Choose an AI provider by weighing legal exposure, control of data and operations, supply-chain dependencies, security, portability, capability and total cost—not model quality or hosting location alone. Start with the workload and the sensitivity of its data, then compare providers against the same evidence-based criteria. The right choice depends on your country’s laws and threat model; there is no universally best provider, and a domestic brand or regional data centre is not proof of sovereignty.
What does AI sovereignty mean when countries depend on competing technology blocs?
AI sovereignty is the ability to make and carry out decisions about AI systems, data and critical infrastructure under the laws and conditions relevant to your country. It has legal, operational and supply-chain dimensions as well as cybersecurity. A provider may store data locally while relying on foreign corporate control, support staff, software or hardware, or legal obligations that affect the service.
Sovereignty does not have to mean building every part of an AI stack at home or cutting off international partnerships. The European Commission’s 2026 communication describes technological sovereignty as grounded in “openness, partnership and fair competition.” That framing matters for smaller countries and organisations: the practical aim is usually to retain meaningful control, alternatives and resilience, not to eliminate every external dependency.

Nor is sovereignty only a state-level concern. A public agency, regulated organisation or company may need to know who can access its data, how models change, whether service can continue during a geopolitical disruption, and whether it can move to another provider. The answers depend on the intended use, data class, applicable law and consequences of service failure.

Does data residency make an AI provider sovereign?
No. Data residency tells you where certain data is stored or processed; it does not, by itself, establish who controls the provider, who can administer the service, what laws apply, or whether the underlying technology and supply chain can be sustained.
Assess residency as one part of a wider control map. Ask the provider to distinguish storage, inference, backups, telemetry, support access and incident response rather than treating “data stays in the region” as a complete answer. Clarify what data is retained, whether it is used for training or service improvement, how deletion works, and what audit evidence is available.
Also establish where the people who operate and support the service are located, which subcontractors they use, and what access those parties may have. For sensitive workloads, citizenship and subcontractor controls may be relevant to the organisation’s threat model. The answer should be documented in contract terms and operational procedures, not inferred from a marketing label.
The European Commission’s 2026 staff working document offers a concrete illustration of why residency is not enough: its conditions for a sovereign service are cumulative and include EU establishment, EU-located infrastructure and personnel, EU data, cybersecurity, software-stack control and protection from third-country legal interference. The document also says services that meet none of its conditions would remain available on the market, but would not be classified at any sovereignty level. These are EU framework conditions, not a universal legal test for every country.
How should you compare AI providers?
Define the workload first, then use a weighted scorecard to compare providers against the same requirements. Set the weights before reviewing vendor claims so that a provider’s strengths do not quietly redefine what matters.

For each criterion, record the evidence, its source, any contractual commitment, unresolved questions and the consequence if the provider cannot meet the requirement. Separate mandatory conditions from preferences: a high overall score should not compensate for a failure on a legal or security requirement that your organisation treats as a gate.
Jurisdiction and legal exposure
- Map the provider’s corporate establishment, ownership and control, and identify the laws that may apply to the company and service.
- Ask about government-access duties, the process for handling demands for information, and what notice or challenge rights the contract permits.
- Assess sanctions and export-control exposure for your country, provider, critical suppliers and the specific technology involved. The relevant implications depend on the jurisdictions and workload; do not assume a provider’s national identity settles them.
Data and AI control
- Record processing and storage locations, including backups and telemetry, and identify who can access each category.
- Confirm retention periods, training use, deletion procedures, audit rights and the ability to control or review model updates.
- Specify what happens to prompts, outputs, logs and derived data when the contract ends or a service changes.
Operational sovereignty
- Map where administration, customer support and incident response take place, and which staff or subcontractors can reach sensitive systems.
- For sensitive use cases, identify personnel and subcontractor controls that are necessary for your threat model.
- Check whether your organisation can carry out essential administration and incident decisions without depending on a single external team.
Technology and supply chain
- Identify important hardware, software, model and service dependencies, including critical third parties and the provider’s continuity plans.
- Examine model provenance and the degree of control available over the software stack and model changes.
- Prefer open interfaces and documented export formats where they help preserve the option to move workloads. An interface alone does not prove that a replacement provider will be compatible.
Security, compliance and oversight
- Request evidence of relevant certifications, secure development practices, testing and incident reporting obligations.
- Set expectations for human oversight, validation on the intended workload, transparency and contractual remedies if commitments are missed.
- Match controls to intended use and risk. EU guidance describes the AI Act as a risk-based framework whose obligations vary with intended use and risk; organisations elsewhere must assess their own applicable requirements.
Resilience, capability and economics
- Assess whether the service can run across regions or providers, and test export, portability, fallback models and termination assistance rather than relying only on written promises.
- Measure capability on the actual workload, including quality, latency and capacity, and review the service-level commitments that matter to the organisation.
- Compare total cost alongside energy and environmental impact. A quoted service price alone does not capture migration, integration, validation or exit costs.
The European Commission’s framework groups sovereignty into eight categories: strategic; legal and jurisdictional; data and AI; operational; supply chain; technological; security and compliance; and environmental sustainability. In 2026, the Commission said its Sovereignty Effectiveness Assurance Level framework uses an overall score based on 48 criteria. These categories can help structure a review, but a framework score should not replace the organisation’s own legal analysis, threat model or workload testing.

