Evaluate an AI vendor against your specific use case, data, legal duties, and failure impact—not against a generic “AI compliant” label. First define what the system will do and whose information it will handle. Then map every data flow and supplier, verify security and privacy evidence, document party roles, negotiate assessment and incident terms, and monitor the service after approval. A certification or broad compliance claim is evidence to examine, not proof that a deployment is suitable. The process below gives security, privacy, legal, procurement, and business teams a repeatable way to reach a defensible decision.

What should an AI vendor evaluation establish?

Your evaluation should show, in writing, whether the service is acceptable for one defined deployment and what conditions make it acceptable. The answer depends on processing context: a model that drafts low-risk internal text may require different controls from one that analyzes health records, customer identities, or information used in consequential decisions.

Use NIST AI 600-1 as a procurement and governance reference, the UK Information Commissioner’s Office (ICO) contracts and third parties guidance for processing relationships, and the ICO’s guidance on security and data minimisation. These sources support a risk-based process; they do not certify any particular supplier.

Set a decision record before contacting vendors

  • Business purpose and tasks the system supports.
  • Users, affected people, and whether outputs influence decisions about them.
  • Data categories, including confidential, personal, regulated, or proprietary information.
  • Deployment model, integrations, administrator access, and expected volume.
  • Consequences of an incorrect output, disclosure, outage, or supplier failure.
  • Acceptable residual risk, mandatory evidence, and conditions that block approval.

This record prevents a polished demonstration or a broad privacy statement from replacing a use-case assessment. The ICO notes that security measures should reflect the risks of the specific processing activity rather than follow a one-size-fits-all recipe.

How do I define the AI use case and risk?

Write a short use-case specification that a vendor, security reviewer, privacy counsel, and business owner can all interpret the same way. Do this before comparing products so every supplier answers the same questions.

Describe people, decisions, and consequences

Identify who operates the service and who may be affected by its outputs. State whether the output is a suggestion, an automated action, or an input to a human decision. Record foreseeable harms from disclosure, manipulation, bias, inaccurate output, or unavailability. A system that summarizes internal meeting notes has a different exposure from one that ranks applicants or recommends treatment.

Classify the information

List input fields, uploaded files, prompts, generated outputs, feedback, telemetry, support tickets, and logs. Mark personal data, special-category or sensitive information, financial records, credentials, trade secrets, and data subject to contractual or sector restrictions. Include information that could be inferred from apparently harmless prompts.

Set evidence and risk thresholds

Specify which controls must be demonstrated before a pilot, before production, and at renewal. For high-impact use, require stronger evidence, documented human oversight, an accuracy or bias evaluation, and a tested fallback. A threshold can require contractual deletion, a defined incident-notification period, or a prohibition on using customer content for model improvement. The threshold should be tied to the consequences you recorded, not to a vendor’s marketing tier.

How can I map data flows and the AI supply chain?

Ask the vendor to trace organizational content through the complete service, including suppliers that operate infrastructure, models, analytics, support, or moderation. The ICO recommends considering the whole supply chain and formally documenting the relationships; NIST recommends an inventory of third parties with access to organizational content.

Build a data-flow map

  1. Inputs: Record every channel, such as an API, web interface, plug-in, file transfer, or connector, and what is sent through it.
  2. Processing: Identify the model, retrieval or indexing layer, filters, human review, abuse monitoring, and any processing performed by another provider.
  3. Outputs: Show where generated text, scores, embeddings, or actions go, who can view them, and whether they are written into another system.
  4. Logs and support: Ask what prompts, outputs, metadata, diagnostics, and administrator actions are logged, who can access them, and for how long.
  5. Storage and transfers: Document regions, backups, replication, cross-border transfers, encryption, and the legal mechanism used where applicable.
  6. Exit: Define how content, indexes, logs, credentials, and backups are returned or deleted, and how deletion is evidenced.

Inventory suppliers and components

Request a current list of subprocessors and other material suppliers, their functions, processing locations, and notice process for changes. Include model providers, cloud hosts, data-labeling or moderation services, observability tools, customer-support platforms, and identity services. Ask whether a supplier can access your content directly or only encrypted infrastructure. A diagram and a written inventory should agree; unexplained gaps are a risk signal.

