Evaluate an AI startup by starting with your business task and the consequences of failure, then testing the exact product and deployment you would buy. A credible decision combines product performance, supplier and dependency risk, data governance, security, human oversight, lifecycle cost, and contract protections. A polished demo, benchmark score, certification, or privacy statement alone cannot establish that the product is suitable.
Set a measurable threshold and a go/no-go rule before comparing vendors. Run representative and adversarial tasks, trace every data flow, verify who is responsible for each component, and make the startup put important promises about performance, security, updates, support, and exit into the contract.
What should you define before evaluating an AI startup?
Write the buyer’s problem in operational terms before looking at products. Identify who will use the system, which decision or task it supports, the outcome that matters, the current baseline, constraints, and the harm caused by an incorrect, biased, delayed, or unavailable result.
Specify the job, users, and stakes
- Users: name the people who enter data, review outputs, administer the service, and handle exceptions.
- Task and outcome: describe the action the system must improve, such as classifying requests, drafting a document for review, or detecting a condition for escalation.
- Baseline: record the existing human process, conventional software, or rule-based method, including its cost, speed, and error pattern.
- Constraints: list required integrations, latency, availability, accessibility, languages, geographic processing limits, and retention rules.
- Failure impact: state what happens if an output is wrong, unfair, leaked, delayed, or unavailable, and which errors require a human decision.
Set a minimum acceptable performance level, the evidence needed to demonstrate it, and a no-go condition. UK government procurement guidance recommends problem statements grounded in user needs and output-based requirements, together with impact assessment covering human and socioeconomic effects, data quality, unintended consequences, technical context, and whole-of-life costs. See the UK Guidelines for AI procurement.

Keep non-AI options in the comparison. A conventional workflow, a human service, or no purchase may meet the need with less dependency and risk.
How do you identify the exact product and supplier chain?
Evaluate the system you would actually deploy, not an unnamed model or a future roadmap. Record the contracting entity, product name, edition, version, deployment model, support channel, and all material suppliers.
Build a product identity record
- Legal entity that will sign the agreement and the entity that provides support.
- Product, release or model version, environment (cloud, private tenant, on-premises, or hybrid), and enabled features.
- Foundation models, APIs, retrieval or search services, cloud infrastructure, databases, monitoring tools, safety filters, and other dependencies.
- Subprocessors and locations where data, logs, telemetry, and backups are handled.
- Components that may change without customer approval, the notice period for changes, and the effect of an upstream outage or pricing change.
NIST SP 1326, published in July 2026, frames ICT supplier due diligence around foreign ownership, control or influence; provenance; resilience; foundational cyber practices; and supply-chain tiers. Its definition is useful here: “Due diligence research is the investigative process of researching all available, pertinent information about a given supplier or product so that informed decisions can be made on new acquisitions or existing systems.” Read the NIST SP 1326 publication.

What evidence should an AI startup provide for its claims?
Create a claim register rather than accepting marketing language. For each material claim, record the precise wording, product and version covered, test date, population and conditions, metric definition, evidence owner, independent verification, and unresolved uncertainty.

Request reproducible supporting material
- Evaluation protocol, datasets or data characteristics, sampling method, exclusions, and statistical treatment.
- Definitions for accuracy, precision, recall, hallucination, latency, uptime, safety, and any composite score.
- Known limitations, failure modes, abstention behavior, and conditions outside the tested range.
- Results by relevant user groups, languages, document types, environments, or other populations affected by your use.
- Change history showing which model, prompt, retrieval index, or safety component produced each result.
- Customer references with genuinely similar tasks, while treating references as supplementary rather than a substitute for your test.
The UK procurement guidance advises buyers to request documentation on development, testing methods, model approach, data origins, performance, and known limitations. It also emphasizes reproducibility, varied-condition testing, defined acceptable performance, accountability, and robust security. Link evidence to the exact release offered; a score for a public benchmark or an earlier version is not evidence for a changed deployment.
How should you test an AI product before selection?
Run a time-boxed pilot using representative work, realistic data, edge cases, and examples where the correct behavior is to abstain or escalate. Involve eventual users and domain experts, compare with your baseline, and define measures before viewing results.

Design the test set
- Sample normal work: include the volume, formats, languages, and variation the service will see after launch.
- Add consequential edge cases: include ambiguous, incomplete, adversarial, rare, and out-of-distribution inputs.
- Define expected actions: specify the correct output, acceptable alternatives, escalation trigger, and maximum error severity for each case.
- Measure the workflow: capture task success, error severity, latency, availability, human correction time, override rate, and performance for relevant groups.
- Record configuration: preserve prompts, model and retrieval versions, system settings, integrations, and test data identifiers so another evaluator can reproduce the run.
- Decide in advance: set the minimum threshold, remediation requirement, and go/no-go rule before scoring.
The UK’s Information Commissioner’s Office (ICO) recommends deciding acceptable accuracy before procurement, checking information accuracy and sources, considering accuracy KPIs or service-level agreements, assessing bias and discrimination, and setting a reasonable re-evaluation timetable. Its guidance also suggests asking about training, feature selection, tuning constraints, fairness assessments, user testing, and explainability where relevant. Consult the ICO contracts and third parties guidance, which notes that its content is under review following the UK Data (Use and Access) Act.
Do not convert an aggregate score into a suitability verdict. A system can perform well on an average while producing unacceptable errors for a particular population, domain, or high-impact decision. Decide when a human must review, correct, or stop an output.
How do you trace data use, privacy, and intellectual property?
Require a data-flow map before sending production information. It should show what the customer submits, what the service derives, what is logged, which parties can access each item, where processing and backups occur, how long information is retained, how deletion works, and whether any data is used to train or improve a model.

