To verify whether a SaaS provider really keeps your data in the EU, do more than check an “EU-hosted” badge. Obtain the provider’s current Data Processing Agreement (DPA), service terms, named storage and processing countries or cloud-region identifiers, backup and failover locations, support-access locations, complete subprocessor list, retention and deletion rules, and the legal safeguards for any processing outside the European Economic Area (EEA). Then confirm that each answer applies to your exact plan, tenant, enabled features and support tier.
Residency is a scope question: primary database storage may be in an EU region while replicas, backups, logs, telemetry, analytics, support tooling or disaster-recovery copies are elsewhere. Your evidence should cover every path by which personal data is stored, viewed, transmitted or transformed.
What “stored in the EU” should mean
Start by defining the claim you need to verify. A provider can truthfully keep primary application data in an EU region while processing other data in another country. Decide whether your requirement covers only production records or also copies and operational data.

Separate storage, processing and access
- Primary storage: the production databases and object stores that hold customer content.
- Replicas and caches: read replicas, search indexes, content-delivery caches and temporary queues.
- Backups and disaster recovery: scheduled backups, snapshots, cold archives and standby systems used after an outage.
- Operational data: logs, telemetry, diagnostics, analytics, billing records and configuration data that may contain identifiers or customer content.
- Human access: support tickets, screen-sharing sessions, incident-response tools and engineering access. Data can leave the EEA through a person’s access even when databases remain in Europe.
Ask for countries and, where a hyperscaler is involved, the exact region identifier. “Europe” or “EU-based infrastructure” is too broad to test against a contract or an internal policy.

Identify the data and legal roles
List the fields your organization sends: names, email addresses, identifiers, messages, files, device data, authentication records and support conversations. Mark which fields are personal data and which are not. A mixed dataset that combines personal and non-personal information generally remains subject to GDPR when the parts cannot be separated.
Determine whether the vendor is your processor, a joint controller or a controller for any operation. The same service can have different roles for customer content, account administration, fraud prevention, product analytics or billing. Your DPA and service terms should describe those boundaries and your instructions for each processing purpose.
Use the contract as your primary evidence
A written Article 28-style processor agreement should state the processing instructions, security duties, locations, subprocessor rules, deletion or return obligations and audit rights. The Irish Data Protection Commission (DPC) puts the responsibility plainly: “A data controller must remain in control of the personal data it collects when it subcontracts the processing to a cloud provider.” It also notes, “Important for both control and security is the location of the data.”

- The current DPA, including annexes and the version or effective date.
- Service-specific terms describing data residency, regional availability and exceptions.
- The provider’s subprocessor list and change-notification procedure.
- Security, retention, deletion and backup documentation that is incorporated into the contract or clearly referenced by it.
- Any data-transfer addendum, Standard Contractual Clauses (SCCs), adequacy references or supplementary-measures description used for non-EEA processing.
Do not rely on a marketing page that is not incorporated into the agreement. Save the documents you reviewed, because a later web-page revision may not show what the provider promised when you purchased the service.
Step-by-step residency verification
1. Define the boundary you must meet
- Write down the data categories and features that will be enabled, including file uploads, integrations, mobile applications, AI or analytics features, support and identity services.
- State whether your policy requires storage in the EU, the wider EEA, or merely a lawful transfer mechanism when data is accessed elsewhere.
- Specify whether backups, logs, telemetry, support records and failover systems are in scope. If your policy is silent, treat them as in scope until the vendor demonstrates that they cannot contain personal data.
This written boundary prevents a provider from answering a narrower question than the one your compliance team actually needs answered.
2. Read the DPA and service terms line by line
Find the clauses for processing locations, security, subprocessors, deletion and return, audits, incident response and international transfers. Check whether “customer data” is defined narrowly while “service data,” “diagnostic data” or “usage data” is excluded. Those excluded categories may still contain personal data and should be addressed separately.
Confirm that the contract identifies your instructions, the provider’s purposes, confidentiality obligations, technical and organizational measures, and what happens when the relationship ends. Look for a practical audit method rather than a statement that audits are available only at the provider’s discretion.
3. Obtain precise location answers
Request a map of every data path, not just the production database. The following table turns a vague residency claim into verifiable questions.

The DPC advises organizations to establish “precisely where and how the data you provide to a cloud provider will be handled.” Treat an answer that omits one of these paths as incomplete rather than assuming the missing path follows the primary region.
4. Audit every subprocessor
Obtain the current list and record each subprocessor’s purpose, corporate location, processing location, access type and retention. Include cloud infrastructure, email delivery, monitoring, customer-support systems, payment services, identity providers and incident-response tools.
Read the change mechanism. The EDPB Cloud Code of Conduct calls for mechanisms to provide subprocessor lists and advance communication of changes when general authorization is used. Your contract should tell you how much notice you receive, how to object, what happens if an objection cannot be resolved and whether the provider may suspend or terminate the affected service.

If any personal-data path leaves the EEA, document the mechanism for that specific path. It may be an applicable adequacy decision or another safeguard such as SCCs, together with supplementary measures and access controls. GDPR protection follows personal data when it is transferred outside the EU; an EU database does not eliminate transfer analysis for remote support, telemetry or subprocessors.
Ask which transfer mechanism applies to each country and where the signed terms are located. A generic statement that the provider complies with GDPR is not a substitute for identifying the mechanism, the parties covered and the technical controls that reduce access risk.
6. Test the promise against your purchased configuration
Residency can be limited to selected tenants, products, data categories or subscription tiers. Verify the exact region selected during provisioning and the features you will enable. Identity and collaboration services can introduce a separate boundary: documentation for tenant-based identity systems warns that collaboration with tenants outside an EU data-residency or EU data-boundary program may cause some account, usage or configuration data to be stored or processed outside that boundary.
Ask the provider to confirm in writing that the commitment applies to your plan, tenant, enabled features and support tier. Keep a screenshot or export of the region setting, because a later administrator may change it without realizing that residency depends on it.
7. Preserve evidence and schedule rechecks
Create a dated evidence file containing the DPA, service terms, subprocessor snapshot, region selection, written vendor answers, transfer terms and any audit or certification scope. Recheck after a material product change, new subprocessor, region change, contract amendment, acquisition, support-model change or disaster-recovery redesign. A one-time approval is not proof that the same data paths remain unchanged.

