For a high-stakes decision, choose an AI vendor only after you define the decision, the people affected, an acceptable error rate, and the evidence that would justify deployment. Compare every vendor on the same representative workflow, test conditions, and scoring rules; then approve the option whose residual risks are owned, monitored, contractually controlled, and reversible. A security badge, benchmark slide, or general AI policy is not proof that a particular system is suitable for your use case.
What should you decide before speaking to AI vendors?
Write a use-case brief before demonstrations or requests for proposal. This prevents a polished product tour from defining the problem for you and gives every supplier the same target.
Describe the decision, not just the technology
State the exact task or decision, who will operate the system, who may be affected, what data it will receive, and whether it will advise a person or take an action automatically. Record the current process, its cost and delays, and the measurable business outcome you want to improve.
- Users: roles, expertise, access rights, and expected workload.
- Affected people: customers, employees, applicants, patients, borrowers, or other groups that could experience a wrong or delayed outcome.
- Decision authority: what a person remains responsible for and what the system may do without approval.
- Data: sources, sensitivity, quality, languages, time span, and geographic coverage.
- Consequences: financial loss, safety impact, denial of service, discrimination, privacy harm, or reputational damage if the output is wrong.
- Alternatives: process improvements, rules-based software, additional staff, or a lower-risk non-AI method.
UK government procurement guidance recommends a multidisciplinary impact assessment covering user needs, impacts, data quality, unintended consequences, and whole-of-life costs. Assign a business risk owner and define go/no-go checkpoints before procurement.

Set boundaries and a stop condition
Write intended uses, prohibited uses, operating jurisdictions, supported populations and languages, and the situations that require human escalation. Define a stop condition such as an accuracy floor, an unacceptable disparity, a security incident, a material model change, or a failure to provide audit data. Procurement should stop when a blocking condition is met, even if the product performs well on average.
How do you set an acceptance threshold for a high-stakes AI system?
Set measurable thresholds before you see vendor results, and measure the complete human workflow rather than a model’s headline score.
Choose task-specific measures
For classification, specify precision, recall, false-positive and false-negative limits, and how errors are weighted. For extraction, define field-level accuracy and an allowable abstention rate. For generation, evaluate factuality, completeness, harmful content, and the proportion of outputs that a reviewer must correct. For ranking or recommendations, define the business outcome and the exposure of affected groups.
Do not use a single average score when the cost of errors differs. A missed fraud alert, an incorrect benefit denial, and a harmless duplicate notification require different thresholds and escalation paths. Document confidence intervals or uncertainty ranges when your evaluation sample supports them; otherwise label the result as an estimate rather than a guarantee.
Specify fairness and coverage tests
Identify legally or operationally relevant groups and test performance for each group where data and privacy rules permit. Compare error rates, abstentions, and time to human resolution, not only overall accuracy. Ask the supplier to explain measured trade-offs and mitigation choices. The UK Information Commissioner’s Office (ICO) recommends setting accuracy thresholds in advance, conducting bias due diligence, and independently evaluating trade-offs.
Define what would make AI inappropriate
Record cases where a deterministic process, trained professional, or simpler control is safer. If the data is too sparse, labels are unreliable, explanations cannot support an appeal, or no qualified person can review exceptions, the correct decision may be not to deploy AI.
What should you ask an AI vendor before buying?
Send every supplier one evidence request and require answers for the exact service, model, version, configuration, and subprocessors proposed. Ask for scope, dates, test conditions, and limitations with every result.

