Audit an AI interview as part of the employer’s entire selection procedure, not as a stand-alone software check. Start by documenting what the system measures, which applicants and decisions it influences, and who is accountable. Then test job relevance, subgroup outcomes, disability access, privacy controls, notice, human review, and monitoring after launch. A vendor’s audit or a single pass/fail statistic cannot establish fairness or legal compliance by itself. The employer remains responsible for the effects of a tool it chooses, while the exact duties depend on the jobs, data, and jurisdictions involved.
What exactly should an AI-interview audit cover?
An effective audit follows the candidate from sourcing and screening through interview scoring and final selection. Include every automated or AI-assisted component, even when a person makes the final decision. The U.S. Department of Justice (DOJ) identifies video interviews, qualification assessment, and résumé scoring as examples of employment-selection technology.
Begin with a system inventory. For each component, record the employer decision owner, vendor, job family, locations, version, deployment date, and applicable law. Classify the tool’s role precisely:
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Fix the driver behind crashes, sound loss and screen glitches3Clear out junk files and repair common Windows errors| Component | Possible function | Audit question |
|---|---|---|
| Asynchronous video interview | Collects recorded answers; may transcribe or score them | Does it measure job competencies or presentation, speech, facial, or timing signals unrelated to the job? |
| Speech, face, or behavioral analysis | Derives features from voice, image, gaze, expression, pace, or gestures | Are those features validated for the specific job, and could a disability or accommodation change them? |
| Automated question selection | Chooses follow-up questions based on earlier responses | Do candidates receive equivalent opportunities to demonstrate each essential competency? |
| Transcription and summarization | Converts audio to text or creates a reviewer summary | How are accents, speech differences, pauses, and corrections handled, and can a reviewer inspect the original response? |
| Ranking or recommendation | Orders applicants or recommends advancement or rejection | What decision does the output influence, who can override it, and is the override recorded? |
| Human-assist tools | Highlights answers or suggests ratings without making a formal decision | Could automation bias cause reviewers to defer to a suggestion they cannot independently verify? |
Document the handoffs between components. A transcription error can become a score, the score can become a ranking, and the ranking can determine who receives a live interview. The audit should show that chain rather than examining each screen in isolation.

Accountability stays with the employer. DOJ’s May 12, 2022 ADA guidance states: “The ADA applies to all parts of employment, including how an employer selects, tests, or promotes employees.” The guidance is technical assistance and does not itself create binding legal obligations beyond applicable law, but it makes clear that outsourcing a process does not outsource responsibility.
How do I define the job criteria before testing the model?
Write the essential job functions and competencies first, then test whether the interview actually measures them. Do not infer job relevance from a vendor’s feature list or a polished score dashboard.
1. Specify the purpose of each score
For every question, feature, and output, state the decision it supports: for example, “advances applicants who can diagnose a customer problem using the required troubleshooting steps.” Distinguish essential functions from preferences, culture-fit impressions, and conveniences. A feature such as eye contact, vocal energy, response speed, facial expression, or accent is not job-related merely because a model can detect it.
2. Request evidence at a useful level
Ask the vendor for intended use, input features, scoring logic or decision rules at a level that permits meaningful review, validation studies, known limitations, version history, and subgroup performance evidence. “Proprietary” does not answer whether the procedure is valid for your position and purpose. Record what the vendor will not disclose and treat that limitation as an audit finding.
3. Compare automated outputs with qualified human review
Use a predefined rubric tied to essential competencies. Have qualified reviewers independently score a representative sample, then compare the automated result with those job-relevant ratings and with later work outcomes when a lawful, appropriate outcome measure exists. Investigate disagreement instead of treating human scores as automatically correct; reviewers can carry their own bias.
The EEOC’s technical assistance says: “Employers should ensure that employment tests and other selection procedures are properly validated for the positions and purposes for which they are used.” A vendor’s validation can inform that analysis, but it does not transfer the employer’s duty to establish job-specific validity.
How should an audit test for bias and adverse impact?
Measure outcomes by stage and protected group where collection is lawful and methodologically sound, while also examining whether the procedure is job-related. A single aggregate parity number cannot prove that an interview is fair, and the available sources do not establish a universal pass/fail threshold for AI-interview bias.

