Disclose AI-generated advertising according to the campaign’s market, the AI’s role in the asset, how realistic the result appears, and how much a mistaken impression could affect people. There is no universal “AI ad” label that satisfies every country or platform. In the European Union, Article 50 of the AI Act creates specific provider and deployer duties from 2 August 2026; Google and Meta provide additional ad-transparency controls, but neither platform feature is a legal safe harbor. Start by mapping each asset and audience, then place a clear, perceivable disclosure at or before first exposure whenever the applicable rule requires it.

What does “disclose AI-generated content” mean in an advertisement?

Disclosure tells the audience, platform, regulator, or all three that artificial intelligence generated or materially changed part of an ad. It can involve a consumer-facing statement, a platform transparency label, a machine-readable provenance signal, or several of these at once. These layers serve different purposes and should not be treated as interchangeable.

A hidden metadata mark may help a platform or investigator detect synthetic media, while a visible statement such as “AI-generated image” helps a person understand what they are seeing. The correct combination depends on the law in each market, the ad format, and whether the content could be mistaken for an authentic person, event, product result, or statement.

Three layers that are often confused

  • Provider marking: The developer or provider of a generative system may have to mark outputs in a machine-readable format so they can be detected as artificially generated or manipulated.
  • Advertiser or deployer disclosure: The business that publishes or uses the output may have to tell people that content is synthetic or manipulated, in a clear and distinguishable way.
  • Platform transparency: An advertising service may add an “AI info,” “How this ad was made,” overlay, or account-level setting. This can improve transparency but does not replace a legal assessment.

Do I need to label every AI-assisted advertisement?

No. Neither the EU AI Act nor the practical frameworks described here treats every use of an AI tool as requiring the same prominent consumer label. The decisive questions are what AI changed, how authentic the result appears, and whether the difference could matter to a reasonable consumer in that context.

For example, using an AI tool to remove sensor noise from a product photograph is materially different from generating a nonexistent customer testimonial, digitally changing a product’s apparent performance, or making a synthetic person appear to endorse a service. Record the intervention rather than relying on the tool’s marketing description of it as “assistance.”

When a label is more likely to be needed

  • The output depicts a real-looking person, place, object, event, voice, or result that never existed in the advertised form.
  • The edit changes a claim, demonstration, testimonial, review, before-and-after result, or other evidence on which a purchase decision could rely.
  • A synthetic voice or digital likeness could reasonably be attributed to a real individual.
  • The ad concerns elections, public-interest events, health, finance, safety, or another subject where an incorrect impression has significant consequences.
  • The platform or local law requires a disclosure for the format or targeting used, regardless of the advertiser’s own risk assessment.

When a less prominent or no extra label may be defensible

Limited AI assistance that does not alter the meaning or apparent authenticity of the asset may present a lower disclosure case. Clearly fictional, artistic, satirical, or fantastical material can also receive different treatment under applicable law. Those exceptions are conditional; they do not automatically cover realistic commercial claims or every creative use of generative tools.

What does the EU AI Act require for advertising?

Article 50 is the main EU transparency rule for covered synthetic content. It separates obligations placed on providers of AI systems from obligations placed on deployers—the organizations that use outputs in practice. The European Commission says these Article 50 obligations apply from 2 August 2026, so campaigns running after that date need an implementation decision, not merely a future-readiness plan.

Provider marking and advertiser disclosure are different

Providers of systems that generate synthetic audio, images, video, or text must ensure outputs are marked in a machine-readable format and detectable as artificially generated or manipulated. That signal is designed for technical detection. It is not necessarily visible to an ad viewer and does not by itself satisfy a deployer’s consumer-facing duty.

Deployers have separate duties for qualifying deepfakes and for specified AI-generated or manipulated text published to inform the public about matters of public interest. Article 50 requires the information to be clear, distinguishable, accessible, and supplied no later than the first interaction or exposure. Article 50(5) states: “The information referred to in paragraphs 1 to 4 shall be provided to the natural persons concerned in a clear and distinguishable manner at the latest at the time of the first interaction or exposure.”

