Clear two separate rights before shipping: permission for the song’s composition and permission for the specific sound recording. Then make the written grant explicit about your game, release platforms, territories, term, trailers, advertising, livestreams, VODs and clips. Keep the signed agreement and a track-level rights log, and arrange a process for releasing automated platform claims. These steps substantially reduce risk, but no license can guarantee that YouTube Content ID, Twitch systems or another automated service will never flag a recording.
This is general information, not a determination of rights for a particular track, contract or country. Copyright ownership and platform rules are deal-specific and can change, so have qualified counsel review material agreements and recheck current platform policies before release.
What rights do I need to put an existing song in a game?
You normally need both a synchronization license for the musical composition and a master-use license for the particular recording you plan to ship. One permission does not automatically grant the other.
The composition (songwriting) right
The composition is the underlying music and lyrics written by the songwriters. A composition can have several writers and publishers, each with a share of the copyright. Trace those ownership shares and confirm that every necessary party, or an authorized representative with power to grant the right, is covered by the agreement.

Synchronization permission authorizes timed use of that composition with audiovisual material such as gameplay, a cutscene or a menu video. It does not, by itself, authorize a commercial recording made by someone else.
The master (sound-recording) right
The master is the specific recorded performance. The label, artist, producer or another entity may control it, and control can differ from the composition owners. A master-use license is needed for the actual recording file that will be embedded in the game. Identify the exact version, edit, remix, language version and file supplied so the contract and your build refer to the same asset.
WIPO’s game-industry guidance describes synchronization and master-use rights as the usual permissions for existing music in games. Treat that as a rights map, not as a substitute for checking the ownership chain in your territory.
If you commission a new recording
Recording your own version changes the master question but not the composition question. You still need permission to synchronize the song, while the newly created performance and recording require their own written arrangements with the performers and producers. Do not assume that a permission to make a cover also grants every game, trailer or streaming use.
Does a game music license cover Twitch streams and YouTube videos?
Not automatically. A license negotiated for interactive game distribution may omit creator broadcasts, archived VODs, short clips, trailers, advertisements or social posts. Ask for each of those uses expressly rather than relying on “in-game use” or “all media” language that is unclear in your jurisdiction.

Streaming and VOD scope
Check whether the grant covers livestream transmission, platform-created recordings, clips, highlights and user-generated videos. Confirm that the permission applies to the channels and platforms your audience uses, and whether the streamer or the game publisher is the licensed party. WIPO notes that a publisher can have music rights for inclusion in a game while lacking streaming rights.
Twitch’s official guidance states: “Most importantly, don’t play recorded music in your stream unless you own all rights in the music, or you have the permission of the necessary rights holder(s).” Twitch also cautions that a license can fail to cover the precise Twitch use. Read your agreement against the actual broadcast workflow, including archived copies and clips.

Trailers, advertisements and social clips
Promotional uses are separate risk points. List launch trailers, store videos, paid advertising, influencer assets, press clips, social posts and event reels in the grant. Specify whether an agency, platform, creator or distributor may publish the material on your behalf. A right limited to the shipped game should not be stretched to cover a trailer.
How do YouTube Content ID and similar systems create claims?
YouTube Content ID compares uploads with reference files supplied by rightsholders. As YouTube explains, “If Content ID finds a match, the matching video will get a Content ID claim.” The claimant can choose actions such as blocking the video, monetizing it or tracking its views, and the result may differ by country.
An automated claim is a platform action, not a court finding that you infringed copyright. A valid license may still produce a match because the system recognizes the recording without knowing your contract. Twitch and other services can likewise flag music when a license does not cover the particular use or when the claimant has not been informed of your permission.

Why a claim can appear even when your paperwork is valid
- The rightsholder supplied the recording as a Content ID reference and the system matched your game video.
- Your agreement covers the game but not a trailer, livestream, VOD or clip.
- The grant covers one territory or term and the upload is available elsewhere or after expiry.
- The claimant’s operational team has not allowlisted your channel or received the evidence needed to release a claim.
Claim-release arrangements are useful administration, but they do not replace a broad, signed license. You still need the underlying composition and master permissions.