Pre-register the comparison
Before looking at results, define:
- the population (all applicants, only those who completed the interview, or another clearly bounded group);
- the stage (invitation, completion, score threshold, advancement, offer, or another decision);
- the comparison groups and the lawful basis for using demographic information;
- the outcome (completion, score, ranking, rejection, or selection);
- the time period, job family, location, model version, and sample size; and
- the uncertainty measure and the rule for deciding when a result warrants investigation.
Keep denominators visible. If only applicants who could access and complete the interview are analyzed, the result can hide exclusion at the invitation, technology-access, or accommodation stage.
Examine more than one statistic
Compare selection rates, score distributions, completion rates, accommodation requests and outcomes, and error patterns across relevant groups. Where lawful, examine intersections such as disability and race or age and sex, but state when sample sizes are too small for reliable conclusions. Look for differences by device, bandwidth, browser, language, interview timing, and location when those factors may be proxies for access or protected characteristics.
Investigate a disparity instead of explaining it away
A material disparity is a prompt for root-cause analysis, not a verdict on its own. Check whether the cause is a job-irrelevant feature, inaccessible interface, transcription error, question branching, threshold choice, training-data limitation, or human reliance on the output. If the procedure screens out a protected group, EEOC guidance recommends considering an equally effective alternative with less adverse impact. Document why an alternative was accepted or rejected.
Separate evidence from speculation
The sources do not provide a current, generalizable rate of AI-interview bias or accessibility failure. Do not present a vendor’s benchmark, a small internal sample, or one favorable metric as a population-wide claim. Report confidence limits, missing data, exclusions, and unresolved uncertainty alongside every result.
How can I test accessibility in the real candidate journey?
Run the interview as candidates actually encounter it, using assistive technologies and realistic constraints. The key question is whether the system measures a skill needed for the job or instead measures vision, hearing, speech, dexterity, communication style, device quality, bandwidth, or tolerance for timing pressure.
Test the interface and the assessment signal
- Complete the flow with a screen reader, keyboard only, browser zoom, high-contrast settings, captions, transcripts, and alternative input devices.
- Test visual, auditory, speech, mobility, dexterity, fatigue, and neurodivergent access needs with appropriately qualified testers.
- Check focus order, labels, error recovery, time limits, replay controls, caption accuracy, transcript availability, and whether a candidate can request help without losing an attempt.
- Repeat tests on supported mobile and desktop devices, low bandwidth, ordinary microphones, and common browsers.
- Compare what the system rewards with the written competency rubric. Face direction, eye contact, vocal fluency, speaking rate, background noise, or a particular gesture may be irrelevant to the work.
Accessibility is not limited to the invitation page. Include account creation, identity checks, consent screens, practice questions, recording, upload, confirmation, scheduling, accommodation requests, and post-interview communications.
Provide an effective accommodation route
Publish clear information about the technology and evaluation process before collection. Give candidates a usable channel to request an accommodation, identify a responsible contact, protect the request from unnecessary disclosure, and set a response time that does not make the opportunity illusory. Offer an effective alternative assessment when the automated format cannot accurately measure the applicant.

