Do not connect a patient portal, wearable, medication list, photograph, or lab report until you can trace the app’s entire data flow. Identify what the app is for, what it collects and infers, which companies and people receive it, whether prompts or uploads train a model, how long records and logs remain, and how deletion reaches backups and vendors. Check security controls and the app’s clinical limits independently. A “HIPAA compliant” badge is not proof that HIPAA applies to a stand-alone consumer app, nor that the service is secure. The safest choice is the app that accomplishes your goal with the least sensitive data, gives you specific consent and deletion controls, names its AI and service providers, and explains when its output must not be trusted.
What does the app actually do, and what medical claims does it make?
Classify the service before judging its privacy. An app that counts steps has a different risk profile from one that triages symptoms, interprets an image, recommends treatment, or opens a clinical record.
Classify the intended function
- Wellness: tracking activity, sleep, nutrition, mood, or other self-management data without claiming to diagnose or treat.
- Administrative: scheduling, billing, forms, or record access. These functions can still expose highly sensitive information to vendors.
- Symptom triage: suggesting possible urgency or directing you to a level of care.
- Diagnosis or treatment support: interpreting symptoms, images, laboratory values, or medications and proposing a clinical action.
- Record access: importing information from a patient portal, insurer, pharmacy, laboratory, or another app.
Read the app’s intended users, evidence, validation method, clinician involvement, and escalation instructions. A responsible service says when an output is outside its intended use, identifies situations requiring emergency care, and explains whether a professional reviews anything. HHS and the Federal Trade Commission (FTC) note that an app’s function and data practices help determine which legal obligations may apply; a polished interface does not establish clinical validity or legal coverage.

Ask whether the output is a general educational explanation, a risk estimate, a triage suggestion, a diagnosis, or a treatment recommendation. The stronger the claim, the more you should demand published validation for the relevant population, clear performance limitations, and a human escalation route. If the app presents a confident answer without describing uncertainty, bias, hallucination risk, or what to do when symptoms worsen, stop before sharing additional data.

What information will the app collect, import, infer, and create?
Make a four-part inventory before granting access. The FTC’s mobile-health guidance starts with “Minimize data”: every field should have a stated purpose, and a less sensitive input should be preferred when it can deliver the same function.
| Data layer | Examples | Questions to ask |
|---|---|---|
| Collected directly | Symptoms, diagnoses, medications, age, sex, pregnancy status, photographs, audio, location, contacts, account identifiers | Which fields are required, which are optional, and why is each necessary? |
| Imported | Patient-portal records, laboratory results, prescriptions, insurance information, wearable measurements, device identifiers | Which source systems are connected, what date range is copied, and can access be limited or revoked? |
| Inferred by the model | Possible conditions, risk scores, behavioral patterns, location-based assumptions, or attributes derived from an image or voice sample | What inferences are made, are they stored, and can you challenge or delete them? |
| Generated as output | Chat transcripts, summaries, triage results, reminders, care suggestions, reports, and model confidence or safety flags | Who can see outputs, how long are they retained, and are they used for training, quality review, or advertising? |
Check permissions separately from the privacy policy. A symptom assistant may not need your contacts, continuous location, microphone access outside a consultation, or every historical record. Deny unrelated permissions and test whether the core feature still works. If the service will not operate without broad access, decide whether that convenience justifies the exposure.
Who receives the data, and does an AI provider train on it?
“We do not sell your data” does not describe every disclosure. Request a named list of recipients and the purpose for each transfer.
Map the service chain
- AI or large-language-model provider: obtain the model name, provider name, processing region, retention setting, and whether prompts, images, audio, uploads, and outputs are reviewed by people or used for training or fine-tuning.
- Cloud host and storage provider: ask where source records, backups, and logs reside and which contractual safeguards apply.
- Analytics and crash-reporting vendors: determine whether event data contains symptoms, record identifiers, screen text, or device identifiers.
- Advertising and data partners: find out whether health-related events are used for targeting, measurement, audience building, or cross-service profiling.
- Human reviewers and support staff: learn when people can inspect content, how access is logged, and whether reviewers are bound by confidentiality obligations.
CMS Blue Button guidance recommends identifying the model, describing data shared with AI tools, explaining training use and opt-out, disclosing limitations, and stating whether agreements such as a data-processing or business-associate agreement govern the provider. An opt-out is meaningful only if it is available before sharing and covers prompts, uploads, outputs, logs, backups, and vendor copies. Ask whether a deletion request propagates to each recipient or only removes the app’s primary database.
Read consent screens as a data-flow contract
Look for separate choices for essential processing, model improvement, advertising, human review, and sharing with affiliates. A single “accept all” button that bundles unrelated purposes gives you little control. Save a copy or screenshot of the consent text and the privacy policy’s version date; policies, providers, and retention periods can change.
Does HIPAA protect data in a consumer AI health app?
Usually, not automatically. HIPAA protects most individually identifiable health information held by covered health plans, health-care providers, health-care clearinghouses, and their business associates. A stand-alone consumer app is generally outside HIPAA unless it is offered by, or operating for, one of those regulated entities.

