Choose an AI tool for sensitive business data by matching its technical controls and contract to the specific information and task—not by relying on a “business” label or a promise that prompts are not used for training. Start by classifying the data, mapping where it will go, and assessing the harm if it is exposed, retained, altered, or used in a decision. Then verify training terms, retention, location, access controls, auditability, connectors, and human review for the exact product, plan, endpoint, and region you intend to use.

What makes an AI tool suitable for sensitive business data?

A tool is suitable only when its actual controls and contractual commitments address the risks of your data and use case. A consumer chatbot, an enterprise workspace, and an API may have different terms and controls even when they use related models; assess the exact service and configuration rather than assuming one product’s protections apply to another.

“Not used for training” is useful but incomplete. It does not by itself establish how long prompts or files are kept, who can see them, where processing occurs, what connected systems can retrieve, or what happens during an incident. Enterprise controls can reduce risk, but they do not make every use lawful, accurate, or appropriate.

The Office of the Australian Information Commissioner (OAIC), in its Guidance on privacy and the use of commercially available AI products, updated January 17, 2025, recommends that organizations not enter personal information—particularly sensitive information—into publicly available generative AI tools because of the significant and complex privacy risks. Treat that as a strong reason to keep personal or sensitive data out of public consumer tools unless your organization has assessed and approved the specific service and use.

How should you classify the data before comparing tools?

Inventory the information and the people or organizations it concerns before testing a vendor. Classify it in terms staff can apply consistently, then define whether the AI service needs the real data at all.

  1. List the data and its owner. Identify whether it is public, internal, confidential, personal, regulated, or a trade secret. Note whether it belongs to your organization, an employee, a customer, a partner, or another party.
  2. Describe the task. Specify what the AI will do: summarize, draft, search, classify, answer questions, or take an action. A tool that drafts an internal outline presents a different risk from one that sends a customer response or changes a system of record.
  3. Map the data paths. Include prompt text, uploaded files, retrieved documents, embeddings, model context, generated outputs, logs, analytics, backups, fine-tuning data, and connected systems. Do not limit the review to what an employee types into a chat box.
  4. Define the impact of failure. Consider disclosure, retention, alteration, inaccurate output, or use in an automated decision. Set the required protections and human checks before selecting a product.
  5. Ask whether real data is necessary. If not, use a minimized or de-identified example, or synthetic data where it is suitable. This reduces exposure during experimentation without pretending to replace a privacy or security assessment.
Example classification Typical handling decision What to verify before use
Public information May be suitable for a general-purpose tool, subject to organizational policy and task risk. Whether the output is accurate enough for the intended use and whether prompts or outputs are retained.
Internal information Use only in a service and workspace approved for internal material. Access controls, retention, administrator visibility, and whether connected content respects permissions.
Confidential business information or trade secrets Require explicit approval; minimize what is sent and assess the exact product and contract. Training and secondary-use terms, deletion, processing location, key controls, logs, subprocessors, and connector boundaries.
Personal or regulated information Do not place it in a public tool by default. Require a documented assessment and appropriate contractual and technical controls before an approved use. Applicable legal and contractual obligations, data movement, residency, retention, access, incident response, and human review.

This is a practical starting point, not a substitute for your organization’s formal classification policy or legal advice. A category alone does not decide whether a use is permitted; the purpose, jurisdiction, recipients, and applicable commitments matter too.

Which controls should you compare across AI tools?

Use the same questions for every candidate, including an existing productivity suite or an API. Record the answer, the source of the commitment, and the product scope so that marketing language does not silently become your security requirement.

Training and secondary use

Ask whether prompts, files, outputs, feedback, or other customer content are used to train or improve models. Check whether the answer is an opt-in, an opt-out, a default setting, or a contractual prohibition. Verify it separately for the product, workspace, API endpoint, and any connected agent; an organization’s choice in one service should not be assumed to cover another.

OpenAI says business and API inputs and outputs are not used to train models by default. Microsoft says organizational Copilot prompts, responses, and Microsoft Graph data are not used to train foundation models. These are vendor statements about the described offerings, not proof that all data is unretained, inaccessible to administrators, or covered by identical controls in every configuration.

Retention, deletion, and administrator access

Ask what is kept and for how long: prompts, uploaded files, generated responses, abuse-monitoring logs, traces, embeddings, backups, and intermediate files. Determine who can delete each category, the expected deletion timeline, and whether deletion covers replicas and backups. Ask whether an administrator, support staff member, or incident-response process can access content, and how that access is controlled and recorded.