YouTube requires exclusive rights in the territories being claimed for Content ID references and excludes non-exclusive licensed content from eligible references. Its guidance says original video-game soundtracks are valid references only when the game publisher owns them. A non-exclusive license to use someone else’s song therefore does not authorize you to register that song as your own reference or claim other creators’ uploads.
How do I clear a track before putting it in the build?
Use a written, track-by-track process. The following sequence creates an evidence trail that your production, community and support teams can use if a platform claim arrives.
- Inventory the exact music. Record the title, artist, writers, publishers, label or master owner, recording version, ISRC or other identifier when available, featured performers, samples and intended file. Include music supplied by contractors, middleware or mod teams.
- Map the ownership chain. Determine who controls the composition shares and who controls the master. Ask each contact to identify its authority and any co-owner whose approval is required. Do not assume that the artist, label or one publisher controls every right.
- Choose a sourcing route. You can negotiate directly for a named song or use a production-music library. In either case, evaluate the actual grant rather than labels such as “royalty-free” or “creator-safe.”
- Request both permissions in writing. For an existing recording, obtain synchronization permission for the composition and master-use permission for that recording. If the recording will be replaced with a new performance, obtain the composition permission and document rights in the new recording separately.
- List every release channel and territory. Name PC, console, mobile, cloud or other channels you will distribute through, plus physical editions if relevant. State the countries or worldwide territory and the license term. Include demos, early-access builds, free weekends and review copies if they will be publicly accessible.
- List derivative and promotional uses. Cover patches, downloadable content, expansions, ports, sequels, bundles, in-game cinematics, launch and update trailers, advertisements, store pages, social clips, esports or event presentations and influencer materials. If user-generated content can include the track, say whether that use is permitted and who is responsible for it.
- Address broadcasts and archives. State whether players, creators, your staff and partners may livestream gameplay, retain VODs, publish clips or monetize those videos. Identify the platforms and whether permission is worldwide for the same term as the game.
- Agree on claim handling. Ask whether the claimant will allowlist specified channels, release mistaken claims, provide a rights contact and accept a standard evidence package. Record the exact procedure, response address and any channel or video identifiers required.
- Execute and store the documents. Keep the signed license, amendments, invoices, correspondence, track metadata, ownership confirmations and platform instructions in a location accessible to release and support teams. Make a cue sheet or internal rights log showing where each track appears, its license dates and its permitted uses.
- Test only within permitted conditions. Before launch, upload a private or otherwise authorized test where the platform and rightsholder allow it. A clean test is not proof that a future upload cannot be matched or claimed; it only checks that the planned workflow and contacts function at that time.
What should the written license say?
Use a schedule or rights matrix so an approval cannot be misunderstood months later. The exact wording is a legal matter, but these are the decisions the agreement should make unambiguous.

If a cell is not agreed, treat the use as unlicensed until the rightsholder confirms it in writing. Keep the agreement and its schedules together with the build metadata so a support agent can identify the exact track and applicable territory immediately.

Should I license music directly or use a production-music library?
Both routes can work. The safer choice is the one whose written grant matches your distribution and creator plans, not the one with the most attractive marketing label. No universal “royalty-free” or “creator-safe” wording defines the rights you need.

Specific vendors’ current packages, prices and claim-release procedures are not universal facts. Read the license attached to the exact track and retain a copy of the version in force when you ship.

“Creator-safe” is a policy label, not a general license for any game. The permitted content, platforms, territories and monetization rules come from the publisher’s own terms.
Example: a game publisher playlist
Riot’s playlist terms are limited to specified player-created content and prohibit claiming its music through Content ID. That policy does not grant permission to place the tracks in an unrelated game or to register them as your own references.
Example: music approved for Minecraft-related content
Mojang describes approved Minecraft-owned music for Minecraft-related content under its usage guidelines. Those guidelines are not a blanket license for an independent game, a different franchise or every advertising use. Match the policy to the exact content and platform before relying on it.