What counts as a qualifying deepfake?

The deepfake concept concerns image, audio, or video that resembles an existing person, object, place, entity, or event and would falsely appear to be authentic or truthful. A realistic synthetic spokesperson, fabricated news-style scene, or altered recording can fall within this concern even when the advertiser did not intend to deceive.

Whether a particular ad qualifies depends on the actual asset and context. A cartoon character in an obviously impossible setting is not evaluated the same way as a photorealistic video that appears to show a named executive making a statement. Use the Commission’s current scope guidance for borderline cases and retain the reasoning in the campaign file.

What about AI-generated text?

Article 50 addresses AI-generated or manipulated text when it is published to inform the public on matters of public interest. The Act describes a limited exception where the text has undergone human review or editorial control and a natural or legal person carries editorial responsibility. That exception has statutory conditions; it should not be generalized to ordinary commercial copy or treated as a blanket exemption for all human-edited AI text.

How do the artistic and fictional exceptions work?

The Act provides limited treatment for evidently artistic, creative, satirical, fictional, or analogous works. The presentation still must not undermine the required transparency more than necessary for the work’s purpose. A fictional ad concept may therefore need a lighter treatment than a realistic fabricated testimonial, but the exception is not a license to hide a material commercial manipulation.

How should I decide whether an ad needs a disclosure?

Use a documented, risk-based assessment even where a rule does not prescribe a single label. The IAB Framework V2 (18 August 2026) and EASA’s guide (22 October 2026) both help teams evaluate materiality, although neither replaces law.

Assess the level of AI involvement

Classify the contribution for every asset: generated image, video, audio, text, synthetic voice, digital likeness, background replacement, object removal, enhancement, or AI-powered interaction. Note whether a human supplied the substantive content and whether the tool only performed routine production work. Keep the original and final files where feasible so the description can be verified.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Assess plausibility and authenticity

Ask whether a reasonable audience could mistake the output for an authentic person, event, product result, location, or statement. Photorealism, a familiar voice, realistic motion, documentary-style editing, and use of a real person’s likeness all increase the chance of confusion. Obvious fantasy, visible stylization, or an unmistakable fictional setting generally reduce it, but do not erase a platform or sector-specific rule.

Assess significance to the consumer

Consider whether the mistaken impression could change a person’s understanding or decision. A synthetic background in a low-stakes brand animation may have little significance; a generated clinical result, financial outcome, political statement, safety demonstration, or customer review may have much more. The greater the potential impact, the stronger the case for an explicit disclosure near the claim.

Apply the cumulative test

EASA describes three cumulative dimensions: level of AI use, plausibility or authenticity, and significance or potential impact. Disclosure is generally less indicated when all three are low. It becomes increasingly appropriate as extensive AI use creates realistic content that matters to consumers. IAB’s materiality approach can help document the same judgment in markets without a specific statutory rule.

What should the disclosure say and where should it appear?

Use plain language that identifies the relevant manipulation without forcing people to hunt through a menu. “AI-generated image,” “Synthetic voice,” “Dramatization: this scene was generated with AI,” or “This video uses a digitally created likeness” are more informative than an unexplained icon. Name the affected element when only part of an asset is synthetic.

Place it at first exposure

For rules that require timing at first interaction or exposure, put the notice in the initial frame, caption, audio introduction, or another immediately perceivable location. Do not place the only explanation behind a profile page, a hover state, a collapsed “more” link, or a post-click disclosure. Make the text readable on mobile, maintain sufficient contrast, and provide an equivalent audio or textual treatment where the format requires it.

Match the notice to the format

  • Static image: Add a readable overlay or adjacent caption that remains visible in the delivered creative.
  • Video: Show the notice in the opening frame or before the synthetic segment, and keep it on screen long enough to read; include a spoken or captioned equivalent when appropriate.
  • Audio: State the use of a synthetic voice before the relevant content or in an immediately preceding disclosure.
  • Social or display copy: Put the disclosure in the visible post or ad text, not only in a linked policy page.
  • Interactive assistant: Tell users when they are interacting with an AI-generated character or response, and update the notice if a human takes over.