DOJ says employers should examine tools before use and regularly during use and may need an accessible version of the interview program. EEOC visual-disability guidance gives an alternative testing format as a possible accommodation when an AI tool may not accurately assess an applicant.
As context for planning, EEOC guidance reports that 18.4% of U.S. adults were blind or had “some” or “a lot” of difficulty seeing even when wearing corrective lenses, based on Centers for Disease Control and Prevention data from 2022. That is a general-population figure, not a measurement of AI-interview exclusion.
Test accommodation consistency
Run matched scenarios with and without an accommodation and verify that the alternative produces a comparable opportunity to demonstrate the same competency. Do not require an applicant to disclose a diagnosis when the request can be handled by describing the functional limitation and needed adjustment. Record whether an accommodation changes a model feature that the job does not require; if so, reconsider the feature rather than penalizing the candidate.
What privacy and transparency checks belong in the audit?
Map every data element from collection through deletion and explain the process before the candidate participates. Audio and video are only the beginning; transcripts, derived features, scores, reviewer notes, logs, and model-training data can all create privacy obligations.
| Data point | Questions to answer |
|---|---|
| Raw audio and video | Why is each format needed, where is it stored, who can view it, and when is it deleted? |
| Transcript and captions | Are they retained separately, corrected, searchable, or used to train another system? |
| Derived features | Does the tool create voice, face, emotion, fluency, gaze, or behavioral inferences, and are they necessary for the job? |
| Scores, rankings, and recommendations | Which people and systems receive them, and can a candidate request access or correction where law requires? |
| Vendor logs and backups | What is the retention period, deletion process, backup treatment, and incident-notification route? |
| Secondary use and model training | Is candidate data reused for product improvement or training, under what authority, and can that use be refused? |
For each category, document purpose, lawful basis under the applicable jurisdiction, access roles, processors and sub-processors, transfers, retention, deletion verification, candidate rights, and security controls. Reconcile the public notice with the contract and the product configuration; a notice that promises deletion is not effective if backups or vendor analytics keep the data.
The UK Department for Science, Innovation and Technology’s 2024 recruitment guidance flags data protection and high-risk processing issues, including innovative technology and biometric data, and recommends considering a data protection impact assessment where required. In New York City, the Department of Consumer and Worker Protection (DCWP) identifies notice and disclosure duties for covered automated employment decision tools (AEDTs), including information about data type, data source, and retention policy. These are jurisdiction-specific pointers, not a complete privacy-law analysis.
Which legal requirements differ by jurisdiction?
Use the audit to identify applicable duties, then confirm current law and local guidance before deployment. The following points are dated and scoped to the authorities named; they are not a global legal survey.

United States: disability protections
DOJ’s May 12, 2022 guidance states that ADA duties apply to employment selection and testing, including when an employer chooses hiring technology. It warns that facial or voice analysis and other tools can screen out qualified disabled applicants and describes accommodations or accessible alternatives. The guidance is technical assistance, so obtain current legal advice for a specific decision.
United States: employment-selection procedures
EEOC technical assistance explains that tests and other selection procedures can violate federal anti-discrimination laws when they intentionally discriminate or disproportionately exclude a protected group without legal justification. It emphasizes validation for the particular position and purpose and consideration of an equally effective, less discriminatory alternative.

How should I compare audit methods or outside auditors?
Choose the method that can produce job-specific evidence, test the complete funnel, protect candidate data, and drive remediation. There is no universal mandated vendor scorecard, so require written justification for the weighting of each criterion.
| Comparison axis | What strong evidence looks like | Warning sign |
|---|---|---|
| Job-specific validation | Competency mapping, validation design, outcome definition, and limitations for the actual role | Generic benchmark or a pass based only on model accuracy |
| Funnel and group coverage | Invitation, completion, scoring, advancement, and selection analyzed for relevant groups | Only final scores or one aggregate demographic comparison |
| Accessibility expertise | Assistive-technology testing, disability expertise, accommodation scenarios, and alternative-format review | Automated accessibility scan with no candidate-journey testing |
| Transparency | Inputs, versions, thresholds, limitations, and change history disclosed to the employer | “Black box” outputs with no reviewable evidence |
| Independence | Auditor discloses financial and vendor relationships and controls conflicts | The same party sells the tool, defines the test, and certifies the result without separation |
| Privacy safeguards | Data minimization, lawful-use analysis, access controls, retention, deletion, and incident handling | Raw recordings copied into an unbounded analytics or training environment |
| Repeatability | Reproducible sampling, documented code or procedures, uncertainty reporting, and post-deployment monitoring | One pre-launch report treated as permanent assurance |
| Remediation | Findings linked to owners, deadlines, retesting, suspension criteria, and candidate remedies | Dashboard metrics with no action or escalation path |
What human oversight and monitoring controls are needed after launch?
Define oversight before the first applicant is processed. Human review must be capable of correcting the tool, not merely approving its recommendation.

