Do not treat an AI tool as safe merely because it is popular, polished, or useful in a quick demo. Before using one, define the task and possible harm, map every piece of data and permission involved, read the provider’s privacy and security terms, test the system with low-risk examples, verify its outputs, and keep a qualified person accountable for consequential decisions. Start with the least data, access, and autonomy that can accomplish the job, then document when you will pause or remove the tool.
The right level of scrutiny depends on the use case. Drafting a private shopping list is different from processing medical records, making hiring recommendations, or allowing an agent to send payments. The framework below helps you match evidence and controls to that risk instead of relying on a universal “safe AI” label.
What does it mean for an AI tool to be safe and private?
Safety covers whether the system behaves reliably, resists misuse, protects its environment, and fails in a controlled way. Privacy covers what information enters the system, where it goes, how long it remains, who can access it, whether it is reused for training or other purposes, and whether you can delete it. A tool can be strong in one area and weak in another: encrypted transport does not stop a provider from retaining prompts, and a private deployment can still produce dangerously inaccurate advice.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitchesNational Institute of Standards and Technology (NIST) describes trustworthy AI as valid and reliable, safe, secure and resilient, accountable and transparent, explainable and interpretable, privacy-enhanced, and fair with harmful bias managed. Those characteristics should be evaluated across the tool’s lifecycle, not only during a sales demonstration. NIST’s voluntary AI Risk Management Framework (AI RMF 1.0), released January 26, 2023, is use-case agnostic and can structure that work.

Use this rule of thumb: treat every prompt, upload, connector, and generated output as a disclosure or consequential artifact until the provider’s terms, technical controls, and your own testing establish otherwise.
How do I decide whether the use case is too risky?
Write down the intended purpose before comparing products. The purpose determines what evidence you need and how much human oversight is required.
Describe the task and affected people
- State exactly what the tool will do, such as summarize internal tickets, classify applications, or draft customer replies.
- Identify who could be affected directly or indirectly, including customers, employees, patients, students, or people represented in a dataset.
- Define the consequence of an incorrect, biased, leaked, unavailable, or manipulated result.
- Record whether the output is advisory, operational, or capable of triggering an external action.
The Office of the Australian Information Commissioner (OAIC) recommends asking whether a product is appropriate and reliable for the intended use and whether it has actually been tested for that use. A low-impact drafting task may be suitable with basic controls. A system influencing access to housing, employment, healthcare, education, benefits, credit, or legal rights needs stronger evidence, independent validation, explanations, correction processes, and qualified human review.
Assign an impact level
Create a simple internal rating—low, moderate, or high—based on the severity and reversibility of harm. High-impact uses should require approval before launch, a named owner, documented tests, an appeal or correction route, and a stop condition. The rating is a risk-management decision, not a claim that a particular vendor is safe.
What data does the AI tool receive and retain?
Make a data map before entering a real prompt. Include information that is obvious to a user and information sent automatically by an integration.
Inventory every data flow
- Prompt text, attachments, images, audio, video, code, and generated outputs.
- Account identifiers, email addresses, device details, IP addresses, payment records, and usage telemetry.
- Files indexed by retrieval or search features and content pulled from connected drives, mailboxes, calendars, or ticketing systems.
- Inferences the system creates, such as a profile, topic label, risk score, sentiment, or predicted preference.
- Logs, feedback, abuse reports, support conversations, and administrator exports.
For each item, document where it is processed and stored, the retention period, backup and deletion behavior, the legal or contractual basis for processing, and whether data can cross national borders. Check whether the provider keeps deleted content in backups or safety logs and how long those copies persist.

