Choose a cloud provider by testing its contracts, data flows, security evidence, and exit arrangements against your actual processing—not by relying on an “EU-hosted” label or a certification badge. First define what personal data the service will handle and why; then establish the parties’ legal roles, map storage and access locations, review an Article 28-compliant data-processing agreement (DPA), assess security measures and any international transfers, and make deletion and portability practical. The provider can support compliance, but your organization remains accountable for the processing it delegates.

What does it mean for a cloud provider to meet European data-protection requirements?

There is no single physical product, hosting region, or certification that makes a cloud provider “GDPR compliant” for every customer and use. The relevant question is whether the provider’s specific service and your organization’s specific processing satisfy the applicable requirements together. The same provider may be suitable for one workload and unsuitable for another if the data, purpose, access model, risk, or contract differs.

The GDPR applies to EU organizations processing personal data and can also apply to organizations outside the EU that offer services to people in the EU or monitor their behavior there. A provider’s location alone therefore does not settle whether the rules apply. Before comparing providers, identify the people whose data is involved, the purposes of processing, and the organizations deciding how the service is used.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The Irish Data Protection Commission puts the customer’s continuing responsibility plainly: “A data controller must remain in control of the personal data it collects when it subcontracts the processing to a cloud provider.” That means procurement is not a one-time vendor check. Your organization needs enough information, contractual rights, and operational control to oversee the service for as long as it processes personal data.

How should you define the workload before comparing providers?

Write down the processing you intend to perform before asking vendors for proposals. A provider cannot be assessed meaningfully against a vague requirement such as “secure EU cloud hosting”; the questions depend on what data will be processed, for what purpose, and with what consequences if it is exposed, unavailable, or retained too long.

Build a workload inventory

  • Data: List personal data categories, including any special-category data, and identify the people the data concerns.
  • Purpose: State why the data is processed and what the cloud service must do. Check that the intended use is lawful, transparent, limited to the stated purpose, and necessary for that purpose.
  • Scale and duration: Estimate the volume, retention period, and whether processing is regular or large-scale.
  • Service need: Document availability needs and the operational impact of downtime, data loss, or delayed recovery.
  • Risk: Record whether the processing is sensitive or likely to create high risk for people. A data protection impact assessment (DPIA) is mandatory when the intended processing is likely to result in high risk.

Use this inventory as the same baseline for each provider. If a vendor’s proposal depends on a different purpose, data category, retention practice, or support arrangement, capture that difference rather than treating the proposals as equivalent.

How do you determine whether the provider is a processor or controller?

Classify the provider’s role for each processing operation, not just for the overall commercial relationship. The provider may be a processor for one operation and have a different role for another; a generic vendor label is not a substitute for examining who decides the purpose and means of each activity.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Document whether your organization and the provider act as controller, processor, or joint controllers for each operation. The relationship affects obligations and liabilities. Where the provider processes personal data on your behalf, require sufficient guarantees that it can implement appropriate measures and a legally binding written agreement meeting GDPR Article 28 requirements.

Ask the provider to explain any activity it says it performs for its own purposes, and identify the data and operations involved. Record the answer and check it against the service description, DPA, privacy information, and actual support or telemetry practices. If those documents describe different roles, resolve the discrepancy before approval.

What should a cloud DPA include?

A DPA should turn the provider’s obligations and your oversight rights into workable contract terms. It should be specific enough to show what the provider may do with the data, how it will protect it, and how it will help you meet your own responsibilities.

DPA or contract area What to establish
Instructions and purpose Document the customer’s instructions and the processing the provider is authorized to perform. Address restrictions on using the data for secondary purposes.
Confidentiality and personnel Set confidentiality obligations and identify the provider’s relevant personnel controls.
Security responsibilities Describe the provider’s and customer’s respective security responsibilities, rather than leaving shared responsibility implicit.
Subprocessors Set the authorization and notice process for subprocessors, including how changes are communicated and how you can respond to them.
Rights requests and incidents Specify how the provider assists with individual rights requests, security incidents, and related cooperation.
Assurance and audit Define access to audit or assurance information and the process for addressing findings.
End of service Provide for return or deletion of data, including the treatment of copies held by subprocessors and backups.

The European Data Protection Board’s cloud controls call for a cloud-services agreement that incorporates GDPR obligations and defines customer and cloud-service-provider security responsibilities. A template agreement may be a starting point, but compare its actual terms with your workload and required controls. If a key obligation is absent, ask for a written commitment or determine whether the service can meet the requirement another way.

How can you check where data is stored, accessed, and transferred?

Ask for a data-flow map that covers more than the primary storage region. The relevant picture includes backups, disaster recovery, support, telemetry, administrator access, subprocessors, and onward transfers. A location answer limited to “your data is hosted in Europe” may leave important processing or remote access unexplained.