Document roles and permissions
- Identify the purpose for every processing activity, including support, abuse monitoring, analytics, and model improvement.
- Assign controller, processor, joint-controller, or equivalent roles for each activity and put those allocations in the agreement and privacy information.
- List subprocessors and upstream model providers, their locations, access rights, and replacement or notification process.
- Define customer control over prompts, uploaded files, outputs, logs, embeddings, backups, and derived profiles.
- Specify retention periods, deletion verification, legal holds, export format, and treatment of data after termination.
- Clarify ownership and permitted use of inputs, outputs, fine-tuning material, feedback, and generated artifacts, including third-party intellectual-property risk.
The ICO says buyers should consider the whole supply chain, identify processing purposes, document the parties’ roles, and agree those roles formally. The NIST profile places intellectual property and privacy among generative-AI procurement concerns. These sources are guidance rather than a legal determination; obligations vary by country, sector, data type, and use case.

Ask for evidence across the full lifecycle: design, development, deployment, and operation. A startup should be able to explain how it models threats, protects code and dependencies, secures infrastructure and models, detects misuse, handles incidents, and manages updates.
Evidence to request
- Threat model covering prompt injection, data exfiltration, insecure tool use, model theft, abuse, and tenant isolation.
- Secure development practices, dependency and supply-chain controls, vulnerability management, penetration or adversarial testing, and remediation records.
- Authentication, authorization, encryption, secrets handling, network boundaries, administrative access, and tenant segregation.
- Logging and monitoring scope, retention, alert ownership, abuse detection, and customer access to relevant records.
- Incident-response plan, notification timelines, communications channel, evidence preservation, and post-incident remediation.
- Release, rollback, and change-management process for models, prompts, retrieval indexes, safety filters, infrastructure, and subprocessors.
- Continuity plan for model, API, cloud, connectivity, or upstream-provider failure, including manual or alternative-process fallback.
The NCSC Guidelines for secure AI system development (version 1.0, 27 November 2023) organize these concerns across secure design, development, deployment, and operation and maintenance. Use that lifecycle as an evidence request list even though it is written for system providers.
For systems that can call tools, send messages, modify records, or access sensitive repositories, inspect permissions and approval boundaries directly. A useful question is not merely whether the model is accurate, but what the system can do when it is wrong.
What human oversight and redress should be in place?
Assign accountability for outputs and incidents before launch. Users should know when an AI system is involved, what uncertainty means, how to inspect or correct an output, when a human must decide, and how to report harm.

Define operating controls
- Named owner for the product, data, security, and consequential decisions.
- Human review or approval for specified risk categories, with authority to override and stop automated actions.
- Clear escalation path for unsafe, discriminatory, materially incorrect, or unexplained results.
- Monitoring responsibility, review cadence, alert thresholds, and records of overrides and corrections.
- Procedure for use outside tested conditions, including temporary suspension and fallback.
- Communication to affected people about the system’s role and available appeal or correction route.
Canada’s ISED implementation guide for managers describes safety, accountability, transparency, fairness and equity, human oversight and monitoring, and validity and robustness as core principles. It recommends applying controls proportionately to the risk of the business operation and use case rather than treating them as a rigid checklist.
How should you compare cost, integration, and exit risk?
Compare total lifecycle value after products meet minimum performance and risk thresholds. Subscription price is only one component; implementation, review labor, data preparation, integration, monitoring, training, incident response, migration, and replacement can dominate the cost.
| Dimension | Questions to quantify | Evidence or commitment to seek |
|---|---|---|
| Task value | What measurable improvement over the baseline justifies adoption? | Pilot results using your data, including correction time and error severity. |
| Integration | What engineering, identity, data, workflow, and accessibility work is required? | Implementation plan, interfaces, dependencies, and customer responsibilities. |
| Operations | What staffing is needed for review, monitoring, support, and incident handling? | Runbook, service levels, support route, and escalation commitments. |
| Dependency | How exposed are you to an upstream model, cloud, API, or policy change? | Dependency list, notice periods, substitution plan, and outage behavior. |
| Portability | Can you export data, configurations, prompts, evaluations, and audit records? | Documented formats, deletion certificate or process, and migration assistance. |
| Exit | What does it cost to retrain users, rebuild integrations, and replace embedded workflows? | Termination rights, transition period, export access, and cooperation duties. |
UK procurement guidance recommends whole-of-life costing, multidisciplinary evaluation, and explicit treatment of vendor lock-in and explainability. Include the cost of a failed pilot and a fallback process when calculating expected value.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Which contract terms should you negotiate?