For OpenAI’s API, documentation says abuse-monitoring logs may be retained for up to 30 days by default. Zero-data-retention and feature-level controls have eligibility requirements and endpoint limitations. Therefore, “zero data retention” should be checked against the exact endpoint and features being used; do not assume a label means every associated log, file, or connected service is excluded.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Microsoft’s work or school Copilot Chat information says prompts, Bing queries, and responses are logged and may be available to an IT administrator. That is an important distinction: not used for training does not mean not stored or visible to an authorized administrator.

Storage, inference, and cross-border movement

Ask where content is stored and where inference is performed. Identify subprocessors and cross-border transfers, including paths created by connectors, monitoring, support, or backups. A vendor’s headquarters or the sales region shown on an invoice does not establish data residency. If a location restriction is essential, obtain a commitment for the specific service and configuration and confirm which processing activities it covers.

OpenAI says qualifying organizations can use regional storage or inference options. Availability is qualification-dependent; verify the relevant organization, product, region, and feature rather than treating regional options as universal.

Encryption, keys, identity, and permissions

Verify encryption in transit and at rest, and ask who controls the keys. Where customer-managed keys or external key management are offered, clarify key rotation, recovery, and what happens to access if a key is disabled. Then assess identity protections: single sign-on (SSO), multifactor authentication (MFA), roles, tenant isolation, document permissions, sensitivity labels, and connector or agent access.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Microsoft says Copilot under enterprise data protection applies identity permissions, sensitivity labels, retention policies, audit controls, encryption, and tenant isolation. In a Microsoft-centered environment, inherited permissions and labels may be particularly relevant. They are not a reason to skip permission hygiene: an assistant can surface material that a user is already authorized to access, so broad or stale permissions still create risk.

Audit, incident response, and governance

Check whether administrators can review prompt and output logs, use e-discovery or data-loss-prevention (DLP) controls, investigate incidents, and suspend a user, connector, endpoint, or agent. Ask what incident notification commitments apply and what evidence is available to support an investigation. Confirm whether logging itself contains sensitive content and how those records are protected.

Governance continues after procurement. The OAIC warns that due diligence is not a “set and forget” exercise. Assign an owner, train staff, monitor use, track vendor changes, and reassess when the data, model, connector, purpose, or legal context changes.

How do you compare tools for a real use case?

Score each candidate against the same use case and required controls. A single overall security score can conceal a disqualifying gap, so mark mandatory conditions separately from preferences.

Comparison area Questions to answer Why it can change the decision
Data use and training What content is used for training or improvement? Is the restriction contractual, a setting, or a default? It establishes whether the vendor may reuse business content and whether the commitment applies to the exact service.
Retention and deletion What is retained, for how long, and how is deletion verified? Content can remain exposed to access or disclosure risk even when it is not used for training.
Geography and subprocessors Where are storage and inference, and which providers or transfers are involved? Residency and transfer requirements are service- and configuration-specific.
Identity and content access Does access follow user permissions and labels? Can administrators limit connectors and agents? Retrieval can expose information through an assistant when source permissions are overly broad.
Audit and incident handling What can administrators investigate, and how can access be stopped? Useful controls need to support both prevention and response.
Accuracy and oversight How will outputs be checked before publication, advice, decisions, or system changes? Confidentiality controls do not make generated answers correct or unbiased.
Integration and total cost What work is required for identity, permissions, monitoring, and staff training? A low-friction pilot may still require meaningful governance and configuration effort at scale.

Priorities depend on the organization. A Microsoft-centered organization may value inherited Microsoft 365 permissions and labels. An API-led team may place more weight on endpoint-level retention controls, regional processing, and eligibility for zero-data-retention options. A regulated organization may prioritize contractual terms, residency, audit evidence, and a documented risk assessment ahead of raw model capability.

What should procurement ask an AI vendor?

Ask for answers tied to the proposed SKU, workspace, endpoint, region, and enabled features, then preserve the answers in the procurement record. If a vendor cannot answer a required question clearly, treat that as an unresolved risk rather than filling the gap with an assumption.