Request a location and transfer inventory

  • Ask which regions hold primary data, backups, and disaster-recovery copies.
  • Ask where support staff and administrators can access the service or its data from.
  • Identify telemetry and other service data that may contain personal data, and ask where it is processed.
  • Request the current subprocessor list, each subprocessor’s role, and the locations relevant to its work.
  • Ask whether data is transferred onward, to which countries, and under what legal mechanism.

For a relevant transfer to a country outside the EEA, establish the transfer mechanism. Options described in the European Commission’s guidance include an adequacy decision, appropriate safeguards such as Standard Contractual Clauses (SCCs), or a narrowly applicable derogation. The Commission adopted its modernized SCCs on 4 June 2021. SCCs do not eliminate the need to assess the actual transfer context, including the destinations and access involved.

EU data residency is useful information, but it does not by itself demonstrate GDPR compliance. It tells you something about a specified storage location; it does not answer whether support or administrator access occurs elsewhere, whether subprocessors make onward transfers, or whether the contract and security measures are adequate. Ask for the full data-flow picture and assess it against the service you will actually configure.

What security evidence should you ask a provider to show?

Assess technical and organizational measures in relation to the risks of your workload, and ask for evidence rather than accepting broad assurances. Relevant areas include access control, encryption and key control, tenant isolation, vulnerability management, monitoring, resilience, incident handling, deletion, personnel practices, and change management.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Control area Questions for the provider
Identity and privileged access How are identities verified, access limited, and privileged accounts managed? What controls apply to provider staff who can reach customer environments?
Encryption and keys What encryption and key-management options are available, and who controls the keys? Which parts of the service and data flows do those options cover?
Isolation and network defense How are customer environments separated, and what network defenses protect the service?
Vulnerabilities and changes How are vulnerabilities, patches, and material service changes managed? What information can the provider share about its processes?
Logging and monitoring What activity is logged, how is it monitored, and what records can the customer access or retain?
Backup and resilience How are backups and restoration handled? What evidence is available about resilience and recovery testing?
Incident response How will the provider notify and assist you in an incident, preserve relevant evidence, and cooperate with appropriate inquiries?
Deletion and personnel How is data securely deleted, including copies, and what personnel controls and training apply?

The Irish Data Protection Commission recommends attention to access control and identity verification, firewalls, secure default settings, documented policies, provider assurances, training, and risk-based categorization. Use these as diligence prompts, then ask how the provider implements them in the specific service and what evidence supports its answers. Confirm which controls are the provider’s responsibility and which you must configure or operate.

Do certifications prove that a cloud provider is GDPR compliant?

No certification or mapped control set should be treated as a legal conclusion that a particular service and use comply with the GDPR. Certifications and independent assurance can organize evidence requests and help you understand a provider’s control environment, but you still need to check scope, freshness, and relevance to your workload.

Evidence frameworks that can structure diligence include ISO/IEC 27001, ISO/IEC 27017, ISO/IEC 27018, ISO/IEC 27701, SOC 2, and the EU Cloud Code. Ask which service, locations, and organizational units an assessment covers, when it was current, and whether exceptions or findings affect the controls you rely on. A report covering a different service or an outdated control environment may not answer your question.

The EDPB says its cloud-control mapping is a starting point and “is not intended to provide an exhaustive and binding reference.” Therefore, passing a mapped control set—or holding a certificate—does not by itself establish GDPR compliance. Use assurance material alongside the DPA, service-specific security evidence, and your own assessment of the processing.

When do you need a DPIA, and how should the provider help?

A DPIA is mandatory when the intended processing is likely to result in high risk to people. Make that decision based on the processing you plan, including its data, purpose, scale, and context—not simply because a provider offers or does not offer a particular cloud region.

Build the provider’s cooperation into procurement. You may need service and data-flow details, security information, retention and deletion practices, and descriptions of subprocessors to assess the planned processing. If the provider cannot supply information needed to evaluate the risk, identify that as a procurement blocker or a condition that must be resolved before the processing begins.

How should you assess incidents, resilience, and regulatory oversight?

Contract for incident cooperation and resilience information before an outage or incident occurs. Establish notification timelines, cooperation duties, evidence retention, audit rights, availability terms, business continuity expectations, recovery-testing evidence, and regulator cooperation. Set expectations in the contract or service terms rather than relying on informal assurances.

For a provider within the scope of NIS2, ask how the applicable implementing requirements are addressed. Applicability depends on the provider and service; do not assume that every cloud supplier is within scope. The European Data Protection Supervisor’s cloud guidance also emphasizes that cloud use should maintain an equivalent level of personal-data protection to other IT infrastructure models.

How do you compare providers and make a defensible choice?