Questions to send the provider
Send a written questionnaire and require answers that name countries, regions and services. This template can be pasted into a procurement or privacy ticket:
Please confirm the following for our exact plan, tenant, enabled features and support tier:
1. In which countries and exact cloud regions are primary data, replicas, backups and disaster-recovery copies stored?
2. Where are logs, telemetry, analytics, diagnostics and support tickets processed and retained?
3. Which subprocessors can access customer data, for what purpose, from which locations, and for how long?
4. Can support personnel or engineers access data from outside the EEA? If yes, from which countries and under what approval, logging and least-privilege controls?
5. What happens to data during failover, incident response, maintenance, migration or capacity shortages?
6. Which transfer mechanism applies to every non-EEA processing path, and where is the applicable agreement documented?
7. How are subprocessor additions or replacements communicated, how much notice is provided, and how can customers object?
8. What are the retention periods and verified deletion or return procedures for production data, backups, logs and support records?Ask the provider to identify any exception rather than accepting a blanket “EU data residency” answer. If an answer depends on a configuration choice, have the provider state the setting and the consequence of changing it.
How to compare two SaaS providers
Use the same evidence request for every candidate. Compare the commitment’s scope, not the wording of the marketing label.

Prefer the provider that can answer every row with contract-backed evidence, even if another provider uses stronger-sounding “sovereign” or “EU-only” language. A narrower but enforceable promise is more useful than a broad slogan with exceptions.

Only the primary database is in the EU
Symptom: The vendor names an EU production region but cannot state where backups, search indexes or disaster-recovery copies reside.
Fix: Ask for each copy’s country, retention and restoration path. Require the contract to cover those copies or classify the service as unsuitable for an EU-only policy.
Support can access data from outside the EEA
Symptom: “Global support” or follow-the-sun coverage is offered without a list of access countries.
Fix: Determine whether support sees content, metadata, screenshots or logs. Require location-specific transfer safeguards, ticket redaction, approval, time-limited access, session logging and deletion rules. If support cannot be restricted, include that access path in your transfer assessment.

Failover silently changes the geography
Symptom: The provider promises EU storage during normal operations but reserves the right to fail over globally.
Fix: Obtain the standby-region list, activation criteria, customer notification process and restoration plan. Decide whether a temporary non-EEA copy is acceptable under your policy and, if so, document the safeguard before signing.
Telemetry is treated as harmless
Symptom: Product analytics or diagnostics are excluded from the residency statement, even though they include user IDs, IP addresses, filenames or error payloads.

A new subprocessor appears after approval
Symptom: The provider posts an updated list but gives no advance notice or objection route.
Fix: Use the contractual notification and objection procedure. Record the date you reviewed the list and assess the new party’s location, purpose, access and transfer mechanism before allowing continued processing.
The residency feature is not included in your edition
Symptom: Documentation describes regional storage for enterprise tenants, while your plan has automatic placement or shared infrastructure.

Deletion covers production but not backups
Symptom: The service deletes active records on request but retains encrypted backups for an unstated period.
Fix: Request backup-retention duration, deletion scheduling, restoration safeguards and how a deleted record is prevented from reappearing after recovery. Record the answer in your data-retention register.
Interpreting GDPR and transfer language
Processor, controller and joint-controller statements
A processor acts on your documented instructions. A controller determines purposes and means for its own operation, while joint controllers determine them together. Ask the provider to separate these roles by feature; a processor clause for file storage does not automatically describe advertising, fraud prevention, account management or analytics.

Article 28-style terms
For processor activities, the agreement should cover documented instructions, confidentiality, security, assistance with rights and incidents, deletion or return, audits and subprocessor authorization. The location clause should identify where processing occurs, not merely where the provider is incorporated.
Adequacy decisions, SCCs and supplementary measures
An adequacy decision can permit a transfer to a recognized destination under its stated scope. Where adequacy does not apply, SCCs or another valid safeguard may be used, but you still need to understand supplementary measures and access controls. Ask which mechanism covers each path, including remote personnel and subprocessors, rather than accepting one mechanism for an entire product family.
Build an internal approval record
Before approving the service, complete a short record that another reviewer can reproduce:
- Data categories and legal roles for each feature.
- Required geography: EU, EEA or a documented lawful-transfer standard.
- Primary, replica, backup and failover regions.
- Locations and purposes for logs, telemetry, analytics, diagnostics and support.
- Subprocessor list, access type, notice period and objection rights.
- Transfer mechanism and supplementary measures for every non-EEA path.
- DPA version, service-term version and date of vendor confirmation.
- Tenant region setting, enabled features and support tier.
- Retention, deletion, return and backup-expiry behavior.
- Next review date and events that trigger an earlier review.
Store the record with procurement and privacy documentation. If the provider cannot answer a material item, mark the risk explicitly, obtain a compensating control or choose a service whose boundaries are documented.
A practical decision rule
Approve an EU-residency claim only when you can trace your personal data from collection through primary storage, replication, backup, operations, support and deletion; identify every country or region on that path; and point to a contract or documented transfer safeguard for each exception. If any path is unknown, the provider has not demonstrated EU-only storage. You may still use the service under a broader transfer assessment, but that is a different decision from proving that the data stays in the EU.