Ask who operates the service
Find the legal entity in the terms, privacy notice, or support contact. If a clinic supplies the app, ask whether the app is acting as its business associate and whether a written business-associate agreement exists. If you downloaded the app independently, do not assume that information remains HIPAA-protected merely because you copied it from a medical record.

Understand the protection gap
The gap is not a legal vacuum. FTC privacy and deception rules can apply to misleading promises, and the FTC’s Health Breach Notification Rule may require notice after certain unauthorized disclosures by health apps outside HIPAA. HHS also explains that tracking information collected by a regulated entity’s app can itself be protected health information. Conversely, information you voluntarily enter into a stand-alone app does not become HIPAA-protected solely because it originated in a clinic record.
Treat “HIPAA compliant,” “HIPAA secure,” or “HIPAA certified” slogans without an identified covered entity, business associate relationship, scope, and security details as warning signs. HIPAA compliance is a legal and organizational question, not a consumer security certification.
How can I inspect an app before creating an account?
Use this sequence while you still have the option to walk away. Do not connect a portal or upload a document merely to discover the terms.
- Open the developer and legal-entity information. From the app store listing, website footer, or in-app path such as Settings → About → Legal, record the operator, support address, policy version, and jurisdiction.
- Read the privacy policy’s collection and sharing sections. Write down every direct input, imported source, inference, recipient, purpose, retention period, and international transfer. Search within the policy for “AI,” “model,” “training,” “review,” “advertising,” “analytics,” “deletion,” and “backup.”
- Open the consent and permission screens. Note which choices are optional, whether you can withdraw them later, and whether the service remains usable with a smaller data set.
- Verify the clinical purpose. Locate intended users, validation evidence, clinician oversight, contraindications, emergency directions, and a channel for escalating an abnormal or uncertain result.
- Ask support specific questions. Request the model and provider names, processing locations, human-review policy, training use, vendor agreements, retention schedule, and deletion procedure. Keep the answers.
- Test account controls with low-risk data. Before importing records, create the minimum profile needed, inspect the dashboard’s connected sources, and confirm that access can be revoked without contacting sales or support.
- Decide using the least-data option. Choose the service that meets the same goal with fewer permissions, shorter retention, clearer recipients, stronger authentication, and a documented deletion path.
What security controls should an AI health app show?
Privacy promises describe intent; security controls show how exposure is reduced. Look for concrete, current explanations rather than a badge or a generic statement that data is “secure.”
- Encryption in transit and at rest: the policy or security documentation should say that transmissions and stored records are encrypted, and identify important exceptions such as support exports or local caches.
- Strong authentication: use a unique password and multi-factor authentication where available. Ask whether staff and vendors also use strong authentication.
- Least-privilege access: personnel should receive only the records needed for their role, with access logging and periodic review.
- Update responsibility: determine who patches the app, servers, integrations, and connected devices, and how users are notified when an unsupported version creates risk.
- Incident response: look for a breach-reporting process, contact channel, expected notification steps, and a responsible-disclosure process for security researchers.
- Independent testing: security assessments or audits are useful when their scope, date, and corrective actions are described. A claim that an app follows a framework is not the same as an audit of the consumer product.
NIST SP 800-66 Revision 2, authored by Jeffrey Marron and published in 2024, is a technical reference for safeguarding electronic protected health information. It can help you recognize sensible controls, but it does not certify a consumer app and does not prove that HIPAA applies to it.