Once providers have supplied comparable answers, evaluate them against the workload inventory and separate mandatory conditions from preferences. A lower price or a convenient region should not compensate for a missing legal transfer mechanism, an unworkable DPA, or a security gap that conflicts with your risk assessment.

Comparison axis Evidence to compare Decision question
Processing and support geography Region-level storage, backup, recovery, support, telemetry, and administrator-access locations Can you explain every relevant location and access path?
Roles and DPA Role descriptions for each operation and the written agreement Are roles coherent, and does the DPA provide the required obligations and assistance?
Subprocessors List, locations, change notices, authorization terms, and onward-transfer details Can you identify who handles the data and respond to changes?
Transfers Transfer destinations, mechanism, and assessment of the real context Is every relevant transfer supported by an appropriate mechanism?
Security and assurance Service-specific controls, key options, logging, incident process, and current independent evidence Does the evidence address this workload’s risks and your configuration responsibilities?
Resilience and service levels Availability terms, recovery evidence, remedies, and continuity arrangements Can the service meet the workload’s documented availability needs?
Exit and portability Export formats, deletion terms, migration support, and exit costs Can you leave without losing control of the data or an essential capability?
Total cost and constraints Expected cost, lock-in, and sector or national requirements that apply to your organization Is the solution sustainable and suitable for your operating context?

Do not collapse the comparison into one score unless the method preserves non-negotiable legal and security requirements. A practical decision record can list each requirement, the provider’s answer, supporting evidence, an owner for any unresolved issue, and the approval condition or rejection reason. Treat an unanswered material question as uncertainty to resolve, not as proof that the provider has no issue.

How can you leave a provider without losing control of your data?

Design the exit before selecting the service. A promise that “you can export your data” is not enough unless you know what can be exported, in what format, how long the process takes, what assistance is available, and how copies are removed afterward.

  • Specify export formats and the scope of data included, including relevant metadata.
  • Set out migration assistance and any limits or costs that affect a practical transition.
  • Define when the provider must return or delete data and how it will evidence deletion.
  • Address backup expiry and deletion by subprocessors, not only the primary service copy.
  • Include suspension or termination rights for material contract or compliance failures where appropriate.
  • Run a portability test using a representative workload before relying on the export path.

European Data Protection Supervisor guidance recommends integrating safe return of data and portability into cloud contracts and procurement specifications. An exit clause is only useful if the technical export works and the organization has a realistic path to migrate; test both the contract and the process.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What are the most common selection mistakes?

  • Choosing by region label alone: Storage location does not reveal remote access, support, telemetry, or onward transfers.
  • Accepting a generic compliance claim: Ask for the service-specific contract, role allocation, control evidence, and transfer details behind the claim.
  • Relying on the provider’s role label: Determine the relationship for each operation and resolve inconsistencies between product practices and contract terms.
  • Treating a certificate as a verdict: Check what is covered and whether the evidence matches the actual workload.
  • Leaving shared security responsibilities unstated: Confirm which controls the provider operates and which your organization must configure.
  • Postponing exit planning: A migration path, deletion process, and subprocessor cleanup are harder to verify after a contract is signed.

Non-compliance can carry substantial penalties. The EU’s Your Europe GDPR guidance, on a page checked 5 August 2026, gives a maximum administrative fine of EUR 20 million or 4% of global annual turnover, as applicable. This is a ceiling stated in the guidance, not a prediction of the fine for a particular failure; the practical reason to conduct diligence is to identify and address the risks before processing begins.

Frequently Asked Questions

Do SCCs and a cloud DPA do the same thing?

No. A DPA sets the terms for processing carried out on a customer’s behalf, including the processor relationship and assistance obligations. The European Commission’s SCC framework includes terms for Article 28 processor relationships and separate clauses for transfers to third countries, so identify which legal function a given set of clauses is intended to serve.

Does GDPR require my cloud provider to be an EU-owned company?

The selection framework turns on the processing, the parties’ roles, the provider’s controls, and the data flows—not a simple ownership label. Assess the actual service and any relevant locations, access, subprocessors, and transfer safeguards rather than treating corporate nationality as a substitute for due diligence.

What should I keep as a record of cloud-provider due diligence?

Keep the workload inventory, role analysis, DPA and service terms, location and subprocessor information, transfer assessment, security evidence, and the rationale for approving or rejecting unresolved risks. A dated record of answers and supporting documents makes it easier to revisit the decision when the service, provider, or processing changes.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

How often should I review an approved cloud provider?

Set review triggers around material changes rather than relying only on a calendar reminder: a new subprocessor or region, a changed service feature, a security incident, or a change in the data or purpose can affect the original assessment. Your contract should provide enough notice and information for your organization to evaluate relevant changes.