Ask who can see it
Read the privacy policy, terms, administrator documentation, and data-processing terms together. Look for access by employees, contractors, support personnel, safety reviewers, affiliates, subprocessors, and law-enforcement authorities. OAIC specifically advises checking whether terms permit developer access to personal information in inputs or outputs and whether an opt-out or other control exists.
Separate service operation from model training
“We do not train on your data” can mean different things. Determine whether prompts are used to improve a general model, tune a private model, detect abuse, evaluate quality, or provide personalized features. Ask whether the setting applies to future data only, whether it covers uploaded files and outputs, and whether an administrator can enforce it for every user. Record the product edition, geography, and date because these settings can differ by plan and change over time.
How can I minimize exposure before testing?
Use representative data without using sensitive data. The goal is to learn how the system behaves while limiting the consequences of a mistake or leak.
- Remove direct identifiers. Replace names, email addresses, account numbers, exact dates of birth, addresses, and identification numbers with consistent placeholders.
- Remove secrets. Never paste passwords, API keys, private certificates, recovery codes, or unannounced vulnerabilities.
- Reduce context. Supply only the fields needed for the task. Extra conversation history and irrelevant documents increase exposure without improving the result.
- Use synthetic or public examples. Preserve the structure and difficulty of the real task while changing the underlying people, transactions, and confidential facts.
- Control copies. Keep test files in an approved location, restrict downloads, and delete temporary exports when testing ends.
CMS guidance says never disclose personally identifiable information, protected health information, or sensitive CMS data to publicly accessible AI platforms. Sensitive information should move only through secure channels to authorized personnel with a legitimate need to know. Apply the same discipline to confidential business information, client materials, source code, and unpublished research.
Which privacy terms should I inspect?
Do not stop at a short privacy summary. Search the complete terms for the following questions and save a dated copy for your records.

| Question | Evidence to find |
|---|---|
| What is collected? | Prompt and file categories, account data, telemetry, cookies, device data, and inferred information. |
| How long is it kept? | Default retention, log retention, backup periods, deletion timing, and exceptions for safety or legal claims. |
| Is it used for training? | Default training use, opt-out scope, administrator controls, treatment of feedback, and whether human reviewers inspect samples. |
| Who receives it? | Employees, contractors, subprocessors, affiliates, integration partners, and authorities. |
| Can I delete or export it? | Account and content deletion steps, export format, verification, and residual copies. |
| Where is it processed? | Hosting regions, international transfers, regional restrictions, and applicable law. |
| What changes without notice? | Terms, model versions, features, subprocessors, retention, and training settings, plus the notice period. |
If a term is vague, ask the provider for a written answer that names the relevant product and plan. Treat an unanswered question as an unresolved risk, not as an assurance.

What security evidence should an AI provider supply?
Security claims should explain how the service protects confidentiality, integrity, and availability and how it responds when controls fail. The joint guidance on deploying AI systems securely, published by CISA and partner agencies on April 15, 2024, emphasizes known-vulnerability mitigation and the ability to protect, detect, and respond to malicious activity.
Access and isolation
- Require strong administrator authentication, role-based access, least-privilege service accounts, and timely removal of departed users.
- Ask how customer data is isolated from other tenants and from the provider’s development and testing environments.
- Check whether logs show administrator access, connector use, exports, and policy changes, and whether customers can review those logs.
Protection and resilience
- Understand encryption in transit and at rest, key-management responsibilities, and any customer-managed key option.
- Ask about vulnerability management, security testing, patch timelines, backup recovery, rate limits, and service availability commitments.
- Request the incident-notification process: what counts as an incident, how quickly notice is sent, what evidence is provided, and how the provider supports containment.
The Information Commissioner’s Office (ICO) warns that AI can exacerbate security risks and that controls must be proportionate to the specific processing risk. There is no one-size-fits-all security checklist. A public text prompt and an agent connected to production systems require different safeguards.
How do I test an AI tool for unreliable or harmful behavior?
Test before deployment with realistic, non-sensitive cases, then record enough detail to reproduce every result. Fluent wording is not evidence of accuracy.