What should the app’s retention and deletion process include?
Find the complete lifecycle, not just an “ delete account” button. A credible policy states what is deleted, what is retained for legal or safety reasons, the time required, and how copies in backups, logs, AI-provider systems, and analytics platforms are handled.
Check deletion in four places
- Source data: confirm that profile fields, uploaded files, imported records, device links, and photographs are removed.
- AI artifacts: ask whether prompts, embeddings, generated responses, feedback, and model-evaluation records are deleted or detached from your identity.
- Operational copies: ask about backups, disaster-recovery replicas, caches, audit logs, crash reports, and exports. “Deleted from the live database” may not mean immediate removal everywhere.
- Recipients: determine whether vendors and human-review teams receive deletion instructions and how completion is verified.
Look for a path such as Settings → Privacy → Delete account and data, a confirmation message, and a support contact for records that cannot be removed through the interface. Revoke patient-portal, wearable, and API access separately; deleting the app from your phone normally removes only the local software, not the server-side account or vendor copies.
How do I judge whether an AI health answer is clinically safe?
Evaluate the system as decision support, not as a clinician. Even a well-designed model can produce a fluent but wrong answer, miss an emergency, or perform differently for people unlike those in its validation data.
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
Look for evidence that matches your situation
- Population, language, age range, and condition studied in validation.
- Input requirements and known failure modes, including poor-quality images, missing medications, or incomplete records.
- Whether performance was evaluated prospectively or only on historical examples.
- How often outputs are reviewed by qualified clinicians and what happens when the model is uncertain.
- Whether the app distinguishes educational content from diagnosis or treatment and clearly labels unverified suggestions.
Confirm escalation and emergency behavior
The app should tell you when not to rely on it, provide an urgent-care or emergency instruction when appropriate, and offer a route to a qualified professional. It should not ask you to delay emergency services while you continue a chat or upload more information. A responsible-disclosure process for abnormal results, recommended in CMS Blue Button guidance, gives users and clinicians a way to report dangerous outputs.
Check for bias and privacy-sensitive inference
Ask what demographic or behavioral attributes the model infers and whether those inferences affect recommendations, access, advertising, or prioritization. A service that cannot explain its limitations, update process, or method for correcting an incorrect record deserves less trust than one that does.
How should I compare two AI health apps?
Compare documented controls and behavior, not marketing language. Use the same questions for every candidate and keep the answers side by side.

