisms to feed feedback into the data model are crucial for ethical use.
- Track performance, error types, subgroup outcomes, input drift, data quality, availability and operator overrides against agreed thresholds.
- Give users and affected people a route to report harmful, incorrect or inaccessible outputs, and route reports to an accountable service owner.
- Define incident severity, escalation contacts, investigation records, notification duties and conditions for suspending automated operation.
- Review impacts periodically and whenever purpose, population, data source, model version or connected system changes.
- Re-test after updates, retraining, security events or material drift; do not rely on the original acceptance report.
- Maintain a retirement trigger and an orderly process to preserve records, notify users, switch to a fallback and delete or return data.
Which laws and policies must a public-sector buyer map?
Build a requirements map for the jurisdiction, sector and use case before tender and update it through operation. UK central-government teams should check PPN 017 alongside applicable procurement, data-protection, security, records, accessibility and equality requirements. The named UK guidance does not remove the need for legal advice on a specific service.
Public administrations in the European Union must determine whether they are acting as an AI-system provider, deployer or another regulated role under the EU AI Act. The resulting obligations and safeguards depend on the system’s risk category and use. Document that classification and the evidence supporting it; do not assume that buying a hosted service transfers the deployer’s responsibilities.

What procurement mistakes most often make AI unsafe?
- Starting with a product: A compelling demo replaces a public-benefit problem statement and a non-AI option.
- Using average accuracy as the verdict: Aggregate scores hide subgroup harms, costly error types and degraded-input failures.
- Skipping data due diligence: Teams discover unlawful access, missing populations or prohibited training use after award.
- Leaving AI out of supplier governance: A subcontractor introduces a model without disclosure, testing or change control.
- Accepting “human in the loop” as a slogan: Operators lack time, authority, explanation or a functioning fallback.
- Buying a closed interface: Proprietary formats and undocumented behaviour make audit, migration and retirement impractical.
- Treating approval as permanent: Model updates, data drift and new users invalidate the original evidence.
Correct these weaknesses by making each one an explicit requirement, test, contract duty or monitoring threshold owned by a named person.
What should the final decision record contain?
Keep a concise decision record that another accountable official can inspect without reconstructing the procurement from emails. Include the problem and public-benefit case, alternatives considered, team and roles, data and impact assessments, requirements, supplier scores, test datasets and results, exceptions, legal and policy mapping, contract controls, residual risks, approval expiry and monitoring plan. Record why the chosen option is proportionate to the expected benefit and why rejected options failed the stated thresholds.
Frequently Asked Questions
Can we pilot an AI system with real personal data?
Only when the processing has a documented lawful basis, appropriate safeguards, access controls, retention limits and a clear purpose. Start with controlled or de-identified data where it can answer the validation question, then obtain explicit approval before exposing additional sensitive records.
Is an open-source model automatically safer for a public service?
No. Licensing and inspectable code may help portability or review, but safety still depends on data provenance, testing, security maintenance, operating controls and who is accountable for updates. Apply the same performance, impact, audit and incident criteria as for a proprietary system.
What should happen when a supplier releases a new model version?
Treat it as a potential material change. Require advance notice, a description of changed behaviour, repeat the relevant safety, fairness, security and performance tests, obtain approval, and keep a rollback path before allowing the version into consequential work.
How can a small public body obtain independent assurance?
Define the specific assurance questions and risk threshold first, then procure proportionate external testing or peer review for the highest-consequence areas. Independence matters most where the supplier produced the original benchmark or where the buyer lacks specialist evaluation and security skills.