Use procurement to convert priorities into verifiable commitments. A provider’s response should be specific enough that your organisation can test it, monitor it and act if it is not met.
- Describe the use case. Document what the AI system will do, who will use it, what decisions it may influence, and what failure or unavailability would mean.
- Classify the data. Identify the sensitivity of inputs, outputs, logs and related records. State which categories may be sent to the service and which must remain outside it.
- Set the threat model and legal scope. Record relevant domestic and foreign laws, plausible access or disruption risks, and the controls required for this workload.
- Map provider control. Document ownership and jurisdiction, hosting and processing locations, personnel, subcontractors, software and model dependencies, and support or incident-response arrangements.
- Define gates and weights. Mark must-have legal, security and operational conditions separately from scored preferences. Assign relative weights based on the consequences and needs of this use case, not a universal template.
- Request evidence and commitments. Compare contractual terms and supporting evidence for data use, retention and deletion; access and audit; incident reporting; model changes; security; service levels; and subcontractor controls.
- Validate the service. Test the provider on representative tasks and data under appropriate safeguards. Evaluate quality, latency, capacity, human oversight and the effects of model updates before production use.
- Test portability and fallback. Practise exporting the workload, restoring it elsewhere or switching to a fallback, and check whether formats, interfaces and operational skills make the move feasible.
- Record the decision and exit conditions. Keep the scorecard, evidence, accepted risks, responsible owners, termination assistance and an achievable exit timetable together.
- Reassess when conditions change. Re-score when laws, ownership, model terms, hosting regions or geopolitical conditions change, and when the workload or data classification changes.
For public or regulated deployments, make the record part of governance rather than a one-time vendor-selection document. The UK Department for Science, Innovation and Technology’s 2026 AI Risk Management Toolkit covers commercial integration, broad adoption, in-house models, and procurement and delivery risks. EU legal and procurement guidance likewise highlights contracts, safeguards, transparency, skills, testing and validation. These resources address different policy settings; an organisation should use the guidance applicable to its jurisdiction.
Should a government or company use one AI provider or several?
Using more than one provider can reduce concentration and geopolitical disruption risk, but it also adds integration, testing and governance work. A single provider may be simpler to manage; it can also become a critical dependency if the service, legal access or supply chain is disrupted.

Choose diversification based on the consequences of losing the service and the feasibility of a real alternative. A second contract is not meaningful resilience if the workload cannot be moved, the fallback has not been tested, or both providers depend on the same critical supplier or jurisdictional exposure.

In 2026, the Commission awarded a tender worth up to €180 million over six years, selecting four provider groupings to avoid over-reliance on one provider: Post Telecom with CleverCloud and OVHcloud; STACKIT; Scaleway; and Proximus with S3NS, Clarence and Mistral. This is an example of one EU procurement, not a universal recommendation or proof that any grouping is suitable for a different country or workload.
Where multiple providers are justified, decide what will be diversified: workload types, regions, providers, models or critical infrastructure. Define the interface and data formats needed for movement, identify what cannot be transferred, and run a fallback exercise. If the added complexity outweighs the resilience benefit for a low-impact workload, a documented single-provider decision may be reasonable.
How can you avoid foreign-law exposure and vendor lock-in?
You cannot remove every legal or geopolitical dependency simply by choosing a local supplier. You can make dependencies visible, reduce avoidable concentration and contract for controls that preserve options.
For potential foreign-law exposure, map corporate control, applicable jurisdictions, government-access processes, operational staff and critical subcontractors. Ask the provider to describe how it handles legal demands and what it can commit to in the contract. Have qualified counsel assess the actual entities, data and jurisdictions; a general sovereignty label cannot determine how a particular law applies.