Product identity and intended use
- What exact service, model, version, configuration, and sub-processors will be used?
- Which uses are intended, supported, excluded, or prohibited?
- Which languages, populations, data formats, and operating environments are supported?
- What changes can the supplier make without customer notice?
Performance and fairness evidence
- How were performance and fairness measured, on what data, against which baseline, and under what conditions?
- Which results are vendor-reported, independently verified, or reproducible by a customer?
- What known failure modes, edge cases, abstention behavior, and confidence calibration have been documented?
- How were trade-offs between groups or error types handled?
Data, privacy, and intellectual property
- What data is transmitted, retained, used for training or tuning, or shared with another party?
- Where is data processed and stored, and which deletion controls and retention periods apply?
- What rights does the customer receive in inputs, outputs, fine-tuning data, logs, and derived artifacts?
- How does the supplier establish data provenance and handle third-party content or copyright claims?
Security, service, and audit
- Which controls and independent assessments cover this specific service rather than the parent company generally?
- How are vulnerabilities, incidents, and suspected data exposure reported, investigated, and remediated?
- What availability, recovery, support, and service-credit commitments apply?
- Can the customer obtain logs, model or prompt versions, access records, and evidence needed for an audit or appeal?
Change, portability, and termination
- How are model, data-processing, subprocessor, and API changes announced and tested?
- What notice, customer approval, rollback, or revalidation rights apply to a material change?
- Which data, configurations, evaluation sets, and logs can be exported in usable formats?
- What termination assistance, migration support, and deletion certification are available?
Canada’s government guidance recommends standardized criteria and supplier documentation of development, testing, and limitations. Use the same questionnaire and evidence standard for every bidder so that a more detailed respondent is not unfairly penalized or rewarded.
How can you compare AI vendors fairly?
Run a controlled, like-for-like evaluation using representative inputs, difficult cases, and the actual human workflow. A benchmark supplied by one vendor is not a comparison unless every vendor is tested under the same conditions.
Build the evaluation set
- Sample real work: draw cases from the intended process across normal, rare, recent, multilingual, and boundary conditions. Remove or protect personal information as required.
- Create a reference answer: have qualified reviewers establish the expected decision, acceptable alternatives, and escalation outcome for each case. Resolve disagreements before scoring.
- Freeze the test protocol: record prompts, system settings, retrieval sources, software versions, reviewer instructions, and the date. Do not change the protocol for one vendor.
- Test failure modes: include ambiguous, incomplete, adversarial, out-of-distribution, and high-impact cases. Measure abstention and escalation, not just a forced answer.
- Evaluate the workflow: measure how long a trained reviewer takes, what they correct, whether they can understand the output, and whether escalation works.
- Separate evidence types: label each result as vendor claim, independent assessment, or your own observed test. Never present a supplier’s number as your test result.
UK procurement guidance calls for testing under a range of conditions and monitoring after deployment. For consequential decisions, include human review in the test because a model that looks accurate in isolation can still increase risk by creating automation bias or unmanageable review queues.
Use a repeatable scorecard
Score only evidence that is applicable to the proposed deployment. An illustrative scorecard can use a 0–3 scale (0 = unacceptable or no evidence, 1 = major gaps, 2 = meets the requirement with conditions, 3 = strong evidence and controls). Set blocking criteria separately; a high total cannot compensate for a failed privacy, safety, or exit requirement.

| Whole-life cost | Integration, evaluation, monitoring, training, support, and migration costs | What will the deployment cost beyond the subscription? |
For each cell, record the evidence date, applicability, uncertainty, mitigation, owner, and whether the item is a blocker or a contract condition. If a supplier does not establish a comparable value, mark it “not stated” rather than inferring parity.
How should you assess data, privacy, security, and intellectual property?
Evaluate the service and its dependency chain, not only the vendor’s public policy. Confirm what happens to your prompts, documents, labels, logs, embeddings, and outputs.
Trace data and rights
Ask for the source and permission basis for training, retrieval, and evaluation data relevant to your deployment. Clarify whether customer content is used to improve a shared model, whether deletion propagates to backups and derived indexes, and how a data-subject or copyright request is handled. Obtain written allocation of responsibility for infringing or unauthorized content; do not assume that an output license resolves an input-rights problem.

Check security in context
Request architecture and access-control details for the exact service, including encryption, tenant isolation, administrative access, key management, vulnerability handling, logging, and recovery objectives. Verify the scope and date of any independent assessment. A corporate certification that excludes the product, region, or subprocessors in your design has limited evidentiary value.
Map hidden dependencies
List foundation models, model hosts, API providers, data processors, plug-ins, model libraries, and critical cloud regions. NIST’s Generative AI Profile (NIST AI 600-1, released July 26, 2024) recommends updating vendor due diligence for privacy, security, intellectual-property, and third-party risks. Require notification when a dependency, ownership arrangement, or processing location changes.
What supply-chain and resilience questions matter most?
A dependable vendor must remain usable during failures, attacks, ownership changes, and upstream model revisions. Evaluate resilience as an operational property, not a marketing promise.
- Ownership and control: identify controlling entities, material investors where relevant, and the parties able to change the service.
- Component provenance: maintain an inventory of models, libraries, data sources, and build or deployment environments.
- Tiered suppliers: understand critical fourth parties and whether the vendor can obtain incident and change information from them.
- Continuity: review recovery objectives, capacity constraints, regional failover, and communication during an outage.
- Fallback: document a manual process, alternate provider, cached result, or safe degradation mode and test it.
- Incident cooperation: set notification timelines, evidence preservation, investigation access, and customer communication duties.
NIST’s ICT Supply Chain Risk Management Quick-Start Guide, SP 1326, published July 8, 2026, identifies ownership and control, provenance, resilience, foundational cybersecurity practices, and deeper supply-chain tiers as due-diligence dimensions.
How do you make an AI deployment governable?
Approval is meaningful only when people can understand, challenge, monitor, and stop the system.

Name a business risk owner, technical owner, privacy contact, security contact, and operational escalation route. Define who reviews exceptions, who can suspend the system, and how an affected person can request reconsideration. Train users on limitations, appropriate reliance, secure handling of data, and signs of fabricated or unsupported output.
Make outputs auditable
Capture the input or a protected reference to it, model and prompt versions, retrieval sources, output, reviewer action, escalation, and final decision. Set retention and access rules that preserve accountability without creating an unnecessary store of sensitive data. Explanations should be appropriate to the use: a reviewer may need the evidence used, confidence or uncertainty, rule path, and reasons for an abstention rather than a generic statement that the model is complex.

