An AI version of you is not just a software project. It combines identity rights, recordings and other source material, data protection, employment or union rules, advertising law, and a contract that defines exactly what another party may do. The safest approach is to separate model creation, training, generation and publication; obtain informed written consent for each stage; and license only named uses for a defined term, territory, audience and medium. Your agreement should also cover compensation, approvals, disclosure, security, sublicensing, deletion, takedown, audits and what happens after death or incapacity. Have an independent lawyer familiar with intellectual-property and entertainment contracts check the governing law before you sign.

What counts as an AI version of yourself?

The phrase can describe several different assets, and a contract should identify each one instead of treating them as a single “avatar.” A system might reproduce your:

  • Recorded or synthetic voice, including accent, cadence, vocal mannerisms and catchphrases.
  • Face, name, photograph, body, gestures, movement or other visual likeness.
  • Performance captured from motion, facial or volumetric data.
  • Biography, personal history, opinions, writing style or other persona traits.
  • Training recordings, scans, photographs, scripts, interviews and other source files.
  • Model, voice profile, avatar rig, embeddings, model weights and generated outputs.
  • Materially altered versions of an existing performance, such as changing words, actions, age, language or context.

These assets can have different owners and legal protections. You might own a recording but not the underlying music, script, photograph or studio contribution. Conversely, a company may own a model file while you retain rights in your name, likeness, voice or performance. List every asset and right in an exhibit to the agreement.

How do I make an AI clone of myself legally?

Use a staged process. Do not give a developer or client a blanket right to “create and use my digital replica” before you know what will be captured, trained, generated and published.

1. Define the replica before any recording

Write a plain-language specification covering voice, face, body, movement, name, biography, catchphrases, performance capture, training data, model, outputs and permitted alterations. State whether the system may create new dialogue or actions that you never performed, translate your speech, change your apparent age or combine your likeness with another person. If an existing performance may be edited, identify the performance and the changes allowed.

2. Inventory the source material and other rights

Make a list of every recording, photograph, scan, script, music track, costume, trademark, location and piece of personal data that will be supplied. Confirm who owns each item and whether a producer, employer, photographer, label, co-star or union agreement imposes restrictions. A license from you cannot transfer rights that belong to someone else.

3. Give informed written consent for capture and training

The consent should explain what will be recorded, how long it will be retained, who will receive it, whether it will train a model, whether the model may be reused for other projects, and what security controls apply. Consent to a test recording or internal prototype should not automatically authorize public distribution.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

4. Obtain a separate approval for generation and publication

Model creation, training, generating a performance and publishing an output are different acts. Require a new written approval when the project moves from one stage to the next. Also require fresh approval for a new client, campaign, character, language, product category, territory or materially different performance.

5. Test the output and document the decision

Review sample outputs for unauthorized statements, unsafe behavior, misleading endorsements, impersonation, sexual or violent material, medical claims and reputational risks. Keep an approval log identifying the version, prompt or script, reviewer and date. The log helps establish what you actually authorized if a dispute arises.

6. Put security and deletion requirements in writing

Require encryption in transit and at rest, role-based access, a list of approved vendors, breach notice deadlines and a process for revoking access. Identify whether recordings, scans, biometric information, model weights, prompts and outputs must be returned or deleted when the project ends, and require written certification of deletion.

What rights am I licensing when I license my voice or likeness?

A contract should distinguish identity rights from copyright and from contractual performance rights. The legal mix depends on the person, project and jurisdiction.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Asset or interest What it may protect Contract question
Name, image, likeness and voice Commercial exploitation of your identity under publicity, privacy, labor or similar laws Which uses, audiences, products, territories and terms are allowed?
Recorded performance Rights in the performance and permissions granted by a performer or union agreement May the recording be edited, reused, transformed or used to train a model?
Photograph, sound recording, script or video Copyright in the fixed work, often owned by the photographer, producer, writer or employer Who owns or licenses the underlying work, and does that license cover AI processing?
Model, voice profile or avatar files Contractual control, trade-secret or software rights, and possibly copyright in eligible human-authored material Who owns the files, may they be copied or sublicensed, and what is deleted at termination?
Generated output Rights that may attach to human-authored contributions; purely machine-generated material may have limited copyright protection Who may publish the output, and who bears responsibility for statements or infringement?

The U.S. Copyright Office’s January 29, 2025 report addressed copyrightability of generative-AI outputs. Copyright in a photograph or recording remains separate from rights in the person depicted or heard. A contract must address both layers rather than assuming that ownership of one automatically grants the other.

What should an AI voice or digital-likeness contract include?

Use a schedule or exhibit with concrete examples, then make the operative clauses match it. These provisions are the minimum issues to negotiate.