UK recruitment guidance frames assurance across procurement and deployment, and DOJ recommends regular evaluation during use. Together, those principles support a lifecycle control rather than a one-time certificate.
What should we do when an audit finds a problem?
Protect applicants first, then determine whether the issue can be corrected without weakening the job-related assessment. Do not wait for a perfect causal explanation before stopping a harmful workflow.
- Contain. Pause the affected score, ranking, or feature; preserve relevant logs; and prevent automatic rejection while the issue is investigated.
- Identify the affected population. Define the dates, jobs, locations, model version, accommodation status, and decision stages involved.
- Reassess candidates. Offer a qualified human review or effective alternative assessment, notify affected applicants where appropriate, and correct records that were based on an error.
- Find the cause. Separate interface access, data quality, transcription, feature relevance, threshold, branching, reviewer reliance, and vendor-change causes.
- Choose a remedy. Remove a job-irrelevant feature, revise the rubric, change the threshold, improve accessibility, retrain reviewers, renegotiate data handling, or replace the component.
- Retest before resuming. Use the predefined population and uncertainty plan, include accessibility scenarios, and obtain sign-off from the accountable employer owner.
- Document and monitor. Record the decision, evidence, affected applicants, deadlines, and post-remediation monitoring plan.
If the procedure continues to screen out a protected group, evaluate an equally effective alternative with less adverse impact rather than assuming a small technical adjustment solves the problem.

A reviewer should be able to reconstruct what was tested, why it was tested, and what happened to the findings. Keep a versioned record containing:
- scope, system map, job functions, locations, decision owners, vendors, and applicable jurisdictions;
- candidate notices, consent or lawful-basis analysis, accommodation instructions, and alternative-assessment procedures;
- feature and data inventory, retention schedule, access list, sub-processors, and deletion evidence;
- validation materials, human-review rubric, sampling plan, subgroup definitions, metrics, uncertainty, and limitations;
- accessibility test scenarios, assistive technologies, tester expertise, defects, and remediation;
- model, prompt, question-set, threshold, and workflow change logs;
- incidents, complaints, overrides, candidate remedies, suspension decisions, and retest results; and
- named owners, deadlines, escalation contacts, and the date of the next review.
Date-stamp jurisdiction-specific conclusions. Laws, agency guidance, vendor versions, and candidate populations change; an audit record is useful only when its conditions and limits remain visible.
Frequently Asked Questions
Can a vendor’s bias-audit report satisfy the employer’s legal duties?
No. A vendor report can provide evidence, but the employer must determine whether the procedure is valid for the specific job and purpose, accessible to applicants, and lawfully used in the relevant jurisdiction. Review the report’s scope, sample, version, methods, conflicts, limitations, and remediation commitments.
Do I need candidate consent before recording an AI interview?
The answer depends on the jurisdictions, purposes, and data involved; there is no single consent rule for every employer. Give a clear pre-interview notice, identify the data collected and retention, explain any secondary use, and obtain whatever authorization or other lawful basis the applicable law requires.
What if an applicant says the AI interview misread an accent or disability?
Route the complaint to a trained human decision owner, preserve the original response and processing record, and suspend reliance on the disputed output for that applicant. Offer an effective alternative assessment or qualified human review, then investigate whether other candidates were affected by the same failure.
How often should an AI-interview audit be repeated?
Repeat testing after material changes to the model, vendor, prompts, questions, scoring, job criteria, workflow, or candidate population, and monitor periodically during ordinary use. A fixed annual interval may be insufficient when the system or hiring context changes rapidly.
Is there one statistical threshold that proves an AI interview is fair?
No universal threshold is established by the cited U.S., New York City, and UK sources. Interpret multiple outcomes with their population, stage, sample size, uncertainty, job-validity evidence, and accessibility findings, and investigate material disparities rather than declaring fairness from one number.