Contract checklist
- Product, model, version, deployment boundaries, and included features.
- Accuracy or task-performance KPIs, measurement method, service levels, maintenance windows, and remedies.
- Permitted data uses, retention, training or improvement restrictions, locations, subprocessors, access controls, and deletion.
- Security controls, vulnerability handling, audit or evidence rights, incident notice, cooperation, and liability allocation.
- Human-review responsibilities, escalation support, records, and handling of harmful or materially incorrect outputs.
- Advance notice and approval or termination rights for material model, data, provider, feature, or terms changes.
- Support hours, response targets, update policy, rollback expectations, and continuity commitments.
- Termination, export format, migration assistance, deletion verification, and treatment of backups and derived data.
The ICO specifically discusses accuracy-based KPIs or SLAs and periodic reassessment. NCSC guidance covers operational monitoring and update management, while the NIST profile calls for continued third-party-risk assessment. Assign an internal owner and a reassessment date, with an earlier review after a major model, data, provider, or workflow change.

What questions should you send an AI startup?
Send a written questionnaire and require answers tied to the proposed edition and deployment. The following prompts expose gaps that a demonstration will not:
- Which legal entity contracts with us, and what exact product, model, version, environment, and support route are included?
- Which models, APIs, clouds, retrieval systems, data stores, safety components, and subprocessors are in the chain?
- Which components can change without our approval, how much notice will we receive, and what happens if an upstream service is unavailable?
- What evidence covers our defined task threshold, relevant populations, edge cases, abstention behavior, and known limitations?
- How were accuracy, fairness, robustness, and safety measured, and can we inspect the protocol and version history?
- What information is collected, logged, retained, shared, processed geographically, used for training or improvement, and deleted?
- Who is responsible for each processing activity and each security or service failure across the supply chain?
- What threat modeling, secure-development, vulnerability, incident-response, logging, monitoring, and update records can you provide?
- When is human review required, who can override an output, and how are errors, appeals, and unsafe behavior escalated?
- What performance, data, security, support, change-notice, portability, termination, and deletion commitments will be contractual?
How do you make the final go/no-go decision?
Use a staged gate rather than averaging every attribute into one score. First reject products that fail a non-negotiable requirement, such as prohibited data use, missing human control, unacceptable error severity, or no workable fallback. Then compare the survivors on evidence quality, task performance, data and IP terms, security, oversight, integration burden, resilience, lifecycle cost, support, and exit.
| Gate | Pass condition | Typical decision |
|---|---|---|
| Problem and baseline | Outcome, users, constraints, baseline, stakes, and threshold are documented. | Proceed only if the purchase has a defined purpose. |
| Supplier and system identity | Contracting entity, version, deployment, dependencies, and change exposure are known. | Hold if material components remain undisclosed. |
| Performance and safety | Representative tests meet thresholds, with acceptable edge-case and human-review behavior. | Reject, remediate, or limit scope if failures exceed the risk tolerance. |
| Data and security | Roles, flows, retention, controls, incident process, and fallback are documented. | Do not deploy where required protections cannot be evidenced. |
| Commercial and exit | Lifecycle cost, support, change rights, portability, and termination protections are acceptable. | Contract, pilot with conditions, or choose another approach. |
Keep a decision record showing evidence, assumptions, unresolved risks, owners, and the date for reassessment. These sources provide procurement and risk-management guidance, not a legal-compliance determination. GOV.UK and ICO materials are UK-focused; NIST is a US standards body and its AI risk material is generally voluntary; ISED Canada’s guide reflects Canada’s voluntary-code context; and NCSC is the UK’s national cybersecurity agency. Frequently Asked Questions
Are an AI startup’s certifications or benchmark scores enough to approve it?
No. A certificate may cover only a defined organization, scope, and audit period, while a benchmark may use conditions unlike your workflow. Check scope and date, then require your own representative test and contractual commitments.
What if the startup refuses to name its underlying model or cloud provider?
Treat the undisclosed dependency as a material uncertainty, especially when it affects data location, continuity, intellectual property, or change control. Limit the pilot or require disclosure, notice, and a usable fallback before sending sensitive or operationally critical data.
How often should an AI product be re-evaluated after launch?
Set a regular review cadence in the operating plan and contract, and trigger an earlier review after a material model, data, provider, security, or workflow change. Re-run the measures that matter to the task rather than relying on the original demonstration.
Can a small startup be suitable without enterprise-scale documentation?
Possibly, if evidence and controls are proportionate to the use case and the startup can clearly show limitations, responsibilities, and recovery paths. For high-impact or sensitive deployments, missing records are themselves a risk and may justify a narrower scope, additional safeguards, or no purchase.