Resolve training and improvement use

Obtain a precise answer about whether prompts, files, outputs, feedback, or telemetry may be used to train, fine-tune, evaluate, or improve a model. Clarify defaults, opt-out controls, account-level settings, and whether a subcontractor can use the data for its own purposes. “We do not train on data” is incomplete unless it identifies the data covered, the retention period, exceptions for abuse monitoring, and the parties bound by the restriction.

What security evidence should an AI vendor provide?

Match evidence to the service and data in scope. A generic certificate, questionnaire, or security page cannot answer deployment-specific questions. NIST calls for assessing AI vendors and services against incident or vulnerability information, while the Australian Cyber Security Centre guidance advises supplier diligence on security, data handling, and supply-chain risk.

Access control and isolation

  • How are customer tenants, projects, indexes, and conversations isolated?
  • Which vendor roles can access content, under what approval and logging controls, and for what support purpose?
  • Are administrator accounts protected with strong authentication, least privilege, and periodic review?
  • Can your organization enforce single sign-on, role-based access, session limits, and rapid revocation?

Encryption and key handling

Ask where encryption is applied in transit, at rest, in backups, and in temporary processing. Determine who controls keys, how keys are rotated, and whether customer-managed keys are available for the deployment. Confirm that encryption does not prevent required deletion or leave plaintext copies in logs or support tools.

Vulnerability and incident response

Request the vulnerability-reporting channel, severity criteria, remediation targets, penetration-test scope, dependency-management practice, and process for handling model-specific attacks such as prompt injection or data exfiltration. Contractually define how and when you will be notified of an incident, suspected compromise, material vulnerability, or supplier incident, including the information needed for your own legal notifications. The Australian guidance recommends discussing shared responsibilities early and requiring supplier reporting and response for vulnerabilities and incidents.

Resilience and recovery

Ask for service-dependency diagrams, availability commitments that fit the use case, backup and restoration arrangements, recovery objectives, and evidence of testing. Identify what happens if a model, cloud region, identity service, or subprocessor fails. For a high-risk workflow, require a usable manual or alternate-service procedure rather than relying on a promise that the platform will remain available.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Independent assurance and testing

Review the scope, period, exceptions, and corrective actions in independent assessments. Confirm that the report covers the exact service, environments, regions, and controls you will use. Treat an assurance report as evidence to test against your threat model, not as a universal conclusion that the vendor is secure.

How should I assess privacy roles, purposes, and compliance?

Determine which organization decides why and how personal data is processed, which organization acts on instructions, and whether any party uses data for its own purpose. Put those roles and responsibilities in the contract and privacy information; do not assume a vendor’s general privacy notice settles your organization’s duties.

Document purposes and legal responsibilities

For each data category, state the purpose, permitted operations, retention, recipients, transfer locations, and deletion trigger. Identify how your organization will handle minimization, transparency, access or deletion requests, correction, objection, security, and records of processing. Engage the responsible privacy team or counsel to determine which jurisdictions and sector rules apply; this framework is not legal advice.

Minimize before data reaches the model

Remove unnecessary identifiers, redact secrets, restrict context windows, and send only fields needed for the task. Consider tokenization, pseudonymization, local preprocessing, or a retrieval design that returns the minimum relevant passages. Test whether logs, error traces, evaluation datasets, and human-review queues reintroduce information you removed from the prompt.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Check rights, retention, and deletion operations

Ask how the vendor locates a person’s data across prompts, outputs, indexes, backups, and derived artifacts. Establish the time and method for deletion, the treatment of immutable backups, and the evidence you receive. Verify whether a deletion request can be completed when data has been used for evaluation or model improvement. The ICO’s AI security guidance is marked as under review following the Data (Use and Access) Act, so verify the current UK law and guidance at the time of procurement.

Assess accuracy and potential bias where people are affected

For systems that influence decisions about individuals, set accuracy-related key performance indicators or service levels where appropriate. Obtain documentation about known limitations, evaluation data, monitoring, and potential bias. Define human review, appeal, correction, and suspension procedures; a contract should not imply that generated output is automatically correct.

What contract terms protect an AI deployment?

Convert important answers into enforceable terms, order forms, security exhibits, and processing agreements. NIST AI 600-1’s suggested action GV-6.1-006 says to “Include clauses in contracts which allow an organization to evaluate third-party GAI processes and standards.” The statement is NIST guidance, not a guarantee supplied by a vendor.