Asset definition and permitted alterations

Identify the exact voice, likeness, performances, source files, model and outputs covered. State whether the license permits translation, dubbing, age changes, accent changes, synthetic dialogue, compositing with other people, or alteration of an existing performance. Prohibit uses outside the listed changes.

Intended uses

Name the product or campaign, character, scripts or subject matter, medium, distribution channel, audience, language, territory and duration. A clause that simply permits “all media now known or later developed” can be too vague, especially where law requires a reasonably specific description of intended use. If a future use matters, add a documented amendment and a new fee instead of relying on a catch-all.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Separate permissions for creation, training, generation and publication

State whether the license covers making a dataset, training or fine-tuning a model, generating outputs, internal testing, public release, advertising and archival storage. Make each permission independently revocable or renewable where commercially appropriate.

Compensation and accounting

Specify the signing or session fee, minimum guarantees, royalties, residuals, reuse fees, buyout scope, payment triggers, expenses, taxes, reporting frequency and audit rights. A model that is reused for several campaigns should not silently convert a one-time session payment into an unlimited buyout. Covered union work may include minimum compensation rules that cannot be waived by an informal side letter.

Approval, veto and disclosure rights

Reserve approval or veto rights for political endorsements, sexual or violent content, medical or financial claims, news-style presentation, endorsements, fundraising, satire and other reputationally sensitive contexts. Define response deadlines and what happens if you do not respond. Require a visible or audible disclosure that the performance is synthetic when the audience could reasonably be misled, and specify the wording or placement where possible.

Term, territory and exclusivity

Set a start date, end date, renewal process and geographic scope. Explain whether the license is exclusive for a named category or nonexclusive. If exclusivity prevents you from licensing your voice or likeness to others, list the competing categories, minimum payments and release conditions. A perpetual, worldwide, exclusive transfer should be priced and reviewed as a sale of long-term control, not as an ordinary project license.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Sublicensing, assignment and vendors

Say whether the licensee may let an advertising agency, cloud provider, model host, distributor, client or other vendor access the source material or model. Require written flow-down terms, security obligations and responsibility for vendor conduct. Prohibit assignment to an unrelated buyer without your consent unless the commercial deal expressly includes it.

Data, model and output control

Specify who owns or controls recordings, scans, datasets, embeddings, model weights, prompts, logs and outputs. Prohibit training a future general-purpose model on your material unless that use is expressly named. State whether the licensee may retain a backup, use the model to create internal demos or combine it with other identity data.

Security, breach and incident response

Require access controls, encryption, logging, vulnerability management and prompt notification of unauthorized access. Set a deadline for containing and investigating a breach, identify who pays for required notices and remediation, and give you a right to suspend access while the incident is investigated.

Takedown, correction and termination

Include a rapid takedown procedure for unauthorized or harmful outputs, a correction process for false statements and a right to terminate for material misuse, nonpayment, security failure or uncured breach. State whether existing advertisements may finish their booked run after termination and whether new generation is prohibited immediately.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Deletion and return

At expiration or termination, require return or deletion of source recordings, scans, biometric data, datasets, model weights, credentials and copies held by vendors. Address backups, disaster-recovery copies and outputs already distributed. Set a deadline and require a signed deletion certificate or an explanation of any legally required retention.

Death, incapacity and successor authority

Name the person authorized to act if you become incapacitated and identify the estate representative who may approve new uses after death. Specify whether the consent survives death, for how long, with what compensation, and whether new campaigns require estate approval. Do not leave successor authority to an undefined “heirs and assigns” phrase.

Governing law, remedies and insurance

Choose the governing law and forum after checking where you live, where the performance occurs, where the licensee operates and where the audience is located. Address injunctions or emergency takedown orders, indemnities, liability caps, insurance, attorneys’ fees and dispute procedures. A remedy that cannot be obtained quickly is of limited value when a synthetic advertisement is spreading.

How specific must the intended uses be?

Specificity is both a practical safeguard and, in some jurisdictions, an enforceability issue. Describe the use so that an ordinary reader can tell what you agreed to without guessing from a broad assignment.

California digital-replica performances

California AB 2602 addresses new digital-replica performances fixed on or after January 1, 2025. A covered provision can be unenforceable when it lacks a reasonably specific description of intended uses and the individual was not represented by qualifying legal counsel or a labor union. The statute is sector- and fact-specific, so counsel should confirm whether a particular performance and agreement fall within it.

New York contracts

New York General Obligations Law §5-302 also addresses contracts for creation and use of digital replicas and requires attention to reasonably specific intended uses. A New York agreement should therefore identify the performance, use, medium and scope rather than relying on an unlimited future-media clause.

Why a blanket clause is risky

“All media, now known or later developed” may not tell you whether the replica can endorse a medicine, appear in a political message, speak another language or be licensed to an unrelated client. If those possibilities are commercially important, list them, set separate prices and obtain approval for each category. Counsel should assess enforceability under the law selected in the contract.