Do not confuse machine-readable marks with visible labels

Technical provenance can support detection, auditing, and platform processing. It may be required from a provider, but it is not a substitute for a clear consumer-facing notice when deployer disclosure applies. Preserve both layers when possible.

How do Google Ads’ AI disclosure controls work?

Google describes two layers: advertiser-selected disclosures for assets and labels that Google may apply in certain circumstances. Its “How this ad was made” information is available through ad-information controls. For campaigns targeting the European Union, India, and New York, designated AI-created or AI-edited assets may also receive visible overlays.

Advertiser-selected settings

Use the asset disclosure setting when the campaign interface offers it, and supply accurate information about which creative elements were generated or edited. Google may automatically label some assets made with its own automated tools; those labels may not be overwritten. Check the rendered ad rather than assuming the setting appears identically in every placement.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Election advertising

Election ads have an additional rule. Google requires campaign-setting disclosure for synthetic or digitally altered content that is consequential to the ad’s claims, and some formats require a prominent disclosure inside the ad itself. Treat the election workflow separately from ordinary commercial creative review and check the current format-specific requirements before launch.

Why Google’s label is not enough by itself

Google’s July 2026 update says advertisers may add text or visual labels directly to image and video creatives to help meet emerging requirements. Google also expressly warns that using its setting does not guarantee compliance with specific regulations. The advertiser remains responsible for the law in every target market, including markets not listed in Google’s examples.

What is Meta’s “AI info” transparency update?

Meta’s 1 June 2026 update describes a rollout of “About this ad” as a central destination for transparency information. It says the destination will include “AI info” labels already applied to ads created or significantly edited with Meta’s generative AI tools, with expansion to ads shaped by third-party AI tools.

This is a product rollout, not a guarantee that every account, placement, or ad currently exposes identical information. Review the live preview and the delivered placement, keep your own disclosure where a law requires one, and document which Meta controls were available when the ad was approved.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

How do I disclose an AI-generated ad step by step?

Use this workflow for each campaign, not just once per account. Re-run it when the target geography, creative, audience, platform feature, or official guidance changes.

  1. Map the campaign. List every country or region, platform, format, language, audience, and launch date. Identify election, public-interest, sectoral, or other special rules that may apply.
  2. Assign legal roles. Record the system provider, your organization as deployer or advertiser, agencies, production vendors, and any publisher that controls placement. Do not assume a platform’s label transfers your responsibility.
  3. Inventory AI changes. For each image, video, audio track, voice, text block, avatar, and interactive component, record what was generated, edited, or merely enhanced.
  4. Test authenticity. Ask what a reasonable viewer would believe the asset shows and whether the presentation could be mistaken for a real person, event, product result, or statement.
  5. Test materiality. Decide whether that possible mistake could affect understanding, trust, safety, eligibility, spending, voting, or another meaningful consumer decision.
  6. Check mandatory rules. Apply the relevant EU Article 50 scope, local law, election requirements, and platform policies. Use current official guidance for unresolved cases.
  7. Choose the clearest format. Put a visible, readable notice at or before first exposure where required. Add machine-readable provenance and platform settings as additional layers.
  8. Quality-check delivery. Inspect mobile and desktop renders, autoplay video, audio, captions, translations, compressed images, and every placement. Confirm that the disclosure survives cropping and does not disappear behind an interaction.
  9. Archive the decision. Keep the asset versions, AI-use description, risk assessment, geography, platform settings, rendered proof, reviewer, date, and source guidance used. This makes later changes auditable.
  10. Monitor and refresh. Recheck when a platform changes its label behavior, when a new market is added, or when the creative is materially edited. Pause or revise an ad if the delivered result differs from the approved disclosure.

What are the most common disclosure mistakes?