To reduce lock-in, examine the practical path out before signing. Check which data, prompts, outputs, configurations and logs can be exported, in what formats, and whether they remain usable elsewhere. Identify proprietary components, dependencies that cannot be transferred, migration support, termination notice periods and the time needed to validate a replacement.
Then test the path. Portability is a capability to demonstrate, not just a clause to quote. A useful exit plan names an alternative or fallback, the people responsible, the steps to preserve service and data, and the point at which the organisation would trigger a move.

Policy frameworks can clarify what to examine, but they do not substitute for a country-specific decision. Apply a framework as a structured lens and confirm which conditions are legally binding, which are procurement criteria and which are voluntary assurance measures in your setting.
The EU Cloud and AI Development Act describes four sovereignty assurance levels and links sovereignty to infrastructure capacity, data control, supply-chain resilience and open markets. The European Commission’s staff working document sets out cumulative conditions for its sovereign-service classification. Its approach makes clear that sovereignty is broader than a data-centre address, while its EU-specific conditions should not be presented as a global standard.

An EUI policy brief from 2025 treats AI sovereignty as contested, noting limits of state control, risks of authoritarian misuse and “sovereignty washing.” It recommends a comprehensive socio-technical view and stronger Global South representation. Those concerns are relevant to governance as well as procurement: ask who benefits from a system, who bears its risks and whether greater state or provider control creates new risks for people.
What are the most common mistakes when choosing an AI provider?
- Treating local hosting as a complete sovereignty claim. Location is only one factor; assess corporate control, law, personnel, software and supply chain too.
- Choosing by model quality alone. A model that performs well on a demo may still fail a workload’s legal, resilience, security or portability requirements.
- Using a generic score without hard gates. A high aggregate result can conceal an unacceptable failure on a requirement that should disqualify a provider.
- Accepting promises that cannot be checked. Ask what evidence, audit rights and contractual remedy accompany each important commitment.
- Assuming several vendors automatically provide resilience. Confirm that workloads can move and that the fallback is operationally viable.
- Confusing self-sufficiency with sovereignty. Complete independence may be impractical; a clear view of dependencies, alternatives and control may be more useful.
- Letting the initial review become permanent. A change in ownership, law, region, model terms or geopolitical context can change the risk decision.
How do you decide which provider is right for your country?
Choose the provider—or mix of providers—that meets the non-negotiable legal and security conditions for the workload, performs adequately on that workload, and leaves your organisation with credible control and exit options. Give more weight to jurisdiction, personnel, supply chain or portability when the data and consequences of disruption make those factors critical; a different use case may justify different priorities.
Document what you are accepting, what evidence supports the decision and how you will respond if the conditions change. Domestic branding, a regional hosting option or a framework score can be useful evidence, but none should stand in for that assessment.

Frequently Asked Questions
Does a small country need to build its own foundation model to be sovereign?
Not necessarily. Sovereignty is not the same as producing every component domestically; a country can focus on control over sensitive data, operational decisions, alternatives and the dependencies most important to its needs. Whether local model development is worthwhile depends on capability, costs and the use cases involved.
Does using an open model remove dependence on foreign technology?
No. A model’s openness does not by itself settle who supplies the infrastructure, maintains the software, controls updates or provides operational support. Evaluate those dependencies separately from the model’s licensing and availability.
Can a provider claim sovereignty without meeting every criterion in an EU framework?
The European Commission’s classification is specific to its own framework, and its 2026 staff working document says services that meet none of its conditions remain available but receive no sovereignty level. That classification should not be confused with a universal judgment about every country’s laws or procurement requirements.
Who should approve an AI provider for a sensitive public-sector workload?
The decision should involve the people accountable for the use case, information security, legal compliance, procurement and operations, with domain expertise for the system’s intended use. The necessary approvers and formal obligations depend on the country and organisation.