What is the difference between a narrow license and a broad exclusive buyout?

A narrow nonexclusive license preserves future control; a broad exclusive buyout transfers or locks up much more of it. The economic and legal consequences should be visible in the deal sheet.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Issue Narrow, nonexclusive license Broad, exclusive buyout
Permitted uses Named campaign, product, character, media and performance limits Wide categories, often including multiple products, formats or altered performances
Term Fixed period with renewal or reapproval Long-term or perpetual control, subject to the contract and applicable law
Territory Specified countries or distribution regions Often worldwide, with fewer geographic limits
Compensation Project fee plus agreed reuse, royalties or residuals Larger upfront payment, negotiated buyout premium and any continuing payments
Approval rights Approval or veto for listed sensitive uses and new categories More limited control unless expressly reserved
Sublicensing Named vendors or clients with flow-down obligations Broad sublicensing or assignment may be requested and must be priced
Data and model control Purpose-limited training and deployment with deletion at expiry Longer retention and wider model rights, requiring stronger security and successor terms
Postmortem rights Defined estate approval, term and compensation Potentially continuing control after death; negotiate limits and estate payments
Remedies Takedown, suspension and termination for misuse Detailed injunction, audit and termination rights are essential because reversal is harder
Governing law Selected law matched to the parties and performance Careful jurisdiction review because the wider grant increases conflict risk

Do not accept an exclusive buyout merely because the document calls it a “license.” Exclusivity, perpetual duration and assignment language can remove practical control even when legal title is not formally transferred.

How should compensation and approvals work in practice?

Compensation should follow the ways the replica creates value. A useful schedule ties payment to events rather than leaving reuse to a vague “full buyout.”

  • Pay a capture or session fee for recording, scanning or performance work.
  • Pay a separate model-creation or training fee if the material will produce future outputs.
  • Set a minimum fee for each campaign, product category, language, territory or renewal.
  • Define reuse fees, royalties or residuals when an output is extended, repurposed or distributed to a new audience.
  • Require periodic statements and an audit right for revenue-based compensation.
  • Set a higher rate or separate approval for political, medical, financial, sexual, violent, news-style or otherwise sensitive uses.
  • State whether the payment is a buyout and exactly which future uses that payment covers.

Approval mechanics should be workable. Name the reviewer, permitted communication method, response period, emergency procedure and the consequences of a missed deadline. Silence should not automatically authorize a materially different performance unless you knowingly agree to that rule.

How do I control downstream use of my model and data?

Most misuse occurs after the initial recording, when a model is copied, moved to a vendor or reused for a new client. Control the chain of custody in the contract.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • List every approved model host, production vendor and distribution partner.
  • Require written permission before a new client, territory, language or product category is added.
  • Prohibit sublicensing, assignment and model export unless the recipient signs equivalent restrictions.
  • Ban training of unrelated models or combining your data with another person’s identity data without approval.
  • Require access logs and the right to inspect compliance records at reasonable intervals.
  • Set a breach-notice period and a duty to preserve evidence, stop generation and support takedown.
  • Require deletion or return of all source material, model files and credentials when the license ends.

Ask whether a vendor’s “backup,” “quality improvement” or “service analytics” exception allows indefinite retention or secondary training. Narrow those exceptions to what is necessary, time-limited and secured.

What happens if I die or become incapacitated?

Death does not produce one universal result. The answer depends on the contract, the identity and publicity laws connected to the transaction, union rules and estate authority.

California AB 1836 requires estate consent for covered commercial digital replicas of deceased performers. The statute applies to covered uses, so an estate representative and counsel should verify the facts before approving a campaign. The Congressional Research Service has also discussed postmortem consent in connection with the 2023 SAG-AFTRA studio agreement.

Your contract should name the successor decision-maker, identify whether consent survives death, set a postmortem term and compensation, and require approval for new uses. It should also explain what happens to an existing model, already published outputs, queued campaigns and retained backups. An estate clause that gives a company perpetual control without a clear payment and approval process is a major risk.

How do union-covered and nonunion arrangements differ?

Union coverage can add representation, minimum compensation and consent procedures that are not present in an individual deal. The agreement and the actual work determine which rules apply.

Issue Union-covered work Nonunion work
Representation Union rules and, in some California cases, qualifying union representation can affect enforceability Independent legal counsel should review the individual contract and applicable statutes
Compensation Covered agreements may include minimum compensation, reuse payments or residuals Fees, minimums, royalties and reuse payments must be negotiated expressly
Consent SAG-AFTRA describes its guardrails as “clear consent, fair compensation, control over performances”; the 2023 studio agreement calls for “clear and conspicuous” consent and a “reasonably specific description” of intended use Written consent should still be specific, staged and tied to named uses
Enforcement Grievance, arbitration or other union procedures may supplement ordinary remedies Remedies come from the contract and applicable court or arbitration forum
Postmortem use Check the governing collective agreement and any required estate process Specify successor authority, term, payment and new-use approval in the contract

Do not assume that a union card resolves every issue. A separate model-hosting, advertising or technology agreement may still need detailed data, sublicensing and deletion terms.

