Short answer: Treat an AI compliance review as a lifecycle decision, not a vendor checkbox. Define the tool’s purpose, users, data, jurisdictions and potential impact; identify your legal role; classify the use case; obtain verifiable evidence; test the controls in a representative environment; negotiate enforceable safeguards; and monitor the system after launch. A certification or a vendor’s “compliant” statement is evidence to examine, not proof that the tool is suitable for your organization.

This approach works whether you are buying a hosted assistant, integrating a model through an API, embedding AI in a product, or developing a system internally. It also separates voluntary governance practices from binding obligations such as data-protection law, sector rules and the EU AI Act.

How do I define the AI use case before checking compliance?

Write a one-page use-case record before reviewing a supplier. Compliance depends on what the system does, who is affected and how the output is used—not merely on the model’s name or marketing category.

Record the intended purpose and boundaries

  • Business objective: State the problem the tool is meant to solve and the outcome expected from its output.
  • Users: Identify employees, contractors, customers or other people who can submit prompts, view results or act on them.
  • Prohibited uses: List decisions or activities the tool may not support, such as making an unreviewed employment, credit, housing, insurance or safety decision.
  • Affected people: Note whose rights, opportunities, finances, health or safety could be influenced, including people who never interact with the system.
  • Jurisdictions: Record where the organization, supplier, users and affected individuals are located, and where processing occurs.
  • Data categories: Inventory personal data, confidential business information, regulated records, credentials, source code, biometric data, health information and children’s data.
  • Integrations: List connected storage, identity systems, customer records, business applications, plugins and downstream recipients.
  • Retention and deletion: Set how long prompts, outputs, logs, uploaded files and administrator records may be kept.
  • Impact tolerance: Define acceptable error rates, review thresholds and the consequences that trigger a pause or escalation.

Use this record as the baseline for procurement, privacy assessments, security testing and post-deployment monitoring. The UK Department for Science, Innovation and Technology’s AI Risk Management Toolkit is intended for projects that buy commercial solutions, build models internally or support internal and external operations; it emphasizes that teams must understand and justify their risk-treatment strategy.

What legal role does my organization have, and which rules apply?

Map the legal scope before deciding whether a control is sufficient. One organization can have different roles for the same system—for example, a provider of a customer-facing AI feature and a deployer of a separate internal assistant.

Identify your role in the AI supply chain

  • Provider: You develop an AI system or general-purpose AI (GPAI) model and place it on the market or put it into service under your name.
  • Deployer: You use an AI system under your authority, including a purchased cloud service.
  • Importer or distributor: You bring a system into a market or make it available there without being its original provider.
  • Downstream integrator: You combine a model or service with your own product, data or decision workflow.

The European Commission states that the EU AI Act can apply to public and private actors inside and outside the EU when they place an AI system or GPAI model on the EU market, put it into service or use it in the EU. Obligations vary by the system’s risk category and by role, so an organization outside the EU cannot assume it is out of scope.

Separate binding law from voluntary frameworks

Check data-protection law, employment and consumer rules, financial or health-sector requirements, records obligations, intellectual-property restrictions, accessibility duties and cybersecurity regulation relevant to your operations. Then use a governance framework to organize controls. A framework can reveal gaps and assign ownership, but it does not waive a statutory duty.

How do I classify risk and screen for prohibited uses?

Classify the use before accepting a vendor’s risk label. Examine the purpose, the people affected, the autonomy granted to the system and the severity of a wrong result.

Screen for prohibited practices first

Ask whether the design involves manipulation, exploitation of vulnerable people, impermissible social scoring, prohibited biometric practices or another use restricted by the law that governs your deployment. If the answer may be yes, stop procurement and obtain legal review rather than trying to compensate with a disclaimer.

Determine whether high-risk obligations are triggered

For an EU deployment, high-risk systems can require risk management, suitable data quality, technical documentation and traceability, user transparency, human oversight, accuracy, cybersecurity and robustness. A general-purpose model may create additional duties for the provider and information requirements for downstream users. Your assessment should document why the use is in or out of a category, not merely record a supplier’s assertion.

Consider impact, not just probability

A low-frequency error can still be unacceptable if it can deny a person a legal right, expose sensitive records or create a safety hazard. Set a risk rating using at least severity, likelihood, affected population, reversibility and the ability of a human reviewer to detect and correct an error.

Is the AI tool GDPR compliant for my organization?

No tool is universally “GDPR compliant” in isolation. Compliance depends on your purpose, lawful basis, instructions to the supplier, data flows, safeguards and how people use the outputs.