  • Using one global label: A notice suitable for one market may be too late, too hidden, or incomplete in another.
  • Relying only on metadata: Viewers cannot act on a machine-readable signal they cannot perceive.
  • Labeling the tool instead of the effect: “Made with AI” may not tell people that a voice, face, product result, or event was fabricated.
  • Disclosing after the claim: A notice that appears only after a viewer has already seen a realistic false impression may fail a first-exposure requirement.
  • Assuming human editing removes the issue: Human review can matter for a specific statutory exception, but it does not automatically erase a deepfake or materiality concern.
  • Ignoring partial edits: An otherwise real photograph can still require explanation when AI changes the product’s apparent performance or inserts a real-looking person.
  • Overstating an exception: Fictional, artistic, satirical, or public-interest-text exceptions have defined conditions and should be applied narrowly.
  • Failing to test the final placement: Captions, overlays, and labels can be cropped, hidden, translated poorly, or omitted in a different ad format.
  • Assuming platform compliance equals legal compliance: Google and Meta features are useful controls, but advertisers retain responsibility for applicable law.

Which approach should a small advertising team use?

Use a short internal decision record for every AI-influenced asset. It can be a spreadsheet or ticket with these fields:

Field What to record
Market and date Target countries, launch date, and the rule version checked
Asset and AI action File, format, tool role, generated or edited elements, and human contribution
Authenticity risk What a reasonable viewer might believe the asset shows
Consumer significance How a mistaken impression could affect a decision or understanding
Required treatment Visible label, audio or caption notice, machine-readable mark, platform setting, or combination
Verification Rendered screenshots or recordings, reviewer, approval date, and later changes

For a high-risk asset—such as a realistic synthetic person, altered executive statement, election claim, health result, or financial outcome—obtain qualified legal review in the relevant market before publication. For lower-risk creative, the record still shows why the team chose a particular notice or concluded that no additional consumer label was needed.

How should agencies and advertisers divide responsibility?

Put the allocation in the statement of work and approval process. The advertiser should provide the claim, target markets, and factual substantiation; the agency or production vendor should disclose tools and material edits; and the platform or publisher should be checked for its own labeling behavior. A contract cannot remove a statutory duty from the party that legally carries it, but clear records prevent gaps between production and launch.

How current are these rules and frameworks?

The EU application date, Google’s July 2026 update, Meta’s 1 June 2026 rollout description, IAB Framework V2 dated 18 August 2026, and EASA’s non-binding guide published 22 October 2026 reflect a fast-changing environment. EASA’s guide is a practical compass for the European advertising ecosystem, not a compliance instrument or legal interpretation. IAB’s framework is a voluntary, risk-based approach covering text, images, video, audio, synthetic voices, digital twins, and AI-powered consumer interactions.

Rules, enforcement interpretations, and platform interfaces can change independently. Before each launch, verify the current official rule for every market and platform, and update the campaign record when the creative or targeting changes.

Frequently Asked Questions

Can a disclosure be placed only in the ad’s terms and conditions?

Usually that is too late or too difficult to perceive when the synthetic element could affect the first impression. A terms page can provide additional detail, but it should not be the only notice where a rule calls for clear information at first exposure.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Do I have to disclose AI-written advertising copy?

Not automatically in every market. The EU AI Act’s specific text provision concerns AI-generated or manipulated text published to inform the public on matters of public interest, with a conditional human-review exception; ordinary commercial copy still needs a context and risk assessment.

What if the platform adds an AI label that I did not choose?

Keep evidence of the label and check whether it is visible in every placement, language, and device. An automatic platform label may supplement your notice, but it does not remove your responsibility to meet a local legal requirement.

Should I disclose an AI-generated background that is obviously imaginary?

Assess whether the background could nevertheless make the product, location, endorsement, or result appear real. If the fictional treatment is unmistakable and immaterial to the buying decision, a prominent warning may be unnecessary, but document the reasoning and check any platform-specific rule.

How often should an AI disclosure decision be revisited?

Revisit it whenever you add a market, change the creative or audience, switch format, or learn that a platform has altered its labeling behavior. A new edit can change an asset from a low-risk enhancement into a realistic synthetic claim.