- Collect representative tasks covering normal, ambiguous, incomplete, and adversarial inputs.
- Include edge cases relevant to affected groups, languages, disabilities, dialects, and formatting styles.
- Prepare authoritative references or expert judgments for each expected outcome.
- Run the same cases across dates, model versions, and account settings to detect drift.
Evaluate more than factual accuracy
- Correctness: Does the answer match reliable sources, calculations, or expert review?
- Uncertainty: Does the tool acknowledge missing information instead of inventing a confident answer?
- Refusal: Does it decline unsafe, illegal, or unauthorized requests while still offering a useful safe alternative?
- Prompt-injection resistance: Can untrusted text override system instructions, expose hidden data, or trigger an unauthorized connector action?
- Fairness: Do error rates or recommendations differ materially across relevant groups?
- Reproducibility: Do equivalent inputs produce acceptably consistent results?
- Degradation: What happens when the service is slow, unavailable, rate-limited, or given a very long document?
OAIC recommends testing inaccurate responses and having people verify AI-derived personal information. NIST treats testing and evaluation as lifecycle activities, not a one-time acceptance test. Record the model and tool version, date, settings, prompt, input data category, output, reviewer, expected result, and disposition for every case.
When must a human review the output?
An AI output should not become a high-impact decision without qualified human judgment. The reviewer must have enough context, authority, time, and expertise to reject or correct the system rather than merely approve it.
Design an accountable workflow
- Name the person or team responsible for the decision, even when a vendor operates the model.
- Show the reviewer the source material, relevant uncertainty, and limitations; do not present a score without context.
- Require independent checks for identity, calculations, citations, eligibility, safety, and other consequential facts.
- Provide a correction and appeal route for people affected by an output.
- Keep an audit trail of the input, output, reviewer action, and final decision, subject to applicable privacy rules.
CMS guidance calls for human oversight and independent validation. NIST treats accountability and transparency as cross-cutting trustworthiness characteristics. A person who cannot inspect, understand, or challenge the result is not meaningful oversight.

How should I limit permissions and agent autonomy?
Give the tool only the accounts, files, connectors, and actions required for the stated task. Permissions are a separate risk from prompt privacy: a provider may protect a prompt while an over-privileged agent can still read or change too much.

- Connect a narrow folder or project rather than an entire drive or mailbox.
- Prefer read-only access for discovery and drafting; require a separate approval for writes, sends, deletes, purchases, or code deployment.
- Use short-lived credentials, scoped tokens, network restrictions, and separate test and production environments.
- Disable unused connectors and review permissions after every feature or model change.
Add controls for agentic systems
Guidance on careful adoption of agentic AI services, published by CISA and partner agencies on May 1, 2026, advises limiting autonomy so agents do not receive broad or unrestricted access, especially to sensitive data or critical systems. Combine strong identity management, layered defenses, threat modeling, continuous monitoring, and regular security assessment. Require confirmation before an irreversible action and make it possible to revoke access immediately.
What should I compare when choosing between AI tools?
Use the same questions and test cases for every candidate. A side-by-side record prevents a persuasive demo from outweighing material gaps.
| Comparison axis | Questions to ask | Evidence to record |
|---|---|---|
| Data practices | What is collected, retained, deleted, trained on, or shared? | Current policy, plan-specific settings, deletion process, and written provider answers. |
| Security and resilience | How are identities, encryption, isolation, logging, incidents, vulnerabilities, and outages handled? | Architecture details, assurance reports available to you, incident terms, and recovery commitments. |
| Reliability and safety | What testing covers accuracy, bias, refusals, injection, and performance degradation? | Your test results, provider evaluations, model version, and known limitations. |
| Transparency | Are documentation, explanations, change notices, and version history adequate? | Release notices, model cards or equivalent documentation, and records of changes. |
| Human control | Can users review, correct, appeal, override, and audit outputs? | Workflow design, reviewer roles, correction route, and audit-log fields. |
| Integrations and exit | What permissions and autonomy are needed, and can data and workflows move elsewhere? | Connector scopes, token controls, export format, termination steps, and deletion confirmation. |
| Context and obligations | Does the price, support model, geography, and applicable law fit the use? | Plan, region, support commitments, contractual terms, and internal legal review. |
Weight the first five axes most heavily when the tool affects people or sensitive information. Price or convenience cannot compensate for an unacceptable privacy or safety risk.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. How do I monitor the tool after approval?
Approval is the start of monitoring, not the end of evaluation. Establish a baseline, assign an owner, and define triggers that force a review.
Monitor these signals
- Changes to the model, system prompt, connectors, retention, training use, subprocessors, or hosting region.
- Accuracy, refusal, bias, latency, outage, and security metrics from representative samples.
- Prompt-injection attempts, unauthorized actions, unusual downloads, and access-log anomalies.
- User complaints, correction requests, near misses, incidents, and decisions overturned by human reviewers.
- New legal, contractual, regulatory, or organizational requirements.
Set explicit stop conditions
Pause or remove the tool when it suffers a material breach, cannot meet a required deletion or access control, shows unacceptable error or bias, changes terms without an acceptable transition, loses necessary auditability, or takes an unauthorized action. Document who can invoke the stop, how access is revoked, how affected people are notified, and how work returns to a safe fallback process.