Map the personal-data flow

  • Identify whether prompts, uploaded files, outputs, telemetry, support tickets and abuse-monitoring logs contain personal data.
  • Document the controller, processor and any independent-controller roles, along with written processing instructions.
  • Locate processing and storage, including support access and subprocessors, and assess international transfers and transfer safeguards.
  • Confirm whether prompts or outputs are retained, reviewed by humans, or used to train or improve a shared model. Obtain an opt-out or contractual restriction where your purpose requires it.
  • Define deletion, access, correction, objection and restriction procedures, including how a person can challenge an AI-assisted decision.
  • Apply data minimization, purpose limitation, retention limits and access controls before data reaches the service.

Use a privacy assessment that covers the entire lifecycle

CNIL’s GDPR-oriented self-assessment is organized into seven areas: proportional purpose; collection and qualification of training data; development; production quality and transparency; security; individual rights; and responsibilities and documentation. Use those areas to assign evidence requests and owners. A privacy impact assessment should explain the residual risk, the safeguards selected and the point at which the project is stopped if safeguards fail.

Check provenance and bias controls

Ask how training, fine-tuning and retrieval data were obtained, licensed and quality-checked. Require a process for correcting unlawful or inaccurate data and for investigating disparate performance across relevant groups. If the supplier cannot explain provenance or subgroup testing, record that as an evidence gap rather than inferring compliance from general privacy language.

What evidence should I request from an AI vendor?

Request specific, dated artifacts that let your legal, privacy, security and operational teams verify claims. A polished trust page is useful for orientation but is not a substitute for evidence that matches your configuration.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Core documentation

  • System description, architecture, dependencies and intended-use and limitation statements.
  • Model and feature version history, release notes, deprecation policy and a method to identify the exact version that produced an output.
  • Evaluation and validation reports, test datasets or test methodology, error analysis and known failure modes.
  • Performance by relevant subgroup, language, geography and operating condition, with the sample sizes and confidence limits needed to interpret the results.
  • Robustness, red-team, abuse, privacy and security testing, including unresolved findings and remediation dates.
  • Logging and monitoring specifications, retention periods, customer access to logs and procedures for exporting them.
  • Incident history, notification process, root-cause reporting and customer communication commitments.

Additional GPAI evidence

For GPAI models, ask how the provider supplies technical documentation, downstream information, a copyright policy and a public summary of training content. Models identified as presenting systemic risk face additional evaluation, risk-assessment, incident-reporting and cybersecurity duties. European Commission guidance uses a compute threshold of 1023 floating-point operations (FLOP) together with specified generative capabilities when identifying models that qualify as GPAI; this is a context-specific Commission guidance threshold, not a universal legal definition of every large model.

Test whether evidence is usable

Check the document date, scope, tested product edition, geographic coverage, exclusions, test independence and whether the report covers your tenant and configuration. Ask the supplier to map each claimed control to an owner, a test result and a remedy if the control fails.

How do I test an AI tool in a representative environment?

Run a controlled pilot using realistic workflows and de-identified or synthetic data first. The goal is to validate both technical behavior and the organization’s operating controls.

  1. Freeze the test scope. Use the same model version, connectors, permissions, prompts, moderation settings and retention configuration planned for production.
  2. Create a test set. Include normal cases, edge cases, ambiguous requests, adversarial prompts, multilingual inputs and examples representing affected subgroups.
  3. Measure the outcomes that matter. Record accuracy, false positives and negatives, refusal behavior, latency, availability, cost, citation or attribution quality and the rate at which reviewers catch errors.
  4. Probe confidentiality. Test prompt leakage, cross-tenant exposure, retrieval of unauthorized records, memorization of supplied data and the effect of sharing outputs.
  5. Test misuse and resilience. Attempt prompt injection, malicious files, excessive requests, tool abuse, dependency failure and loss of a connected service. Confirm rate limits, isolation and recovery.
  6. Have representative reviewers assess outputs. Capture disagreements, escalation time and whether a reviewer can understand enough about the result to make a safe decision.
  7. Document exceptions. Link each failure to an owner, mitigation, due date and decision about whether the residual risk is acceptable.

Do not treat a successful demo as production evidence. A demo usually omits the data volumes, permissions, integrations and user behavior that create the largest compliance risks.

How should human oversight work?

Human oversight must be an operational control with authority, competence and time—not a statement that users should “check the AI.”

Assign accountable people

Name a business owner, a technical owner, a privacy contact and an incident lead. For EU high-risk deployments, the Commission’s high-risk FAQ says deployers must assign one or more people for human oversight and equip them to exercise it.