| Criterion | Prefer evidence of | Pause when |
|---|---|---|
| Data minimization | Only inputs necessary for the stated function, with optional fields clearly marked | Broad permissions or a full-record import is required for a narrow task |
| Consent and control | Separate choices for core service, training, advertising, analytics, and human review; withdrawal works before new sharing | One bundled acceptance or consent hidden in a long screen |
| Recipients and AI providers | Named model, cloud, analytics, advertising, and review providers with purposes and regions | The operator refuses to identify who processes prompts or uploads |
| Retention and deletion | Specific periods, account and source-data deletion, vendor propagation, and backup/log treatment | “We delete your data” has no scope, timing, or vendor explanation |
| Security | Encryption, strong authentication, least privilege, updates, incident response, and dated independent testing | Only an unsupported security slogan or a badge with no scope |
| Clinical reliability | Population-matched validation, limitations, uncertainty handling, clinician escalation, and emergency guidance | Confident recommendations with no evidence or safety instructions |
| Accountability | Identified legal operator, support channel, responsible-disclosure process, and clear regulatory role | No legal entity, unreachable support, or unexplained cross-border transfer |
When two apps offer the same practical benefit, select the one that keeps less data, retains it for less time, and gives you more granular control. A lower subscription price or smoother interface does not compensate for an opaque data flow.
Which warning signs mean I should stop?
Pause the setup and do not upload additional information if any of these conditions appears:
- The app requests contacts, continuous location, camera, microphone, or complete medical history unrelated to its stated purpose.
- Recipients, retention periods, processing countries, or the AI provider are hidden or described only as “trusted partners.”
- The operator claims HIPAA protection without naming a covered entity or business-associate relationship.
- The service says data is deleted but cannot address backups, logs, model records, or vendor copies.
- Health data is used for advertising or model training without a clear, separate choice available before sharing.
- Medical recommendations appear without evidence, limitations, clinician escalation, or emergency instructions.
- Support will not answer basic questions about model use, human review, security testing, or incident response.
These are not proof of misconduct, but they prevent you from making an informed risk decision. Choose a service with verifiable answers instead.
What if I already connected my records or uploaded symptoms?
Act promptly, but do not assume that uninstalling the app is enough.
- Use the app’s privacy or account settings to revoke connected-record, wearable, and API permissions.
- Submit an account-and-data deletion request that names uploaded files, imported records, prompts, outputs, logs, backups, and vendor copies.
- Ask each connected provider whether the app’s access token has been revoked and whether a new token must be issued.
- Save confirmation numbers, dates, policy versions, and support replies.
- Watch for breach or unauthorized-disclosure notices and report a deceptive privacy promise to the appropriate regulator, including the FTC when its rules may apply.
If the app produced a concerning medical result, contact a qualified clinician or emergency service rather than waiting for a privacy response. Treat the result as unverified decision support until a professional evaluates it.
What questions should I send to the app’s support team?
Send a written list so vague assurances are easier to identify. The FTC’s consumer-health guidance frames the essential questions as: “What health information are you collecting? From what sources? How are you using it? To whom are you disclosing it? For what purposes? How long are you retaining it and why?” Add the AI-specific questions below:

- Which model and provider process my data, and in which countries?
- Are prompts, uploads, images, audio, outputs, or feedback stored, reviewed by humans, or used to train or fine-tune a model?
- Can I opt out before sharing, and does the opt-out cover logs, backups, evaluation sets, and vendor copies?
- What known hallucination, bias, accuracy, and medical-advice limitations apply to my use case?
- What clinician escalation and emergency instructions are provided?
- Does account deletion remove source data, imported records, and AI-produced responses, and when are backups and recipient copies removed?
- Is the operator a HIPAA covered entity or business associate, and what agreement governs each service provider?
- How do I report a security issue or an abnormal result, and how will I be notified of a breach?
If the answers are incomplete, contradictory, or impossible to obtain before signup, treat that uncertainty as a material risk and do not share your medical data.
Frequently Asked Questions
Can I use an AI health app without connecting my patient portal?
Often you can start with manual, minimal information, but the app may make portal access a condition of its core feature. Test a low-data mode first and verify that imported records are not copied automatically when you link the account.
Does a business-associate agreement automatically make an app HIPAA-covered?
No. The agreement supports a relationship with a HIPAA covered entity, but it does not turn every consumer feature or independent use of the app into a HIPAA-covered service. Confirm which legal entity is covered and which data and functions the agreement actually governs.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Scan for outdated or missing drivers - takes under a minute3Repair Windows errors before they cause bigger problemsIs deleting the app from my phone the same as deleting my health data?
No. Uninstalling normally removes local software while the account, server records, backups, logs, and vendor copies remain. Use the service’s account-and-data deletion control and request written confirmation of what was removed.
What should I do if the app asks for location or contacts?
Deny the permission unless the stated function genuinely requires it, then check whether the app still works. If refusing unrelated access blocks a basic health task, choose a service with narrower permissions rather than granting access by default.
What if an AI health app gives me an alarming result?
Do not wait for the model to become more certain or for support to reply. Follow the app’s emergency instructions and contact a qualified clinician or emergency service, because an AI output can be wrong or miss information that changes the risk.