Data-use and confidentiality clauses

  • Define organizational content and prohibit uses outside documented purposes.
  • State whether prompts, outputs, feedback, logs, and metadata may be used for training or improvement, including exceptions.
  • Require confidentiality obligations for employees, contractors, subprocessors, and support personnel.
  • Specify ownership or permitted use of inputs, outputs, indexes, and customer configurations without assuming that ownership alone prevents disclosure.

Assessment and transparency rights

  • Require timely responses to security and privacy questions and access to relevant evidence.
  • Allow audits or alternative assurance when risk justifies them, with reasonable confidentiality safeguards.
  • Require notice of material service, model, location, subprocessor, or control changes.
  • Set obligations to cooperate with investigations, regulatory inquiries, and individual-rights requests.

Incident, vulnerability, and subprocessor terms

Define what counts as an incident or material vulnerability, the notification channel and deadline, minimum notice content, preservation of evidence, investigation cooperation, and remediation updates. Require an up-to-date subprocessor list and a meaningful objection or termination process for material changes. Cover incidents at suppliers, not only events in the vendor’s own environment.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Retention, deletion, and exit

Set retention periods for each data class, deletion triggers, backup treatment, and written confirmation. Require export in a usable format, assistance with migration, credential revocation, destruction of copies, and continued confidentiality after termination. For a critical dependency, define a transition period and access to the information needed to operate a fallback.

How do I compare two or more AI vendors fairly?

Use the same use-case description, evidence request, scoring definitions, and decision owners for every supplier. Do not award a higher score simply because one vendor supplies more marketing material. Record unanswered questions and remediation commitments separately from verified controls.

Comparison axis Questions to resolve
Data handling and privacy What data is collected, retained, transferred, used for model improvement, and deleted? Which parties process it, and where?
Security evidence What controls and independent evidence cover the service in scope? How are access, vulnerabilities, and incidents handled?
Supply-chain transparency Which suppliers and components are involved? Can the organization assess material changes and dependencies?
Contractual protections Are roles, permitted uses, notification duties, assessment rights, retention, deletion, and exit terms documented?
Operational resilience What happens during an outage, incident, or supplier failure? Is there a workable fallback?
Use-case fit Can the vendor provide evidence that performance, accuracy, limitations, and operational controls suit the intended use?

Use decision gates, not an average score alone

Some requirements should be mandatory. For example, approval may be blocked when the vendor cannot state where personal data is processed, refuses a necessary deletion commitment, or provides no workable incident-notification path. A strong score in usability or price should not offset a failed legal or security prerequisite. Record accepted exceptions, their owners, expiry dates, and compensating controls.

What should a practical vendor questionnaire contain?

Send a concise, deployment-specific request and ask for evidence rather than yes-or-no assertions. The following checklist can be adapted to your risk tier.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Service and architecture

  • Describe model versions, hosting regions, interfaces, connectors, logging, and human-support paths used for this service.
  • Identify every supplier with potential access to organizational content and explain each supplier’s function.
  • Explain tenant isolation, administrative access, privileged-session logging, and customer configuration controls.

Data lifecycle

  • List data collected at input, during processing, in outputs, logs, telemetry, backups, and support cases.
  • State default and configurable retention, deletion timing, backup handling, and export options.
  • State whether any data is used for training, fine-tuning, evaluation, abuse monitoring, or service improvement and identify who may use it.
  • Describe cross-border transfers and the locations in which content and backups are processed.

Security operations

  • Provide relevant independent assurance, its scope and dates, exceptions, and remediation status.
  • Describe vulnerability intake, severity assessment, patching, penetration testing, dependency tracking, and security testing for integrations.
  • Provide incident definitions, notification commitments, investigation cooperation, recovery testing, and customer responsibilities.

Performance and responsible use

  • Document intended use, known limitations, accuracy measures, and conditions under which output should not be relied upon.
  • Explain controls for prompt injection, data leakage, malicious files, abusive use, and unsafe output.
  • Describe human review, feedback, correction, and suspension mechanisms for workflows affecting people.

How should approval, onboarding, and monitoring work?

Approval is a lifecycle decision. Assign an accountable owner, record the approved use and data classes, and set review triggers before production access is granted.

Before production

  1. Complete the use-case, data-flow, supplier, privacy, and security records.
  2. Resolve mandatory gaps or document a time-limited remediation plan with compensating controls.
  3. Configure the least-privilege integration, retention, logging, regional settings, and model-improvement controls.
  4. Run abuse, access, deletion, incident, and fallback tests using non-production or minimized data where possible.
  5. Train users on permitted data, verification of output, reporting channels, and prohibited uses.