Which laws and rules can change the result?

Digital-replica rights are fragmented. Match the legal review to the people, performance, licensee, contract and audience connected to the deal.

U.S. federal policy

On July 31, 2024, the U.S. Copyright Office released Part 1 of its AI report and recommended that Congress create a federal law protecting everyone from knowing distribution of unauthorized digital replicas. That recommendation is not itself a universal federal private right, so state law and contract terms remain important.

Impersonation and advertising rules

The FTC impersonation rule cited here targets impersonation of governments, businesses and their officials or agents in interstate commerce and became effective April 1, 2024. A synthetic performance that misleads people about who is speaking can create regulatory and advertising exposure even when a contract with the performer exists.

United Kingdom comparison

UK guidance says there is no general personal image right in UK law. Copyright protects the fixed work, such as a sound recording or photograph, rather than the person’s voice or appearance as such. A UK deal therefore needs careful contract drafting and analysis of passing off, privacy, data protection, copyright and any employment or performer rules that apply to the facts.

Do I own my AI avatar?

Not automatically. You may own some source material, license identity rights to another party, or have contractual control without owning every model component. Copyright protection for a generated output depends on human authorship and the contributions made by people; the U.S. Copyright Office’s January 29, 2025 report addresses that question.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Ownership should be allocated expressly. State who owns the recordings, scans, dataset, model, weights, prompts, software, avatar rig and outputs; who may modify them; who may commercialize them; and what rights return when the agreement ends. If you want to retain the ability to make your own clone or license another provider, reserve those rights and avoid unnecessary exclusivity.

What contract red flags should I reject or revise?

  • A one-sentence grant covering every use, every medium, every territory and perpetuity without examples or separate compensation.
  • Consent to “any statement or action” with no approval or prohibited-use list.
  • Permission to train “future models,” improve services or use analytics without a defined purpose and deletion date.
  • Unrestricted sublicensing, assignment or transfer to an unknown buyer or vendor.
  • No distinction between internal testing, model training, generated output and public distribution.
  • No security standard, breach notice, audit right or vendor responsibility.
  • No takedown, correction, suspension or termination remedy for harmful or unauthorized output.
  • No clear treatment of backups, model weights, cached files or outputs after expiration.
  • No successor, estate or incapacity procedure.
  • A governing-law clause chosen for convenience even though the performer, production and audience are elsewhere.
  • A promise that you “waive all rights” without identifying which rights, for which uses and for what payment.

What should I do before signing?

  1. Prepare an asset and rights inventory, including every source file and third-party permission.
  2. Mark each proposed use by medium, product, campaign, audience, language, territory and duration.
  3. Separate capture, training, generation, publication, archival storage and future reuse approvals.
  4. Price exclusivity, new categories, extensions, territories, languages and sensitive uses separately.
  5. Negotiate approval, disclosure, takedown, correction, deletion, audit and breach provisions.
  6. Identify vendors, model hosts, clients, sublicensees and assignment restrictions.
  7. Choose governing law and dispute forum only after checking the jurisdictions connected to the deal.
  8. Name incapacity and estate representatives and define postmortem consent and compensation.
  9. Have independent entertainment, intellectual-property and data-protection counsel review the final language.
  10. Keep the signed agreement, exhibits, approvals, output versions and deletion certificates in a secure record.

Frequently Asked Questions

Can I revoke consent after my AI likeness has been licensed?

Only if the agreement gives you a revocation or termination right, or another applicable law supplies one. Negotiate a defined withdrawal process, notice period, takedown deadline and treatment of already distributed material before granting access.

Who owns a model trained on my voice?

Ownership may belong to the developer, the licensee, you, or multiple parties under the contract. Ask for an explicit allocation of model files, weights, embeddings and outputs rather than assuming that ownership of your voice determines ownership of the model.

Is my voice automatically protected as biometric data?

Protection varies by jurisdiction and by how the voice data is collected and processed. Treat recordings, voiceprints and scans as sensitive personal data, limit access, state retention periods and obtain advice on applicable privacy notices and consent requirements.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Can a company keep my digital replica after the license expires?

It can do so only if the contract or an applicable legal requirement permits retention. Require deletion or return of source files, model artifacts, credentials, backups and vendor copies, with a written certificate and a narrowly defined exception for legally required records.

Does a synthetic disclosure eliminate impersonation risk?

No. Disclosure can reduce audience confusion, but it does not authorize an unlicensed use, false endorsement, defamatory statement or prohibited advertising claim. The underlying consent, use limits and applicable law still control.