Define intervention points

  • Specify outputs that require approval before they are sent, recorded or acted on.
  • Give reviewers access to the input context, relevant evidence, confidence or uncertainty indicators and the ability to request more information.
  • Provide a documented override, correction and shutdown path that does not depend on the model cooperating.
  • Train reviewers on automation bias, hallucination, privacy handling, discrimination risks and escalation procedures.
  • Log approvals, overrides, rejected outputs and reasons so the control can be audited.

Oversight is ineffective when reviewers are measured only on speed, cannot see the source data or are unable to reverse an automated action.

What security and resilience controls should an assessment cover?

Assess the AI service as a software supply chain and a data-processing system, not just as a model.

  • Identity and access: Require strong authentication, least privilege, tenant isolation, administrator controls and periodic access review.
  • Data protection: Check encryption in transit and at rest, secrets handling, key management, redaction and controls that prevent sensitive data from entering prompts or logs.
  • Prompt and retrieval attacks: Test indirect prompt injection, malicious documents, tool-call manipulation and attempts to make the system reveal hidden instructions or records.
  • Integration risk: Limit what connected systems can read or write, separate test and production credentials and require approval for high-impact actions.
  • Vulnerability management: Obtain disclosure channels, patch targets, dependency management, penetration-test scope and remediation commitments.
  • Availability and recovery: Confirm service-level objectives, backup and restore testing, rate limits, offline procedures and a way to export data and prompts.
  • Incident response: Define severity levels, notification deadlines, evidence preservation, customer cooperation and post-incident reporting.

CNIL’s guidance calls for securing processing and preventing flaws and attacks. For systemic-risk GPAI models, Commission guidance adds model evaluation, incident reporting and cybersecurity safeguards.

Which contract terms turn compliance claims into enforceable controls?

Put the controls that matter in the order form, data-processing agreement, security exhibit and service terms rather than relying on a web page that can change without notice.

Essential clauses

  • Permitted purposes, prohibited uses and instructions for handling customer data.
  • Data-processing roles, processing locations, subprocessors, international-transfer mechanism and notice of changes.
  • Retention and deletion deadlines for prompts, outputs, files, logs, backups and support records.
  • Restrictions on training or product improvement using your data, with a technically enforceable setting where possible.

  • Audit and information rights proportionate to the risk, including access to relevant test summaries and compliance records.
  • Service levels, support response times, portability formats, transition assistance, suspension and termination rights.

GOV.UK procurement guidance treats supplier evaluation, contract implementation and ongoing management as one lifecycle and recommends explicit impact-assessment go/no-go points. Use those points to prevent a pilot from becoming production by default.

How do I monitor compliance after deployment?

Approval is a starting state. Reassess when the model, purpose, data, integrations, law or incident pattern changes.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Maintain a control-evidence register

For every requirement, record the control, evidence location, owner, date tested, result, exception, expiry date and next review. Include decisions to accept residual risk and the authority that approved them.

Define change triggers

  • A new model, model version, system prompt, retrieval index or connected tool.
  • A new user group, jurisdiction, data category or business purpose.
  • A supplier acquisition, subprocessor change, security incident or material service outage.
  • A change in law, regulator guidance, contractual obligation or risk classification.
  • A drift in accuracy, subgroup performance, refusal rates, abuse attempts or human overrides.

Set operating metrics and review cadence

Monitor error and override rates, harmful or sensitive-output incidents, access violations, unresolved vulnerabilities, uptime, response times and deletion success. Review high-impact systems more frequently than low-impact productivity tools, and set a mandatory reapproval date rather than leaving the review open-ended.

Which frameworks should I use to organize the assessment?

Use several frameworks for different jobs. None replaces a legal analysis or a decision about your specific deployment.

Framework or source Best use What it does not do
NIST AI Risk Management Framework 1.0 Voluntary governance across design, development, use and evaluation; useful for assigning trustworthy-AI activities and evidence. It is not a law, certification or automatic proof of compliance. NIST released version 1.0 on 26 January 2023 and notes that the framework is being revised.
CNIL GDPR self-assessment structure Privacy review covering purpose, training data, development, production quality and transparency, security, individual rights, and responsibilities and documentation. It does not decide your lawful basis, replace a data-protection impact assessment or cover every non-privacy obligation.
EU AI Act Binding risk categories and provider, deployer, importer and distributor duties when the Act applies. It does not remove obligations under GDPR, sector law, contracts or national rules.
GOV.UK AI procurement and risk-management guidance Supplier evaluation, impact-assessment gates, contract implementation and ongoing management for purchased or internally delivered systems. It is guidance, not a universal contractual standard for every jurisdiction.