During operation

Maintain an inventory of approved providers, services, owners, purposes, data categories, contract dates, and review dates. Monitor incidents, vulnerabilities, service-level changes, model changes, subprocessor changes, and unexpected data use. Review access and logs on a schedule appropriate to the risk, and investigate unusual downloads, prompt patterns, or support access.

When to reassess

Trigger a new review when the use case, users, data, model, integration, processing location, subprocessor, contract, or applicable law changes. Also reassess after an incident, material vulnerability, unexplained output change, prolonged outage, or a change in the consequences of error. NIST recommends ongoing assessments and alerts, while the UK Code of Practice for the Cyber Security of AI calls for external-provider due diligence and threat management through the lifecycle.

Maintain a fallback and exit plan

For high-risk services, document how staff continue the task if the vendor is unavailable, compromised, or no longer acceptable. Keep exports, configuration details, prompts or workflow definitions, alternative procedures, and contact paths current. Exercise the fallback sufficiently to reveal dependencies that were invisible during procurement.

Do certifications or “AI compliant” claims prove a vendor is suitable?

No. A certification or compliance claim can be useful evidence when its scope, period, controls, exceptions, and service boundaries match your deployment. It does not establish that the vendor’s data use, suppliers, retention, legal roles, accuracy, resilience, or contract terms fit your particular context. ISO/IEC 23894:2023 describes guidance for integrating AI risk management into organizations developing, producing, deploying, or using AI systems; it is a framework reference, not proof that a supplier meets a buyer’s requirements. See the standard at ISO/IEC 23894:2023.

What are common evaluation failures and how can teams correct them?

Choosing from a demo instead of a defined use case

Failure: The team selects a capable model before identifying data, affected people, or consequences. Correction: Freeze a written use-case and risk record, then require every vendor to answer against it.

Stopping at the vendor’s privacy policy

Failure: A public notice is treated as a negotiated data-processing arrangement. Correction: Map purposes, roles, suppliers, retention, transfers, rights support, and deletion in the contract and processing documentation.

Ignoring logs and support access

Failure: The review covers prompts but not telemetry, backups, tickets, or administrator sessions. Correction: Include every copy and access path in the data-flow map and test deletion across those locations.

What’s actually slowing this PC down?

Pick the symptom - the matching free tool is one click away.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Accepting a supplier list that can change without notice

Failure: Procurement approves a static list while the service adds material subprocessors later. Correction: Require change notice, an assessment or objection process, and a termination or migration option for unacceptable changes.

Assuming approval ends responsibility

Failure: No one monitors model changes, incidents, or new data uses after onboarding. Correction: Assign an owner, maintain an inventory, set review triggers, and exercise a fallback for high-risk workflows.

How can teams document a defensible final decision?

Keep one decision file that links the use case to evidence and residual risk. It should contain the data-flow diagram, supplier inventory, questionnaire and supporting documents, privacy and security assessments, contract version, configuration record, test results, exceptions, approval authority, review date, and exit plan. Explain why the selected controls are proportionate to the processing risk and what would cause suspension or reapproval.

The result should be a conditional operational decision, not a permanent label: approved for a named purpose and data scope, with named owners and monitoring obligations. If the evidence does not answer a material question, record that uncertainty and either reduce the data and deployment scope, obtain stronger commitments, or do not proceed.

Frequently Asked Questions

What should a small organization request from an AI vendor first?

Start with the data-use statement, subprocessor list, processing locations, retention and deletion terms, incident-notification commitment, and security-assurance scope. Those documents reveal whether the service can be considered for your use case before you invest time in a full technical review.

How often should an approved AI service be reassessed?

Set a review date based on the service’s risk, then reassess sooner after a material model, subprocessor, location, contract, legal, vulnerability, incident, or use-case change. High-risk services also need a tested fallback, not merely an annual questionnaire.

Can a vendor prohibit audits and still be approved?

Only if the alternative assurance is sufficient for the deployment and your risk owner accepts the limitation. Consider independent reports, targeted evidence requests, incident cooperation, and termination rights; a refusal that leaves a material control unverifiable should block or narrow approval.

What evidence is most important when AI output affects people?

Require documented limitations, accuracy or bias information relevant to the task, human review and appeal procedures, monitoring, and a way to suspend or correct the workflow. Contractual rights to obtain updated documentation matter because performance and model behavior can change.