What should I do when a claim arrives?
Do not panic or dispute automatically. First compare the claim with your rights log and the actual upload.
- Capture the notice. Save the claimant name, matched track, video or stream URL, affected territory, policy (block, monetize or track) and the date.
- Identify the use. Confirm whether the match is the game build, a trailer, a livestream archive, a short clip or a third-party upload containing your gameplay.
- Compare scope. Check the composition and master identifiers, territory, term, platform and use against the executed grant. A mismatch may mean the claim is correct for that upload even if the in-game use is licensed.
- Contact the designated rights team. Use the address and evidence process in your agreement. Provide the contract reference, track identifier, channel or video ID, territory and relevant dates; request allowlisting or release when the grant covers the use.
- Use the platform dispute process in good faith. Follow the current YouTube, Twitch or other platform procedure and submit only evidence supporting a valid permission. A dispute is not appropriate merely because the music was purchased or because the game is commercial.
- Escalate material disputes. If the claimant rejects a covered license, seeks removal, or the dispute could affect distribution or revenue, obtain qualified legal advice before a counter-notification or other formal response.
Keep the original claim, correspondence and outcome with the rights log. A released claim documents what happened, but it does not expand the license to other territories, uploads or future uses.
What mistakes most often cause avoidable claims?
- Clearing only the artist or label. The composition may have different writers and publishers.
- Buying a track and calling it licensed. A purchase or subscription does not identify synchronization, master, game or streaming rights.
- Assuming “in-game” includes promotion. Trailers, ads, store footage and social clips need their own scope.
- Ignoring player broadcasts. A game publisher’s license can omit livestreams, VODs and clips.
- Registering non-exclusive music in Content ID. YouTube requires exclusive rights for claimed territories and excludes non-exclusive licensed content from eligible references.
- Using a different edit or remix. Permission for one master does not automatically cover another recording.
- Relying on a clean upload test. Automated matches and claimant policies can change, and a test cannot prove future immunity.
- Failing to document expiration. A term-limited license can become a problem when an old build, trailer or VOD remains available after expiry.
What is the final pre-release checklist?
- Every track has identified composition owners and master owner.
- The exact recording, version and metadata are in the rights log.
- The signed grant covers the game, release channels, territories and term.
- Trailers, advertising, store media, social clips and events are expressly covered.
- Livestreams, VODs, clips, monetization and user-generated content are expressly covered or intentionally excluded.
- Updates, downloadable content, ports, bundles and sequels have a documented answer.
- The agreement states whether the permission is exclusive or non-exclusive.
- A claimant contact, allowlist method and evidence package are recorded.
- Signed documents, invoices and correspondence are stored where support and release teams can retrieve them.
- Any pre-release platform test was authorized and is treated as a workflow check, not a guarantee.
Frequently Asked Questions
Can I use a cover version of a famous song in my game?
You still need synchronization permission for the underlying composition. The new performance has a separate recording-rights trail, so obtain written agreements with the performers and producers and confirm that the cover license includes game, marketing and streaming uses.
Does calling a track “royalty-free” mean I can monetize gameplay videos?
No. “Royalty-free” describes a pricing or royalty mechanism, not a universal grant. Read the track’s license for interactive-game distribution, livestreams, VODs, clips, territories, term and monetization.
What happens if a licensed track is removed from a game after the license expires?
Check whether the agreement requires takedown, replacement or continued support for existing copies and archived videos. Plan an asset-replacement process before expiry, including patches and store or trailer media that may remain publicly accessible.
Can I mute only the licensed song in a streamer’s VOD?
A mute or streamer-mode feature can reduce exposure, but it does not itself grant rights to the music. Configure it only as a risk-control option and keep the license scope and claim procedure for streams that retain the track.