  • Data use: Are inputs, outputs, feedback, or logs used to train or improve models? Can this change, and how will we be notified?
  • Retention: What is retained in the service, abuse monitoring, analytics, traces, backups, and connected tools? What deletion controls and timelines apply?
  • Access: Which vendor personnel, administrators, subprocessors, or support processes can access content? What roles, approvals, and audit records govern that access?
  • Location: Where are storage and inference performed? Which subprocessors and cross-border transfers apply? Can the vendor commit to the location constraints we require?
  • Security: What encryption and key-management options are available? How are tenant isolation, SSO, MFA, roles, and connector permissions enforced?
  • Audit and response: What logs and evidence can we access? What is the incident-notification process, and can we promptly suspend an endpoint, connector, agent, or account?
  • Scope: Which contractual terms and controls apply to this exact plan and feature set? Are there eligibility conditions, exceptions, or endpoint limitations?
  • Change management: How are product, model, subprocessor, and policy changes communicated, and what options do we have if a change no longer meets our requirements?

Have privacy, security, legal, procurement, and the business owner review the answers appropriate to the risk. A vendor questionnaire is evidence for a decision, not the decision itself.

How can you reduce exposure when using an approved tool?

Apply safeguards to the whole data flow, not only the prompt. The UK Information Commissioner’s Office (ICO) advises documenting data movement and storage and deleting unnecessary intermediate files; it also identifies de-identification, synthetic data, federated learning, and differential privacy as approaches organizations may consider where suitable.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Minimize the input. Remove identifiers and irrelevant fields; provide only the portion needed for the task. Use synthetic or de-identified material for development where appropriate.
  2. Restrict access. Use named accounts, least-privilege roles, and approved workspaces. Review source-document permissions before enabling retrieval, connectors, or agents.
  3. Constrain the task. Tell users and systems what sources and actions are allowed. Filter prompts where suitable, monitor outputs, and avoid giving an agent broad access merely for convenience.
  4. Review consequential outputs. Require a qualified person to check outputs before external publication, legal or financial use, consequential decisions, or changes to systems of record.
  5. Keep an incident route ready. Know who can disable a user, connector, endpoint, or agent, how to report a suspected disclosure, and how relevant logs will be preserved and reviewed.
  6. Reassess changes. Repeat the assessment when a new data type, model, region, connector, or use case is introduced, or when vendor terms and controls change.

AWS identifies risks including hallucinations, data poisoning, adversarial prompts, model inversion, and agentic-AI risks. Its guidance highlights data classification, minimization, anonymization or synthetic data where appropriate, prompt filtering, output monitoring, access controls, and incident response. The Canadian Centre for Cyber Security similarly recommends an AI cyber-risk plan, security by design, careful vendor assessment, validation of training-data provenance, secure collection, storage, and transfer, and avoiding PII or sensitive corporate data in prompts.

When should you reject a tool or use case?

Do not approve a use merely because it saves time or has a business plan. Reject it, reduce the data, or redesign the task if a necessary protection cannot be verified or the remaining risk is not acceptable.

  • The tool’s data-use or retention terms are unclear for the exact product or endpoint.
  • Required residency, access, deletion, or contractual commitments are unavailable or unverified.
  • The use depends on a connector whose permissions cannot be limited or audited adequately.
  • There is no practical human review before a high-impact action or external release.
  • The task can be completed with less sensitive information, but the workflow sends the full record anyway.
  • The organization cannot monitor use, respond to incidents, or reassess a material product change.

For a lower-risk alternative, redesign the task around public, minimized, de-identified, or synthetic information where suitable. For a higher-risk task, pause until the organization has an approved assessment, appropriate terms, and workable controls.

Frequently Asked Questions

Can I paste a customer email into an AI tool to draft a reply?

First check whether the email contains personal, confidential, or regulated information and whether your organization has approved that exact tool and workflow. If the task can be done with names and identifying details removed, use a minimized version; have a person review the draft before it is sent.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Does an AI vendor’s data processing agreement prove that a tool is safe?

No. A contract is one part of the decision; you still need to confirm how the configured product handles access, retention, connected content, location, and operational response. The agreement must also cover the service and features you actually plan to use.

Can a business use of AI comply with GDPR or HIPAA automatically?

No product label or model setting establishes compliance for every organization or use. The relevant legal duties depend on the data, purpose, jurisdiction, contracts, and implementation, so obtain qualified privacy or legal review for regulated workflows.

What should employees do if they accidentally submit confidential data?

They should report it promptly through the organization’s security or privacy incident process, including what was submitted, where, and when. The response team can then use the service’s available controls and logs to assess exposure and decide whether further action is needed.