OAIC calls for ongoing monitoring, audits, permitted-use policies, and staff training. Recheck the decision after a model or integration change and keep an audit trail of the evidence supporting continued use.
What are the most common warning signs?
- The provider cannot state retention, training use, deletion, processing location, or staff-access rules for the exact plan you would use.
- Privacy controls exist only as an individual setting that administrators cannot enforce or verify.
- Marketing promises “secure” or “private” without describing isolation, logging, incident response, or vulnerability management.
- The system discourages independent verification, hides its model or version, or gives no notice of material changes.
- An integration requests broad mailbox, drive, repository, or production privileges for a narrow task.
- There is no human owner, appeal path, export capability, or emergency revocation process.
- Testing uses only polished demonstrations and omits ambiguity, harmful requests, group differences, or prompt injection.
Any one warning sign may be solvable through configuration or contract. Several together indicate that the use case should be redesigned or rejected.
What should a written approval record contain?
A concise record makes the decision repeatable and gives the organization evidence when the tool changes.
- Purpose, impact rating, affected people, owner, and approved users.
- Data-flow map, prohibited data categories, retention and deletion decisions, and processing locations.
- Permissions, connectors, autonomy limits, authentication method, and logging coverage.
- Test plan, representative results, known failure modes, reviewer qualifications, and unresolved risks.
- Provider terms and security answers captured with product, plan, geography, and date.
- Monitoring schedule, change triggers, incident contacts, stop conditions, rollback steps, and training requirements.
Keep the record proportionate to the risk, but never omit the facts needed to reproduce the decision or stop the system safely.
Frequently Asked Questions
Can an AI provider’s employees read my conversations?
Possibly. Access may be available to support, safety, quality, security, or contracted personnel under the provider’s terms. Check the exact plan for human-review rules, access controls, logging, and opt-out options; do not assume that encryption prevents authorized provider access.
Is a local or self-hosted model automatically safer?
No. Local hosting can reduce transfer to a third party, but you still must secure the server, updates, logs, backups, credentials, connectors, and model supply chain. A poorly administered local system may expose more data than a well-controlled hosted service.
How often should an approved AI tool be reevaluated?
Reevaluate on a scheduled basis appropriate to the impact, and immediately after a model, terms, connector, hosting region, incident, or material workflow change. Trigger an unscheduled review when complaints, accuracy drift, or unauthorized behavior appears.
Recommended Free Tools
What should I do if an AI tool produces a harmful answer?
Stop the affected workflow, preserve the prompt, output, version, time, and relevant logs, and notify the responsible owner. A qualified reviewer should assess impact, correct or reverse the decision where possible, restrict the tool if needed, and update tests or controls before reuse.