NIST describes its AI RMF as intended for voluntary use to improve the ability to incorporate trustworthiness considerations into the design, development, use and evaluation of AI products, services and systems. Pair that governance backbone with the binding rules that apply to your organization.

Comparison axis Questions to answer
Legal scope and role Who is provider, deployer or downstream integrator, and which jurisdictions and risk categories apply?
Data location and use Where are inputs, outputs and logs processed; how long are they retained; and are they used for training?
Privacy rights Can you support access, correction, objection, deletion and restrictions, and respond to an individual challenge?
Security architecture How are tenants, identities, keys, connectors, prompts and retrieved documents isolated and tested?
Accuracy and robustness What evidence covers your languages, subgroups, edge cases, adversarial inputs and operating conditions?
Transparency and explanation Can users understand limitations, provenance, confidence and the basis for a consequential output?
Human oversight Who reviews outputs, when is approval mandatory, and can a reviewer override or shut down the process?
Traceability Can you identify the model version, prompt, retrieved context, user, action and resulting decision?
Incidents and audit What notification, cooperation, evidence-access and remediation rights are contractual?
Integration and portability Can you export prompts, outputs, logs, configurations and knowledge bases in usable formats?
Continuity and exit What happens during an outage, supplier change, price change or termination, and how quickly can you switch?
Total cost and effort What are the subscription, usage, storage, review, testing, integration, training and exit costs?

What are the most common assessment failures?

  • Accepting a “compliant” badge: Ask what was tested, for which edition, date, tenant, geography and control scope.
  • Reviewing the model but not the workflow: A safe model can become high impact when connected to an automated decision or privileged system.
  • Using production personal data in a trial: Treat a free or short pilot as real processing and apply the same minimization, access and deletion rules.
  • Leaving version changes uncontrolled: Require notice, testing and a rollback or suspension path for material changes.
  • Making human review nominal: Verify that reviewers have authority, context, training and enough time to intervene.
  • Ignoring exit: Confirm export, deletion verification, transition support and the ability to preserve records needed for disputes or audits.
  • Failing to document uncertainty: Record missing evidence, compensating controls, residual risk and the person who accepted it.

What is a practical go/no-go decision process?

Use a staged decision so unresolved issues cannot hide inside a broad approval.

  1. Scope gate: The purpose, users, data, jurisdictions, roles and impact thresholds are documented.
  2. Legal and privacy gate: Applicable law, prohibited uses, lawful basis, transfer route and individual-rights process are approved.
  3. Evidence gate: The supplier has supplied sufficient technical, security, performance and change-management evidence for the risk.
  4. Pilot gate: Representative testing has produced acceptable results, and every exception has an owner and deadline.
  5. Control gate: Human oversight, access, logging, incident response, retention and deletion work in the configured environment.
  6. Contract gate: The required safeguards, remedies, audit rights, notification times and exit assistance are enforceable.
  7. Operations gate: Monitoring, review cadence, change triggers and funding for ongoing assurance are in place.

Approve only the documented purpose and configuration. A later expansion to new data, users, jurisdictions or decisions should reopen the relevant gates.

Frequently Asked Questions

Does an ISO certificate or SOC report prove an AI tool is compliant?

No. Such reports can provide useful evidence about a defined control scope and period, but they do not decide whether your purpose, data, jurisdiction, risk classification or human-review process is lawful. Read the scope, exceptions and test dates, then verify controls in your own configuration.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Can we use pseudonymized data to avoid an AI privacy assessment?

Pseudonymization reduces exposure but usually does not remove personal-data obligations if your organization can reconnect the data to a person. Keep the re-identification key separate, restrict access, test whether the model can infer identities and document why the remaining risk is acceptable.

What should we do if a supplier will not disclose model or training details?

Ask for alternative evidence such as independent evaluation summaries, data-use restrictions, version-specific limitations, incident history and contractual audit or termination rights. If the missing information prevents you from evaluating a material risk, narrow the use, add compensating controls or choose a service that provides sufficient transparency.

Do employees’ personal AI accounts create a separate compliance issue?

Yes. An unsanctioned account can bypass your retention, access, transfer, deletion and incident-response controls even when the underlying model is reputable. Publish an approved-use policy, provide an enterprise-controlled route for permitted tasks and monitor for sensitive-data leakage without collecting more employee data than necessary.