Monitor after launch
Track accuracy, subgroup error rates, abstentions, reviewer overrides, queue time, incidents, availability, cost, and drift in input data. Establish a review calendar and triggers for re-evaluation: model or prompt changes, new data sources, population shifts, incidents, unexplained performance changes, or a changed purpose. The ICO recommends accuracy KPIs or service-level agreements and a reasonable timeline for re-evaluation.
What should the contract require?
Put the acceptance criteria and controls into enforceable terms rather than relying on a sales proposal.
- Service identity, versioning, scope, supported uses, and prohibited uses.
- Accuracy or quality KPIs, measurement method, service levels, and remedies.
- Permitted data use, retention, location, deletion, subprocessors, and IP responsibilities.
- Security controls, audit cooperation, vulnerability handling, incident notice, and recovery commitments.
- Change notification, testing evidence, customer approval or termination rights for material changes.
- Logging, records access, explainability support, human-review obligations, and assistance with appeals.
- Training, documentation, knowledge transfer, portability, transition services, and deletion certification at exit.
Include a schedule that identifies which claims are guaranteed, which are targets, and which are informational. Preserve your evaluation set and acceptance report so a later version can be compared with the approved baseline.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Which standards and guidance can support the process?
Use frameworks as process aids, not as substitutes for deployment-specific evidence.
- NIST AI Risk Management Framework 1.0: released January 26, 2023; a voluntary framework for incorporating trustworthiness through design, development, use, and evaluation.
- ISO/IEC 42001:2023: first edition published December 2023; specifies requirements for establishing and continually improving an AI management system. An organization’s management system does not prove that its particular product meets your performance or risk threshold.
- NIST AI 600-1 Generative AI Profile: released July 26, 2024; adds generative-AI risk considerations, including privacy, security, IP, and third-party dependencies.
- NIST SP 1326: final ICT supplier due-diligence quick-start guide published July 8, 2026; covers ownership, provenance, resilience, cybersecurity practices, and supply-chain tiers.
- UK AI Risk Management Toolkit: published by the Department for Science, Innovation and Technology on September 8, 2026; useful for structuring risk management and procurement discussions.
These materials come from UK and Canadian government guidance, US NIST publications, and international ISO standards. They do not determine legal compliance for a particular buyer, sector, jurisdiction, or use case.
What are the most common evaluation mistakes?
Buying the demo
Failure: a fluent demonstration substitutes for evidence. Fix: use your frozen test protocol and require reproducible results on representative cases.
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
Comparing incompatible claims
Failure: one vendor reports a laboratory benchmark while another reports a production pilot. Fix: label conditions, baselines, dates, and evidence owners; rely on a common evaluation for the decision.

Ignoring the human process
Failure: automation increases review burden or causes people to accept confident errors. Fix: test reviewer workload, escalation, override rates, and training in the same trial.
Treating certification as a product verdict
Failure: a management-system certificate or security assessment is treated as proof of task fitness. Fix: verify scope and combine organizational evidence with use-case performance and control tests.
Forgetting exit
Failure: data, prompts, labels, and workflows are trapped in a changing service. Fix: require export formats, transition assistance, change notice, revalidation rights, and a tested fallback before launch.

How do you record the final approval decision?
Create a decision record that another team could audit six months later. Include the use-case brief, alternatives considered, thresholds, test protocol, results, subgroup analysis, vendor evidence, unresolved uncertainties, risk owners, mitigations, contract conditions, monitoring plan, review date, and exit plan. State clearly whether the decision is approved, approved with conditions, piloted only, or rejected, and identify the evidence that would change that decision.
Frequently Asked Questions
How many AI vendors should we evaluate for a high-stakes use case?
There is no universal number. Include enough suppliers to test whether the requirements are genuinely contestable, while keeping the same protocol and evidence burden for each; a single compliant option may be reasonable when the use case is unusually specialized, but document why alternatives were not viable.
Can we use production data in a vendor pilot?
Only after confirming the lawful purpose, access controls, retention, deletion, and supplier training restrictions. Prefer de-identified or synthetic data for early testing, then move to a tightly governed production sample when it is necessary to validate real-world behavior.
What if a vendor will not disclose its underlying model?
You can still evaluate the service, but treat undisclosed details as uncertainty rather than assuming safety or portability. Require stronger black-box testing, output and version logging, change notice, audit cooperation, and a contractual right to suspend or exit if performance or risk changes.
Who should sign off on a high-stakes AI purchase?
The business risk owner should accept the remaining operational risk, with documented review by privacy, security, legal or compliance, procurement, and technical specialists appropriate to the use case. The sign-off should cover the workflow and contract, not just the model.
